WORK & PURPOSE: The applicant proposes to modify an existing marina by decreasing the rnMftt of slips from 47 to 42; iridEMeing the square footage of the dock from 4332 to 12,,070; maintetMce: dredging of 1854 cubic yards from around the dock; and adding six channel markeza and one 8 -foot by a- foot marina advertising sign between the Indian River channel and the marina. A hydraulic dredge will be utilized. The spoil will be placed in an upland contained spoil area for dewatering, dried and trucked off-site. Return water fron the contained spoil area will be discharged to the Indian River. The slips will be designed to a000ntnodate vessels up to 50 -feet long. The applicant is proposing eight live -aboard slips, two fuel p zgos, and one sewage )-cut facility. Zhao of the slips are designated for sailboats. Zhe project site is located in a designated critical habitat for the West Indian (Florida) manatee. The applicant has indicated a willingnesa to follow the manatee special conditions which outline stm ard, manatee construction precautions and othet manatee ptotection measures. Unfortunately, the City Council was unable to finish business that night within their allotted time frame and will continue the review of fir. Fey's request on November 18, 1992, at which time, the City will forward any comments regarding this request. City staff would like to advise your department regarding a recent survey provided by Mr. Fey indicating the dock on a slight angle and not on a 90 degree angle, perpendicular with the rear property line. All documents that have been submitted via your department indicates this dock to be on a 90 degree angle. District Director Florida Department of Environmental Protection 3319 Maguire Blvd Suite 232 Orlando, Fl 32803-3767 RE: Dredge and Fill permit 31-241218-4 (Richard FeYY Dear Mr. Alexander; We are in receipt of your notice for short form application for a dredge and fill permit for the above referenced project. the City of Sebastian would like to exercise its option to file objections to the application for the following reasons: 1. The rip rap added along the south shoreline of the upland area is within the City's privately owned submerged lands and there is not sufficient information regarding the material, the extent of the placement such as its proposed height and encroachment into City property and the purpose for the proposed placement. 2. The City Council at a regularly scheduled meeting of August 12th, 1992, approved the installation of new pilings along Channel Marker's 68 north property line with the stipulations that the pilings be set back ten feet from the property line for the first 200 feet from the shoreline and then one foot set back from the north property line for the remainder of the new pilings installations along the north side. The dimensions indicated on sheet 9 of 12 for the installation of the new pilings are not typical for the entire length because the existing dock structure is not normal to the shoreline or parallel with the property lines and the applicant will be required to provide a letter of certification from a registered public land surveyor in the state of Florida that the new piling installations will meet the set backs established by the City Council.
