Chairman McPartlan called the Board of Adjustment Meeting to order at 6:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL: Present: Mayor Bob McPartlan (Chair) Vice -Mayor Jim Hill (Vice Chair) Council Member Jerome Adams Council Member Andrea Coy Council Member Richard Gillmor City Staff Present: City Attorney, Robert Ginsburg City Manager, Joseph Griffin City Clerk, Sally Maio City Engineer, Frank Watanabe Community Development Planner, Jan King 4. ANNOUNCEMENTS: None 5. APPROVAL OF MINUTES: Meeting of September 10, 2014 MOTION by Ms. Coy and SECOND by Mr. Gillmor to approve. Roll Call: Ayes: McPartlan, Hill, Adams, Coy, Gillmor Nays: None Passed: 5-0 6. OLD BUSINESS: None 7. NEW BUSINESS: 8. QUASI-JUDICIAL PUBLIC HEARING: DR. HAL BROWN, AS REPRESENTATIVE FOR PLAZA OF COTTAGES, LLC AND HIGHPOINT COMMERCIAL CENER, LLC, IN REGARDS TO PROPERTY LOCATED AT 9707 U. S. 1, IS REQUESTING A VARIANCE FROM SECTION 54-3-15.4(a)(2) OF THE SEBASTIAN LAND DEVELOPMENT CODE TO ALLOW A PORTION OF THE PARKING FOR A MULTIFAMILY RESIDENTIAL USE TO BE 500 FEET OR LESS FROM THE DOOR OF THE BUILDING, WHEREAS THE CODE REQUIRES PARKING TO BE WITHIN 150 FEET OF THE UNIT FOR WHICH THE SPACES ARE INTENDED. Board of Adjustment Meeting October 8, 2014 Page Two Mayor McPartlan opened the public hearing and the City Attorney read the variance request as set out above. No member of City Council had ex -parte communications to disclose. The City Clerk swore in all who intended to offer testimony. Geoffrey Barkett, Schulke Bittle & Stoddard, LLC, said he was in attendance with Dr. Brown and Bruce Barkett to try to obtain a variance on the 150 foot separation from their apartment building to the parking spots. He said the project was approved at P & Z and this was a condition going forward. He said this is a peculiar, long and skinny lot, they have a layout that works, have almost all permits in hand to start construction for the three story building and it is virtually impossible to meet the 150 foot requirement for locations in certain areas. He said 130 of the spaces are within the 150 feet of all entrances which is 1.5 spaces per unit, and the remaining 48 are outside the 150 feet. CDD Planner, Jan King said this is a peculiar shaped property, the building design mimics the property shape, to get the parking closer to the building would be very difficult, and are before you tonight because we cannot physically make this work, believe this is a good site plan and provides 2 spaces per unit as requested by Code, which may in excess of what this building needs. She said staff recommends approval. Mr. Hill agreed that two spaces per unit is excessive since these are one bedroom units, and suggested we start looking at some code provisions discussed in the past. Ms. King said during the site plan approval, the engineer submitted some information, noting that the County requirement is 1.5 spaces, and they are providing 1.5 spaces in the required 150 foot area. Chairman McPartlan called for public input and there was no response, then closed the hearing. MOTION by Mr. Gillmor and SECOND by Ms. Coy to approve the variance.
