AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA,
RELATING TO PURCHASING; AMENDING SECTION 2-11 OF THE
CODE OF ORDINANCES ENTITLED LOCAL VENDOR
PREFERENCE POLICY; LIMITING THE DEFINITION OF "LOCAL
BUSINESS" TO INDIAN RIVER COUNTY ONLY; PROVIDING FOR
REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, AS FOLOWS:
Section 1. Section 2-11 of the Code of the City of Sebastian is hereby amended to read as
follows:
Section 2-11 Local vendor preference policy.
(a) Definitions.
(1) Local business means the vendor has:
a. A valid business tax receipt issued by the City of Sebastian or
by Indian River County, St. Lueie County, MaAia County,
at
the time a bid or proposal is submitted, and
b. A physical address located within the local area, in an area
zoned for the conduct of such business, from which the
vendor is operating a significant portion of its business, and at
which it maintains full-time employees.
Section 2. CONFLICTS All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
Section 3. SEVERABILITY. In the event a court of competent jurisdiction shall determine
that any part of this Ordinance is invalid or the remainder of the Ordinance is invalid or
unconstitutional, the remainder of the Ordinance shall not be affected and it shall be presumed
that the City Council of the City of Sebastian did not intent to enact such invalid provisions.
It shall further be assumed that the City Council would have enacted the remainder of this
Ordinance without said invalid or unconstitutional provision, thereby causing said remainder to
remain in full force and effect.
Section 4. EFFECTIVE DATE. This Ordinance shall take effect immediately upon its
adoption.
The foregoing Ordinance was moved for adoption by Councilmember Coy . The motion
was seconded by Councilmember Gillmor and, upon being put to a vote, the vote was as
follows:

The Mayor thereupon declared this Ordinance duly passed and adopted this 1f1rh day of
