SUMMARY
As an informational item — Please see attached Memorandum of Understanding
between the City and the Four Chaplains committee. As of this writing, Mr. Wapnick and
the City have not signed the MOU. However, the City Manager's Office believes that all
items are in place and Council directives have been met. Once the MOU is finalized, the
permit for the monument construction will be released.
MEMORANDUM OF UNDERSTANDING
This memorandum memorializes the intent between the City of Sebastian, hereinafter referred to
as "CITY" and FOUR CHAPLAINS MONUMENT COMMITTEE OF INDIAN RIVER COUNTY,
FLORIDA, hereinafter referred to as "FOUR CHAPLAINS", regarding the construction and future
maintenance of the Four Chaplains Memorial.
1. FOUR CHAPLAINS, shall construct an interfaith memorial to fallen war veterans. The
site of the memorial will be Riverview Park, Sebastian, Florida. The specific location and
design of the memorial was provided to and reviewed by the City Council on January 25,
2012. Specifications for the site location and memorial are on file in the Community
Development Office of CITY.
2. FOUR CHAPLAINS shall complete the construction of the memorial within_ months.
Failure to complete the memorial within the time frame shall terminate the CITY's
commitments under this MOU and other any other commitments.
3. All costs to construct the memorial shall be the sole responsibility of FOUR CHAPLAINS.
As of February 9, 2012, FOUR CHAPLAINS has represented that remaining costs for
construction are approximately $33,000. FOUR CHAPLAINS also represents that their
current available construction fund is $29,892.40 (Attachment #1). FOUR CHAPLAINS
further represents that another $14,000 will be received in contributions prior to the start
of construction; thereby, bringing their total construction balance to approximately
$43,892.40.
4. FOUR CHAPLAINS will apply for and receive all necessary construction permitting from
CITY prior to start of construction. Due to the charitable mission of the FOUR
CHAPLAINS' mission, CITY will waive permit fees.
5. FOUR CHAPLAINS intends to construct an eternal flame on the memorial. FOUR
CHAPLAINS has represented that said eternal flame will be properly constructed,
operated, funded and perpetually maintained by . Recurring use of natural
gas shall also be provided by . City shall have no obligation to operate, provide
natural gas or maintain eternal flame. City shall retain the right to remove eternal flame
at its sole discretion.
6. FOUR CHAPLAINS shall provide best efforts to provide maintenance to the memorial.
These efforts shall include cleaning fountain, planting/maintaining landscape (as may be
approved by the CITY) and general area clean up.
7. Funds permitting, FOUR CHAPLAINS may and will strive to provide future funding for
major memorial repairs such as reflection pool maintenance, eternal light
operation/maintenance, memorial stone repair/refurbishment and other unforeseen repair
items in excess of $5,000.
8. CITY shall assist in construction by providing fill materials, in-kind labor and equipment.
CITY shall not provide any funds for construction.
9. CITY shall provide general routine maintenance to include, weed removal, lawn
maintenance and standard memorial maintenance.
The above accurately reflects the construction and maintenance plan of the Four Chaplains
Memorial between the CITY and FOUR CHAPLAINS.
