The Pledge of Allegiance was said by all. Dodd stated Mr. Roth was excused from the meeting, and Mr. Alvarez would be voting in his place. APPROVAL OF MINUTES: MOTION by McManus/Carter to accept the minutes of both the February 5, 2015 and February 19, 2015 Planning and Zoning Commission meetings as submitted. Motion was approved unanimously by voice vote. OLD BUSINESS: None NEW BUSINESS: A. PUBLIC HEARING — REVIEW AND MAKE A RECOMMENDATION TO CITY COUNCIL REGARDING ORDINANCE 0-15-03 WHICH PROPOSES TO AMEND THE LAND DEVELOPMENT CODE, ARTICLE III, SECTION 54-2-3.2(a)(7) REGARDING PERMITTED LOCATIONS FOR TEMPORARY USES AND SPECIAL EVENTS Ms. Bosworth reviewed that the previous Ordinance 0-14-06, along with other changes, defined the locations of where temporary uses and special events could be held to commercial and public service zoning districts in non-residential areas. She stated that shortly after the ordinance was approved, some of the churches in the residential areas approached the city manager that the new ordinance would affect their fundraising efforts. They presented a plea before the City Council, who directed the City Manager to meet with them and bring back a proposal that would accommodate the churches yet keep the flea markets out of the residential areas. The proposed changes noted in the section allowed permits for non-commercial uses only in the residential 2 Ea C areas, and Ms. Bosworth gave two examples of community -type fundraisings events that would be allowed such as a Fall Festival with a Pumpkin Patch, or a Blessing of the Pets. She stated the applications would still need to be submitted to staff for processing and review. There were no comments from the Commissioners. Mr. Dodd asked for clarification that non-commercial meant no renting or leasing spaces to vendors. Ms. Bosworth stated not totally, because it may be appropriate at a pet blessing event to have H.A.L.O. or the Humane Society have a booth. She stated staff would have discretion, and the final decision for any gray area would be by the City Manager. Mr. Dodd asked if the staffs review of the applications included impacts to parking, traffic flow, etc., for smaller type of events. Staff stated yes. MOTION by Dodd/Carter "to recommend to the City Council that they approve Ordinance 0-15- 03." Mr. Dodd asked if there was anyone in the public that wished to speak about the Ordinance. CHAIRMAN MATTERS: None MEMBERS MATTERS: Mr. Carter stated the new Cumberland Farms turned out to be a very, very nice remodel. The new store was big, clean, and set up efficiently with good traffic flow. Mr. Qizilbash stated the road repaving job on Engler Drive looked good and the contractor did a nice job. DIRECTOR MATTERS: None ATTORNEY MATTERS: Mr. Ginsburg informed the Commission that a legal challenge brought to Circuit Court about the Capt. Hiram's site plan was dismissed by the Court last week. Mr. Carter asked if they had begun the project yet. Ms. Bosworth stated the silt fencing had been installed, and they had recently picked up their landclearing and building permits. She also noted there was a groundbreaking ceremony for the Assisted Living Facility project adjacent to the Catholic Church next Wednesday, and she would forward the announcement to the Commissioners. Chmn. Dodd sent his condolences to Rich Stringer's family, and stated he had had the opportunity to work with him when he was on the Code Enforcement Board, and also earlier with the PZ Commission, and it was a shame he passed so soon.
