REGULAR MEETING MINUTES
April 21, 2015 — 6:00 P.M.
Meeting was called to order by Ch. Carbano at 6:00 P.M.
Pledge of Allegiance was led by Ch. Carbano.

ANNOUNCEMENTS:
Building Official Wayne Eseltine stated because Board member Mr. Dalessandro had
recently moved out of the area, and Mr. Berry had health problems, both members had
resigned from the Board. Ms. Lohsl stated the open positions were being advertised by
the City Clerk's office.

NEW BUSINESS: RENEWAL OF CERTIFICATE:
IN THE MATTER OF MR. JOHN KNUDSEN
A TILE & MARBLE CONTRACTOR: LOCAL LICENSE NO. 1512
MR. KNUDSEN IS SEEKING BOARD APPROVAL TO RE -INSTATE HIS LICENSE
THAT EXPIRED ON 9/30/2009
APPLICABLE CODE SECTION FROM THE CITY CODE OF ORDINANCES:
• SECTION 26-168 (C) OF THE CITY CODE OF ORDINANCES
A CERTIFICATE WHICH IS INOPERATIVE BECAUSE OF FAILURE TO
RENEW SHALL BE RESTORED ON PAYMENT OF THE PROPER
RENEWAL FEE. IF THE APPLICATION FOR RESTORATION IS NOT
MADE BEFORE THE BEGINNING OF THE NEXT FISCAL YEAR OF THE
CITY, THE FEE FOR RESTORATION SHALL BE DOUBLE THE ORIGINAL
RENEWAL FEE AND IN ADDITION THE BOARD MAY REQUIRE RE-
EXAMINIATION OF THE APPLICANT. A CERTIFICATE WHICH IS NOT
RENEWED WITHIN THREE FULL YEARS AFTER EXPIRATION MAY
NOT BE RENEWED, RESTORED, OR REINSTATED THEREAFTER
EXCEPT BY REAPPLICATION AND RE-EXAMINATION.
Building Official stated that Mr. Knudsen is seeking board approval to reinstate his local
license that expired 9/30/2009, and read Section 26-168 (C) of the City Code of
Ordinances, which required reapplication and reexamination, and that was the basis for
Mr. Knudsen's appeal to the Board.
Mr. Knudsen, 5525 42nd Terrace, Vero Beach, stated in 2009 he worked for Home Depot
and took a transfer to Connecticut, since has returned and is still connected with HD
through US Installation Group, who is requiring that he get licensed again.
Summary of findings:
Ms. Carbano noted his testing, which Sebastian sponsored, was in 2002. Mr. Knudsen
verified he had been in the [tile & marble] business for 35 years.
Mr. Fortier asked if there was any continuing education required for this type of
licensing. Mr. Eseltine responded there was not. Mr. Knudsen stated he did not consider
that he should have continued to pay his renewal fee when he was in Connecticut. Ms.
Lohsl stated the fees would be $360.00 to reinstate the license, which included the current
year.
A motion was made to override the requirement of section 26-168 requiring the
examination since the license has been expired for more than three years, and reinstate
this license for $360.00 since no continuing education was required.

Review "Charge" and Mission of the Construction Board
First, Mr. Eseltine gave a brief update on his meeting last week at the local Treasure
Coast Building Officials Association where there was a class on Contractor Licensing
and all the jurisdictions that were present discussed sharing disciplinary information so
contractors wouldn't move city to city committing the same type of violations. He stated
they discussed Sebastian's expiration code requiring reexamination or Board override,
how other cities did not have this, and how it affected reciprocity letters.
As a follow-up to the City Council workshop with the Boards & Commissions, Mr.
Eseltine stated he wanted to review the mission of the Board and handed out a copy of
the Code of Ordinances sections referring to the Board's powers and duties. The seven
items listed in Section 26-197 were read and discussed. Mr. Eseltine also clarified why
types of violations by contractors would go before the Special Magistrate vs. the
Construction Board, and collection of fines levied. Section 26-175, where the Board was
used in appeals, along with other pertinent sections was also read.
Mr. Fortier asked why this discussion was needed now. Mr. Eseltine stated it was
suggested at the workshop and the current agenda was short. Mr. Fortier opined he
would like to see the Construction Board meet more often, even if to just be updated with
building departmental activities and meeting discussions.
Mr. Eseltine proceeded to update the members with information about the new computer
software the Building Department was purchasing and installing, which enabled more
online permitting, better features for the inspectors and contractors, and electronic
submittal of documents.
Mr. Fortier questioned if there was an increase in construction activity within the last two
years, and did the Building Department have the same staffing positions as before. Mr.
Eseltine discussed the previous and current positions, a current retirement, and current re-
hire. Mr. Fortier inquired if the Building Department had a mission statement, too. Mr.
Eseltine stated it was on the home page of the Department's website.
Ms. Hays asked how the city finds the violators. Mr. Eseltine responded that it was
usually by a complaint from a resident who hired an unlicensed contractor, got taken, and
then came to the city for help. Ms. Hays suggested a letter could be sent to homeowners
offering guidelines when hiring a contractor, and a discussion ensued with the members
about avoiding unlicensed ones.
