Agreement Amendment Background: On 23 October 2013, Council approved, and accepted, a Florida Inland Navigation District (F.I.N.D.) Grant #IR -SE -13-54 for additions/improvements at the Sebastian Working Waterfront. The agreement was fully executed by F.I.N.D. on 28 October 2013. This grant was to help finance the reconstruction of the Fish House, along with supporting structures, at the Working Waterfront. The provisions of the Project Agreement provided for a completion date of 01 September 2015. When it became apparent that the City was not going to meet that deadline, the City Manager applied for an extension to the project on 27 July 2015 (Attachment 2). On 10 September 2015, the City received an appropriate extension extending to 01 September 2016 for project reimbursement. The Project Agreement Amendment/Extension received by the City was executed by Ken Killgore, City CFO. This was done during an unavoidable absence of the City Manager from City Hall. Mr. Killgore, acting in good faith and believing `time -is -of -the -essence,' executed as the "Contract Administrator"—a term inserted by F.I.N.D. Since the original F.I.N.D. Project Agreement was signed by the Mayor, the City Manager requests Council acknowledge the validity of Mr. Killgore's signature and authorize the City Clerk to attest to same in order that the City's records reflect the proper process. Chronology of events, and justification, for the grant extension request is as follows: I. F.I.N.D. grant award for IR -SE -13-54: 28 October 2013 2. City immediately engaged engineering/architectural Finn: Schulke, Bittle & Stoddard, LLC. 3. Design completion, permit applications sent: October 2014. 4. Construction bid publically advertised on 17 November 2014. 5. Construction bid opened: 18 December 2014. 6. Construction bid awarded by City Council: 25 February 2015. 7. Army Corps permit received: 30 March 2015. 8. FDEP permit received: 12 June 2015. 9. FDEP Modified Submerged Lands Lease granted: 15 July 2015 10. Construction Notice to Proceed (NTP) issued: 10 July 15. The construction period is scheduled for 110 days. That would give a completion date in early November 2015. I am requesting, at minimum, a six (6) month extension, until 01 March 2016, to provide for any contingencies. The City of Sebastian is fully committed to this project and has worked diligently toward its completion through the challenges of design, permitting, and construction.
