OF CITY CLE1 April 12, 2004 Mayor McCollum City Council City of Sebastian 1225 Main St. Sebastian, FL 32958 Dear Mayor McCollum: We oppose the proposed 195 single-family housing development which is to be near Sebastian Elementary School and Grange Heights. We don't want houses going on land that contains several kinds of wildlife. Has an independent environmental impact study been completed whose findings can be presented to the City Council? Has the Council contacted the Indian River Board of Education to ask them if this land could be used for a future middle school in the area? When we attended the Planning and Zoning Board meeting when this development was discussed, the Board told the developer to cut out 10% of the houses and to make the lots larger. This recommendation was made by Ms. Monier. However, the developer is presenting his plan unchanged. So many of us are tired of catering to the developers. A large number of concerned Sebastian residents (The Lawn Chair Brigade) are expected to attend. We cannot predict with certainty, how many people will actually attend, however, public response has been considerable and we anticipate 200 or more people. Their interest lies in 2 specific agenda items that currently are scheduled late in the agenda. 1. Item number 9A Second Reading, Quasi-Jusdicial Public Hearing of Ordinance No. 0-03-21. 2. Item number 11A., First reading of Ordinance No. 0-04-03, Voluntary annexation ... Ashbury Subdivision. Out of consideration for the general public that will be outside in our mosquito evening air, request both these items be moved to the front of the schedule. Perhaps the four previously scheduled presentations could be rescheduled for a later date or moved to the end of the evening. Please don't make it difficult for our city residents to be seen and heard in these matters. Approval of this request will facilitate crowd-control/unrest and assist in the orderly departure of the public and media after these agenda items have been addressed. It took three verbal direct questions and 2 written emails for him to finally admit that "the Office of the City Manager has authority to schedule City Council meeting agendas. As such, as a result of this charter granted responsibility, I made the decision - as well as for reasons outlined in my City Council Information Letter report last week." Not sure why he couldn't just say "I did it" the first time I asked. It also appears that the legality of the sequence of events may be OK. However, it's questionable and not in the best public interest to confuse the issues and put carts before horses. I am sending a request to the City Manager for additional police support and special accommodations (perhaps a TV outside) to accommodate the Lawn Chair Brigade. As a concerned citizen of Sebastian, I ask that you consider voting no on both of these issues. Ashbury is an unneccesary development as we can find a better use for that land. I am a member of the School District long range planning committee and plan on taking that idea to our meeting nexr week. Sebastian Preserve is very much against the interests of the people and the environment. The city planning and zoning committee had the forsight to see this and I hope you will too. The Eagles nest and other wildlife will be foreveer disturbed by the construction no matter what. As the developer will not contract to keep the area for the animals and birds in perpertuity, they will be driven out. Also, the density and size of the lots are not in keeping with the needs of the city. We have to increase the services and build the new schools before more large developments are built. I am a full-time Sebastian resident and registered voter and live in Orange Heights. I love this City and hope you will try to keep from turning into a suburb of Miami. Please vote no on the Ashbury zoning request for a PUD. This doesn't belong in downtown Sebastian. Our beautiful woods is too precious to clear-cut. Please vote no on annexation of the Ashbury property. I'm sure we could find other alternatives that would save the woods. Doesn't the County need more school property?
