AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA,
AMENDING THE CONCEPTUAL DEVELOPMENT PLAN AND
PRELIMINARY DEVELOPMENT PLAN/PLAT FOR A PLANNED UNIT
DEVELOPMENT KNOWN AS SANDCREST SUBDIVISION;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Sandcrest, LLC, has filed a petition for modification of the conceptual
development plan for a Planned Unit Development known as Sandcrest Subdivision, originally
approved by City Council on April 8, 2015 by Ordinance 0-15-05; and
WHEREAS, the approved Conceptual Development Plan established certain design
parameters, including a minimum rear setback of 25 feet for perimeter lots, which is proposed to
be modified to a minimum rear setback of 20 feet for perimeter lots; and
WHEREAS, the Preliminary Development Plan/Plat for Sandcrest Subdivision,
originally approved by City Council on June 24, 2015 by Resolution R-15-14, also identifies the
design parameters, including a minimum rear setback of 25 feet for perimeter lots, which is
proposed to be modified to a minimum rear setback of 20 feet for perimeter lots; and
WHEREAS, the Planning and Zoning Commission held a public hearing on September
3, 2015, to consider this modification, and by a unanimous vote recommended that City Council
approve this change;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. MODIFICATION TO CONCEPTUAL DEVELOPMENT PLAN.
The City Council of the City of Sebastian does hereby approve an amended conceptual
development plan for Sandcrest Subdivision, originally approved by Ordinance 0-15-05,
specifically changing the minimum rear yard setback for perimeter lots from 25 feet to 20 feet, in
accordance with the Sandcrest Conceptual Development Plan prepared by Jodah B. Bittle, P.E.,
latest revision date of August 13, 2015, and attached hereto as Exhibit "A".
Section 2. MODIFICATION TO PRELIMINARY PLAN/PLAT. The City
Council of the City of Sebastian does hereby approve an amended preliminary plan and plat for
Sandcrest Subdivision, originally approved by Resolution R-15-14, specifically changing the
minimum rear yard setback for perimeter lots from 25 feet to 20 feet, in accordance with the
Sandcrest Preliminary Plan prepared by Jodah B. Bittle, P.E., latest revision date of August 13,
2015, and attached hereto as Exhibit `B".
Section 3. FUTURE MODIFICATIONS. Any future change to the conceptual
development plan and/or the preliminary plan/plat for Sandcrest Subdivision shall be approved
by resolution of City Council.
Section 4. CONFLICT. All ordinances or parts of ordinances and resolutions or
parts of resolutions in conflict herewith are hereby repealed.
Section 5. SEVERABILITY. In the event a court of competent jurisdiction shall
determine that any part of this Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the City Council of the City of
Sebastian did not intend to enact such invalid provisions. It shall further be assumed that the
City Council would have enacted the remainder of this Ordinance without said invalid or
unconstitutional provision, thereby causing said remainder to remain in full force and effect.
Section 6. EFFECTIVE DATE. This Ordinance shall take effect immediately upon
its adoption.
