Further to our telecom moments ago, this to further advise and confirm that based on the
most recent information and the letter of certification dated 17 April '06 from SBS / Joe
Schulke, Engineer of Record for the Ashbury project, the Engineering Department has
NO OBJECTION to the release of the subject performance bond(s). Any further
enforcement of outstanding items may be done under the notes/letter(s) of commitment
from the developer.

Re: Ashbury Subdivision
Dear Mr. Fisher,
This is to advise you the asphalt repairs and overlay between stations 100+00 and
105+00 have been completed in accordance with my letter of April 12, 2006. A minimal
amount of thermal striping which must be reinstalled cannot be completed until the new
asphalt overlay has cared for 30 days. A separate letter from the developer guaranteeing
the installation of the rhermal striping within 45 days is attached.
As you are aware, the additional work agreed to be completed at the end of
Powerline Road by the Developer was not part of the City approved construction plan but
will still be completed in accordance with the April. 121fi letter. Since this work was not
part of the original construction plans I believe the release of the performance bond
should be zt the time of substantial completion of the overall subdivision, rather than
delayed until that work is complete.
I therefore certify ail construction for the Ashbury Subdivision has been
substantially completed in accordance with the City of Sebastian approved construction
plans and respectfully request the release of the performance bonds.
If you have any questions please do not hesitate to give me a call.

Dear Dave,
In response to the remaining issues at Ashbury, I have:
1. Sidewalks — Attached is my correspondence to Tracy Haas and to you (Dave
Fisher) regarding sidewalk requirements. On November 1, 2004, I attended a TRC
meeting at the City to review the construction plans. I had not proposed a
sidewalk north of our project frontage (in front of the FP&L substation on
Powerline Rd.) for several reasons, which are:
a. Typically, we are only required to construct improvements along our
frontage.
b. The existing grades at FP&L were much lower than the proposed
Powerline Rd. grades. In order to construct the sidewalk along the east
right-of-way line, we would have to fill several feet, which would cause
anencroachment onto FP&L property with the fill sloped.
However, at the T.R.C., it was strongly recommended that I add the sidewalk
along Powerline Rd. from our northern limits, across FP&L's frontage and
connect to the sidewalk at the Pelican Isle Apartments. Your staff suggested I put
the 5' sidewalk against the curb to solve the fill slope encroachment problem.
Based on this recommendation, I revised the plans and submitted for final
approval. Attached are my notes from the meeting and correspondence to you
dated November 24, 2004, indicating that we revised the sidewalk pursuant to
staff review and request.
Based on the above, I would respectfully request your acceptance of the sidewalk
construction as completed.
2. Drainage pipe crossing Powerline Rd. — I did not realize the City had a policy or
regulation prohibiting B.C.C.M.P. pipe in the right-of-way. On the contrary, I was
under the impressions that this was a suitable pipe, and the ADS -N12 pipe, which

the entire site was specified to have, would not be allowed - many agencies do not
allow plastic pipe in their right-of-way (i.e.: I.R.C.). The pipe was specifically
changed in the right-of-way to B.C.C.M.P. for this reason, and because, as a rule,
we do not specify plastic pipe where it will be exposed to direct sunlight. This
pipe outfalls into a ditch and is exposed to sunlight. Our use of B.C.C.M.P. was
not proposed as a cost saving measure, but based on our understanding of what
the City would prefer and approve.
At this point, the pipe is installed crossing Powerline Rd., and I do not believe the
removal and replacement with ADS or RCP is in the City's best interest. This
would leave a patch and potential area where settlement would likely occur now
or in the future. I also believe that the expected design life of the B.C.C.M.P. is
adequate and will outlast the pavement design life. Based on the above, I would
respectfully request your acceptance of the drainage pipe as installed.
3. Dead end condition at Powerline Rd. — Based on my recent conversation with
you, I understand that the Police Department concurs that a clear and level area is
more desirable than the installation of a guardrail. We have submitted
specifications to your office for approval. In general, we proposed to add
additional signage and clear and level a suitable area beyond the pavement
terminus to permit a vehicle to stop if it were to run through the warning signs.
I believe this addresses the remaining items on the punchlist for Ashbury
subdivision that require your additional consideration.
Please let me know your decisions on these matters as soon as possible. If you
have any questions or need additional information, please do not hesitate to contact
my office.
