RE: Joy Haven Seawalls/Bulkheads

Today, I sent the attached letters to property owners on Joy Haven Drive. They
had voiced/sent concerns about seawalls/bulkheads on their property separating
and `leaning over' onto the waterside. Contrary to what you may have heard,
please be advised that NO seawall has collapsed.
Our investigation has revealed that the 4 subject seawalls are on private property.
There may be more that `come to light' in the near term. Since you may hear
about this problem soon, I wanted members of Council to be aware that we are
investigating all citizen concerns regarding seawalls.
As a sidebar; I have instituted the `Citizen Request Line.' We are into the 2"d
week and you may consider this effort as a `clearinghouse' for
complaints/concerns/requests/etc. Debbie Abreu --- in the AM she works with
Greg Schmidt in the Central Garage doing admin work ---she staffs the `round'
desk in the City Hall lobby greeting visitors in addition to the `voice' for Citizen
Requests. There is a slide on ch 25 announcing the request line. Please pass to

This office has conducted an investigation relating to your concerns regarding the
seawall/bulkhead at the rear of your property. Upon notice of your concern, I conducted
a personal inspection on Friday, 10 October 2014. I then instructed the City Engineer,
and staff, to conduct an investigation. Their preliminary investigation revealed that,
according to the survey on record of the property at 219 Joy Haven, the seawall/bulkhead
is not on City property. Subsequently, I instructed the Engineer to order an updated
survey conducted by a commercial professional survey company. Today, I was presented
with those results. The survey reveals that the bulkhead is on private property (copy
enclosed). Unfortunately, I am precluded from making repairs on private property. It is
the opinion of the licensed professional City Engineer that this bulkhead issue has
potential negative safety consequences. The City Engineer is recommending that you
pursue an immediate repair to the seawall/bulkhead and surrounding landscape. The City
is prepared to help you, as the property owner, to find a competent contractor. You
should know that there are three (3) other properties that may have similar problems. I
am proposing a meeting of those property owners on Friday, November 7, 2014 at I OAM
to discuss alternatives. I will have the City Engineer present to help with suggestions.

This office is in receipt of your correspondence regarding the seawall/bulkhead at the rear
of your property. Upon notice of your concern, on Thursday 09 October 2014, I
dispatched the City Engineer and the Stormwater Supervisor to visually inspect your
property. After they reported to me, I conducted a personal inspection on Friday, 10
October 2014. I then instructed the City Engineer, and staff, to conduct an investigation.
Their preliminary investigation revealed that, according to the survey on record of the
property at 243 Joy Haven, the seawall/bulkhead is not on City property. Subsequently,
I instructed the Engineer to order an updated survey conducted by a commercial
professional survey company. Today, I was presented with those results. The survey
reveals that the bulkhead is on private property (copy enclosed). Unfortunately, I am
precluded from making repairs on private property. It is the opinion of the licensed

This office is in receipt of your correspondence regarding the cracks in the seawall cap at
the rear of your property. Previously, I had conducted a personal inspection on Friday,
10 October 2014. Subsequently, I instructed the City Engineer, and staff, to conduct an
investigation. Their preliminary investigation revealed that, according to the survey on
record of the property at 249 Joy Haven, the seawall/bulkhead is not on City property.
Recently, the City Engineer ordered an updated survey conducted by a commercial
professional survey company on the property directly east of your property, 243 Joy
Haven. Your property has a common border with that property. Today, I was presented
with those survey results. The survey reveals that the bulkhead is on private property
(copy enclosed of the 243 survey). I am precluded from making repairs on private
property, therefore, the City will not make repairs to the cap on your bulkhead/seawall.
The City Engineer is recommending that you pursue an immediate repair to the
seawall/bulkhead cap. The City is prepared to help you, as the property owner, to find a
competent contractor. You should know that there are three (3) other properties that may
have similar problems. I am proposing a meeting of those property owners on Friday,
November 7, 2014 at 1 OAM to discuss alternatives. I will have the City Engineer present
to help with suggestions. Please contact Jean Tarbell at 388-8203 if you are able to
attend the meeting.
