HomeMy WebLinkAbout09-06 Hangar A Covered WalkwayRFP 09-06 DESIGN BUILD SERVICES FOR SEBASTIAN MUNICIPAL AIRPORT HANGAR "A" CANOPY COVERED WALKWAY ALL PROPOSALS WERE REJECTED 5/12/09 Unsuccessful Bidders Covered Walkway at Airport Hangar A: Brian Kruger Awnings Plus Palm Coast Commercial Development, LLC American Metal Co SEBASTLAN MUNICIPAL AIRPORT SEBASTIAN MUNICIPAL AIRPORT- REQUEST FOR PROPOSAL DESIGN -BUILD SERVICES FOR CANOPY WALKWAY SYSTEM This is a publicly advertised Request for Proposal (RFP) to provide design -build services for the Sebastian Municipal Airport's Airport Hangar Building "A" project. This RFP is for solicitation of bid proposals for the design/build of a 105 -foot (more or less) Canopy Covered Walkway. The covered walkway is to connect the airport administration building with Hanger "A" at the Sebastian Municipal Airport. The covered walkway must meet all applicable laws, regulations, and ordinances. It is anticipated that any design, and materials selection, will closely match the airport administration building and Hanger "A" Decisions regarding materials and final construction design are to be decided by the proponent, with the requirement that the most cost effective product giving the best value to the city will be the successful selected proposal. Proposal packages are to be mailed or hand -delivered to the City Manager's Office (c/o Jean Tarbell — tel. 772-388-8203) at Sebastian City Hall, 1225 Main Street, Sebastian, Florida 32958. The deadline for the City's receipt of any PROPOSAL PACKAGE SUBMITTAL IS 11:00 AM ON MONDAY, 27 APRIL 2009. Proposals received after the specified time will not be accepted. One (1) original (marked "ORIGINAL") and one (1) copy of all proposal sheets and required attachments must be executed and submitted in a sealed envelope clearly and prominently marked on the front: "PROPOSAL FOR CANOPY WALKWAY SYSTEM AT THE SEBASTIAN MUNICIPAL AIRPORT" with proponent's name, return address, telephone contact number, and email address also clearly identified on the outside of the sealed envelope. Material changes, if any, to the scope of services or proposal procedures must be in writing (email transmittals allowed) to be effective. Also note that in the interest of timely and accurate communications, correspondence by email transmittal is preferred during this RFP process. Oral interpretations/clarifications will be without legal effect; any matter of this nature must be addressed in writing. Any bids received without Public Entity Crime Form, Drug Free Workplace Form, Proof of Insurance, may be considered incomplete and immediately disqualified. Appropriate forms are included in the information package for execution and submission with a bid. Any person or affiliate who has been placed on the convicted vendor list following conviction for a public entity crime may not submit a bid as proscribed by Section 287.133, F.S. The City reserves the right to reject any or all bids, waive any informality or irregularity on any bid if considered non -substantial by the City, and/or to cancel this invitation at will. Bids received after the date and time stipulated herein will be considered late and therefore disqualified. Bids duly submitted will be publicly opened and read aloud at the date and time specified above in City Hall, The City reserves the right to reject any and all bids and/or to accept any bid or portion thereof deemed to be in the best interest of the City and/or to waive any non -substantial irregularities. Make a good faith effort to continue to maintain a drug free workplace through implementation of Paragraph 1 through 5. The 1989 Florida Legislature passed Senate Bill 458 creating Sections 287.132 - 133, Florida Statutes, effective July 1, 1989. Section 287.132(3)(d), Florida Statutes, requires the Florida Department of General Services to maintain and make available to other political entities a 'convicted vendor" list consisting of persons and affiliates who are disqualified from public and purchasing process because they have been found guilty of a public entity crime. A public entity crime is described by Section 287.133, Florida Statutes, as a violation of any State or Federal law by a person with respect to and directly related to the transaction of business with any public entity in Florida or with an agency or political subdivision of any other state or with the United States, including, but not limited to, any bid or Agreement for goods or services to be provided to any public entity or with an agency or political subdivision and involving antitrust, fraud, theft, bribery, collusion, racketeering, conspiracy, or material misrepresentation. By law no public entity shall accept any bid from, award any Agreement to, or transact any business in excess of the threshold amount provided in Section 287.017, Florida Statutes, for category two (currently $10,000) with any person or affiliate on the convicted vendor list for a period of 36 months from the date that person or affiliate was placed on the convicted vendor list unless that person or affiliate has been removed from the list pursuant to Section 287.133(3)(f), Florida Statutes. American Metalco's obligation under this Warranty shall be limited to the repair or exchange of any part or parts which may thus prove defective under normal use and service within one year from the consignment of the Product to the common carder by the original Purchaser, and which our examination shall disclose to our satisfaction to be thus defective. This warranty is expressly in lieu of all other warranties expressed or implied including the warranties of merchantability and fitness for use and of all other obligations or liabilities on our part. American Metalco neither assumes nor authorizes any other person to assume for American Metalco any other liability in connection with the sale and installation of this product. This warranty shall not apply to this product or any part thereof which has been subject to accident, negligence, alteration, abuse, or misuse. American Metalco makes no warranty whatsoever In respect to accessories or parts not supplied by American Metalco. The tern "original purchaser," as used in this warranty, shall be deemed to mean that person for whom the product is originally installed. American Metaloo extends to Purchaser any guarantee or warranty provided by the manufacturer of any cover material. Such guarantee or warranty shall be a separate obligation of such manufacturer and not of American Metalco. LIMITATION ON LIABILITY: No cause of action by Purchaser shall include a claim, nor may recovery be had against American Metalco by Purchaser, for any punitive, incidental or consequential damages, including but not limited to, damages to property, for loss of use, loss of time, loss of profits or income. The aggregate total liability of American Metalco under this Contract, whether for breach of warranty or otherwise, shall in no event exceed the Contract Price. • SECURITY INTEREST: Purchaser will execute and deliver to American Metalco all proper forms for filing and identifying American Metalco's security interest in any material delivered to the site. In addition, Purchaser hereby grants to American Metalco a security interest in the products referenced on page 1 hereof, and all related products, and in the proceeds thereof, to secure payment of the purchase price. A copy of this Agreement may be filed at any time as a financing statement in order to protect American Metalco's security interest • SITE WORK: The Purchaser will be responsible for all site surveys, soil analyses and any other and all similar requirements having to do with site preparation and/or layout. Storage charges and or security for material after arrival on site will be the sole responsibility of the Purchaser. The Purchaser must supply temporary power for American Metalco's use on site. In the event American Metalco supplies any labor, services or materials at the site, all delays and associated costs due to changes in the work after American Metalco's arrival on the site will be the sole responsibility of the Purchaser. PERMITS: Purchaser shall, at its own cost and expense, secure any and all permits, licenses, variances and/or zoning changes required for installation. Purchaser represents and warrants that he is either the owner(s) in fee of the real property on which American Metalco's structure is to be erected, or that he is duly authorized in writing to act for and on behalf of the owners of the fee. DOCUMENTS: Any and all drawings relative to this Agreement and/or Project are the sole property of American Metalco. Drawing is an instrument of service and is intended for and limited to use only on the project indicated. Any use or reproduction of these drawings, in whole or in part, by any means whatsoever, is strictly prohibited except with the specific written consent of American Metaloo. Drawings are submitted for use only in connection with proposals or contracts of American Metaloo upon the express condition that they are not to be used directly or indirectly in any way detrimental to the interests of American Metalco. It is our intention to match the metal roofing of the Administration Building and Hangar 'A' using manufacturer, material and color to the best of our ability. The canopy will consist of columns and an open trussed roof system as listed below. Columns, open area of trusses and underside of sheathing to be painted white to match the existing column color of the Administration Building.
