Recommendation: Approve Resolution No. R-15-33
Background: The applicant is requesting approval of a one -lot commercial
subdivision on 2.04 acres located along Sebastian Boulevard between the North County
Library and the entrance to Sebastian Lakes. This is a replat of a portion of Tract C of
Sebastian Lakes PUD, and contains two existing ponds. The western pond, part of the
master stormwater system for Sebastian Lakes PUD, will be reconfigured. The eastern
pond, extending across the property line onto the Indian River County Library site (0.56
acres) serves no stormwater purpose for either property and will be filled. The existing
wetlands (0.22 acres) will also be filled. The reconfigured stormwater pond will continue
to provide drainage for the overall PUD, as well as future development of this property.
Approval of the preliminary plat and subsequent construction
drawing approval by the City Engineer will allow the owner to fill the eastern lake and
wetlands, and reconfigure the western lake. Further development of the commercial lot
will require a fully designed site plan showing building location, access drives, parking,
and landscaping.
On September 17, 2015, the Planning and Zoning
Commission held a public hearing and by a vote of 4 — 0 recommended approval of the
Preliminary Plat for Brook's 512 Commercial Development, with conditions as outlined
in Resolution R-15-33.

RESOLUTION NO. R-15-33
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, APPROVING THE PRELIMINARY PLAT
FOR A SUBDIVISION KNOWN AS BROOK'S 512 COMMERCIAL
DEVELOPMENT; PROVIDING FOR CONFLICTS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owner of the subject land has filed an application for approval of
a preliminary plat for a subdivision known as Brook's 512 Commercial Development, a
replat of a portion of Tract C, Sebastian Lakes Unit 1; and
WHEREAS, the preliminary plat complies with applicable State and City codes
and regulations; and
WHEREAS, the Planning and Zoning Commission of the City of Sebastian held
a public hearing on September 17, 2015, and recommended approval of the Preliminary
Plat for Brook's 512 Commercial Development, with conditions, by a vote of 4 — 0;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, as follows:
Section 1. PRELIMINARY PLAT APPROVAL. The City Council of the
City of Sebastian, Florida does hereby approve the preliminary plat for Brook's 512
Commercial Development prepared by Randy L. Mosby, P.E., bearing the latest revision
date of October 6, 2015, as maintained on file with the Community Development
Department, subject to the following conditions being met prior to release of the
construction design approval by the City Engineer:
a. Provide a stormwater easement for the reconfigured drainage pond and
a sign easement for the existing subdivision entrance sign.
b. Provide a written agreement between the owner and the Sebastian
Lakes Master Association, Inc. regarding maintenance responsibility
of the stormwater pond and the entrance sign.
c. Preserve the landscape buffer along the rear (southern) property line,
to the extent possible.
Section 2. CONFLICT.

8. Project Description

of Sebastian Lakes PUD, and contains two existing ponds. The western

be reconfigured. The eastern pond, extending across the property line
onto the Indian River County Library site (0.56 acres) serves no
stormwater purpose for either property and will be filled. The existing

future development of this property at a maximum 1.40 acres of new
impervious area.
Approval of the preliminary plat and subsequent construction drawing
approval by the City Engineer will allow the owner to fill the eastern lake

the commercial lot will require a fully designed site plan showing building
location, access drives, parking, and landscaping.

12. Other Matters: The Brook's 512 Commercial Development Preliminary Plat has been
reviewed by the City Engineer, IRC Fire Department, IRC Utilities Department, the Florida
Department of Health, and zoning staff. All comments have been addressed.
Jurisdictional permits from St. Johns River Water Management District and the Army
Corps of Engineers have been obtained. In addition, the Board of County Commissions
approved the plan to fill that portion of the pond which lies on the North Indian River
County Library property, with conditions outlined in a letter from Joseph Baird, County
Administrator, dated March 24, 2015 (attached).
13. Planning and Zoning Hearing: The Planning and Zoning Commission held a public
hearing on September 17, 2015, and by a vote of 4 - 0 recommended approval of the
Preliminary Plat for Brook's 512 Commercial Development, with the following conditions:
a. Developer to work out an easement agreement for the
existing sign and the proposed reconfigured drainage pond.
b. Developer to try to save the buffer along the rear property.
C. Developer to provide an agreement with the subdivision's
HOA on who will be maintaining the pond.
14. Conclusion: The proposed one -lot subdivision is consistent with the Comprehensive
Plan, the Code of Ordinances and the Land Development Code.
15. Recommendation: The Planning and Zoning Commission and staff recommend
approval of the Preliminary Plat for Brook's 512 Commercial Development, with conditions
noted above.

X1. The following information is required on all preliminary plats:
a. A vicinity sketch showing the location of the boundary lines and distance of
the land proposed for the subdivision in reference to other areas of the city.
4 b. A north arrow, graphic scale, and date of preparation.
c. The name of adjacent subdivisions, if any, and the plat book and page
reference, together with the names of the owners of records having interest
in adjacent acreage.
d. The names, alignment, and width of all existing and proposed streets,
alleys, rights-of-way or easements adjacent to or within three hundred (300)
feet of the proposed subdivision including name, right-of-way width, street
or pavement width, and established center line elevation. Existing streets
shall be dimensioned to tract boundary.
Xe. All existing and proposed property lines, easements and rights-of-way, their
purpose, their effect on the property to be subdivided, and the proposed
layout of lots and blocks.
'X f. Access points to collector and arterial streets showing their compliance to
access requirements.
g. All existing drainage facilities.
h. Existing and proposed utilities such as telephone, electricity, water, sewer,
gas, etc. on or adjacent to the tract. The preliminary plat shall contain a
statement that all utilities are available and have been coordinated with the
required utility departments.
i. Site for proposed parks, recreational areas and schools.
d% j. The location of any temporary structures or permanent structures having a
temporary use.
/V/ k. If the proposed plat borders upon any public water bodies, delineate the
mean high water line.

Xb. The name, address and telephone number of the mortgage holder or any
other person having a legal equitable or beneficial interest in the land
together with a statement from such that they will join in the dedication of
the proposed subdivision.
Lc. A surface water drainage facilities plan certified by an engineer registered in
the State of Florida.
d. A land survey with complete legal description prepared and certified by a
registered surveyor.
NAe. A traffic impact analysis, if required.
Lf. An erosion/sedimentation control plan.
g. A contour map showing ground elevations at intervals of not more than one
foot of the area to be subdivided and of a perimeter strip at least fifty (50)
feet and up to one hundred and fifty (150) feet in width around the area.
A14 h. A statement concerning required potable water improvements, wastewater
improvements or on-site wastewater disposal data.
i. A schedule for multiple phases, if appropriate.
j. A list of the names and addresses of all owners of parcels of real property
within three hundred (300) feet of the parcel to be considered.

Re: Approval to fill a portion of a pond located on the
North Indian River County Library site
Sebastian, Florida
Dear Mr. Mosby:
This letter serves as official approval to fill a portion of a pond which lies within the ownership
of Indian River County and is partially located on the site of the North Indian River County
Library.
As approved by the Board of County Commission on September 9, 2003, the approval of the
request is subject to the following stipulations:
1. Submittal and acceptance of a proposed grading plan of the county's portion of the filled
pond.
2. Stabilization by means of sod that is of the same type currently in place at the library site.
3. The contractor names Indian River County as an additionally insured party at an amount
satisfactory to the Indian River County Risk Manager.
4. Submittal of any and all required regulatory permits needed to accomplish such work.
