Dear Mr. McCarthy:
The staff has reviewed your response to the District's request for additional
information received on April 4, 1994. Unfortunately, the following technical
information is lacking to sufficiently review the possible impacts the project may
have on the surrounding area. Pursuant to the authority vested in the St. Johns
River Water Management District under Chapter 373.229(1)(i), F.S., and Sections
40C-2.101 and 40C-2.301, Florida Administrative Code (F.A.C.). The following
information is requested:
The proposed orifice invert is at an elevation of 15.5 ft. N.G.V.D.,
however, the existing culvert is at an elevation of 16.0 ft. N.G.V.D. It
appears that the maximum use of the surface water for irrigation will
be compromised given the proposed elevation of the orifice. Please
explain the design intent. [Paragraph 10.3(e,g); A.H.]
2. Please provide eitherthe seating capacity or the square footage of the
clubhouse for District staff to determine a sufficient allocation for
household use from well no. 2. [Paragraph 10.3(a); A.H.]
In accordance with paragraph 40C -2.101(3)(b), F.A.C., if the applicant desires to
dispute the necessity for any information requested on an application form or at a
pre -application conference, he may do soat a regularly scheduled regulatory
meeting of the Governing Board. An applicant should submit a written request to

present evidence regarding such dispute at least 21 days prior to the regulatory
meeting at which he plans to present the evidence.
Please be advised, pursuant to subsection 40C-1.605(5), F.A.C., any application
which has not been technically and administratively completed within sixty (60) days
from the date of receipt of a request for additional information by the District, will be
prepared for an Intent to Deny at the Governing Board meeting. If you require more
than sixty (60) days, please indicate the circumstances to the staff in writing. For
good cause shown, the application shall be held in active status for one additional
period of up to 60 days.
In order to expedite the review of your application, please include the District's
permit application number on all cover correspondence and submit three (3) copies
of all requested information unless otherwise indicated by a specific information
request. All responses to this request for additional information should be sent to
Blanche Soucheck at the Melbourne Field Office address.

Dear Blanche:
I have received your letter dated March 18, 1994 requesting
additional information for the above referenced project. I have
spoken with Perry Jennings in reference to this matter to obtain
his opinion about the necessary permit application. From my
conversation with him, he had explained that this was required
pursuant to Florida Statutes.
Please note that we had submitted the modification to the outfall
pipe utilizing the structure because of the benefit it would
serve by attenuating the storm water runoff from the project
area. However, the justification for the modification of the
outfall system cannot be rationalized because of the expenditure
necessary for the permit application fee of $700. Therefore, we
would leave the system as it now exists without the proposed
modification to secure the required Consumptive Use Permit.
After further discussion with Mr. Jennings that it may be
possible to include this project with another project that the
City is currently filing a MSSW permit application for the
Schumann Drive drainage renovations. Mr. Jennings, also
explained the primary objective of the application is to make a
determination between the pre -development runoff conditions and
the post -development runoff conditions. He feels as I feel that
without the control structure, it is quite possible that the pre -
development runoff rate could be somewhat higher than it would be
with the modified control structure in place.
I would for the benefit of the downstream outfall system, like
to install the control structure. However, the application would
have to be part of a combined application with another project so
both could be included under the same application fee. If you
could respond back to me whether this would be acceptable or not
I would be happy to wait until I hear from you as to whether this
would be feasible before I make a formal response to your request
for additional information dated March 18, 1994.

information received on February 18, 1994. However, the following additional
information must be provided to properly and fairly evaluate the application pursuant
to subsection 40C-1.602(1), Florida Administrative Code (F.A.C.).
In order to expedite the review of your application, please include the District's
permit application number on all cover correspondence and submit three (3) copies
of all requested information unless otherwise indicated by a specific information
request. All responses to this request for additional information should be sent to
Blanche Soucheck at the Melbourne Field Office address.
TECHNICAL INFORMATION
Pursuant to subsection 40C-2.101(4), F.A.C., the following information must be
provided to technically complete this application. Subsection 40C-2.101(4), F.A.C.,
states:
"in addition to the information required to be included on Form
40C-2-1082-1, the District staff may specifically request such
reasonable additional information as may be necessary to evaluate the
hydrologic impacts of the withdrawal to insure that the impacts will not

be harmful to the water resources of the District as set forth in section
40C-2.301, F.A.C., and are in compliance with statutory and rule
requirements. The Governing Board will be informed of such request
for additional information at a regularly scheduled regulatory meeting.
If the applicant desires to dispute the necessity for the information
required, he may do so at that time."
The citation A.H. refers to Applicant's Handbook as adopted in subsection
40C-2.101(2), F.A.C.
In the calculations provided, determining the necessary treatment
volume, the existing pipe outfall structure is being replaced by a
control structure. It appears that given the proposed control structure,
which serves an area greater than 40 acres, that a Management and
Storage of Surface Waters permit is required. Please find enclosed
a permit application form with a list of the application fees. Please
include the calculations for the sizing of the "water quality" notch
placed at elevation of 15.5 feet N.G.V.D., as well as normal water
table information. Please include on-site soil borings to verify the
assumption of the water table elevation. [Paragraph 10.3(e); A.H.;
40C -4.041(1)(2)(b)2.]

Dear Blanche:
I have received your letter dated May 2nd, 1994. In response to
your first question, the orifice invert elevation of 15.5 was
proposed to reduce pollutant loading from storm water runoff from
the Golf Course.
Initially it was my understanding that the consumptive use permit
would require that the lake system not be kept artificially full
by the existing well. It was my understanding that the district
was concerned about pollutants discharging from the golf course.
That is if the lakes were kept artificially full, then the
pollutants entering the lake would exit the system without any
treatment.
The District requested that a 25 year storm event be analyzed for
the golf course to determine the elevation that would retain the
runoff, to assure treatment. A staging rod would identify the
level of the lake that no additional filling of the lake would
take place.
Considering the districts' objective to reduce pollutant loading.
I considered the installation of the orifice at elevation 15.5 to
reduce stormwater pollutant loading for all weather conditions.
I emphasize all weather conditions, because the orifice will help
to reduce pollutant loading during the rainy seasons whereas the
culvert outfall from the system will not. To understand why this
is true consider two separate weather conditions.
1. Rainy or wet conditions
2. Dry or parched conditions.
Considering the rainy or wet conditions, the existing culvert
pipe is set at elevation 16 which will establish the water level.
Then when a moderate rainstorm occurs, the storm surge would pass
immediately through the culvert pipe into the receiving drainage
ditch carrying the pollutants. This is because, there was no
storage volume to prevent that surge of stormwater from passing
directly out through the culvert pipe.
If an orifice is constructed, as part of the outfall system, then
the storage volume would be available to halt the surge. The
orifice would then allow a gradual discharge of the lake allowing
the pollutants to settle out.
Considering the dry season, both systems function identically.
The maximum level at which the lake can be filled would be
elevation 15.5. Instead of a range rod being located in the
lake, the maintenance supervisor would be able to determine the
maximum filling level of the lake once it reached the orifice
level without discharging. Now, in either case, should a
moderate storm event occur, this storm surge entering the lake
would be impeded by the storage volume available which occurs
between elevation 15.5 and 16.0.
I discussed this matter with Perry Jennings on the premise that
it was beneficial to the district in reducing the stormwater
pollutant loading. He understood the method to my madness, but
pointed out from the hydrologists point of view that the orifice
would be negatively affecting the groundwater table. So what
might be good from a pollution reduction standpoint would not
necessarily be beneficial from the hydrologists point of view.
Continuing with the thought of impacts to groundwater, one needs
to consider both weather conditions which are as identified
above. During the wet season the ground is typically saturated
from continual rainfalls and the groundwater elevation is
extremely high which moves laterally to the lakes. The orifice
will not drastically affect the average high groundwater table.
Because the lateral movement of groundwater through the soil is a
function of the hydraulic head and the soil conditions. This is
a gradual process, the ground enters the lake system at the same
rate it exits the orifice, providing a steady state system.
Under dry conditions, the ground becomes significantly parched.
Most of the groundwater recovery will occur as the moisture is
taken up into the soil before it reaches the lake. In other
words, most of the rainfall will be recharged into the ground
where the rainfall event occurred and not because the lake system
will be recharging the groundwater.
In conclusion, I felt that the orifice would be a benefit to the
district in obtaining their objectives. However, if the district
feels that other objectives are being compromised, then I would
be more than satisfied to eliminate the orifice and allow the
discharge to occur through the culvert pipe. I believe that it
was my responsibility to consider the best alternative to reach
the districts objective.
In response to the second question of your letter dated May 2nd,
1994, the number of seats located inside of the club house is 60.
