Dear Dr. Fischer:
The Sebastian City Council, at its May 25, 1994 Regular Meeting,
unanimously approved the following motion:
MOTION by Oberbeck/Freeland
I would move that we honor the request of BFT only for this
particular light in light of the fact that we as a Council
elected to put this road in after his plat had been submitted
after that shopping subdivision had been approved. There was no
intent in the original concept of his drawings to have a Wave
Street so the City elected to do it, I suggest that the City pay
for this particular light, that he be held to the Code on the
remaining portion of the subdivision.

The required improvements and design standards for a major subdivision are identified
within the provisions of Article XVII, Sec. 20A-17.1 and 20A-17.2 of the Sebastian Land
Development Code. This section of the code does not provide authority for staff to waive
any of the required conditions.
Sebastian General Partnership, B.F.T., is requesting a waiver regarding the requirement to
install a street light at the intersection of Wave and Fleming Streets in the Chesser Gap
subdivision. The particular provision of the code is paragraph N. "Street Lighting" of
Section 20A-17.1, which states in part: "Street lights shall be installed at each street
intersection, at mid -block locations where the distance between intersections exceeds nine
hundred (900) feet..."

You may recall that Wave Street was not a connecting street under the original plans of the
subdivision. This modification was accomplished at the request of the City Council. The
intersection of Wave and Fleming therefore, is an additional intersection that requires a street
light under the requirements stated in the above paragraph. The developler, Sebastian
General Partnership, B.F.T., is requesting a waiver for a street light requirement that the
developer cites as created by the City and not by the subdivision.
RECOMMENDATION
The City Council has the authority to waive the provisions of the Land Development Code
pertaining to street lights. Also, if the City Council declares the need for a street light at the
intersection of Wave and Fleming Streets, the burden of cost would be on the City.

RE: Street Lights - Fleming Street
Dear Mr. Koford:
Sebastian General Partnership, B.F.T. would like to request
at this time that the Sebastian City Council grant a waiver
to Sebastian General Partnership, B.F.T. for the installation
of street lights along the Fleming Street extension due to the
opening of Wave Street which has created a thoroughfare in our
private access development. Wave Street was not part of our
preliminary plat approval.
1) Fleming Street, in Chesser's Gap and throughout
Sebastian, is a public street, not a private street, and is
owned by the City of Sebastian, and should be maintained by
the City of Sebastian as part of the City's thoroughfare road
system. Fleming Street, in Chesser's Gap, is part of the
County's thoroughfare road system.
2) The action of opening Wave Street has increased through
traffic along Fleming Street in Chesser's Gap. Much of this
traffic does not stop at our development.
3) Property owners along public thoroughfare streets do
not maintain the streets or street lights at their own expense.
These are publicly owned and used streets. That is the
responsibility of the City of Sebastian, and is the reason the
City has, in place, a street light master plan.
4) The development has paid road traffic impact fees.
5) No other land owners on County Road 512, U.S. #1, or
Fleming Street provide street lighting.

Street Lighting within Chesser's Gap
This Ietter is in response to your letter of March 11,1994 concerning the above referenced
My client is prepared to work with the City on the installation of the street lighting. The City
sent Dr. Fischer a letter dated December 20, 1993 that set a time of 90 days for the installation of
the lights. My client has contacted FP&L concerning the installation of the street lights. Your
recent letter of March 11, 1994 seemed a little premature since the 90 days had not expired at that
time. ,
It is my understanding from talking to Randy Mosby that the street lights would be installed
as development progressed to the east and that the City agreed to this. As you know, since the
initial phase was platted there has been no development activity within Chesser's Gap by my client.
The City did open Wave Street, which has apparently sparked the City's desire to have the street
lights installed at this time. The City's action has resulted in a need for the street lights.
It seems to me that this matter is capable of being resolved without having to resort to the
Code Enforcement Board. It would be appreciated if you would call me to arrange a time to review
this matter.

Dear Dr. Fischer:
This department sent a letter dated December 20, 1993 to you
regarding the street lighting request from yourself within
Chesser's Gap Subdivision. Within this letter, I advised you of
the requirements of the Land Development Code and the requirements
for Chesser's Gap Subdivision.
I had asked you to contact Dave Smith with Florida Power & Light in
order to have the street lights installed in accordance with your
approved subdivision. As of March 3, 1994, Mr. Smith has not heard
from you.
Therefore, I have no alternative but to require you within 5 days
from receipt of this letter to contact Dave Smith and coordinate
the street lighting pursuant to your approved subdivision plat.
The City Attorney has advised me that you will be responsible for
all costs relating to maintenance and operation of these new street
lights pursuant to Section 20A -17.1(N) of the Land Development
Code.

Dear Henry:
Pursuant to our conversation today, you had questioned whether or
not the dedication of South Fleming Street was made to the County
instead of the City and also questioned whether or not the City has
accepted the maintenance of the road. Apparently, these questions
have stemmed from the letter dated December 20, 1993 from Bruce
Cooper regarding the street lighting for Chesser's Gap.
For your information, please be advised of the following documents
that the City of Sebastian has in its files:
1. I have enclosed a copy of sheet 1 of 2 of the final plat for
Chesser's Gap Subdivision Phase I which platted the right-of-
way known as South Fleming Street. Please refer to the
certification of dedication #1 which states all streets and
right-of-ways have been dedicated in perpetuity to the City of
Sebastian and not Indian River County.
2. Enclosed is a copy of Resolution R-92-42 which the City of
Sebastian has accepted the improvements of South Fleming
Street.
3. Enclosed is a copy of a letter dated January 17, 1992 from
your Engineer, Randy Mosby, to our City Engineer, Dan Eckis,
which states specifically that the street lights are your
responsibility and will be completed as the project progresses
to the east. With the construction of Wave Street, it is the
City's position that the sidewalk and street lighting shall be
constructed now in accordance with your approved subdivision
plans which would provide a measure of safety for the general
public.

Reference: Street Lighting Within Chesser's Gap
Dear Henry:
Kay O'Halloran, Acting City Manager, has asked me to review your
request dated October 26, 1993 regarding street lighting on Fleming
Street S. and Wave Street extension. Enclosed is a copy of a
letter dated December 15, 1993 from Dave Smith, F. P. & L. , regarding
the proposal.
First, the street light at the corner of Wave Street and George
Street will be authorized by the City.
Secondly, apparently you are unaware or have forgotten that the
approval for the Chesser's Gap Subdivision pursuant to your
approved plans prepared by Mosby & Associates indicates street
lighting along Fleming Street pursuant to Section 20A -17.1(N) of
the Land Development Code. I have also included a copy of sheet 3
of 24 of the overall paving, drainage and utility plan regarding
Fleming Street which indicates the street lighting that should have
been constructed at the time of your improvements to Fleming
Street. From what I can remember, I believe the City Engineer at
that time, allowed the improvements, such as street lighting and
the sidewalk that was required, to be constructed in phases or on
an "as -needed basis" along with your development of Chesser's Gap
P.U.D..
Since it has come to our attention based by your own admission, the
City is going to require that the street lighting be constructed
according to your approved set of plans and any and all costs will
be paid for by you as the developer of the subdivision. One of the
proposed street lights (according to your plans) will be right at
the corner of Wave Street and Fleming which will solve the lighting
problem at this intersection.
In reviewing Section 20A -17.1(N) of the Land Development Code
regarding street lighting, it is also apparent that all costs
related to maintenance and operation of new street lights within a
new subdivision, shall be paid for by owners of the property within
the subdivision. By way of this letter to you, I will be sending
this section of the code to the attorney to review and determine
its validity since this has not been the common practice.

the street name approved on the subdivision plat as well as the
approved street number if practical.
N. Street lighting. Street lights shall be installed at each street
intersection, at mid -block locations where the distance between
intersections exceeds nine hundred (900) feet, and at the end of
each cul-de-sac. Such lights shall be required on interior streets
and may be required on alleys, boundary streets and access paths
if the city council finds that the anticipated frequency of usage
makes such requirements reasonable for public safety and wel-
fare. Wherever, in the opinion of the city engineer, a dangerous
condition is created by sharp curves or irregularities in street
alignment, additional lights shall be required. The street lights
and mounting poles shall be a type approved by the city engineer
and shall be wired for underground service except where over-
head service is permitted. The applicant shall place deed restric-
tions covering the property to be developed which state that the
owners of property within the subdivision are subject to assess-
ment by the city under a legally constituted improvement or
special taxing district or by a property owners' association or a
condominium or cooperative association as defined by Florida
law for the cost of maintenance and operation of such street
lights. Upon completion of the development, street lights shall be
owned, operated and maintained separately or jointly by a prop-
erty owners' association, or a condominium or cooperative asso-
ciation as defined by Florida law, and the public utility furnish-
ing the electrical service.
O. Central water system. A complete water supply, distribu-
tion and treatment system shall be provided for all subdivisions.
In the event individual water facilities are allowed under appli-
cable state and county regulations, the applicant shall be re-
quired to deposit in escrow with the city for the purpose of con-
structing a water distribution and treatment system, the amount
of the cash or a guarantee acceptable to the city equal to one
hundred ten (110) percent of the system's estimated construction
and installation costs as certified by the project engineer and
approved by the city engineer. The design of the entire system
shall be engineered and coordinated with the city engineer to
meet applicable local and state specifications.

This letter is in response to your request street lights at
Chesser's Gap. An in-line pole will be required at the
intersection of George and Wave in order to install a light.
There is a light about 100' north of the intersection. Would the
City like to relocate the light to the intersection or install an
additional light at George and Wave? A charge will be associated
with installing the light of approximately $500.00 because the
light requires installing the in-line pole.
A charge will also be associated with the installation of a light
at Chesser's Gap and Wave. The cost is not available at this time
as a cost estimate will have to be performed -to determine the
cost of installing the light.
Would the City still like FPL to proceed with the design?

Dear Ms. O'Halloran:
This letter is my formal request to have street lighting
provided on the Wave Street Extension and thoroughfare within
Chesser's Gap Shopping Center.
This thoroughfare (Fleming Street) was donated to the City--,
of Sebastian, and the street was constructed by Sebastian
General Partnership, B.F.T. The Wave Street Extension land
was donated by Sebastian General Partnership, B.F.T. and also
needs lights. It would seem to me, from a safety point -of -view,
that you would want this area to be very well lit at night.
Many people, both young and old, travel through this
shopping center at night. Additionally, many kids ride their
bicycles within the shopping center going to the video store,
etc.
This lack of lighting makes this area unsafe and you need
to have the street lights installed on both the Wave Street
Extension and the thoroughfare within Chesser's Gap Shopping
Center in a timely manner.
