PAT FLOOD, JR., STATED THAT HE HAD CALLED MR. ALLEN ABOUT 6 WEEKS AGO TO ARRANGE
THIS MEETING. HE BROUGHT A FILM THAT RUNS APPROXIMATELY 30-45 MINUTES. PRIMARILY,
ON THE FILM IS OUR MAIN CONCERN, THE ROAD BASE ON SOME ARTERIAL ROADS. WE HAD
SOME OF YOUR ENGINEERS IN THE VERO BEACH AREA DRAW WHAT THEY FELT WERE THE ARTERIAL
ROADS WHICH COMES UNDER ANOTHER SET OF STANDARDS AS SECONDARY STREETS. IN THE
FILM YOU WILL SEE WHERE SOME OF THE ROAD BASES HAVE SOMETHING LIKE 2 OR 3" OF
JUST PURE MARL AND JUST 1/2" OF ASPHALT. I DON'T KNOW IF MR. ALLEN HAS BEEN ABLE
TO FIND OUT WHEN SOME OF THESE ROADS WERE DEVELOPED. WE HAVE BEEN FIXING POTHOLES,
AND AFTER TRUCKS WOULD RUN OVER IT, ANOTHER POTHOLE WOULD DEVELOP ABOUT 2" FROM IT.
SO WE DECIDED TO DIG IN AND FIND OUT THE REAL PROBLEMS AND SEE IF WE CAN'T GET
THEM SETTLED. MOST OF YOU KNOW WE DID ACCEPT UNIT 1 SOME 20 YEARS AGO AND WE
SIGNED AN AGREEMENT SO WE FEEL THEY ARE OUR RESPONSIBILITY, BUT THE PRIMARY INTEREST
NOW IS TO MAKE SURE THAT THE SAME ROADS YOU DEVELOPED IN THE PAST 10, 12, 15 YEARS
WILL NOT BE IN THE SAME POSITION FOR THE CITY TO ACCEPT AS UNIT 1, AND WE HAVE TO
TURN AROUND, BEFORE THE POPULATION GETS BIG ENOUGH, AND GO ANOTHER BOND ISSUE, WHICH
WE ARE LOOKING AT NOW, AND RECONSTRUCT ROADS WHICH SHOULD NEVER HAVE BEEN IN THE
SHAPE THEY ARE NOW. I WILL ADMIT THAT AT THE TIME THOSE ROADS WERE BUILT WE HAD
NO ROAD STANDARDS. WE HAD NO ROAD STANDARDS IN THE CITY OF SEBASTIAN UNTIL 1959.
I HAVE HAD TALKS WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION AND OTHER PEOPLE WHO
HAVE LAID DOWN ROADS, ABOUT ROAD BASES, AND MOST OF THEM HAVE TOLD ME THAT SOIL
CEMENT IN OUR AREA WITH THE CHEMICAL REACTION OF THE SOIL, WILL BREAK DOWN. WE
HAVE SPIDER WEBBING IN THE FILM. I THINK YOU WILL BE ABLE TO SEE SOME OF IT.
3 DIFFERENT PEOPLE AT 3 DIFFERENT TIMES HAVE SAID THIS IS NOT NATURAL IN SOIL
CEMENT BASE ROADS. THIS SPIDER WEBBING RUNS EVERY WHICH WAY. THIS IS ONE OF THE
THINGS WE ARE CONCERNED ABOUT. WE HAVE SOME WE CALL "MOW -ALONG" ROADS. YOU MOW
THEM; THEN YOU RIDE ON THEM. THESE ARE SOME WE ARE REALLY CONCERNED WITH. SOME
WE HAVE NOT ACCEPTED. SOME WE'RE TRYING TO NEGOTIATE AND COME UP WITH A WORKABLE
SOLUTION BETWEEN THE CITY AND GENERAL DEVELOPMENT CORPORATION. WE'RE NOT HERE TO
SAY YOU'RE TOTALLY IN THE WRONG AND WE DON'T WANT YOU TO FEEL THAT WERE TOTALLY
IN THE WRONG. OF COURSE, THIS IS GOING TO BE ON DRAINAGE AND ROADS. I THINK AT
THIS POINT WE SHOULD LOOK AT THE FILM. WE CAN STOP IT AT ANY TIME IF YOU WANT TO
TALK ABOUT A CERTAIN POINT.
MR. AVELLA: ON BEHALF OF THE CORPORATION AND MYSELF I WOULD JUST LIKE TO SAY
THANK YOU TO YOU AND THE MEMBERS OF THE CITY COUNCIL AND THE OTHER GUESTS FOR
COMING HERE. I MEAN THAT SINCERELY. WE ARE A LARGE CORPORATION AND WE TAKE
PRIDE IN WHAT WE DO. I THINK WE WILL NEVER HAVE TOTAL AGREEMENT AND I HOPE THAT
YOUR COMING HERE, AS I SAID, WE GREATLY APPRECIATE YOUR COMING HERE AND TAKING

MR. FLOOD: JUST ONE QUICK THING. WE ARE REALLY FORTUNATE IN OUR AREA TO HAVE
MR. RICHARD SZELUGA WITH HIS VIDEO TAPE EQUIPMENT. HE DID THE PICTURE FOR US
AND AS A CITIZEN HE DONATED HIS TIME AND HIS EQUIPMENT TO THE CITY AND I THINK
HE HAS DONE A GREAT JOB FOR US AND I THINK ALSO IT WILL HELP YOU SEE OUR PROBLEMS.
MR. SEZELUGA: BEFORE I START THIS TAPE, I'M HAVING SOME ELECTRICAL INTERFERENCE
SO THAT THE IMAGES ARE NOT QUITE AS SHARP AS THEY WOULD BE IN AN INTERFERENCE FREE
AREA, BUT I HOPE WE CAN LIVE WITH IT. I GAVE MAYOR FLOOD TWO COPIES OF THE TAPE
WITH THE FOOTAGE COUNTER AND THE SUBJECT MATTER THAT IS ON THE TAPE. I CAN
STOP THE TAPE AT ANY TIME. I CAN GO FAST FORWARD OR REVERSE IT ANY TIME YOU WANT.
YOU JUST LET ME KNOW WHEN YOU WANT TO STOP IT OR GO BACKWARD OR FORWARD. THIS IS
A DUPLICATE TAPE. IT'S NOT THE ORIGINAL. THE ONLY THING THAT WAS DONE IS THAT
WE TRIED TO GROUP THE SUBJECT MATTERS ALL TOGETHER. IN THE ORIGINAL TAPING IT
WAS SCATTERED ALL OVER THE PLACE. I HAVE THE ORIGINALS AVAILABLE IF YOU WANT TO
SEE THEM.
NARRATION, THIS PORTION OF FILM, BY PAT FLOOD: "WE HAVEN'T HAD ANY RAIN TO SPEAK
OF IN THE LAST MONTH. WE FEEL THAT IN THIS PICTURE WE'RE SHOWING YOU, WITH THE
AMOUNT OF WATER COVERING THIS CULVERT, THE WATER IS BACKING UP IN EXISTING DITCHES.
WE CANNOT GET PROPER DRAINAGE WITH THIS TYPE OF SET UP. ALSO, WE WILL BE SHOWING
YOU THE OTHER SIDE WHERE THE WATER IS STANDING IN THE DITCHES AND WE HAVE SEVERAL
OTHER CULVERTS IN THE LAKE HARDEE AREA, WHICH WE'RE IN, THAT WILL SHOW THE SAME
THING. WATER WILL SEEK ITS OWN LEVEL, BUT IT WILL ALSO BACK ITSELF UP. THIS IS
SOME OF THE COMPLAINTS WE ARE GETTING FROM OUR CITIZENS, THAT THE WATER IS BACKING
UP AND STANDING IN THE DITCHES, WHICH BECOME STAGNANT AND SERVE AS A BREEDING
GROUND FOR MOSQUITOES." MR. SZELUGA: THE 1ST CULVERT THAT YOU HAVE SEEN ON THE
SCENE, THIS IS THE SOUTH SIDE OF THAT CULVERT. MR. CRUMP: HOW MUCH OF THAT IS
EXPOSED? I CAN'T SEE. LOOKS LIKE ABOUT - IS THAT THE PIPE? MR. SZELUGA: ABOUT
1/2 OR 2/3. MR. FLOOD: "THIS .DITCH IS THE SAME DITCH OF THE FIRST SHOT OF THE
CULVERT. YOU CAN SEE THE PROBLEM OF THE WATER BACKING UP. IT'S A CONTINUAL PRO-
BLEM OF MAINTENANCE ON THESE DITCHES WITH THE WATER STANDING IN THEM THE WAY IT IS."
MR. CRUMP: I JUST WANT TO SEE, RIGHT THERE, IT LOOKS LIKE IT'S 2'--3' FROM THE TOP
OF THE BANK TO THE TOP OF THE WATER. IS THAT CORRECT?
FLOOD: THIS DITCH - *** IT IS 4WYNTO THE DITCHES AND YOU'LL NEVER BE ABLE
TO GET THESE WEEDS OUT AS LONG AS THIS WATER IS THE MAIN THING IN THESE DITCHES.
THIS DITCH WE ARE BRINGING OUT IS THE SAME DITCH OF THE FIRST SHOT OF THE CULVERT
AND IT GOES DOWN AND YOU CAN SEE THE PROBLEM OF THE WATER BACKING UP AND IT IS GOING
TO BE A CONTINUOUS PROBLEM OF YEARLY MAINTENANCE ON THESE DITCHES WITH THIS WATER
STANDING IN THEM. SOONER OR LATER THAT WILL START IN HERE AND WE WILL REALLY HAVE A
PROBLEM. WE ARE GOING TO SHOW THE WATER EXTENDING BACK AS FAR AS THIS CAMERA
WILL PICK UP OF STANDING. AND ALSO OF THIS CULVERT HERE IS RUNNING ON THE ROAD
ON AN ANGLE AND DICK, IF YOU CAN, IF YOU LOOK DOWN YOU CAN SEE IN THE MIDDLE OF THE
DITCH THE BLUE STAKE AND YOU CAN SEE THE PROPERTY LINE OF EACH OF THESE HOUSES
SHOULD BE. WE ARE ON THE WEST END OF LAKE HARDEE AND THE
BIG 36" CULVERT PIR,AND ALSO FROM THE CATCH BASIN IT RUNS FROM THE WEST AND THIS IS
A WATER BACKUP PROBLEM - THIS WATER STANDS THIS WAY PRETTY WELL YEAR AROUND.
AND THE GROWTH PATTERN - WE COULD FOLLOW THIS DITCH ALL WAY THE WAY BACK FOR A MILE
OR SO THROUGHOUT THE WHOLE AREA AND IT IS AGAIN FROM THE WATER LEVEL OF LAKE HARDEE.
THE HOUSE YOU ARE SEEING IS THE HOUSE WHERE THE CATCH BASIN AND TO THE WEST OF LAKE
HARDEE, ON BONACA STREET WHERE MR. GREEN LIVES, AND WE ARE TRYING TO SHOW YOU THE
DEPTH OF THE DITCH AND THE DISTANCE OF IT. IF YOU COME ON DOWN YOU CAN SEE WATER
STANDING ALL ALONG JTND THE CULVERT WITH THE STREET WE ARE ON - I"D LOVE TO HAVE
A SHOVEL, THERE IS 18�A" OF WATER STANDING IN THIS DITCH AND WHICH IS A PROBLEM, AGAIN

WE HAVE ALL YEAR AROUND. AGAIN, WE HAVE NOT HAD ANY RAIN TO AMOUNT TO ANYTHING
IN 30 DAYS. YOU CAN SEE WE DO HAVE A STANDING WATER PROBLEM.
OKAY, WE ARE LOOKING BACK TO THE SOUTH AND YOU CAN SEE THE DITCH, WHICH IS RATHER
A SHORT ONE, WHICH GOES INTO A TEE. YOU CAN SEE THE DITCH RUNS FROM HERE, GOES
BACK TO THE RIGHT, GOES UNDER THE ROAD WHICH IS DURANT STREET FOR APPROXIMATELY
FOR ANOTHER MILE. I BELIEVE YOU WILL SEE THAT THERE WILL BE WATER STANDING IN
THIS DITCH ALL THE WAY.
GDC: IT WAS LEFT THAT WAY, FOR THIS HOUSE WAS NOT FOR SALE AT THE TIME WE DUG
THAT DITCH. IN FACT, YOU AND I AND WAYNE ALLEN WERE ON THAT PROPERTY WITHIN 30
MINUTES AFTER OUR CREW LEFT THERE. THAT WAS ABOUT 3 MONTHS AGO.
FLOOD: WELL, I DON'T THINK THE POINT WAS THAT IT WAS FOR SALE AT THAT TIME
BUT ....
GDC: THE WORK WAS NOT DONE WHEN HOMEFINDERS HAD THE LISTING.
FLOOD: FLORIDA HOMEFINDERS SHOWED THE ORIGINAL HOUSE.
GDC: IT WAS NOT BUILT BY GDC.
FLOOD: NO, SIR, BUT HOMEFINDERS .....GENE ESTES WHO DID BUILD A HOUSE AND
WHEN THEY CALLED IT TOOK A DAY OR TWO BEFORE WE COULD GET OUT THERE AND DO IT.
WE'VE GOT DITCHES WE'VE BEEN WAITING MONTHS ON THAT HAVE THE SAME PROBLEM.
THAT IS THE POINT WE ARE TRYING TO BRING UP. MAYBE IT'S NOT FAIR BUT IT DOES
BRING THE POINT TO A HEAD OR HE WOULDN'T BE HOLLERING.
MR. BEVAN: MR. FLOOD, WASN'T THE PROPERTY ACTUALLY OWNED BY SOMEONE ELSE
AND FINALLY HOMEFINDERS RESOLD THE LOT BEFORE THAT ORIGINAL OWNER -THEN THEY
SOLD THE HOUSE THAT WAS BUILT BY ESTES?
FLOOD: IT COULD BE A POSSIBILITY, BUT THE FACT REMAINS THAT HOMEFINDERS HAD SOMETHING
TO DO WITH IT. HOMEFINDERS CALLED ME ABOUT THE DITCH AND IT WAS SOLVED WITHIN A
SHORT PERIOD OF TIME. YOU CAN SIT THERE AND SHAKE YOUR HEAD BUT THE POINT IS
THERE.
FLOOD: BACK THE FILM UP A BIT, I WANT TO MAKE A POINT. A YEAR AGO THIS JUNE
MR. CRUMP AND I WENT AND LOOKED AT IT AND NOTHING HAD BEEN DONE ABOUT IT AND
IT IS AT LEAST 20' OUT OF POSITION. SO, THIS IS THE POINT WE ARE TRYING TO TELL
YOU. SEE THAT PIECE RIGHT THERE, MR. CRUMP AND I WENT OUT A YEAR AGO IN MAY OR
JUNE AND IT WAS THERE, YOU CAN SEE WHERE THE STAKE IS, AND IT WAS BROUGHT TO YOUR
ATTENTION. THE OTHER HOUSE ON THIS SIDE OF IT WAS BROUGHT TO YOUR ATTENTION A LOT
LATER AND ONLY TOOK 30 DAYS TO GET IT FIXED. WHEN YOU WANT SOMETHING AND WHEN ONE
OF YOUR COMPANIES IS INVOLVED YOU DO GET IT DONE. IT IS NOT LIKE THIS ONE THAT
HAS BEEN SITTING THERE FOR A YEAR AND NOTHING HAS BEEN DONE ABOUT IT. IF YOU WANT
TO MAKE POINTS, I THINK I CAN MAKE SOME.
DALE WEHR: DAM AT THE HEAD OF COLLIER CREEK. WHAT WE ARE TRYING TO SHOW YOU HERE
IS THE..DISTANCE ... WITH THE HAMMER SHOWING THE PILE DRIVINGS HAVE COMPLETELY
RUSTED THRU AND THERE ARE A NUMBER OF HOLES LIKE THIS THROUGHOUT THE INSPECTION OF
THE DAM. ANYONE STRIKING THIS WITH THE HAMMER I��METALS VERY LITTLE T
TNNISS NO PROBLEM TO PUSH A HOLE
YOU CSEE THE INDICATION

SEE APPROXIMATELY 3/8" BUT AS YOU GO DOWN THRU THE CENTER PIECE YOU WILL SEE IT IS
DETERIORATING DUE TO THE FACT T$AT IT IS RUSTED OUT TO APPROXIMATELY118" DOWN
TO NOTHING, CREATING THESE LARGE HOLES THAT YOU SEE IN THE PILE DRIVINGS.
FLOOD: ONE OF THE ROADS RECENTLY PUT IT INTO SECTION - OR UNIT #1 - IT IS EITTIER
OWNED BY THE CITY OF SEBASTIAN BUT THE POINT OF PUTTING THIS ROAD IN WAS TO SHOW WE

WERE KIND OF WORRIED ABOUT IT. IF THE GROWTH PATTERN OF THE CITY, SOME OF THE
AREAS THE SAME AS THIS, EIGHT HOUSES ON THIS ENTIRE ROAD - ALMOST A MILE LONG -
AND THE ROADS HAVE DETERIORATED OVER THE LAST FIFTEEN OR EIGHTEEN YEARS AND
IT COULD BE TEN YEARS BEFORE WE GET GROWTH ON SOME OF THESE OTHER ROADS, SO THIS
IS THE REASON . THIS IS A CITY STREET WHICH WAS BUILT BY GDC. WE KNOW WE OWN
IT AND THERE IS NO ARGUMENT ABOUT THAT WE ONLY WANT TO SHOW THE GRASS GROWING ON
THEM AND WHEN WE START TO DEVELOP SOME OF THESE AREAS THE ROADS WILL PROBABLY
BE IN THE SAME CONDITION.
FLOOD: WE WILL BE ANYWHERE FROM A HALF UP TO A MILLION DOLLARS WORTH OF ROAD
BONDS TO COMPLETE THE 22 MILES OF ROADS IN THIS AREA. THEY WERE STARTED IN 1957
I DID HELP PUT THE ROAD BASE INBUT I DID NOT PUT ANY ASPHALT IN . OF COURSE, AT
THAT TIME IT WAS MACKLE (?) DEVELOPMENT.
GALE: YOU HAVE BETTER THAN 1/2 MILE TO A MILE OF OF NO ASPHALT WHATSOEVER ON THE
TOP OF IT. YOU ALSO NOTICE ON THE NORTH END HERE ON THE BEND THE AMOUNT OF
PATCHING WE HAVE DONE HERE JUST RECENTLY.
NARRATION CONTINUED BUT IS GARBLED.
GDC: WOULD LIKE TO SUMMARIZE WHAT I THINK IS THE STATUS OF THE ROAD SITUATION.
THERE ARE SOME PEOPLE HERE WHO ARE FAMILIAR WITH OUR BACKGROUND AND I WOULD LIKE
TO ASK C.C. TO SPEND JUST A MOMENT TO DISCUSS THE CHARACTERISTICS OF THE SOIL CEMENT
BECAUSE I THINK THAT IS SOMETHING THAT DOES BEAR DISCUSSION, ESPECIALLY SINCE I
UNDERSTAND THE CITY IS CONTEMPLATING TAKING SOME ACTION AS FAR AS AN ORDINANCE IS
CONCERNED. WE DO HAVE SOME PEOPLE HERE WHO ARE ENGINEERS WHO HAVE EXPERIENCE WITH
THAT MEDIA. THE NORMAL WAY IN WHICH ROADS ARE CONSTRUCTED AND WHICH ..REQUIREMENTS
FOR ROADS ARE DETERMINED THROUGHOUT THE STATE OF FLORIDA AND EVERY JURISDICTION
WHERE WE DO BUSINESS IS THAT A DEVELOPER SUCH AS OURSELVES COMES IN AND PRESENTS TO
A CITY ..... TO DEVELOP AN AREA. IN THE SITUATION WHERE WE ARE IN WHERE WE ARE
BUILDING PROPERTY ON TEN YEAR HOLDING CONTRACTS WE DO NOT BUILD THE ROADS UNTIL THE
CITY HAS APPROVED THE PLAN. WE USUALLY BUILD THOSE AT THE END OF THE CONTRACT TERM
ALTHOUGH THERE ARE SHELTER AREAS WHERE WE BUILD WHERE WE WOULD PUT IN THE ROADS.
MR. AVELLA, PRESIDENT OF GDC, SUGGESTED MAYOR FLOOD AND MR. WAYNE ALLEN GET TOGETHER,
NEGOTIATE AND REPORT BACK TO THEIR RESPECTIVE PEOPLE. THEY ARE TO MEET AGAIN
AND SUBMIT RECOMMENDATIONS FOR A SOLUTION TO THIS PROBLEM WITHIN A TIME FRAME OF
90 TO 120 DAYS.

SUBJECT: Problems between the City of Sebastian and General
Development Corporation on roads and drainage
acceptance by the City in Sebastian Highlands.
Honorable Sir:
In view of the disputes existing between the City of Sebastian
and General Development Corporation regarding the problems of
accepting the roads. swales and drainage ditches in Sebastian
Highlands. I suggested to you, Mr. Mayor, that these problems
be pictorially presented to the higher officials of General
Development Corporation rather than through verbal discussions
between the City council and General Development Corporation's
corporate councils.
With your acceptance of this idea, concurred by Mr. Vocelle,
the City attorney, I have therefore, with your guidance and
approval of the problems to be thus pictorially presented, put
on video tape in color and sound these areas and have hereto
attached Attachment #1 outlining the areas thus video taped.
