MINUTES
SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING
February 16, 2016
The hearing was called to order at 2:00 p.m. by Special Magistrate Kelley H. Armitage.
Present: Special Magistrate Kelley H. Armitage, Acting City Attorney Joseph F. Griffin, Code
Enforcement Officer Richard Iachini and Curtis Bloomfield, Building Director Wayne Eseltine,
Administrative Assistant Janickie Smith and .lean Tarbell.
Wayne Eseltine identified himself as the Building Director.
Magistrate Annitage stated we have two cases on the docket with only one defendant present.
Magistrate Armitage verified with Linda Lacasse her name and Mrs. Lacasse stated her name.
Magistrate Armitage confirmed Myrodes Z. Konstantimides was not present for the hearing of his
case.

Magistrate Armitage called Code Officer Richard Iachini for testimony.
Code Officer Iachini requested a continuance on the case, stating defendant is applying for a
variance in which case Mrs. Lacasse will need to appear before the City Council. Mrs. Lacasse
missed the deadline for February to appear before City Council, but will appear at the March City
Council meeting. Code Officer Iachini stated Mrs. Lacasse will not be able to appear for the March
Magistrate Hearing due to the date of the March Council meeting. Code Officer Iachini requested a
continuance until the April Magistrate Hearing pending the outcome of the variance.
Mrs. Linda Lacasse agreed with Code Officer Iachini. Magistrate Armitage again confirmed with
Mrs. Lacasse if she agreed with the continuance, Mrs. Lacasse stated she was agreeable. Mrs.
Lacasse also stated she has applied for the variance and has a receipt of payment, stating deadline
was missed due to early voting.
Magistrate Armitage ruled the case is continued.

Myrodes Z. Konstantimides
Magistrate Armitage asked if proper notice was given to the defendant. Mr. Griffin confirmed proper
notice was given to the defendant who has not shown, City of Sebastian would be open to a default
judgement.
Code Officer Bloomfield testified the owner of 461 Ponoka called at 1:00 p.m. on today's date
stating he could not be present for the Magistrate Hearing. Code Officer Bloomfield stated defendant
received proper notice and is challenging the invoice.
Magistrate Armitage asked if the defendant was being cooperative or difficult? Code Officer
Bloomfield referred the question to Administrative Secretary Janickie Smith who testified the
defendant has been uncooperative with signing correspondence relative to his case, also an signed
affidavit from Susan Lurosso, the previous Administrative Assistant of defendant who confirmed the
date of the hearing and his presence. Mrs. Smith testified the defendant called at 1:00 p.m. today to
state he would not be present for the hearing.
Magistrate Armitage ruled the order as requested. Myrodes Z. Konstantimides shall be responsible
of all costs related to the overgrowth cutback, mailing fees, and filing of lien for reimbursement to
the City of Sebastian.
