HomeMy WebLinkAbout1995 - JPA 4825349 SuplementalRESOLUTION NO. R-gS-~2 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING RESOLUTION NO. R-94-32; AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST A SUPPLEMENTAL JOINT PARTICIPATION AGREEMENT (GRANT) WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR ENGINEERING FOR LIGHTING AND OVERLAY OF RUNWAY 4-22; INCREASING THE GRANT AMOUNT TO $55,440.00; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS iN CONFLICT HEREWITH; PROVIDING FOR SEVERABiLITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sebastian, at its June 8, 1994 Meeting, adopted Resolution No. R-94-32 authorizing the Mayor and City Clerk to enter into a Joint Participation Agreement with the Florida Department of Transportation for engineering for lighting and overlay of nmway 4-22 at the Sebastian Municipal Airport; WHEREAS, The Joint Participation Agreement would have resulted in the City of Sebastian receiving up to $53,100.00 in grant funds for the purposes of this project from the Florida Department of Transportation; and WHEREAS, the City of Sebastian contracted with Greiner, Inc. for engineering services and the charge for those engineering services is $61,600.00. The grant provides 90°,4 of the engineering services' cost, therefore, the grant mount is increased to $55,440.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: SECTION 1. SUPPLEMENTAL AGREEMENT. The Mayor is hereby authorized to enter into and the City Clerk to attest the State of Florida Department of Transportation Public Transportation Supplemental Joint Participation Agreement on behalf of the City of Sebastian (a copy of said Supplemental Agreement being attached hereto as Exhibit "A"). The Supplemental Agreement increases the grant amount to $55,440.00. ~.,.C...TI.O_~L~ CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. ;,~.,_C_TIQ_]~. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without such invalid and unconstitutional provision, thereby causing said remainder to remain in full force and effect. ~.AT...T[Q_hI~ EFFECTIVE DATE.
