HomeMy WebLinkAboutCounter Drainage Proposal by CityCOUNTER PROPOSAL MADE BY VOCELLE 2/1/79 TO GDC'S PROPOSAL OF 12/7/78: THE CITY SHOULD HAVE A UNIFORMITY AS TO WHAT THE CITY EXPECTS OF GDC. MR. VOCELLE MADE THE FOLLOWING NOTES AS TO THE PROBLEM AREAS: 1. THE CITY ENGINEER FEELS THAT A PROBLEM AREA IS THE DAM AND IT SHOULD BE CORRECTED OR RESTORED TO PROPER CONDITION AND WE WOULD EXPECT GDC TO DO THAT. 2. THE DRAINAGE WHICH GOES THROUGH THE BOY SCOUT CAMP INTO THE SEBASTIAN RIVER, WE WOULD EXPECT GDC TO SECURE THE PERMITS AND PUT THAT DRAINAGE IN. (MR. LLOYD: ACTUALLY CONSTRUCT DRAINAGE OUTFALL. MR. CRAGG: THEY AGREED TO THAT IN THAT LETTER. MR. VOCELLE: WELL, I'M JUST MAKING SOME NOTES HERE.) 3. AS I UNDERSTAND FROM WHAT THE MAYOR HAS INDICATED, THAT THE STREETS THAT WERE NOT PUT IN ACCORDING TO THE ORIGINAL SPECIFICATION, THAT YOU'RE ASKING THAT THOSE BE RE -DONE. 4. AS I UNDERSTAND THE CITY ENGINEER, HE IS ALSO GDC TO CERTIFY AS TO THE PROPER DRAINAGE IN THE VARIOUS UNITS BY ONE OF THEIR ENGINEERS AND TO CORRECT THE DRAINAGE IF IT WAS ACTUALLY IMPROPERLY CONSTRUCTED. MR. LLOYD: WHEN WE DISCUSSED THAT WITH THEM THEY WERE WILLING TO PROVIDE THE DRAINAGE, BUT THEY DID TAKE EXCEPTION WHERE THESE CULVERTS HAVE BEEN PUT IN IMPROPERLY, THEY FELT THAT SHOULDN'T BE THEIR RES- PONSIBILITY AND I HAVE TO AGREE WITH THEM. YOU CAN'T HOLD GDC ACCOUNTABLE FOR WHAT THE BUILDERS HAVE DONE IMPROPERLY. VICE MAYOR GRAY: ONLY IF THE SWALE WAS IMPROPER TO BEGIN WITH AND THEY PUT IT IN IN THE CONTOUR OF THE SWALE, THEN YOU HAVE A PROBLEM. MR. VOCELLE: WHAT I'M SAYING THEN IS TO CERTIFY AS TO THE PROPER DRAINAGE AND CORRECT ANY IMPROPER DRAINAGE THAT WAS DONE. THIS ALSO WOULD BE IN REFERENCE TO THE MAIN- TENANCE OF THE STREET SIGNS, ETC. 5. THIS WOULD BE THE AREAS WE WENT INTO WHERE 7HE STREETS, I DON'T KNOW THESE STREETS THAT WE WERE THERE WITH THE GRASS OVER IT AS GREEN AS A CARPET, THE CITY HAS NOT ACCEPTED THOSE RIGHT? THE AREA IS NOT USED OF COURSE, IN THESE AREAS THE CITY HAS NOT ACCEPTED. YOU CAN PROBABLY DO THIS ONE OF TWO WAYS. I AGREE WITH THE CITY ENGINEER THERE'S NO REASON AT ALL TO GO OUT THERE AND RE -DO THOSE STREETS WHILE YOU DON'T HAVE THE HOUSES AND THE TRAFFIC, BECAUSE IF YOU DO, THE CITY ENGINEER TELLS ME THAT 3 OR 4 YEARS FROM NOW YOU'RE GOING TO HAVE THE SAME PROBLEM. IT MIGHT BE BEST TO ESTIMATE WHAT THE COST WOULD BE TO DO THAT JOB IN THE AREAS WHERE THEY HAVE THOSE STREETS AND FOR GDC THEN TO PLACE CASH MONEY INTO THE TREASURY OF THE CITY TO BE EARMARKED FOR THE CONSTRUCTION OF STREETS, WHATEVER. THE PROBLEM ON THAT PLAN IS THAT THE COST TODAY AND THE COST 10 YEARS FROM NOW WILL BE DIFFERENT UNLESS THE INTEREST ACCUMULATION ON THE MONEY WOULD OFFSET THAT. 6. THE OTHER PROBLEM AREA IS THE DETERMINATION OF THE AMOUNT OF BOND PREMIUMS THAT ARE DUE TO THE CITY IN THE SUBSTITUTION OF THE CORPORATE BONDS AND THAT WE WOULD HAVE TO MAKE SOME DETERMINATION, AND SOMEWHERE IN THE CORRESPONDENCE IS THAT ANY TYPE OF OFFSET, IF THF TOTAL AMOUNT IS DETERMINED, THAT THEY WOULD MAKE A DONATION OF A 12 ACRE PARK SITE ONCE THAT AMOUNT HAS BEEN SET. THOSE ARE THE PROBLEM AREAS THAT I HAVE SET DOWN IN MY NOTES IN THE INVESTI- GATION THAT I MADE WITH VICE MAYOR GRAY AND THE CITY ENGINEER AS TO THE COUNTER -PROPOSALS TO GDC INCIDENT TO THEIR LETTER. I'M TALKING ABOUT THE WHOLE THING. MR. LLOYD: I CAN'T TELL YOU WHAT'S OUT THEIR UNLESS THEY GIVE ME A SET OF AS BUILT PLANS. IF THEY'VE CHANGED ANYTHING IN THE ORIGINAL PLANS AS SUBMITTED, THEN THEY'RE GOING TO HAVE TO TELL ME THE CHANGES. MAYOR FLOOD: THEY HAVEN'T REFUSED TO GIVE IT TO US, BUT THEY WANT USS TO PAY FOR IT. THAT'S WHERE THE DISCREPANCY IS. MR. LLOYD: I DON'T WE SHOULD. MR. SZELUGA: TO ADD TO WHAT MR. VOCELLE SAID, I WOULD LIKE TO ADD THAT ANY HOMES TO BE BUILT, TO REQUEST GDC TO ESTABLISH THE GRADES OF THE SWALES IN ORDER TO PREVENT THIS PROBLEM OF CULVERTS BEING PUT IN AND DRIVEWAYS THAT DIP TO SUCH A DEGREE THAT WATER WILL ACCUMULATE IN THE DRIVEWAY, ETC., AND THAT THEY ARE WILLING TO DO THAT TO HOLD HARMLESS BOTH THE PROPERTY OWNER AND THE CITY, THAT IN THE EVENT THE SITUATION IS NOT CORRECTED. MR. VOCELLE: I DON'T KNOW IF WE CAN REQUIRE THEM TO DO THAT. IF THERE IS A DETERMINATION THAT THE DRAINAGE WAS DONE CORRECTLY IN THE FIRST INSTANCE, I THINK THAT'S THE MAIN THING MR. SZELUGA: I'M LIVING IN A HOME THAT WAS BUILT BY GDC. THE DRAINAGE AROUND THAT HOME IS INADEQUATE. WHEN THEY BUILT IT THEY PUT IT IN ACCORDING TO THEIR GRADES, ETC., YET WHEN IT RAINS FOR AT LEAST A COUPLE OF DAYS I HAVE TO HAVE A ROWBOAT TO CROSS MY DRIVEWAY. MR. LLOYD: I THINK WHERE THE BURDEN SHOULD LIE, IF THE DRAINAGE IS PUT IN CORRECTLY, I THINK IT IS INCUMBENT ON WHOEVER IS BUILDING THE HOME TO MAKE THE DETERMINATION THAT THE GRADE IS DRAWN PROPERLY. MR. SZELUGA: WHO IS TO DETERMINE IF IT IS DRAWN PROPERLY? MR. LLOYD: THERE SHOULD BE A SET OF MAPS IN THE CITY HALL. A REGISTERED ENGINEER OR SURVEYOR SHOULD GO OUT AND SET THE ELEVATION. TO REBUT WHAT VICE MAYOR GRAY SAID, THE LAST THING PUT IN ON A HOUSE IS THE DRIVEWAY. THEY'RE COMING IN WITH TRUCKS AND FILL AND THERE IS NO WAY OF KNOWING WHAT THE GRADE WAS. MR. SZELUGA: BUT THESE ARE SWALES AND DRAINAGE DITCHES, ETC., WHICH HAVE N(T BEEN ACCEPTED BY THE CITY. WHERE IS THE BUILDER GOING TO GET THAT INFORMATION? MR.
