On November 1, 2004, I attended i TRC meeting at the City to review the construction plans. I had not proposed a sidewalk north of our project frontage (in front of the FP&L substation on Powerline Rd.) for several reasons, which are: a. Typically, we are only required to construct improvements along ou; frontage. b. The existing grades at FP&L were much lower than the proposed Powerline Rd. grades. In order to construct the sidewalk along the e: st right-of-way line, we would have to fill several feet, which would ca ase anencroachment onto FP&L property with the fill sloped. However, at the T.R.C., it was strongly recommended that I add the sidewal c along Powerline Rd. from our northern limits, across FP&L's frontage and connect to the sidewalk at the Pelican Isle Apartments. Your staff suggested I put the 5' sidewalk against the curb to solve the fill slope encroachment probler. I. Based on this recommendation, I revised the plans and submitted for final approval. Attached are my notes from the meeting and correspondence to yc u dated November 24, 2004, indicating that we revised the sidewalk pursuant :o staff review and request. Based on the above, I would respectfully request your acceptance of the sidc walk construction as completed. 2. Drainage pipe crossing Powerline Rd. —I did not realize the City had a policy or regulation prohibiting B.C.C.M.P. pipe in the right-of-way. On the contrary. The pipe was specitica .ly changed in the right-of-way to B.C.C.M.P. for this reason, and because, as . L rule, we do not specify plastic pipe where it will be exposed to direct sunlight. T its pipe outfalls into a ditch and is exposed to sunlight. Our use of B.C.C.M.P. was not proposed as a cost saving measure, but based on our understanding of v hat the City would prefer and approve. At this point, the pipe is installed crossing Powerline Rd., and I do not belie ve the removal and replacement with ADS or RCP is in the City's best interest. Tl is would leave a patch and potential area where settlement would likely occur now or in the future. I also believe that the expected design life of the B.C.C.MY. is adequate and will outlast the pavement design life. Based on the above, I w ,uld respectfully request your acceptance of the drainage pipe as installed. Dead end condition at Powerline Rd. — Based on my recent conversation wi 1 you, I understand that the Police Department concurs that a clear and level; rea is more desirable than the installation of a guardrail. We have submitted specifications to your office for approval. In general, we proposed to add additional signage and clear and level a suitable area beyond the pavement terminus to permit a vehicle to stop if it were to run through the warning sib as. I believe this addresses the remaining items on the punchlist for Ashbury subdivision that require your additional consideration. Both the sidewalk and the CMP issues are NOT settled and both require further discussion Any discussions we have had about that since the field inspection visit (and they have been ver brief and not particuiady substantive) have been only for issue identification with no mutual concurrence'n place. This would ii )elude three Red reflectors to be located at the end of Powerline (one in addition to the two existing; with a W14-1 Dead End sign facing the oncoming Powerline Road traffic at the Roy Ave. intersectic i. In addition a two way WI - 7 sign would be placed facing the oncoming Roy Ave. traffic. We fee, that this would be a safer solution than erecting a barrier at the end of Powerline road and reduce liability for all. Using signage would be similar to the solution the City used at Larkspur and Grandeui Please let me know as soon as possible if this solution is acceptable to the City so the develc per can proceed to fill the ditch and order the signs. It is my understanding, in previous discussions with Joe Schulke the City has agreed to accel t the sidewalk as installed and this is no longer an issue.
