CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor McPartlan called the Regular City Council meeting to order at 6:00 p.m. 2. Pastor Karen Leedahl, Christ the King Lutheran Church gave the invocation. 3. Mayor McPartlan led the Pledge of Allegiance. 4. AGENDA MODIFICATIONS Modifications and additions require unanimous vote of City Council members There was no objection to add a Hunt for Hope announcement by Dr. Holly Hamilton after Item #6D. 6. PROCLAMATIONS, AWARDS, BRIEF ANNOUNCEMENTS Presentations of proclamations, certificates and awards, and brief timely announcements by Council and Staff. No public input or action under this heading. 16.138 A. Proclamation — National POW/MIA Recoanition Dav — Fr. Dave Newhart Mayor McPartlan read the proclamation and presented it to Sgt. Pete Sayles, USMC and Chaplain Newhart, USAF. Sgt. Sayles said the ceremony would be in front of the Victory Center Military Store in the Vero Square Mall. Proclamation — Constitution Week — September 17-23. 2016 — Accepted by Karen Bauer and Holly Hamilton, Daughters and Children of the American Revolution Mayor McPartlan read the proclamation and presented it Dr. Holly Hamilton. 16.140 C. Proclamation — Hunger Awareness Month — September 2016 — Accepted by Dolores Korf & Krista Garofalo, Treasure Coast Food Bank Mayor McPartlan read and presented the proclamation to Krista Garofalo. Ms. Garofalo cited some of the programs offered by the Treasure Coast Food Bank and invited the public to go to their website. Mayor McPartlan said the warehouse is always looking for food sorting assistance. 16.141 D. Proclamation — School Attendance Awareness — September 2016 — Mayor McPartlan read and presented the proclamation to Ms. Prescott. Ms. Prescott thanked Council for recognizing the importance of school attendance. Added Dr. Holly Hamilton announced the Hunt for Hope would be held on October I" in Riverview Park to raise awareness of inflammatory breast cancer. 16.062 E. Waste Management Recycling and Subscription Service Update and New Yard Waste Service Enhancements Presentation — Dina Reider-Hicks, Public Affairs Manager F. Ms. Hicks introduced Operations Manager Bob DeLaCruz, District Manager Casey Godwin, and Contracts Compliance Specialist Wendell Morris. Ms. Reider-Hicks displayed a PowerPoint presentation regarding increased recycling services provided by Waste Management. (See attached) Mr. DeLaCruz described the yard waste service that subscribers will receive. Discussion followed on the make-up service after a Monday holiday. Mr. Hill pointed out that there is a state mandate to reach 75% of recycled materials by year 2020 and the County is only at 37%. He suggested going forward there should be more recycling pickups and less garbage pickups. Mayor McPartlan asked if the tonnage has gone up in the garbage since the subscriptions have increased or is it minimized by the recycling. LV IV — I.VV V.III. at RIVCI VIQW rGlm— Mayor McPartlan announced there will be a ceremony in the Park, September 11, 2017. 2 Regular City Council Meeting September 14, 2016 Page Three Ms. Coy announced that on Thursday, September 22, Colonel Gary West who has been riding his bicycle from Maine to Key West to raise money for Folds of Honor that gives scholarships to sons and daughters of disabled and fallen soldiers, will be at the County line at 4:00 p.m. and be escorted down to Riverview Park to the Veterans Memorial. She asked the businesses and residents to come out and show their patriotism. CONSENT AGENDA All items on the consent agenda are considered routine and will be enacted by one motion. There will be no separate discussion of consent agenda items unless a member City Council so requests; in which event, the item will be removed and acted upon separately. If a member of the public wishes to provide Input on a consent agenda item, he/she should request a Council Member to remove the item for discussion prior to start of the meeting or by raising his/her hand to be recognized. A. Approval of Minutes — August 10, 2016 Regular Meeting 16.130 B. Resolution No. R-16-20 FAA Grant to Update Airport Master Plan (Transmittal, July 27 Transmittal, R-16-18, FAA Letter, Grant, R-16-20) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE A FAA AIRPORT IMPROVEMENT PROGRAM (AIP) GRANT TO PROVIDE FUNDING FOR AN UPDATED AIRPORT MASTER PLAN STUDY WITH AIRPORT LAYOUT PLAN (ALP) FOR THE SEBASTIAN MUNICIPAL AIRPORT; PROVIDING FOR CONFLICT; PROVIDING FOR EFFECTIVE DATE. 16.130 C. Waive Bidding Procedures and Authorize the Expenditure of $63,478.82 to xybix Systems, Inc. Approve Alcoholic Beverages for Ammons Event at Yacht Club on November 12, 2016 from 12:30 pm to 5 pm (Transmittal, Application, Receipt) Mr. Gillmor asked to pull item G and Mr. Hill asked to pull item I. MOTION by Ms. Coy and SECOND by Mayor Mc Partlan to approve consent agenda items A through F, H, and J through M. ROLL CALL: Ayes: Coy, Gillmor, Hill, McPartlan, Adams Nays: None. Motion carried. Item G Council Member Gillmor said there are some private citizens that have requested information from the contractor that should be addressed before extending the contract for five years. The City Manager said he was unaware of any public records requests made to the contractor. Mr. Gillmor cited Scientific American information and Ms. Coy noted that glyphosate is not in what Applied Aquatics is spraying. Mr. Gillmor said the herbicides are linked to harmful effects to human embryos and algae blooms and the alternatives suggested by folks should be considered. Mr. Hill noted the City's plan has been approved by the Florida Department of Environmental Protection (DEP) and everything is in line as it should be. Ms. Coy said herbicide company, Monsanto, made a bad decision to call Round Up Custom which is made for aquatic use the same name and noted it does not contain glyphosate. The City Manager explained while there is no biologist on staff; he is relying on the DEP's expertise that the herbicides are safe and recommended approval. MOTION by Mayor McPartlan and SECOND by Mr. Hill to approved Applied Aquatic Management's contract until September 5, 2021. Bob Stephen, 150 Concha Drive, said his scientist acquaintance has six alternatives to spraying the canal he lives on. ROLL CALL: Ayes: Hill, McPartlan, Coy Nays: Gillmor, Adams Motion carried. Item I Mr. Hill noted that no one signed up to serve on the policy committees. MOTION by Ms. Coy and SECOND by Mr. Hill to withdraw Item I from the agenda. ROLL CALL: Ayes: McPartlan, Adams, Coy, Gillmor, Hill. Nays: None Motion carried. 8. COMMITTEE REPORTS & APPOINTMENTS City committee reports and Council Member regional committee reports. No public input or action except for City committee member nominations and appointments under this heading. Ms. Coy reported that at the MPO meeting earlier in the day, the relocation of the Go -Line North County Hub at CR510 and CR512 was discussed. Mayor McPartlan said if there was better lighting and a few cameras at the bus stop it would reduce some of the problems. The City Engineer confirmed there was a study approved to look at a new, larger site. Mayor McPartlan noted even if the bus stop is relocated, the area is still desolate; lighting and a camera should still be considered. S Regular City Council Meeting September 14, 2016 Page Five Ms. Coy said at the Indian River County Commission meeting, there was an interesting report on how much money has been spent on stopping All Aboard Florida and the coming of the train should not be considered over. Mayor McPartlan also reported that street lights at Joy Haven and Concha are listed as a number four priority on the MPO's plan but number one with the City. 9. PUBLIC HEARINGS - None 10. UNFINISHED BUSINESS 16.049 A. The City Manager said the initial design called for millings but he and the City Engineer could tell that heavy equipment would be problem on the millings and recommended approval of the paving contract. MOTION by Mr. Hill and SECOND by Ms. Coy to award the paving contract to Preferred Materials, Inc. in the amount of $63,720 and authorize the City Manager to execute the same. ROLL CALL: Ayes: McPartlan, Adams, Coy, Gillmor, Hill. Nays: None Motion carried. 11. PUBLIC INPUT New information or requests to city council not otherwise on the prepared agenda Ben Hocker said in regard to the police evidence building to be considered at the Planning and Zoning Commission meeting the following night, the paper advertised that a 3,000 sq. ft. building was to be built and the agenda backup states a 30 x 100 sq. ft. building is to be built and asked when the increase was authorized. The City Manager explained once the design started, it was decided by the Chief and staff that at least a 30 x 100 sq. ft. building would be needed for the evidence and a larger, secured parking area. He cited the approval process, noting the public would have many opportunities to provide input. In regard to Mr. Hocker's comment about a Waste Management truck losing its load, Mayor McPartlan asked him to contact the City's hotline in the future. 12. NEW BUSINESS 16.149 A. Review Draft Revised Purchasing Manual (0-96-10, 0-06-01, Draft, Comparison) The City Manager noted one of the biggest changes in the draft policy is the increase of his spending authority to $25,000 and he was open to any suggestions. Mayor McPartlan asked if contract penalties should be in the manual. The City Manager explained that if a high liquidated damage number is put into a bidding document, the bidder will have to program that into the bid and the bid will be an artificially high bid. He said he has tried to get the lowest possible bid at the best value; and, he is rigid with liquidated damages. 5 Regular City Council Meeting September 14, 2016 Page Six Mr. Hill said each of the contracts come before Council and the damages can be looked at that time. MOTION by Ms. Coy and SECOND by Mayor McPartlan to approve the draft revised purchasing manual. ROLL CALL: Ayes: Adams, Coy, Gillmor, Hill, McPartlan. Nays: None Motion carried. 16.150 B. Award Right -of -Way Swale/Ditch Mowing Services Contract to Ace Landscaping and Pest Management in the Amount of $299.956 and Authorize the City Manager to Execute the Same (Transmittal, Summary, Agreement) The City Manager recommended approval. MOTION by Mr. Hill and SECOND by Ms. Coy to authorize the City Manager to enter into a service agreement contract with Ace Landscaping and Pest Management in the Amount of $299,956. ROLL CALL: Ayes: McPartlan, Adams, Coy, Gillmor, Hill. Nays: None Motion carried. 13. CITY ATTORNEY MATTERS The City Attorney noted the purchasing manual will come back in the form of an ordinance. 14. CITY MANAGER MATTERS 16.062 A. Letter from Waste Management The City Manager noted Waste Management's rate increase will be 9 cents a month. He also announced the first budget hearing will be September 19'" and include the Public Employees Association and Police Benevolent Association contracts on the agenda for approval. 15. CITY CLERK MATTERS 16.136 A. Announce Public Hearing for Ordinance No. 0-16-07 - Police Pension Will Be September 28, 2016 to Allow the Police Pension Board to Consider the Ordinance The City Clerk announced the date change for the public hearing. 16. CITY COUNCIL MATTERS A. Mayor Bob McPartlan i. Attendance Mayor McPartlan said it is up to Council to police themselves regarding attendance noting he is only responsible for himself and understands there are work commitments, family commitments and illness, but if they know they cannot come they should make the City Manager aware of it as far in advance as they can. He recommended no more than two excused absences, a possible pay reduction for missed meetings, and an attendance log should be kept to show transparency. He also suggested Council be prepared for each meeting and review tapes of missed meetings to ensure the smooth flow of the meetings. Regular City Council Meeting September 14, 2016 Page Seven Mr. Hill agreed and suggested when the City Clerk calls the roll, Council can decide if the absence should be excused or unexcused. Ms. Coy said she would feel a lot better if a reason is given publicly. Mr. Gillmor noted everything is public record, and could be relayed individually to them. Mr. Hill said he is comfortable with the way things are. Mayor McPartlan noted a Council Member has missed five of out 18 meetings since the election and an attendance log would help. Ms. Coy noted if they included non- attendance to the regional committees, there is cause for concern. She said she was concerned that that they couldn't address the Charter Review Committee's issue and there was no time to call for a special meeting. Vice Mayor Adams said he owes it to the public to explain his absence. He missed a meeting because he was sick and a second time because his (college exam) final was the same night. He said he takes his obligation very seriously and life happens; all Council Members know why they are there. Mayor McPartlan said he wasn't pointing any fingers; he was aware the Charter says Council will decide what is an excused or unexcused absence going forward. B. Council Member Richard Gillmor — None. C. Vice Mayor Jerome Adams — None. D. Council Member Andrea Coy Ms. Coy gave a special thank you to everyone who came to the 9/11 Ceremony. She also commended the citizens that tossed the hateful flyers handed out at the Ceremony by an individual. She said the community exceeded her expectations once again. She reminded everyone to come out and wave flags as Colonel West rides to Riverview Park on September 22. E. Council Member Jim Hill — None. 17.
