The Employment Agreement between the Executive Director and the IRL Council specifically addresses the evaluation as follows: The IRL COUNCIL and EMPLOYEE will work together to mutually agree upon such goals and performance objectives which they determine to be essential for the proper operation of the IRL COUNCIL and progress towards attaining IRL COUNCIL's policy directives. All agreed-upon goals and objectives shall be realistic and have resources committed to be effectively implemented. During the Term, the Board will endeavor to evaluate EMPLOYEE's performance annually on or about the October meeting of the Board of Directors. The PARTIES will agree upon an evaluation format in compliance with applicable Florida laws. If the EMPLOYEE's performance is determined to be at least satisfactory based on an average score of all submitted evaluations, the Board may consider an increase in Base Salary or other Benefits in its sole discretion and subject to budget considerations. Any such increase shall not require a written amendment to this agreement provided a majority of the Board of Directors in attendance at the meeting vote in favor of such increase. The Milestone and Progress checklist (attached) illustrates our collective progress and productivity. It was also a challenging first year as we all responded to catastrophic water quality events and citizen concerns throughout much of the Indian River Lagoon. Ongoing IRL ecosystem challenges highlight the urgent need to move forward with the IRLNEP CCMP revisions in 2017. The positive findings of the 360° Performance Evaluation report were both gratifying and humbling. I want to thank everyone who participated. Responses showed that we have a strong and very passionate support community with a commitment to our vision and long- term success. Comments were in full alignment with our shared goal to focus and actions that will restore the IRL. Although the results of the report were overwhelmingly positive, I have reflected on opportunities for improvement in my self-evaluation (page 30 of report). I have integrated my thoughts carefully with the evaluation and comments from 41 anonymous individuals who responded to Ms. Allen's on-line survey. The following Table identifies some specific issues addressed in the 360 report and specific actions I will take to address those issues. The goal in Year 2 is to deliver those partnerships to assist CCMP revision, multi -agency project identification, and project funding. Goal 4: To identify and develop long-term funding sources for prioritized projects and programs to preserve, protect, restore and enhance the Indian River Lagoon. Actions for 2017 ® Successful completion of U.S. EPA 5 -Year Program Evaluation to ensure continued annual EPA funding. ® Work with Florida Congressional Delegation to secure Congressional appropriation funding for NEPs in alignment with 2016 Congressional reauthorization. ® Increase IRL License Plate revenues with strategic marketing campaign. ® Increase state funding for essential recurring needs. ® Restructure IRLNEP business model as follows: o Local IRL Council annual funds used for restoration projects and program administration. o IRL specialty license plate funds used for small grants program to be administered with assistance from Citizens Advisory Committee. o EPA Section 320 annual funds used for strategic IRLNEP program delivery of projects and initiatives. It takes courage and a genuine commitment to personal development to seek feedback from people all around - supervisors, peers, and direct reports. The questions and respondents are chosen by the person being evaluated and include key indicators of character and interpersonal success. Sometimes, as in this case, markers related to performance in the person's current professional position are included. Deep learning takes place for those who seek the honest feedback of others, especially in areas that contrast starkly with the individual's own self-evaluation. Audience: In most cases the only audience for a 360° Performance Evaluation is the person being evaluated. Respondents are motivated solely by their desire to help that person improve his or her performance by providing developmental feedback. In this case, the subject of the report, Dr. Duane E. De Freese, Executive Director, Indian River Lagoon Council/IRL National Estuary Program, made it known to potential evaluators that he would review the results with Council and with staff. Evidence that respondents were conscious of the public nature of the report can be found throughout, both in their ratings and in their comments. Method: Evaluations were collected in October and November, 2016 from 10 members or alternates of the IRL Council, 21 IRL Council/NEP local partners, and 11 IRL Council staff, service consultants, or county primary contacts. The partners/ peers category included three long-time colleagues from the scientific community. Online surveys were returned to Cathy Allen of The Board Doctor, LLC for compilation. All individual rankings are confidential and will not be shared with Dr. De Freese or with anyone else by Cathy Allen. Individual scores for each indicator within a category (such as Knowledge/Strategic Thinking) were averaged within the groupings (Council, Partners/Peers, Staff). All verbatim comments are presented as they were submitted by the respondents, except as edited to preserve confidentiality or to improve readability (spelling and grammar.) Discussion: This study was characterized by an unusually high number of "straight tens." Because there are a variety of ways to interpret such an evaluation, Cathy contacted four respondents who provided the following explanations for their perfect scores: ® I've had the pleasure to work with numerous management, scientific, and environmental professionals during my career. I can honestly say that Duane is truly exceptional... I don't give my responses to the 360 lightly. We are very lucky to have him in this role. (Peer/Partner) ® 1 was expressing maximum support for Dr. De Freese and his staff. I am not involved in the details of his efforts but from what 1 can tell he has done everything right even if it hasn't worked out like he wanted. (Peer/Partner) -2- He is the absolute right person at the right time. He brings so many right angles to the equation.... I don't know of anyone else who could put all of the connections together that he has. He's the guy. I don't want anyone to be able to say "I know someone who could do better." Duane needs to do this. (Peer/Partner) The guy has gone above and beyond in every category. He started about three weeks before he was collecting a paycheck. I could have given him an 8 or a 9 or some of those, but does he deserve that? No, he deserves a 10 up and down the line. He comes up with his own mission and goals and it is always in alignment with where we want to go. (Council member) Similar comments were made by other respondents throughout the survey. So, while the evaluation may have less value as a development tool than it otherwise might have, it is clear that - in aggregate - the participants highly value Dr. De Freese both as a person of high integrity and as a person with the exceptional skill set needed for the important work they are eager to see done well. Though many respondents appeared to have been reluctant to provide any criticism that could in any way harm Dr. De Freese's relationship with Council or with the public, most did provide developmental feedback which, if well-received by Dr. De Freese, has the potential to assist him to improve in key areas of his performance. ' Three indicators in the Team Building/Managing Others section received scores comparable to the lowest reported above (8.6-8.7). They are not included here because respondents in all three categories commented they were not familiar with Dr. De Freese's management style. He is an effective leader and exactly what we need for this community. C Duane has a very, very good understanding of the Lagoon and its needs. He has organized the program to maintain a focus on those needs. C Duane is a self -motivated, goal -oriented individual. C Duane's first year has been extremely tough. The politics are horrendous and he is getting "help" from all sides. He is trying to make everyone happy, but there have been times when he has not followed protocol, trumping the selection committee, which is not a good precedent or good use of Council funds. IRL Council ILEP Local Partners P Extremely knowledgeable and committed. Duane is a perfect fit for this position. Sometimes his vision may get a little too far outside the box before establishing the success of basic strategies. P Duane is uniquely suited for this position having a background in science, public service, private corp. and conservation. WON P I have never seen a person more committed than Duane. He has attended countless meetings, sacrificing nights and weekends to get the message out that the lagoon needs help. Now. P He is eloquent and well respected in the community, able to talk to school kids as well as corporate heads. P Duane is still identifying strategies to effectively navigate the highly political arena to address very challenging ecological problems. I believe he will continue to fine tune his strategy and allocation of resources as time goes on. He partners extremely well, leveraging funds and expertise. P I think the new NEPs guiding principles are still evolving P As Executive Director, Dr. De Freese has managed to put together a functional IRL Council, providing regional voice to the stakeholders of the lagoon. He has been visionary in engaging the scientific talent of the region as well as industry leaders. He is an excellent speaker and is open to a balanced view, very accessible and adept at navigating the politics. P "8" = 1 believe so, but I don't know P Any lower scores are because I don't know his day-to-day activities well. P Demonstrates the clearest vision for the IRL that I've heard. Also seems to have critical character traits of genuine enthusiasm and exceptional patience for dealing with difficult personalities. P Duane is a good listener, has a strategic mind and is enthusiastic regarding the mission of Saving the Lagoon. P Waste and barriers questions are not Duane's fault. The Council is not as visionary as Duane. P I want to see progress on the update of the NEP comprehensive plan. Essentially a year has passed since the NEP reorganization and this important work has barely begun. Brevard County developed a 10 year plan for their portion of the Lagoon in a few months. P I greatly respect the inclusiveness of the new IRLNEP that has reached out beyond the traditional Lagoon supporters. However, this inclusiveness comes with a cost of slow motion. I would like to see a greater sense of urgency. IRL Council Staff, County Primary Contacts, Service Contract Providers S It is too early to judge the organization on the basis of its mission, vision and strategy or to judge Duane's ability to implement tactics to achieve the goals set by the organization. P I strongly support Duane's approach of trying to get a long term commitment of Land and Water Legacy Amendment funds for the Florida Estuary Programs. Perhaps this will be a priority of the next legislative session. P Much of Duane's effort so far has been organizing the IRLNEP to prepare for future action - such as the three advisory committees. His performance as an organizer has been impressive. Too soon to judge his performance regarding water quality. S The new management structure is still in its infancy. Perhaps this will be a priority of the next legislative session. P Much of Duane's effort so far has been organizing the IRLNEP to prepare for future action - such as the three advisory committees. His performance as an organizer has been impressive. Too soon to judge his performance regarding water quality. S The new management structure is still in its infancy. Hopefully, the structure of the management conference will lead to exceptional performance. S There certainly have been emergency situations to respond to between fish kills and algae blooms. S He is good at selling the IRL and recruiting partners. I'm mainly thinking of industry partners - Port Canaveral, Harris Corp., etc. This is thinking outside the normal environmental box. S Confident public speaker; knowledgeable in his field; excellent at networking; understands the politics which surround the program and works well to find opportunities and mitigate damages; he is genuine in his efforts and takes his job seriously. -28- S Duane's diverse career experience allows him to easily work with public and private sector representatives, and encourages a broad partnership on the IRL Council and NEP. S He is adept at understanding the political framework for making a coalition of disparate sectors work toward a common goal, and his technical background provides credibility to the Program's actions. S Duane is a 'big thinker', which provides the Program with innovative concepts to address the complex issues of IRL, including funding strategies. He also seems to be very good at following up on these ideas. S He is very approachable to colleagues and scientists from outside the IRL region. S He is a thoughtful leader, who exudes confidence drawing from his life experiences and shows his passion for the environment. He is inclusive and patient but not afraid to take on major challenges. S There are a few things I particularly appreciate about Duane. First is his ability to see an issue from the 50K foot level and then focus in on it to see how the program can best address it. S I also appreciate the good mix of scientist, program manager and politician in Duane. The ability to walk in all worlds has been a distinct benefit to the program and makes him uniquely qualified as a leader. S Duane has also built a good team around him and is effective at involving them in decisions, keeping them engaged, making them feel heard, and sharing credit with them. S I have experienced very productive conversations with Duane that have been extremely effective at collective problem solving. Duane's willingness to hear others' ideas and talk through them is something I particularly appreciate. I also appreciate his common sense, flexible approach that focuses on the big picture of getting good things done for the IRL. Duane also has remarkable patience in dealing with some very challenging personalities. -29- De Freese Self -Evaluation D Needs to: - Communicate more often and more effectively with individual council members and IRL NEP management conference volunteers. - Articulate more clearly how the IRL NEP Management Conference will work to deliver effective network governance, CCMP revision, bold vision and behavior/culture change among conference participants. - Identify clear pathway and actions to create and sustain volunteer ownership and engagement. - Build a closer connection to 5 counties and 45 cities to understand opportunities; identify challenges and build trust. - Generate more unrestricted revenue. Program is understaffed and under funded. D De Freese sets BHAGs that are often difficult to achieve. IRL Board Members and Alternates C Needs to work out of the box more on funding opportunities. C Push for IRL to achieve specific programmatic systems and procedures, so staff time is more effectively employed in evaluating compliance in meeting grant requirements by noting variances. C Work with Board. C I get the feeling that management of the council and management board could improve. But I have not particular suggestion except to clone Duane, or see if Frank or Kathy can pick up some of the load. I know they are fairly inundated too. C Duane could work on being more concise with personal presentations and discussions. A lot gets packed into council meetings. C Duane's dedication and overzealous nature could be hazardous.... to his health! :) C His main area of improvement is to be conscious of his ability to talk for a long time without pause. C I would like to see fewer meetings and more lead time with back up documents so there could be less explanation needed during the meetings. A consent agenda would be helpful in facilitating this. C Expand the comfort zone slightly. C Now that Duane has created a successful council and committee structure, we need to move quickly into the project phase to start seeing tangible results. I am confident that with Duane's leadership, that will happen. -30- C He needs to slow down and recharge his batteries on a regular basis. I don't want him to get burned out. C He needs to trust his "Team". He is not an expert in Project Management and/or project construction, etc. Therefore, he needs to rely on those experts when it comes to ranking and funding projects. C He needs to understand the discrepancy between the North and South stakeholders in the Lagoon and bring them closer together. IRL Council ILP Local Partners P Prioritize. P Focus. P Less Flash. P Build upon basic successes first. P Communication with stakeholders. P Coordination with NGOs. P Duane probably needs to delegate more so that he is not stretched so thin. P Salesmanship and education of his board on the vision and priorities of the Indian River Lagoon program. P Learn how to say no sometimes. Don't take on more than you can handle. In addition to taking an occasional trip out of the country to relax, make sure to take some time in between to just do nothing. You have to get some rest. P If you've told someone you will do something, if you find that time is slipping by and you can't get to it, let them know that you're maxed out and will get back to them when you can rather than no response for a few days. They will understand. That way they're not just out there wondering if you forgot about them. P Unsure of any. P The hardest challenge will be to focus on some aspects of the IRL problem that can be addressed effectively, including recognizing that research provides information and identifies potential strategies to address problems, but needs to be implemented in a non -research approach to enable the action needed for a solution. P Duane is really committed to get all involved, but sometimes he just needs to act and use his best judgment to move forward. P He needs to be a really public figurehead for the NEP that people get to know and trust. That requires shining the spotlight a little more on him. P In one on one conversations it is sometimes hard to get a word in. P Lots of issues, lots of stakeholders, lots of committees - need to bring focus to priorities and goals and engage the stakeholders to focus and help achieve those goals. P Maybe slow up a little on the presentations and travel, perhaps replacing some of this with social media outreach, webinar interactions, especially for the educational aspects. P Make a great interactive website. -31- P Enlist volunteers. Get more help with outreach. Identify skills and knowledge available through committee members and use them to manage more or assist in tasks (especially with management plan). P Work with the other estuarine preserves and form more partnership there if possible. P We still have some process and transparency issues to work through in terms of relationship between the management committee and the council and making sure all available information is available to the public in a timely manner. P At some point we need to pivot into agreed-upon priorities and action steps toward those priorities rather than the perception of lurching from crisis to crisis. P Duane is at this point still the cheerleader in chief, but at some point we need to pivot to action steps. The awful difficulty now is there is only one of Duane and insufficient staff to get the real work done. P Areas of improvement: 1) Would have liked to have received a written statement about Duane's accomplishments prior to filling out this evaluation. I would like to have a summary of what Duane feels are his top accomplishments. 2) Duane has many priorities on his plate and there are a lot of expectations that Duane needs to fulfill. I would like to see a set of future goals he would like to achieve for the next 12 months. P Needs to split himself into three... P Not had any negative experiences or seen any weaknesses to comment on. P Please understand that my comments below are from a colleague who understands the overall objectives, but is not familiar with the day-to-day or personnel issues. 1. Duane might try to solve too many things himself, as opposed to delegating. 2. Be more involved with general PR, e.g., press releases to newspapers, reaching out to talk to the media. 3. Without much basis, I think there ought to always be present a clear statement of IRL/NEP goals and objectives -- in a form that could be put on a 3x5 card. And it shows its presence at every meeting. Yes, it would continually change over time. 4. Keep a large number of people (researchers, volunteers, other agency folks, organizations, government officials, the press...) informed through a newsletter and/or blog and/or Facebook page...). Public (in the broad sense), awareness and public education may be Duane's biggest weapon for effecting change. I am not aware of such programs. P As Duane well knows, a big part of cracking this environmental nut involves a really strong PR message. He has attempted to develop a stronger PR machine and been thwarted by petty bureaucrats. I would recommend he employ bureaucracy kryptonite if I only knew what that was. -32- P Again, we are early in the process but the use of the advisory committees has been minimal to date. Hopefully that will change soon. P Taking on too much with minimal staffing is tough. The organizational structure has grown quickly. Keeping all engaged and moving forward competes with organizational growth. Perhaps narrowing the scope of specific accomplishments for the next year might help? P I doubt that Duane could improve because his performance is simply outstanding. Time management is an area where all of us can do better. Duane seems to do well managing how he spends him time, but he probably could do even better. P I worry about burnout becoming a problem for Duane. I was not involved directly, but I have been told that Duane burned out in his EEL Program position. Almost everyone thought that Duane was doing an outstanding job, but he surprised many with his resignation. Some close to the program in those days thought that Duane was tired of the political battles at the County level. P In my opinion, the key element here is his ongoing relationship with the IRLNEP Council. I believe he has an excellent relationship with the current Council members, but the composition is about to change and it will keep changing over time. IRL Council Staff, County Primary Contacts, Service Contract Providers S Foster real and effective collaboration. S Sell less, listen more. S Not much. Duane has been an excellent ED. S Sometimes the level of detail and information is too much and the board gets bogged down in the details vs. providing general policy guidance. S Duane could be stronger in some of his recommendations. The board respects him and his judgment. The benefit to the IRL will only grow if Duane pushes his thoughts and ideas and doesn't get stuck just meeting the day-to- day demands of the organization. S Duane can't be everywhere all the time. He is so willing to speak and help anyone who asks. S I really can't think of much. Duane works very diligently to paint a vision and sell his perspective. He's extremely convincing which is wonderful. Sometimes, it appears he has his audience at "hello" yet they get the entire pitch anyway. If he can learn to read when the sell is easy, he can save some time and energy for the next challenge. S This is selfish on my part but better communication. If you can't get to a communication because of lack of time, delegate it to staff. Now - I am unreasonably saying this because Duane only has a thousand people who want something from him. -33 - S Duane works every day, evenings included, which will take a toll eventually. I recommend reducing his evening speaking events, and taking at least one full day per week "unplugged" and "offline". S With his experience and 'big thinker' ideas, Duane sometimes can tend to dominate a discussion. S The IRL Council/NEP is severely understaffed, especially given the many critical tasks associated with starting up a new NEP, convening a new Management Conference, and addressing the immediate and long-term issues of IRL's environmental condition. It is extremely important for the long- term success of the program that Duane make a successful case for adequate staffing to meet the expectations placed on him and the rest of the staff. S Just continue to champion the effort to improve the water quality in the Indian River Lagoon. S Duane is both very accessible and very busy, and it sometimes makes me wonder if he's over -committing. He has been very effective at becoming the public face of the IRLNEP, but perhaps he and the team need to reflect a bit on when and where Duane should be used to best effect (big events, large audiences, scientific meetings, etc.), and when a meeting or talk should be delegated (small audiences, community group meetings, etc.). S One thing I've noticed is that every now and then, Duane's enthusiasm for explaining something overtakes the interest his audience has, and he's sometimes not aware that they've glazed over and aren't listening any longer. I think his presentations at meetings and talks would benefit from concentrating on the big ideas and going lighter on the details. S In the words of Stephen Covey, seek first to listen, and then to understand. S I can't list anything more than that. Appointment New Member to Indian River Lagoon Council Chairman Gillmor and Mr. Tyson nominated Mr. Winger. There were no objections. Mr. Winger will serve as the Coalition's new chairman. It was noted the next Indian River Lagoon Council meeting would be November 18 in Sebastian's Council Chambers. Mr. Gillmor reported that Sebastian's new representative on the Coalition would be appointed at the November 16th City Council meeting. Discussion followed regarding the interest of Indian River County's Commissioners to join the Council. Mr. Gillmor commented that now that the Council is up and operating, the County should take a seat on the Council but there was not unanimous support of the Commissioners. Chairman Winger asked if the Coalition Chambers. The Coalition will continue upcoming November/December Coalition projects for submittal to the Council. could continue to meet in Sebastian's Council to meet in Sebastian. Mr. Gillmor said the meeting would be important to identify their Indian River Lagoon Coalition Meeting October 24, 2016 Page Two Mr. Tyson asked how the Coalition would end if the County agreed to sit on the Council. Mr. Gillmor said Indian River County's seat would have to be unanimously approved by all of the counties, the water management districts and the Environmental Protection Agency; then, the Coalition would be abolished and their entry fees would be refunded. 5.
