RE: Vicker's Grove Sand Mines bond requirements
Dear Henry,
The City has made their determination on the bond amounts required to be submitted for the Vicker's
Grove sand mine. As we have been discussing over the past few weeks, the City is going to require a
cash deposit be submitted in lieu of a surety or performance bond for the project.
For this project, a compliance bond and a restoration bond are required in the amount of one
thousand dollars ($1,000) per acre. The compliance bond is calculated for the entire site.
Correspondence dated February 24, 1998, has indicated that the former director calculated that
amount to be the entire site, less the stormwater area as that was not part of the excavation site. As
the current director, I am willing to utilize that formula. The entire site is 116.55 acres, less the 65.17
stormwater acreage, the resulting acreage is 52.38. Therefore, the compliance bond will be required
for $51,380. 1 believe that represents the amount of the original compliance bond for the project, so
there is no change in that amount. The compliance terms are the requirements outlined in Resolution
No. 95-07.
While the compliance bond is calculated for the entire site, the restoration bond is specifically for the
portion being mined. You have indicated that only Phase III is being mined, an area of 12.30 acres.
Therefore the restoration bond amount is $12,300.
For your convenience, one check may be submitted made payable to the City in the amount of
$63,680. If your financial institution would prefer a wire transfer, please contact me and I will provide
the City's ACH information to you.

Here is the letter that outlines the bond, Ken has been provided this previously.
We have not yet received the funds, when Ken indicates they've been received and assigns an account number, we can add that
to the bond info.

Yes — that's a good idea. Just a memo from you or a copy of whatever they provide to Finance would be great — then we'd have
the history of the new bond if anyone should want to look in the bond book. When it comes in you can provide something directly
to Donna to file.

I received your phone call and left a message. This e-mail should provide you a quick update on the Vickers Grove Mine
situation.
As of today, Fischer and Sons has not been authorized to mine again by the City. I understand that SJRWMD has approved their
ERP; however, there seems to be some issue over the need/requirement for a Consumptive Use Permit. The City will again let
that matter be handled by the district.
The cash bond to be held by the City is in an amount of approximately $63,000. The value was computed by a formula that was
in the original ordinance approved by the City. Rebecca Grohall can provide additional information on this.

be required to get a Consumptive Use permit for that project.
You said before re -commencement of mining the City of Sebastian will require cash bonds.
What is the amount of the cash bonds?
How is it calculated?
Does this mine operation fall under Section 54-2-7.15.?
