ACCEPTED BY THE CITY OF SEBASTIAN, SEBASTIAN, FLORIDA 32958, UNTIL 2:OC 7, 2005 IN SEALED ENVELOPES, WHICH FOLLOWS: FROM LICENSED MODIFICATIONS OF PROPOSALS WILL BE 1225 MAIN STREET, P.M. ON SEPTEMBER SHALL BE MARKED AS REP: CLUB HOUSE ELECTRICAL MODIFICATIONS OPEN: SEPTEMBER 7, 2005 @ 2:00 P.M. Packages outlining the details and requirements of this Request for Proposals "RFP" can be obtained by contacting the City of Sebastian Municipal Golf Course Director at 772-388-4406 or by e-mail at: ggardner@cityofsebastian.org. Vendor shall show proof of Insurance and be properly licensed to conduct its business, with all licenses, permits, and certificates as required by all local, State, Federal agencies. A Drug Free Workplace Form is provided and must be signed and submitted with your proposal. Any person or affiliate who has been placed on the convicted vendor list following conviction for a public entity crime may not submit a proposal as proscribed by Section 287.133, F.S. A Public Entity Crime Form is provided and must be submitted signed and notarized with your proposal. Questions concerning this RFP shall be directed to Greg Gardner, Golf Course Director 772-388-4406. The City reserves the right to accept or reject any or all proposals, waive any irregularities, make an award to any respondent whose proposal or portion thereof is deemed by the City to be in its best interest, cancel this RFP at will, and/or extend any date or time deadline stated herein. I. City of Sebastian Club House Electrical Modifications Page 3 of 11 Currently, the Club House of the Municipal Golf Course houses the Golf Shop and the Eagle's Nest Restaurant. The Club House's electrical system along with the Cart Barn's electrical and other nearby facilities such as the Starter and Storage Shacks are being metered with one single FPL meter which is located on the west wall of the transformer vault located approximately 100+/- feet west of the Club House. The project is to provide a separate electrical service with an independent meter for the Eagle's Nest Restaurant and related facilities and equipment, and all the other electric demand will go through a second meter. II. GENERAL INFORMATION The Eagle's Nest Restaurant service shall include the electrical requirements for all Restaurant related areas including but not limited to: • Bar, Kitchen, Office, all Storage Areas (cooled or un -cooled) including Storage Shack East of the Club House, • Lighting and power supply outlets in all the Restaurant areas, • All equipment contained within all the Restaurant areas, and • All equipment necessary for the operation of all the Restaurant areas. There are two Cooling Units located on the East side of the Club House for the Restaurant Freezer/Cooler. There is an Air Handler/Cooling Unit located on the ceiling in the Kitchen. This unit services the Restaurant Extension Area Two of the three Units located on the West side of the Club House, the middle and the southern units, cool Restaurant areas. Their respective air handlers are located in Restaurant designated areas. City of Sebastian Club House Electrical Modifications Page 4 of 11 III. SCOPE OF SERVICES= The Contractor shall provide all supervision, labor, materials, tools and equipment necessary to perform all electrical work in order to complete the project and accomplish the requirements outlined in this RFP. The Contractor shall fiunish and install the following including but not limited to: • All necessary conduit, wiring and terminations, • Breaker panel(s) and breakers, • Boxes (junction, termination, outlet, switch) • Checking and testing all circuits for proper working order and labeling same, • Perform all necessary trenching work including break, remove and dispose of pavement, excavation and backfill, removal of excess excavated materials, etc. IV. ADDITIONAL REQUIREMENTS The Contractor shall coordinate and make any necessary arrangements with FPL to establish the additional metering as required for the project, and installation of new meter. The FPL Contact person for this project is (321) 726 - The Club House is open to the citizens every day of the week. Normal operating hours are from 6:30 AM to 11:00 PM. Consequently it is essential that this project be accomplished with minimal disruption to the Club House operations and services. The Contractor shall provide generating equipment when necessary to maintain the Club House in operation and open for business. Furthermore, it is extremely desirable to the City that the Eagle's Nest Restaurant is capable to conduct business and operate every day. Accordingly, the City requests that the Contractor comes up with a plan where by closing the Eagle's Nest Restaurant will not be required. The Contractor is responsible to obtain all necessary permits for this project. The City's permit fees will be waived for this project. V. EVALUATION AND SUBMITTALS A request for Proposal (RFP) is a formal invitation from an organization to a Vendor to submit an offer. The offer is to provide a solution to a problem or a City of Sebastian Club House Electrical Modifications Page 5 of 11 need that the organization has identified. An RFP is a procurement process in which the judgment by the organization of the supplier's proposed solution, experience and qualifications are considered and may take precedence over price. Accordingly, other factor in addition to price such as proposed solution, previous record, ability, capability, project approach, and other factors will be used to evaluate proposals and recommend award of contract to the respondent whose proposal is determined by the City to be in the best interest of the City. The Contractor shall submit an original and a copy of his proposal and the Cost Proposal Form included herein. The Contractor's proposal must clearly describe his approach to the project and how he intends to accomplish the same, all services that will be provided, the impact to Club House operations and Eagle's Nest Restaurant during the performance of the Work, and other issues or clarifications which may be applicable. VI. TERMS AND CONDITIONS 1. The City reserves the right to reject any and all Proposals, and/or re - advertise, to waive any irregularities, informalities or technicalities therein, to negotiate Contract terms with the successful Firm, to disregard all non- conforming, non-responsive, unbalanced or conditional Proposals, or to accept any Proposal which in the City's sole judgment will best serve the public interest. 2. The City reserves the right to request clarification on information submitted from the respondents after deadline for receipt of Proposals. 3. Any Respondent who submits in its Proposal any information that is determined by the City, in its sole opinion, to be substantially inaccurate, misleading, exaggerated, or incorrect may be disqualified from consideration. 4. Your attention is directed to F.S. Section 287.133(2)(A) "Public Entity Crime", which prohibits certain persons or affiliates who have been convicted of a public entity crime from responding to this invitation. A form is provided in this RFP package for your execution and submission. 5. A Drug Free Workplace Form is provided in this RFP package for your execution and submission. 6. Failure to execute and submit the forms in paragraphs 4. and 5. above will subject your response to disqualification. City of Sebastian Club House Electrical Modifications Page 6 of 11 COST PROPOSAL FORM The undersigned having become thoroughly familiar with all of the RFP Documents incorporated herein, hereby proposes to provide the services required hereunder in accordance with the needs and requirements of the City. The price quoted is inclusive of any Addenda that may be issued. By the signature below, the Vendor agrees that this Proposal is made without any other understanding, agreement, or connection with any person, corporation, or firm submitting a proposal for the same purpose and that the proposal is in all respects fair and without collusion or fraud. If awarded the Work, the Vendor agrees to enter into an Agreement for the services described in the RFP documents within ten (10) consecutive calendar days notice by the City, and agrees to all the terms and conditions of all documents stated herein with the City of Sebastian for the below stipulated prices which shall remain firm for sixty (60) days following RFP opening date. Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of such prohibition. 2. Inform employees about the dangers of drug abuse in the workplace, the business' policy of maintaining a drug-free workplace, any available drug counseling, rehabilitation, employee assistance programs and the penalties that may be imposed upon employees for drug abuse violations. 3. Give each employee engaged in providing the commodities or contractual services a copy of the statement specified in Paragraph 1. 4. In the statement specified in Paragraph 1, notify the employees that, as a condition of working on the commodities or contractual services that the employee will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to any violation of Chapter 1893 or of any controlled substance law of the United States or any state, for a violation occurring in the workplace no later than five (5) days after such conviction. 5. Impose a sanction on, or require the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted. 6. The 1989 Florida Legislature passed Senate Bill 458 creating Sections 287.132 - 133, Florida Statutes, effective July 1, 1989. Section 287.132(3)(d), Florida Statutes, requires the Florida Department of General Services to maintain and make available to other political entities a "convicted vendor" list consisting of persons and affiliates who are disqualified from public contracting and purchasing process because they have been found guilty of a public entity crime. A public entity crime is described by Section 287.133, Florida Statutes, as a violation of any State or Federal law by a person with respect to and directly related to the transaction of business with any public entity in Florida or with an agency or political subdivision of any other state or with the United States, including, but not limited to, any bid or contract for goods or services to be provided to any public entity or with an agency or political subdivision and involving antitrust, fraud, theft, bribery, collusion, racketeering, conspiracy, or material misrepresentation. By law no public entity shall accept any bid from, award any contract to, or transact any business in excess of the threshold amount provided in Section 287.017, Florida Statutes, for category two with any person or affiliate on the convicted vendor list for a period of 36 months from the date that person or affiliate was placed on the convicted vendor list unless that person or affiliate has been removed from the list pursuant to Section 287.133(3)(f), Florida Statutes. Therefore, effective October 1, 1990, prior to entering into a contract (formal contract or purchase order) in excess of the threshold amount for category two to provide goods or services to THE CITY OF SEBASTIAN, a person shall file a sworn statement with the contracting officer or Purchasing Director, as applicable. The attached statement or affidavit will be the form to be utilized and must be properly signed in the presence of a notary public or other officer authorized to administer oaths and properly executed. The ownership by one person of shares constituting a controlling interest in another person, or a pooling of equipment or income among persons when not for fair market value under an arm's length agreement, shall be a prima facie case that one person controls another person.
