The amendment involves changes to the Future Land Use Map of the Comprehensive Plan. Based on Chapter 163,Florida Statutes(F. S.),we prepared the attached report,outlining our findings concerning the amendment. We are concerned that the City address the availability of road facilities to support the proposed map amendment. It is particularly important that the City address the objections set forth in our review report so that the issues raised in the report can be successfully resolved prior to adoption. We have also included copies of local,regional and state agency comments for your consideration. Within the next 60 days,the City should act by choosing to adopt,adopt with changes or not adopt,the proposed amendment. For your assistance,our report outlines procedures for fmal adoption and transmittal of the comprehensive plan amendment. Objections relate to specific requirements of relevant portions of Chapter 9J-5,F.A.C., and Chapter 163,Part II, F.S. Each objection includes a recommendation of one approach that might be taken to address the cited objection. Other approaches may be more suitable in specific situations. Some of these objections may have been raised initially by one of the other external review agencies. If there is a difference between the Department's objection and the external agency advisory objection or comment, the Department's objection would take precedence. The City should address each of these objections when the amendment is resubmitted for our compliance review. Objections which are not addressed may result in a determination that the amendment is not in compliance. The Department may have raised an objection regarding missing data and analysis items which the City considers not to be applicable to its amendment. If that is the case, a statement justifying its non-applicability pursuant to Rule 9J-5.002(2), F.A.C.,must be submitted. The Department will make a determination as to the non-applicability of the requirement, and if the justification is sufficient, the objection will be considered addressed. The comments which follow the objections and recommendations are advisory in nature. Comments will not form a basis for determination of non-compliance. They are included to call attention to items raised by our reviewers. The comments can be substantive, concerning planning principles, methodology or logic, as well as editorial in nature dealing with grammar, organization, mapping, and reader comprehension. Appended to the back of the Department's report are the comment letters from the other state review agencies, other agencies, organizations and individuals. These comments are advisory to the Department and may not form a basis for Departmental objections unless they appear under the "Objections"heading in this report. 2 OBJECTIONS, RECOMMENDATIONS AND COMMENTS REPORT PROPOSED COMPREHENSIVE PLAN AMENDMENT CITY OF SEBASTIAN (DCA No. 03-1) I. CONSISTENCY WITH CHAPTER 163, F.S., AND RULES 9J-5 & 9J-11, F.A.C. The Department has completed its review of the proposed amendment to the City of Sebastian Comprehensive Plan(DCA No. 03-1). The amendment affects the Future Land Use Map. The Department has the following objection: Objection: The City has not provided traffic analysis to evaluate the impact of the land use change on the roadway network. The City provides year 2002 traffic counts and level of service. However, the report does not evaluate whether the Level of Service Standard will be maintained through 5 years and how the change may impact long term transportation needs. Section 163.3177(6)(j)5.,F.S.; Rule 9J-5.006(3)(b)1. & (c)3.,F.A.C.; Rule 9J-5.019(4)(b)2. & (c)1., F.A.C. Recommendation: The City should demonstrate through appropriate traffic information what impact the amendment will have on the roadway network and whether level of service will be affected. II. CONSISTENCY WITH STATE COMPREHENSIVE PLAN The proposed comprehensive plan amendment does not adequately address and further the land use goal and policies of the State Comprehensive Plan, Chapter 187, F.S., regarding(16) Land Use (b)1. Promote state programs, investments and development and redevelopment activities which encourage efficient development and occur in areas which will have the capacity to service new population and commerce. Recommendation: The City should revise the proposed amendment to be consistent with the State Comprehensive Plan (see specific objections, comments and recommendations included in this report). 4 I V St.),) %t. OBJECTION: The City does not provide a traffic impact analysis, based on the maximum potential development, to address impacts this proposed amendment would have on the current and future roadway network, including I-95, a Florida Intrastate Highway System facility. DISCUSSION: Data and analysis necessary to support staff's determination that traffic impacts would not adversely affect the current and future roadway network levels of service was not provided. The MPO's 2025 Long Range Transportation Plan indicates that, without this amendment, the level of service in 2025 during the PM peak hour at the CR-512/CR-510 intersection will be�,QS.P. An analysis of the long-term impacts of the proposed change in land use on the surrounding roadway network, including the I-95/CR-512 interchange, is necessary to ensure that future transportation needs can be met. The proposed land use designation to the subject property allows maximum development of 336 units, which potentially could produce 3,200± weekday trips (based on ITE Trip Generation 6`'' Edition for Single Family Detached Housing (210)). Depending upon the use, the 5-acre Commercial Limited portion of the site could generate an additional 4,300± weekday trips based on ITE Trip Generation 6`h Edition for Shopping Center(820)) (at .50 FAR). RECOMMENDATIONS: The City should provide a complete transportation analysis, based on the maximum allowable land uses, to identify peak hour, peak direction level of service impacts, with and without the proposed amendment. This transportation analysis should address short- and long-range impacts to I-95, including the I-95/CR-512 interchange, and how the City will mitigate identified impacts to the roadway network. The proposed designations are: • 67.3 acres—Low Density Residential (Maximum 5 dwelling units per acre) • 5.1 acres—Commercial Limited Surrounding lands are primarily vacant, although there is single-family residential development (Sebastian Acres) across the Sebastian River to the east. There is some existing commercial retail development at the intersection of CR 512 and CR 510. Surrounding FLUM designations are low density residential to the east and south and Commercial/Industrial to the north and west in the unincorporated county. The proposed use of the property is as a 209 unit single-family housing development with a five-acre commercial node along CR 510. The City considers the proposed FLUM designations consistent with the City plan and indicates that public facilities, services, and access are available. The City staff and the Planning and Zoning Commission recommendedapproval.a roval. The City Council transmitted the amendment by. a_unanimous vote. Extrajurisdictional Impacts Analysis of the proposed amendment indicates that it would not have significant extrajurisdictional impacts. A letter was sent to the County requesting comments on any conflicts with the County comprehensive plan. Effects on Significant Regional Resources or Facilities Analysis of the proposed amendments indicates that they would not have adverse effects on significant regional resources or facilities. The preliminary site plan for the proposed development shows a roadway connecting the residential component with the commercial component.
