Suncastles was in attendance as were virtually all other players in the game, including the Engineer of Record (Bruce Moia) and Forte Macaulay, the developer of Sebastian River Landings. Ken's email is self-explanatory. It covers, we believe, the issues at hand; i.e. the need for all builders there to adhere to the latest approved plans issued by the Engineer of Record for the project. • It is the responsibility of the Engineering Department to review and issue Driveway/Drainage permits in a timely manner in response to complete submittals for such permit applications, and then to further inspect in the field for compliance during construction and upon completion of the requisite drainage improvements. We seldom, if ever, shut a project down in the midst of construction. We do, however, advise contractors when we see problems arising prior to final inspection and the request for final sign-off. In this case, we observed obvious potential problems during Suncastles construction operations and we advised Suncastles of same by letter on 19 August 04 (included in the email attachment here). That led to the meeting of August 25 noted above. • To date, Suncastles has submitted approximately 27 Driveway/Drainage Permit applications for homes in Sebastian River Landings, some of them as long ago as July 2004. Engineering has issued approval for approximately 20 of those permit applications. Of the approximately seven (7) remaining unapproved at this time, we are still waiting for proper resubmittal by Suncastles to show accord with the most recent approved drainage site plans for the project. • We make note and emphasize again here that we continue to observe clear and obvious noncompliance with the latest approved drainage site plans for the project (provided to us by the Engineer of Record on 25 August 2004). There were no other plans that were approved. It was brought to the Engineering Departments attention last week by Adams Homes that there were a number of plans were floating around that appeared to be different and there was a great deal of confusion. It was not the City's intent to stop all work on the project, however, the confusion regarding which plans were approved called for immediate action. Therefore, I issued the Memo on Thursday August 19 (attached)stating that the only approved plans were those held in the City Growth Management Department. The developer and all builders were put on notice that they were proceeding at their own risk for any building in Sebastian River Landing and any construction that did not meet the approved plans would be brought into compliance at the developer's/builders expense. A meeting was set at that time for August 25th to further discuss the problem. Bruce Moia was then asked to explain the confusion regarding the plans. Bruce stated that at one point the developer had requested the Engineer to submit to SJRWMD for a change to the rear yard grading for lots on the east side of the project. There was a concern regarding excessive slopes on the lots which drained toward the Sebastian River. Those plans were drawn up and submitted to SJRWMD but were rejected. Therefore the grading and drainage plans were not changed and were the same as submitted and approved by the City of Sebastian. However, another set of plans was drawn up changing the grading of a group of lots that backed up to each other to compensate for the 2 foot change in elevation. This change created a 5:1 slope transition area. These drawing had also gotten out to the builders. Bruce brought to the meeting 5 sets of these plans to be submitted and approved by the City. He also stated that finished floor elevations were added to each lot. I informed those present that the Engineering Department would review the new set of plans as quickly as possible but they would probably not be approved until Monday August 30th. It was noted that all drainage permits applications previously approved by the Engineering Dept. would have to be reviewed again to insure the new changes to the plan have not impacted the previously approved drainage permits. These re-reviews will not be forth coming until the new site plan has be reviewed and approved. I requested that the builders provide the Engineering Department with a priority list of lots that they would like to have re- reviewed first to help speed up the review process to reduce any impact due to the delay as a result of having to re-review the drainage permit applications. I made the statement to all, that in the future, the City of Sebastian is to be notified in advance of any proposed changes to the approved plans. This will keep the City in the loop and help alleviate confusion in the future. I believe all agreed that the City's position and it's actions were reasonable and justified. It was brought to the Engineering Departments attention last week by Adams Homes that there were a number of plans were floating around that appeared to be different and there was a great deal of confusion. It was not the City's intent to stop all work on the project, however, the confusion regarding which plans were approved called for immediate action. Therefore, I issued the Memo on Thursday August 19 (attached)stating that the only approved plans were those held in the City Growth Management Department. The developer and all builders were put on notice that they were proceeding at their own risk for any building in Sebastian River Landing and any construction that did not meet the approved plans would be brought into compliance at the developer's/builders expense. A meeting was set at that time for August 25th to further discuss the problem. Bruce Moia was then asked to explain the confusion regarding the plans. Bruce stated that at one point the developer had requested the Engineer to submit to SJRWMD for a change to the rear yard grading for lots on the east side of the project. There was a concern regarding excessive slopes on the lots which drained toward the Sebastian River. Those plans were drawn up and submitted to SJRWMD but were rejected. Therefore the grading and drainage plans were not changed and were the same as submitted and approved by the City of Sebastian. However, another set of plans was drawn up changing the grading of a group of lots that backed up to each other to compensate for the 2 foot change in elevation. This change created a 5:1 slope transition area. These drawing had also gotten out to the builders. Bruce brought to the meeting 5 sets of these plans to be submitted and approved by the City. He also stated that finished floor elevations were added to each lot. I informed those present that the Engineering Department would review the new set of plans as quickly as possible but they would probably not be approved until Monday August 30th. It was noted that all drainage permits applications previously approved by the Engineering Dept. would have to be reviewed again to insure the new changes to the plan have not impacted the previously approved drainage permits. These re-reviews will not be forth coming until the new site plan has be reviewed and approved. I requested that the builders provide the Engineering Department with a priority list of lots that they would like to have re-reviewed first to help speed up the review process to reduce any impact due to the delay as a result of having to re-review the drainage permit applications.
