Honorable Commissioners:
We are the owners of a 58.089 acre tract of commercial/
industrial property on C.R. 512 in the City of Sebastian, Florida.
The property is commonly known as Chesser Gap and is surrounded on
all sides by the General Development Utilities water franchise area.
In January of 1987, without regard to the potential adverse
affect the action would have on the availability of a public water
supply to our Chesser Gap property, the City of Sebastian, upon the
request of the Indian River County Utilities Department, granted a
water franchise for our property to Indian River County. That action
has resulted in our being unable to provide water service to our
commercial/industrial project via the General Development Utilities
main water line vrhich runs directly along the north property line of
our project.
In view of information received at the County Commission
meeting of November 17, 1987 to the effect that the Indian River
County Utilities Department has no plans to provide water service
to our property for several years in the future, if at all, we request
that the Board of County Commissioners release our Chesser Gap
property from the Indian River County water franchise area for
inclusion within the franchise service area of General Development
Utilities Company. We see no benefit to the County, the City of
Sebastian, or, ourselves to restrict development through the denial
of available public water services. The current franchise policy
adopted by Indian River County and the City of Sebastian has rendered
-ur-property unuseable for uses for which it is zoned, restricted our
right to tap into a readily available,public water supply, and, is
blocking the normal expansion of the City of Sebastian's commercial/
industrial tax base as planned through the City's Master Land Use
Plan and Zoning Ordinance.
We further request that this matter be reviewed by an
independent body which is not.subject to benefit directly by a
decision in the matter. The Ihdian River County Utility Department
has not been receptive to discussion of this matter with us and
its director, Mr. Terry Pinto, has not responded to our formal written
inquiries.
