The private, deed -restricted subdivision includes a total of 195 single-family units thus creating a density of 3.47 units/acre, and is accessed from an entrance off CR 512 westbound near Orange Heights. Staff has verified that the final plat is in accordance with the preliminary plat approved by Resolution R-04-42 on October 27, 2004. The City Attorney has reviewed the plat dedications. The subdivision's bylaws, covenants, and restrictions address a non -monotonous color and building scheme for the residences. Additionally, all engineering, and surveying details have been satisfied in accordance with Florida Statutes. As allowed by the City's land development regulations, the developer has posted a bond in the amount of 110% of anticipated construction completion costs so as to permit final platting prior to completion of infrastructure and site development requirements. The City Engineer has reviewed and accepted the estimated remaining costs, and the City Attorney has reviewed and approved the performance bonds. The City has required a separate performance bond for the construction of the sidewalks, which must be completed within two years. Currently sidewalks are constructed lot by lot as each individual building permit is issued. The sidewalk bond will provide for a complete system regardless of remaining vacant lots after a reasonable period of time of new home construction. The developer has agreed to pay for a "fair -share" of the construction costs for the undeveloped remaining portion of Powerline Road. A developer's agreement in that regard was approved by the City Council on September 14, 2005. Council Member Andrea Coy identified several items of concern at the City Council meeting of September 14, 2005. The developer has met with City staff on several occasions since that meeting to resolve those issues. Council Member Coy was concerned that landscaping was not included as a line item in the engineer's estimate of construction costs. The engineer has revised the cost estimate to include the required landscaping. As a month has passed since the original estimation, and with the continuation of construction during that time, the original bond amount still more than covers the revised construction costs. As noted in the proposed Declaration of Covenants and Restrictions, the developer had proposed that the owners of Lots 82 through 87 would be responsible for planting the landscape buffer to be located in the 25 -foot conservation easement on each lot. However, this would not provide the required 90% opaque buffer until such time as those lots are developed. As a fundamental requirement of the PUD to provide the buffer, this is unacceptable. Therefore, the developer has removed Section 7.20) from the Declaration, and acknowledges that the landscaping must be in place before the subdivision can be considered complete. The approved construction plan references a one -foot berm running parallel to and approximately 25 feet west of the eastern subdivision property line (in the location of the silt fence). The developer and City agree that the purpose of this berm is to direct drainage from the perimeter of their subdivision west toward the interior of their subdivision. The landscape plan for the 25 -foot buffer area as shown on the approved construction plan states, "Preserve all native vegetation (area is dense with pines, oaks, palmettos). Plant additional native vegetation where needed to maintain 6 foot opaque feature -plant wax myrtles, palmettos, pines, oaks, etc. " The developer proposed changing the plan to provide a 3 -foot earth berm 12 1/2 feet from the property line (along the middle of the 25 -foot conservation easement). This would provide for 3 feet of the required 6 -foot opaque feature, with the remainder to be provided by landscaping. This proposed amendment to the approved construction plan has now been withdrawn. The developer agrees to provide the required landscaping as approved on the construction plan, with no earth berm feature. Staff believes that all areas of concern have now been addressed. RECOMMENDED ACTION Approve Resolution R-05-37 to accept the final plat for Ashbury Subdivision. In order to enforce this provision, all Owners leasing or renting their Lots shall be required to incorporate the following provision in their lease or rental agreements (substantially in the following form): The Leased Premises are a part of a Subdivision. All persons occupying property in Ashbury Subdivision are required to observe the Covenants and Restrictions of Ashbury Community Association, Inc. Copies of all Covenants and Restrictions are to be obtained from the Landlord. In addition, all Owners leasing their Lots are required to provide the Association with a copy of the lease and the names and addresses of the Landlord and the Tenant unless they are contained in the lease or rental agreement. Section 7.2. Con:strucdon Restrictions. Construction restrictions for Lots in Ashbury Subdivision are imposed as follows: (a) A minim um twenty X20) foot set back shall be required from the nearest part of the front of a residence to the front lot line. (b) In the event of damage or destruction by fire or other casualty to the residence, or improvements on any Lot, the Owner shall, upon receipt of the insurance proceeds, repair or rebuild such damaged or destroyed residence or improvements in a good workmanlike manner in strict compliance with the original plans and specifications and building layout of said improvements as constructed by the Developer within a reasonable time not to exceed one (1) year and in accordance with the provisions of these Covenants.
