According to Section 5 of Ordinance No. 0-81-8 (General Development Utilities, Inc. - Water) and Ordinance No. 0-81-9 (General Development Utilities , Inc. - Sewer) the utility may pass through a tax increase without consent of Council. I have analyzed the numbers contained in the backup to the letter and the increase in rates relate directly to the increase in ad valorem taxes. Mr. Robert McClary City Manager City of Sebastian P.O. (GDU) are ten copies of GDU's Notice of Intention to Implement a Pass Through Rate Increase, together with supporting documentation. As you can see from the enclosed filing, the rate increase is designed to pass through to GDU's customers the increase in ad valorem property taxes paid by GDU in 1987 over 1986. The total amount of the pass through is $13,084 for water service and $6,097 for sewer service. This results in approximately a 6.2% increase in water rates and a 5.1% increase in sewer rates. EXHIBIT IV NOTICE TO CUSTOMERS In May, 1981, the City Council of the City of Sebastian adopted Ordinances 0-81-8 and 0-81-9, permitting water and sewer utilities to pass through, without a hearing but with verified notice to the Council, a change in rates resulting from an increase or decrease in the rates that are charged for electric power or the amount of ad valorem taxes assessed against its property. General Development Utilities, Inc. has experienced significant increases in its real estate and property taxes. In November, 1988, GDU filed with the City Council of Sebastian its verified notice of intention to increase water and sewer rates in Sebastian Highlands. Rates will, therefore, increase approximately 6.27 for water and 5.17 for sewer. These rates will be reflected in your January bill. An example of how the new charges will be computed for a residential water and sewer customer with a 5/8" x 3/4" meter who uses 5,000 gallons a month is as follows: Water Rate Class WBA: Base Facility Charge....... $12.36 Usage Charge ($1.17 x 5)... 5.85 Sewer Rate Class SBA: Base Facility Charge....... $14.19 Usage Charge ($1.00 x 5)... 5.00 $37.40 For other meter sizes and usage amounts, refer to the table on the reverse side of this notice. Applicability - For sewer service in private residences and individually -metered apartment units. Limitations - Subject to all of the Rules and Regulations of this Tariff and the General Rules and Regulations of the Commission. Monthly Rate - $14.19 Base Facility. Usage - $1.00 per 1,000 gallons up to 12,000 gallons. Seasonal Rate - $14.19 flat rate per month. Any customer who requests that service be interrupted for any length of time will be charged the Seasonal Rate during that period of interruption. Any customer who attempts to circumvent this charge by closing his account (and requesting deposit refund) at time of temporary departure and then returning several months later as a new customer, will be held liable for the Seasonal Rate during the disconnected months. Terms of Payment - Bills are due and payable when rendered and become delinquent if not paid within twenty days, and service may, after five days written notice, be discontinued. Billing - The billing month dates shall coincide with the billing month for water service. Bills rendered for less than 50% of the normal billing period will be billed in accordance with Rule 25-10.111(2), Florida Administrative Code: "Whenever, for any reason, the period of service for which a bill is rendered is less than fifty percent (50%) of the normal billing period, the charges applicable to such service, including minimum charges, shall be prorated in the proportion that the actual number of service days bears to a thirty (30) day month; except that: (a) Opening bills need not be rendered but may be carried to and included in the next regular monthly billing. (b) For service taken under flat rate schedules, fifty percent (50%) of the normal charges may be applied.
