Find attached a copy of the City Attorney's written
statement in which he agrees that my interpretation of
the code is correct and a site plan is needed before
any improvements can be performed on the Chesser's
Gap property. Please refer to the following sections:
Section - 20A-4.2
Section - 20A-4.3
Section - 20A-4.10
Section - 20A-4.10 (D)(2)(a)
Section - 20A-16.1 (C)
Section - 20A-16.4 (B)
Section - 20A-17.2
Section 20A-4.3 Reads: COMPLIANCE WITH SUBDIVISION
REGULATIONS.
All PUD applications shall be reviewed pursuant to
provisions of this Article. In addition, PUD applications
shall comply with provisions of the subdivision control
ordinance. Planned Unit Development plans submitted under
this Article must be in a form which will satisfy the
requirements of the subdivision control ordinance for
preliminary and final. plats. Review time for plats
shall conform to provisions of this Article.
Section 20A -16.4(B) reads: Preliminary plan
procedures.
The purpose of the preliminary plan is to present
the proposed subdivision in an exact and precise manner
in order that it may be evaluated pursuant to this
Code. The preliminary plan shall be completed aInd
approved prior to construction of the improvements
required by these regulations.

Please be aware that PUD (c) - Commercial Planned
Unit Development regulations of the City Land Development
Code Section 20A-4.6 has not been approved by the City
Council and is being reviewed at this point by the
Planning and Zoning Commission. Therefore, I don't
see how you can submit a PUD (c) Site Plan prior to
approval of the regulations to review it. Seems to
me the developer hs to wai ntil the regulations
are approved befur a site plan an be submitted.
