The facts are restated as follows: 1. The home constructed on lot 35 of block 417 adjacent to your lot 36 of block 417 encroaches 2.7 feet into the 10 foot easement on lot 35. 2. General Development will ask for a variance in this regard from the officials of Indian River County. 3. You stated that you had no objections to the encroachment -so long as it did not in any way affect the setback of a home you may build at some 'Later date on lot 36 of block 417. We wish to advise you that the variance request will in no way affect the setback requirement now in effect by Indian River County on your lot 36, block 417, Sebastian Highlands. We will greatly appreciate.your approval of the variance by signing this letter for our records and returning same to us in the prepaid envelope provided.
