Willey'. It was a pleasure speaking with you last week. On behalf of the Council of the City of Sebastian, I would like to thank you for your generous gift of renovations to the restrooms on the golf course. It is not often that a citizen who notices a problem area comes forward with a suaaestion and the method and means for solution. We are truly appreciative of your commitment and service to our City. As I mentioned to you, when renovations are complete, perhaps we can meet with Mr. Frame, Mr. Cerjan and Mr. Oberbeck out at one of the restrooms so we can acknowledge your gift and offer you our thanks. At your request, we will keep this low key and perhaps share dinner afterwards. Mr. Oberbeck will keep us posted on the progress so we can set a defitute date. Oberbeck Letter The City Manager gave a brief explanation of how Mrs. Willey's offer to renovate the Golf Course restrooms came about and read his recommendation to "Recommend that the City accept the gift as proposed by Mrs. Willey through Mr. Oberbeck's letter and that the City waiver any formal bidding requirements and to also waive any required building permit fees that would be applicable. Finally, that the City Manager be authorized to sign a letter of engagement between the City and Oberbeck and Associates, Inc., subject to approval of the City Attorney as to language contained therein". MOTION by Damp/Halloran So move. The City Attorney suggested adding "and waive payment and performance bond". Mrs. Damp and Mr. Halloran concurred. Mayor Cartwright requested the City Manager determine a monetary value for the renovation. AMOUNT APPROPRIATION BUDGETED: N/A REQUIRED: N/A SUMMARY Attached is a letter dated March 25, 1996, from Mr. Frank Oberbeck of Oberbeck & Associates, Inc. As can be seen from the letter, Mrs. Edna Willey, a member of the Sebastian Golf Course, has contacted Mr. Oberbeck regarding improvements to the four (4) fairway restrooms. Mr. Oberbeck has made contact with the Golf Course Manager, Mr. Cerjan and Mr. Cerjan has informed me that he is in agreement with the proposal to the improvements as indicated within Mr. Oberbeck's letter. In order to effectuate the gift through Mr. Oberbeck, the following action recommended by the City Attorney must occur: 1. A waiver from the requirements of City Code, Section 2.91 (b). A waiver of this section would formally waive the requirement for a requirement to solicit sealed bids and would waive the requirement to enter into a formal contract with the contractor by the City Council. If this section is waived, it would be anticipated that a letter of engagement between the contractor and the City would suffice, assuming that the language of the letter of engagement was sufficient to meet the concerns of the City Attorney and that the City Manager would be authorized to sign on behalf of the City Council. 2. Waive the building permit fees that may be applicable in this case. As a matter of practice, the City has always required the contractor, for any City work to apply for appropriate permits, but has always waived the collection of permit fees. Inasmuch this work is being done at the request of Mrs. Willey through Mr. Oberbeck, I would also request that the fees be waived accordingly. RECOMMENDATION Recommend that the City accept the gift as proposed by Mrs. Willey through Mr. Oberbeck's letter and that the City waive any formal bidding requirements and to also waive any required building permit fees that would be applicable. I reviewed this,and met with the Course Manager.Mr. Cerjan. The following items are his recom- mendations: 1. Install Ceramic Tile floors, mud set to pitch to Floor Drains. Color White. 2. Install Marble Threshold at doors. 3. Install 411x 4" White Ceramic Wall Tile 4' high. 4. Install interior trim on windows. 5. Reduce size of Toilet partitions in Men's rooms. 6. Repair decayed door jambs. 7. Paint interior remaining area and doors. 8. Clean all fixtures prior to re -installing . 9. Replace defective sink trim. As discussed, none of the costs for the above work will be charged to the City of Sebastian, or the Golf Course Fund. This is to be a donation from Mrs. Edna Willey. All work will be performed by licensed contractors, and coordinated with the Golf Pro and the Building Dept. Should you have any questions please contact me. Oberbeck, President Oberbeck and Associates, Inc. 1013 U.S. #1 Sebastian, FL 32958 Dear Mr. Oberbeck: This letter will set out the understanding which exists between Oberbeck and Associates, Inc. (Oberbeck) and the City of Sebastian (City) pertaining to the improvements to the Four (4) Fairway Restrooms (restrooms) on the City Golf Course. Mrs. Edna Willey has agreed to pay Oberbeck for all the improvements to the restrooms which are set out in the attached letter dated March 25, 1996 and incorporated in this letter. The nnprovements to the restrooms are to be provided to the City free of charge. Oberbeck will itemize all costs associated with the restroom improvements for Mrs. Edna Willey wiless otherwise requested to the contrary by Mrs. Willey. Oberbeck shall provide and pay for all labor, materials, equipment and tools necessary for the work and will perform all work on the restrooms in conformity with generally accepted construction industry standards. All work shall be provided by properly licensed individuals and shall meet the minimum building code requirements of the City of Sebastian. All materials fmrnished for the restrooms shall be new and of good quality. Oberbeck shall pay all sales taxes and shall comply with all laws and regulations of any public authority bearing on the performance of work. G Oberbeck shall maintain general liability insurance in the minimum amount of $100,000.00 per person and $100,000.00 per incident and worker's compensation insurance while performing such work. The City agrees to allow access necessary to perform the work set out in this letter and Oberbeck agrees to perform the work in a manner which will minimize any interruption with the operations of the golf course. Oberbeck will pay all subcontractors, laborers and materiahnen in order that no claims will be made against the City arising out of this work. All work will be completed, including clean-up from the construction, within CVD days after Oberbeck executes this letter. If this letter represents the entire understanding between the City and Oberbeck, please execute the same and return it to me. Sincerely, CITY OF SEBASTIAN Thomas W.
