CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA The City Attorney selected Skylar Carstairs to act as Chair to open the meeting and she called the meeting to order at 3:01 p.m. 2. The Pledge of Allegiance was recited. 3. Ginsburg City Clerk, Sally Maio 4. AGENDA MODIFICATIONS Modifications and additions require unanimous vote of members. Deletions do not apply. The City Attorney chose Skylar Carstairs to act as Chair for preliminary matters, and Ms. Carstairs asked if there were any modifications to the agenda. There were none. 5. PUBLIC HEARINGS (only if applicable) - None 6. UNFINISHED BUSINESS -None Youth Advisory Council Meeting May 13, 2015 Page Two 7. PUBLIC INPUT Skylar Carstairs asked if there was any public input and there was none. 8. NEW BUSINESS A. Welcome by Vice Mayor Jerome Adams Vice Mayor Adams thanked City staff, the schools liaisons, parents and students for their commitment to the Council and told them he looked forward to the ideas that will come forward. He told the Youth Council members that staff will be a great resource for them, noted we are governed by the sunshine laws, and urged them to ask questions, wished them luck, told them to have fun, said he would be in contact with them and looked forward to great things from them. B. Input from City Manager Re: Committee Mission City Manager, Joe Griffin, introduced himself, welcomed and thanked the members of the Youth Council. He briefly went over how the Youth Council was established by resolution passed by the City Council, and reviewed provisions of the resolution which requires members be City residents, actively enrolled in school, with terms of one year. He said he wanted them to have a positive and friendly experience, cited the need for civility, continued reviewing the resolution, noting meetings will be held one meeting per quarter starting at 3 pm, with proper public notice and an agenda prior to the meeting. He said that meetings can be held if there is a quorum, which is a majority of the membership, but with less than a quorum they can conduct a meeting but not take action; urged them to make an effort to attend the meetings, noting that three unexcused absences will result in expulsion, so if they cannot make a meeting they should contact him or the City Clerk and asked for an excused absence. He said the Youth Advisory Council is tasked with evaluating and reviewing problems facing the City, facilitating meetings with other area youth and bringing ideas forward, and meeting regularly with the City Manager, Mayor and Council to share ideas, to attend City Council Meetings, or watch them on COS -TV (Comcast Cable Channel 25 or UStream on the city website). The City Manager once again welcomed them and thanked them for their volunteerism. C. Input from City Attorney Re: Brief on Sunshine Law & Quorum City Attorney, Bob Ginsburg, said they are now a part of government at the municipal level, and as part of the City of Sebastian certain State laws apply to us and to them too and as an advisory board member they are subject to the Sunshine law. The City Attorney asked if any of them knew one another, and do they talk or text or follow each other on Facebook or Twitter. Getting no affirmative response, he went on to say that the way the Sunshine law works is that it assumes the Youth Advisory Council meetings and work will be done in the public and not in private, such as at a meeting like this. He said there are many more ways to talk to each other now than there were before, but the law does not permit them to email each other or talk to each other about business that will come to them as the Youth Advisory Council. He said that anything they want to say to one another they say at one of these meetings and not by any other method outside of these meetings. He noted the City Clerk gave them a list of staff emails and Youth Advisory Council Meeting May 13, 2015 Page Three phone numbers if they need to contact staff, reiterating they should not communicate with one another about any business that would come before this Council, because if they do any project or idea they discuss outside of a meeting may be undercut later if it resulted from a violation of the Sunshine law. He went on to say that public records law is another part of the Sunshine law and said anything they get in relation to their Youth Advisory Council's work is a public record so they should not dispose of it, rather send it to the City Clerk who will retain it for the required time under State law including all emails. He noted the City Clerk also provided written material about records law, which is written in the State Constitution and Statutes. He said if they have any questions they can call him and he will talk to them. D. Selection of Chair and Vice Chair Skylar Carstairs called for nominations for Chairman Eddie Simchick nominated Ryan Rafuls and Anthony Scaramuzzi seconded the nomination. There were no other nominations. The City Attorney announced that by virtue of his nomination and no other nominations, Ryan Rafuls was appointed Chairman of the Youth Advisory Council. The City Attorney then advised Mr. Rafuls as Chairman to call for nominations for Vice Chairman, and thanked Skylar Carstairs for acting as Chair to this point. Mr. Rafuls called for nominations for Vice Chairman. Skylar Carstairs nominated Anthony Scaramuzzi for Vice Chairman. Chairman Rafuls called for a second. Hearing none, Chairman Rafuls seconded the nomination. Anthony Scaramuzzi nominated Skylar Carstairs for Vice Chairman. Marlee Houck seconded the nomination. The City Clerk explained she would call each name (Mr. Scaramuzzi and Ms. Carstairs) and each member should name the person they were voting for to be Vice Chairman and the person getting the majority will be Vice Chair. A. Determine Meeting Schedule and Set Next Agenda The City Manager advised Chairman Rafuls that the Council needed to determine the next meeting schedule and said Wednesdays before Council meetings would be appropriate and offered August 12th as a possible date since their creating resolution requires at least one meeting per quarter. A voice vote approved that date. Youth Advisory Council Meeting May 13, 2015 Page Four Chairman Rafuls announced the next meeting for August 12`h at 3 pm. The City Clerk noted she neglected to add "Set next agenda items" as the last agenda item, and the City Attorney asked if there were any ideas for the next agenda. No members had anything to add at this time, and the City Attorney advised if any of them thought of things they would like to add to the August 12`h agenda to contact the City Clerk, who prepares the agenda. 9. STAFF MATTERS No public input under this heading The City Attorney had nothing further to add, noting he will review future agendas for their meetings and if there any legal issues involved he will attend. The City Manager thanked them again for serving and asked them to review Section 13 of R-15-11 regarding their responsibilities and duties keeping in mind what the City Attorney has told them regarding the Sunshine Law and records law, and think about any items they may want to bring forward to the next meeting at least a week ahead of time (by August 7th), and contact him or the City Clerk. The City Clerk said she provided information about how they can forward emails they may receive in relation to their business on the Council to her so she can retain them in the public record. She said they should not send emails to one another, and if they send emails relating to Council business out to someone they should also copy it to her. She said she will send a reminder about agenda items for the next meeting, and packets will go out on the Friday before the meeting. She asked them to make sure she has their best email address and a phone number if they wish to provide it. The City Manager asked the Council to allow one of their teachers to address. Chairman Rafuls approved the request. Michael Stutzke, SRHS, congratulated all of them and said it would not be a bad idea for each of them to go to their respective school libraries and get a copy of Roberts Rules of Order which will help them with their organization. 10. BOARD OR COMMITTEE MEMBER MATTERS No member had anything to bring forward. 11. Chairman Rafuls called for a motion to adjourn. MOTION by Taylor Eason and SECOND by Marlee Houck to adjourn the meeting. VOICE VOTE on the motion passed unanimously.
