"To improve the quality of life in Sebastian by nurturing the balanced relationship between our citizens and our environment by protecting, preserving and promoting our natural resources" 1. Chairman George Millar called the meeting to order at 6:00 p.m. 2. The Pledge of Allegiance was recited. 3. Per Chair Millar - Motion to approve. Per Vice Chair Gordian - 2nd motion to approve meeting minutes. 4. UNFINISHED BUSINESS Oyster Mat Restoration Project — Phase I Update of Status Permit status of Agency Permits Per Bob Progulske — provided an update on the completed ACOE application and noted that Frank and Michelle assisted in preparing the maps and the cross sections as requested by ACOE. Contacted Jeff Beal - agency to see about coming out to NRB meeting, but he was busy maybe in the future. Jeff Beal F&W, they preferred only 1-2 Natural Resources Board Meeting October 06, 2015 Page 1 rows of mats and not 50% mat and 50% bags and that the application reflects the bags and mats. Bob Progulske – Read an email from Jeff Beal stating the bags are preferred and they will not be available to attend any meetings and to proceed with the project. Bob will contact ACOE Tamy Dabu to see where they stand regarding a meeting or not. Per Chairman Millar – Reviewed question and answer portion per page RAI and attachments. Per Bob Progulske – Move to accept information as presented. Per Jim Clifton – 2"d the motion Per Chairman Millar – Motion and a second to resubmit the RAI and amend the motion to submit to Saint Johns River Water Management District and to the Army Core. If Tamy Dabu would like to do a field site survey it would be welcomed. The board voted to approve to submit. Once the applications are resubmitted to the agencies the review clock restarts. Per the City of Sebastian's per capita our fee is only $100 and will submit to SJRWMD. Frank Watanabe will submit the responses to the ACOE comments as well as to SJRWMD regarding the F&W comments and we will see where this goes. Typically the review process takes 30 days to complete. Per Chairman Millar - Brought up Boy Scout – Paul Giordano Per Mr. Paul Giordano – John Giordano is currently working he did a workshop on the September 19th, meet the troops at Ocklawaha. Has been in touch with Cate Brown at the zoo, they have a division that did a pilot project with the bags. They will set up an appointment to meet with them. They are waiting on the permits before moving forward and to see what the percentage of mats vs bags. Per Chairman Millar – Goal date to have the project in the water March or April of 2016. Champion Tree Program Update Per Mr. James Clifton – After meeting with Barbara Brooke Reese and Michelle Stromberg were able to go over ideas.—Ms. Barbara Brooke Reese unveiled the webpage she designed for the NRB. Per Mr. James Clifton - Went over the Champion Tree website information and sub categories as Barbara guided the website tour. Jim touched on the Champion Tree types. This is a national tree program. Per Michelle Stromberg - Michelle Stromberg noted that the City had purchased the laser measuring device to the Commission to use in checking the champion trees. Per Chairman Millar – Motion to approve website. Per Vice Chair Gordian – 2"d motion of approval NRB Banner Update Jack Lampiasi was not present at this meeting, so Barbara Reese presented the new banner since she created the Banner. She noted not to use the wording "Home of Pelican Island" since that is the City Logo. The banner is 8 feet long and 2 '/2 feet wide Natural Resources Board Meeting October 06, 2015 Page 2 and it does have grommets. All of the Commissioners liked the banner and appreciated the work the Barbara did to create this NRB banner. Per Ms. Barbara Brooke -Reese - What is the purpose of the banner, the banner is to identify you as an entity, more for a background. Do you want the symbols permanently? Per Chairman Millar - Could we have rider's islets on the bottom of sign to hook the riders to? Michelle Stromberg noted that the City had purchased and received the tent for the NRB commission to use on events. Per Chairman Millar - Motion to approve banner and will add rider to it, and use to walk in parade. Commission approved the banner. Earth Dav Event Uodate Rose provided an update on the Earth Day vendor list and she email to all a new list of current vendors on a spreadsheet. Andrea assisted and she has the old list from Gil from last year sign ups. She mentioned that the event will be April 23, 2016 with set-up from 7 -8:30 am and she has the email site ready. She is mentioned 4 venders have signed up from before and Waste Management will be attending for the recycling as before from gam to noon, and that the wide bike tire will be attending. I have an update, Andrea started a spreadsheet ready to send Per Chairman Millar — Question wanted to know if we will be able to close the street off. There was a comment on having the Police Doggies attend the event as before. Per the City Engineer Frank Watanabe — we will contact Chief Morris to arrange if the police dog training is available for this event. Frank also mentioned to add Public Works to have two spots so they can have a tent to display stormwater and NPDES and to park the new PW vac -truck for display. Per Gil Gordian, we request to assist with the entertainment Vendor application will be available on the website. Per Chairman Millar — like the prizes to be real time, also give credit to the vendor who supplies the prizes. Per Ms. Rose Glaser - will be starting the trivia questions. Clambake Event Per Chairman Millar open the discussion on the Clambake and noted the dates as November 6-8"' and to have at least one member preset at tent at all times. Chairman Millar made a motion to approve the NRB to have a booth at the Clambake and Vice -Chair Gordian seconded the motion. Per Chairman Millar — noted that the NRB should attend this event and that City staff has already reserved a spot at the event for the NRB. City has purchased and received the new 1 0x1 0 foot tent for the NRB. NRB can hopefully display their new NRB banner at this event. Commissioner will need to be table and chairs and probably lights for the evening times. The project is located in the Indian River, in Sebastian, Indian River County, Florida. The application has been assigned number SAJ-2015-01763 (NW -TSD). Please reference this number on all correspondence concerning your application. Based upon the information provided your project may qualify for a Nationwide Permit. While this application originated through the Joint Application Process with the State of Florida, the U.S. Army Corps of Engineers (Corps) received insufficient information to evaluate the proposal. The Corps considers your application incomplete, as it does not provide information needed to review the project and coordinate with the commenting agencies. 1. Please provide the signed signature page to the application or complete the attached application form for the proposed project. This was not supplied with the response received on October 8, 2015. 2. No detailed exhibits were provided with your application and the application did not include any description of the proposed work. Please describe in detail the proposed project. The Corps has the following concerns regarding the oyster reef project sites D & E: a) It appears that the proposed oyster reef project Sites D & E will be located in waters too deep to support oysters. Please revise. b) The proposed oyster reef projects will pose a hazard to safe navigation in the water depths and locations proposed. Please revise. c) Please note that informational signs may not authorized in navigable waters as signage creates a navigational hazard. Any signs and poles may also require approval from U.S. Coast Guard. Please remove. d) Numerous entities such as the University of Central Florida, University of Florida, St Johns River Water Management District, Florida Department of Environmental Protection have been authorized and have conducted studies of the oyster mat/bag restoration projects in the Indian River Lagoon. I encourage you to contact Dr. Linda Walters, Professor at the University of Central Florida for additional guidance regarding your proposed project. Dr. Walters may be reached by phoning 407-823-2148 or IIWaIter(@mail.ucf.edu . e) The response letter states that the oyster projects are 180 feet by 200 feet size which appears extremely large in size especially for a pilot project. f) No specific details were provided for the monitoring of the oyster reefs, please provide. g) Please provide a plan view drawing so that it reflects all dimensions to the project. Include the following in your legible plan view drawing: a. Property boundaries b. North arrow c. Road names d. Name of water body e. Approximate mean high water line f. Wetland and surface water locations g. Types of materials to be used (include anchors, etc...) h. Dimensions to all proposed features (length, width, and height) I. Location of the proposed project (referenced from fixed points) j. Emergent and submerged vegetation k. Existing water depths referenced to mean low water I. Turbidity control measures(if applicable) m. Cross Section location(s) n. Installation method o. Identify and state if the area will have markers installed and the type that will be used. It appears that if sites D or E are proposed that the project may pose a navigational hazard to the area. Please locate the project so that it does not pose a navigational hazard in the Indian River. h) Please provide typical cross sections for the project. Please include the following: a. Identify section b. Existing conditions C. Proposed conditions with description d. Dimensions to all features within the section i) Please explain in detail how the project will take place. Include all materials that will be used to install the project and the following information: a. how you will access the site, b. staging of equipment and materials, c. full description of all types of equipment and materials that will be used to install the project, (how you will carefully hand place the materials, etc...) d. anticipated duration it will take to perform the proposed project, e. anchoring mechanisms i.e. if PVC piling or anchoring mechanisms will be used include size, the number of piles that will be installed, complete details regarding how the piles will be installed into the substrate, IF applicable (if you are using the doughnuts then the PVC piles are not applicable) f. describe the substrate and approximate water depths the project is located in Please be sure to describe the substrate that the project will be placed on and the location of emergent and submerged aquatic vegetation (SAV), with the distance away that any emergent and SAV is found. As the application is considered incomplete, no action will be taken on it until the above -requested information and drawing shave been received. We request that you provide this information within 30 days. If no response is received, we will assume you have no further interest in obtaining a Department of the Army permit and the application will be deactivated. Such action will constitute final action by the Department of the Army. You are cautioned that work performed below the mean high waterline or ordinary high waterline in waters of the United States, or the discharge of dredged or fill material into adjacent wetlands, without a Department of Army permit could subject you to enforcement action. Receipt of a permit from the Florida Department of Environmental Protection or St Johns River Water Management District does not obviate the requirement for obtaining a Department of Army permit for the work described above prior to commencing work. Hey Gil and Sebastian NRB Unfortunately I will not be able to attend the 3 -Nov board meeting. However I would be glad to participate in a site visit meeting with all that can attend. I have been to your project site a couple of times and I would be more than happy to offer some suggestions and guidance and think a site visit is a great idea. On site we can talk specifics (and even lay out a footprint of the reef modules if desired). I can send the NRB board a link to available vendors for purchasing aquaculture grade oyster bags in a follow-up email unless you already know where you are going to purchase your bags. Also, in case you haven't done so, you will need to figure out the amount of shell you will need for your project. The amount will have changed now that you will be using oyster bags (instead of or at least for the bulk of) for your project. I can help you with that too. It comes down to calculating # reef modules, size of reef modules which gets you # bags needed. Amount of shell per bag is then estimated and you go from there... Keep me in the loop and I will put a site visit on my calendar. Our N R Board has run into a snarl with our Army corp ENG permits . We are resubmitting the applications... for final approval soon . How ever they / or SJWD are requesting a possible site meeting as well as suggesting to us to use oyster bags!(TBD) (It would make our work easier to deploy...) I will place it on the November agenda for the city to post for the board meeting... 2 -If you have time could you speak with Brian to see if he or your self have some time to meet with the N R B and Army Corp during the projected site meeting ? City of Sebastian.Fl. 727- 453-7331 =cell 70 62-330.632 General Permit for the Restoration, Establishment and Enhancement of Low Profile Oyster Habitat. (1) A general permit is hereby provided for the constriction, restoration, and enhancement of low profile oyster habitat (LPOH), subject to the following: (a) The total footprint of the LPOH %pimegnartei acrein sr4e pu,lcas,� �,ra ified by GPS or boundary survey; (b) The work shall be conducted by persons having expertise designing and implementing oyster habitat restoration activities and that the person will carefully supervise all persons responsible for installing the LPOH; (c) The LPOH will not be inconsistent with a management plan approved by a federal, state, regional and/or local agency, that already addresses oyster habitat, wetland vegetation, submerged resources, water quality, navigation, or fishing and recreational values of the waterbody, including any adopted aquatic preserve management plan under Chapter 18-20, F.A.C.; (d) The LPOH shall not be part of a mitigation proposal or be used as mitigation to offset impacts from other projects; (e) The LPOH is not regulated under Section 597.03, F.S., and is not intended to serve any aquaculture function; and (t) The LPOH will not adversely affect existing natural resources or resource activities within or adjacent to the footprint of the proposed LPOH footprint. (2) The notice required in Rule 62-330.402, F.A.C., shall include documentation, statements, or demonstrations that the above limitations will be met, together with the following: (a) An explanation of the overall ecological benefit to be achieved by die LPOH; (b) Documentation that the person using this general permit has authorization from the landowner, other than the State of Florida, to conduct activities on their land; if located on state-owned submerged land, such documentation does not need to be provided with the notice — the authorization to conduct the LPOH activity on state-ometned submerged lands will be a component of the Department's evaluation of qualification to use the general permit; (c) An environmental resource survey of the bottom of the waterbody throughout the LPOH area, including an additional 100 foot -wide perimeter surrounding the LPOH area demonstrating that: 1. The LPOH area, including the 100 foot -wide perimeter area, does not have other live native shellfish except as provided in paragraph (3)(d), below, nor submerged grassbeds, clam beds, hardbonom, coral, or macroalgae communities; 2. The LPOH will not affect an archaeological, cultural, or historical resource area regulated under Chapter 267, F.S.; 3. The LPOH mvill not have any work conducted within 100 niters of actively nesting wading bird colonies or within 180 meters of actively nesting mixed tem/skimmer colonies; 4. The LPOH will not be constructed within: a. 100 feet of the near bottom edge of a federally maintained channel, where near bottom is defined as the design edge of tine established channel closest to the project not including the slope, without written approval from the entity responsible for channel maintenance; b. 100 feet fi om the outside edge of any designated channel marked in accordance with Section 327.40 F.S. without written approval from the entity responsible for channel maintenance; c. Any channel traditionally used for navigation; d. 100 feet of any dock or overwater structure without notice to the current property owner; e. Any other designated management zone that requires approval to conduct activities unless written approval is received from the managing agency; or f. Any previously permitted mitigation areas; and (d) Agreement that the activity will comply with the additional conditions of subsection (3), below. (3) All work under this general permit shall be conducted in conformance with the general conditions of Rule 62-330.405 F.A.C., and the following specific conditions: (a) The LPOH shall be installed, restored, or enhanced using only clean, sediment free culture materials (culteh) that does not contain deleterious substances that have the potential to leach into surface waters. Cultch shall consist of: L Recycled shell that has been quarantined for a minimum of three months; 2. Fossil shell; 3. Limerock consisting of a minimum of 20 percent calcium carbonate by volume, with 90 percent of the limerock being no more than six inches in diameter; or 4. Concrete material in which at least 90 percent of the concrete material is no more than 6 inches in diameter. Concrete shall not be used for a LPOH located in an aquatic preserve designated under Chapter 18-20, F.A.C. (b) Cultch shall be firmly fixed on the substrate and contained in such a way as to prevent movement away from the LPOH footprint, through use of designs such as bagged shell, loose Cultch surrounded and contained by bagged shell, or shell securely fixed to aquaculture grade mesh material. (c) LPOH materials shall not be indiscriminately dumped, and shall not be placed outside of the total footprint limits. (d) The LPOH may consist of placement of cultch in locations where no oyster reef currently exists, or restoration of an existing degraded oyster reef to its historic height. Cultch shall not be placed on top of substrate with greater than five live oysters per square meter. Final elevation shall not exceed 18 inches above the existing bottom elevation in locations where no oyster reef currently exists. In existing oyster reef locations, if the historical oyster reef elevation is unknown, restoration shall not result in the placement of cultch to an elevation height greater than the average elevation height of existing natural oyster reefs in the immediate vicinity of the LPOH area. (e) The LPOH shall not cause harmful erosion or shoaling to adjacent submerged areas and shorelines. (f) The LPOH shall avoid impacts to the fishing and recreational use of the waterbody, its aquatic and wetland dependent species, and its submerged resources. (4) A minimum of 60 days prior to submittal of a notice required in subsection (2), the person proposing to use this general permit shall conduct at least one pre -notice meeting with the appropriate Agency staff to discuss the project design, implementation details, and any resource concerns. If the LPOH is included within an aquatic preserve designated in Chapter 18-20, F.A.C., the appropriate aquatic preserve manager, or their designee, shall be invited to die pre -notice meeting. (5) Within 45 days but no less than 30 days prior to the submittal of the notice required in subsection (2) the person proposing to use this general permit shall: (a) Publish a one-time notice in a newspaper of paid general circulation in the vicinity of the project location. The newspaper notice shall provide that any concerns about the LPOH shall be directed to the Department at the Department's contact address. An affidavit of publication shall be included with the notice required in subsection (2). (b) Provide written notice to the appropriate Inland Navigation District, and any other special taxing district with authority to construct or maintain navigation channels within the proposed LPOH. In counties where such districts do not exist, the sane written notice shall be provided to the county or municipal agency with jurisdictional authority over inland navigation. A copy of each notice shall be included with the notice required in subsection (2). (c) Provide written notice of the proposed LPOH to the Florida Fish and Wildlife Conservation Commission's Boating and Waterways Section. A copy of the notice shall be included with the notice required in subsection (2) above; (d) Post readily visible notice of the proposed LPOH at the nearest public boat ramp to the LPOH site, unless prohibited by law. The notice should indicate the location of the LPOH and phone number of the appropriate agency to direct comments to on the proposed LPOH. A copy of the notice and boat ramp locations where the notice was posted shall be included with the notice required in subsection (2), above. All of the above notices include georeferenced coordinates (latitude and longitude) for the LPOH site, or refer to an Internet site that includes a georeferenced map with coordinates of the LPOH site. (6) Implementation of the activities authorized in this general permit shall not commence until the Department has confirmed compliance with the terms and conditions of this general permit. The Department will provide written notification whether the proposed activity qualifies for this general permit within 30 days of the Department's receipt of all the materials required above. The proposed activity shall not be commenced until the Department has provided written notice that the person proposing to use this general permit qualifies for the general permit. Any denial by the Department of qualification to use this general permit shall be made without prejudice for the submission of an individual application for the same or a modified LOPH.
