The City of Sebastian, Florida, has called a Special Election to take place in conjunction with its
November 3,2009 General Election for the purpose of placing a referendum question on the ballot as

Shall the City Council of the City of Sebastian be authorized to grant, pursuant
to s. 3, Art. VII of the State Constitution, property tax exemptions to new
businesses that create jobs and expansions of existing businesses that create

Polling Places within the City of Sebastian are established by the Supervisor of Elections for Indian

municipal election on Tuesday, November 3, 2009 for the purpose of electing
three (3) City Co~~ncil members for terms of two (2) years.
The official candidate qualifying period is August 20,2009 through September 4,
2009 in accordance with Section 4.02(b) of the City Charter. Candidate packets
are available in the Office of the City Clerk, City Hall, 1225 Main Street,

PUBLIC MEE'I'ING OF THE CITIES OF SEBASTIAN AND VERO BEACH CANVASSING BOARDS
AND CANVASSING OF ABSENTEE BALLOTS FOR THE
NOVEMBER 3,2009 MUNICIPAL ELECTION
The Municipal Canvassing Boards will meet at 3:00 p.m. on Wednesday, October 14, 2009 to conduct the
Pre-Election Day Public and Accuracy Test of the voting equipment and tabulating equipment to be used
for early voting and Election Day. This meeting will be held at the lndian River County Supervisor of
Elections office, 4375 43rd Avenue, Unit #101, Vero Beach, Florida, and is open to the public.
Sealed absentee ballots received prior to 1:00 p.m. on Friday, October 30, 2009 for the Municipal Election
will be available for public inspection from 1:00 p.m. until 3:00 p.m. on Friday, October 30, 2009, at the
office of the Supervisor of Elections.
Any absentee ballots received between 1.00 p.m. on Friday, October 30, 2009 and 7:00 p.m. Election
Day, Tuesday, November 3, 2009, will be available for public inspection at 4:00 p.m. on November 3,
2009, until opened.
Pursuant to section 101.68(2)(~)2, Florida Statues, if any elector or candidate present believes that an
absentee ballot is illegal due to a defect apparent on the voter's certificate, he or she may, at any time
before the ballot is removed from the envelope, file with the Canvassing Board a protest against the
canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to
be illegal. A challenge based upon a defect in the voter's certificate may not be accepted after the ballot
has been removed from the mailing envelope.
The Municipal Canvassing Boards will meet at 9 a.m. on Saturday, October 31, 2009, at the office of the
Supervisor of Elections, to open and canvass absentee ballots. The Canvassing Boards will reconvene
on Tuesday, November 3* at 4:45 p.m. to continue canvassing absentee ballots and canvass precinct
returns until the results of the election are obtained. The respective Board will certify its official election
as required by their respective charter. The Municipal Canvassing Boards will reconvene Thursday,
November 5, 2009 at 5:00 p.m. to certify the final official election results if all ballots have been
canvassed in accordance with section 102.141 (2), Florida Statutes and no other recount under section
102.166(1) is required.
The Canvassing Boards will randomly select raceslprecincts for the Post Election Audit at the November
3d Canvassing Board Meeting. The Canvassing Boards will reconvene to conduct the Post Election Audit
at 9:00 a.m. on Tuesday, November 10,2009, which will be made public on Tuesday, November 17,
2009.
It may become necessary for the Canvassing Boards to reconvene at times or places other than those
specified above. If so, the location, date and time will be announced at the conclusion of the pertinent
meeting, posted online at www.voteindianriver.com and posted on the doors at the lndian River County
Administration Building, the lndian River County Courthouse, and the Supervisor of Elections Office.
In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.
Note: Section 286.0105, Florida Statutes, states that if a person decides to appeal any decision by a
board, agency, or commission with respect to any matter considered at a meeting or hearing, he or she
will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a

The City of Sebastian is seeking proposals from licensed contractors to provide mowing
maintenance services for code enforcement lot mowing on an as needed basis.
The contractor shall be properly licensed in the City of Sebastian and shall show Proof of
Insurance to conduct its business with all licenses, permits, and certificates as required by
all local, State of Florida and federal agencies.
Qualified contractors interested in submitting a proposal may request a bid package with

Any proposals received without Public Entity Crime Form, Drug Free Workplace Form,

The City reserves the right to reject any or all RFP's, waive any informality or
irregularity on any proposal if considered non-substantial by the City, and/or cancel this

A hearing will be held before the Florida Public Service Commission in the above
dockets regarding the petition of Florida Power & Light Company (FPL) for a rate increase and
regarding FPL's 2009 depreciation and dismantlement study, at the following time and place:

August 25 - 28 and 31, 2009 and September 2 - 4, 2009, have also been reserved for the
continuation of the hearing, if needed. The starting time of the next day's session will be
announced at the conclusion of the prior day. The hearing will be adjourned early if all
testimony is concluded.
PURPOSE AND PROCEDURE
The purpose of this hearing will be for the Commission to consider FPL's petition for a
rate increase, FPL's 2009 depreciation and dismantlement study, and any motions or other
matters that may be pending at the time of the hearing. The Commission may rule on any such
motions from the bench or may take the matters under advisement.
This proceeding shall: (1) allow FPL to present evidence and testimony in support of its
petition for a rate increase and its 2009 depreciation and dismantlement study; (2) permit any
intervenors to present testimony and exhibits concerning these matters; (3) allow for such other
purposes as the Commission may deem appropriate.
This Commission is vested with jurisdiction over the subject matter by the provisions of
Chapter 366, Florida Statutes. This hearing will be governed by said Chapter as well as Chapter
120, Florida Statutes (F.S.), and Chapters 25-6,2517, 25-22, and 28-106, Florida Administrative
Code (F.A.C.).

The Department gives notice of its intent to find the Amendments to the Comprehensive Plan

4. The project is located in Indian River County, Section 13, 24, Township 31
South, Range 38 East. The permit authorizes a surface water management
system on 0.14 acres to replace existing culvert and headwalls under George
Street pipe and fill 20 feet known as George Street. The receiving water body is
Elkcam Waterway.
The file containing the application for the above listed permit is available for
inspection Monday through Friday except for legal holidays, 8:00 a.m. to 5:00
p.m. at the St. Johns River Water Management District (District) Headquarters,

Construction operations for the Collier Canal Project are now underway. Following are some informational
items pertaining especially to homeowners I residents along the canal north of CR-512. Please review and
take appropriate measures accordingly. As always, please do not hesitate to call the City (5895330) with
any questions, comments, andlor complaints regarding project activities.
In General
Homeowners should nw remove docks, electrical systems and components, and any other items
(including vegetation) of theirs now in the canal rightof-way and/or within the landward easement
(usually 10 feet landward of the existing seawall location) if they want to save such existing items for
their own reuse.
Upon timely request, the Contractor, working with the City, will visit and review any situation on a case-
by-case basis in an effort to minimize unnecessary damage to existing facilities. Project personnel will
try to give residents at least 24 hours advance notice of impending contractor activity at specific lots.
Docks
Unless docks are removed in advance by homeowners, existing docks now in place will be removed by
Contractor. Upon advance request, Contractor will place such removed docks in a temporary storage
location on homeowner's property for homeowner reuse at a later date. OtheMlise, Contractor will place
removed dock material in front of the residence at the street for pick-up and disposal by City crews.
Policies regarding replacement of docks are still in the formative stage.
Electrical
Homeowners I residents are required to disconnect and remove all electrical connections to irrigation
systems, yard lights, and existing docks within the canal right-of-way and easement areas.
lniaation Svstems and Drainaae Outfails
Contractor will remove and cap off any existing intake irrigation piping within the canal right of way and
within the landward easement. Homeowners I residents are responsible for removing any pumping
system components andlor other imgation system components within the canal right of way and
landward easement (including pop-ups andlor electrical wiring, etc.). Homeowners I residents are
cautioned that existing irrigation pumps may be damaged if they remain connected to a capped-off
inigation system.
Policies and arrangements for replacement of irrigation systems utilizing intake from the canal are
currently under discussion.
No drains of any type are allowed into the canal right-of-way, including any from pools, downspouts,
andlor water softeners.
Veaetation and Fencing
Contractor will remove existing vegetation and fencing as necessary for construction operations within
the canal right of way and landward easement. Homeowners I residents are responsible for the
removal I relocation of any vegetation andlor fencing they wish to keep before the contractor arrives to
work at that site. Replacement of such items is not in the Contractor's scope of work.
Contractor will post active construction zone areas. Such areas are off-limits to any other activity
unless prior permission /authorization is granted by Ci I Contractor. Residents are cautioned to
remain a safe distance from any construction activity at all times.

Second reading and public hearing of Ordinance 0-08-01 (annexation), second
reading and public hearing of Ordinance 0-08-02 (land use amendment), and second
reading and public hearing of Ordinance 0-08-03 (zoning amendment) will be held
on Wednesday, March 25, 2009, at approximately 6:30 p.m. in the City Council
Chambers, City Hall, 1225 Main Street, Sebastian, FL.
Following the public hearings, the City Council may adopt these ordinances to
annex the property as shown in the map below and generally described in the
ordinance titles above:

description of the property in the Growth Management Department at City Hall,
Monday through Friday 8 a.m. to 4:30 p.m. and may appear at the hearings and be

THE PLANNING AND ZONING COMMISSION OF THE CITY OF
SEBASTIAN, JNDIAN RIVER COUNTY, FLORIDA, HAS SCHEDULED A PUBLIC
HEARING IN THE CITY COUNCIL CHAMBERS, 1225 MAIN STREET,
SEBASTIAN, AT A REGULAR MEETING TO BE HELD ON THURSDAY,
JANUARY 15, 2009 AT 7:00 P.M., TO MAKE A RECOMMENDATION TO CITY
COUNCIL REGARDING A PROPOSED MODIFICATION TO A CONDITION OF
APPROVAL OF A SPECIAL USE PERMIT AND SITE PLAN. IN ADDITION, THE
PLANNING AND ZONING COMMISSION WILL CONSIDER A WAIVER OF
SECTION 54-4-21.3(b)(2) OF THE SEBASTIAN LAND DEVELOPMENT CODE.
RESOLUTION R-00-56 ADOPTED OCTOBER 25, 2000, APPROVED A SPECIAL
USE PERMIT FOR A CARWASH AT 921 SEBASTIAN BOULEVARD WITH
CONDITIONS. ONE CONDITION REQUIRED THE CONSTRUCTION OF A SIX-
FOOT WALL ACROSS THE FRONT (NORTH SIDE) OF THE PROPERTY. JOSEPH
KORUO, OWNER, HAS REQUESTED A MODIFICATION OF THE SPECIAL USE
PERMIT AND SITE PLAN TO ALLOW REMOVAL OF FOUR FEET OF THE WALL
WITH THE REMAINING WALL TO BE TWO (2) FEET IN HEIGHT. THE CR512
OVERLAY DISTRICT REQUIRES A FOUR-FOOT HIGH OPAQUE FEATURE FOR
USES WITH VEHICLE AND SERVICE BAYS.
ALL INTERESTED PARTIES MAY APPEAR AT THE HEARING AND BE HEARD
WITH RESPECT TO THE PROPOSED MODIFICATION TO THE SPECIAL USE
PERMIT, AND SITE PLAN, AND THE PROPOSED WAIVER.

The Sebastian Natural Resources Board will conduct a regular meeting at 6:00
pm on Tuesday, January 6th, 2009 in the City Co~~ncil Chambers, City Hall, 1225
Main Street, Sebastian, Florida.
Any person who decides to appeal any decision made by the Board with respect to any matter considered
at this meeting (or hearing) will need a record of the proceedings and may need to ensure that a verbatim
record of the proceedings is made, which record includes the testimony and evidence upon which the
appeal is to be heard (286.01 05 F. S.)
