CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor McPartlan called the regular meeting to order at 6:00 p.m. 2. Former Mayor Richard Gillmor gave the invocation. 3. The Pledge of Allegiance was recited. 4. Presentation of Plaque to Former Vice Mayor/Council Member Jerome Adams - 2012-2016 Mayor McPartlan read and presented a plaque to Mr. Adams. 16.026 B. Presentation of Plaque to Former Mayor/Council Member Richard Gillmor— 2013- 2016 Mayor McPartlan read and presented a plaque to Mr. Gillmor, Brief Announcements • Craft Club Show in Riverview Park — Sat. Dec. 17 & Sun. Dec. 18 from 10 am — 3 pm Mayor McPartlan announced the Craft Club Show in Riverview Park December 17 and 18. Regular City Council Meetlng December 14, 2016 Page Two CONSENT AGENDA A. Approval of Minutes — November 23, 2016 Regular Meeting 16.014 B. Approve the Application Process and Accept the 16/17 Florida Justice Assistance Grant in the Amount of $3,904 to Purchase Law Enforcement Equipment (Transmittal, Letter) 16.011 C. Approve Indian River County Historical Society's Mullet Fry Event at the Working Waterfront on Sunday, February 4, 2017 from 12:00 p.m. to 2:00 p.m. (Transmittal, Flyer, Letter) 16.192 D. Approve the Purchase of Two 2018 Freightliner Dump Trucks from Lou Bachrodt Freightliner Under Florida Sheriffs Association Contract #FSA16-VEH14.0 in the Amount of $233,254. No public input or action except for City committee member nominations and appointments under this heading. 16.074 A. Planninq and Zoning Commission (Transmittal, Applications, Ad, List) i. Interview, Unless Waived, Submit Nominations for One Regular Member Position with a Term to Expire November 1, 2019 ii. Interview, Unless Waived, Submit Nominations for One Alternate Member Position with a Term to Expire November 1, 2019 Mr. Dodd nominated Mr. Alvarez to move up to the regular member position and have Mr. Simmons serve as the alternate member. Ms. Kinchen seconded the nomination. There was no objection from City Council. Mr. Alvarez will serve in the regular member position until November 1, 2019 and Mr. Simmons will serve as alternate until November 1. 2019. 9. QUASI JUDICIAL PUBLIC HEARING 16.193 A. Resolution No. R-16-34 Abandonment of a Portion of the Public Right -of -Way for First Street (Taft Street) Between High Street and Old Dixie Highway (Transmittal, R-16-34. Staff Report, Site Maps, Application) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ABANDONING A PORTION OF THE PLATTED RIGHT-OF-WAY FOR FIRST STREET (TAFT STREET); ESTABLISHING A FLORIDA POWER & LIGHT EASEMENT; ESTABLISHING A UTILITY AND DRAINAGE EASEMENT; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. %A Regular City Council Meeting December 14, 2016 Page Three Mayor McPartlan opened the public hearing at 6:07 p.m. and the City Attorney read the title of Resolution No. R-16-34. There was no ex parte communication to disclose by City Council. The City Clerk swore in those who planned to offer testimony. The Community Development Manager said this was a request from Mr. Welsh and Mr. and Mrs. Weber to abandon 260 linear feet of a 50 foot wide right-of-way that runs east to west between Old Dixie Highway and High Street. The property owners agreed to establish a 10 ft. FPL easement and a 15 ft. public utility/drainage easement. Staff recommended approval because of the 16 ft. elevation difference between Old Dixie Highway and High Street and there is no purpose for the property since it cannot have a structure. Mr. Hill noted it would increase the value of the property. The Community Development Manager explained the property would be put back onto the tax roll; the elevation was not the same on High Street as Sebastian Blvd; and the northern part of Old Dixie goes down and was abandoned for stormwater retention. There was no one to speak in favor or opposition of the request. The City Attorney said he would like to add a "whereas clause" that Council finds no monetary value attached to this property. MOTION by Ms. Kinchen and SECOND by Mr. Dodd to approve Resolution R-16-34 with the addition of "(5) no monetary value" to Section 2 of the resolution. The City Attorney advised the applicant did not need to address City Council. ROLL CALL: Motion carried 4-0. Mr. Dodd — aye Ms. Kinchen — aye Ms. Coy —absent 10. PUBLIC INPUT New information or requests to city council not otherwise on the prepared agenda Bruce Zingman, Sebastian, thanked the Mayor, Public Works staff, City Administration, the Indian River County Sheriffs Department, the GFWC Sebastian Senior Woman's and Junior Woman's Clubs, the Sebastian Property Owners, the Chamber of Commerce, and all the participants for the Christmas Parade. He noted Santa will be in Riverview Park on Saturday, December 17 from 2:00 to 4:00 p.m. 2. NEW BUSINESS 16.194 A. Authorize Continuing Services Agreement #1 to the Schulke, Bittle, & Stoddard, LLC Continuing Engineering Services Agreement to Provide Engineering Design for Friendship Park Improvements in the Amount of $43,700 (Transmittal, Schematic, CSA 1, Scope) Regular City Council Meeting December 14, 2016 Page Four The City Manager said the Parks & Recreation Advisory Committee recommends building eight pickle ball courts in Friendship Park. MOTION by Mr. Hill and SECOND by Ms. Kinchen to accept Schulke, Bittle, & Stoddard's Continuing Services Agreement #1 and authorize the City Manager to execute the appropriate documents. Mr. Dodd said there is a possibility that the City might have to acquire land but won't know until after Phase I, and he would like to see a stop after Phase I to see if a land purchase is necessary. AMENDED MOTION by Mr. Hill and SECOND by Ms. Kinchen that if the City Manager finds that a land purchase is necessary, he will cease operations and come back to Council. ROLL CALL: Mr. Hill - Aye Ms. Kinchen - Aye Mayor McPartlan — Aye Mr. Dodd —Aye Motion Carried 4-0. Ms. Coy - absent 16.173 B. The City Manager said he was proposing that the CRA Septic to Sewer Grant Program be amended to award recipients $10,000 that would come from the Indian River Lagoon National Estuary Program Grant and $5,000 from the CRA budget, which would give 20 applicants the ability to hook up. Mr. Hill asked if the CRA would decide how it is divided up --2/3 from the City and 1/3 from the CRA. The City Manager said the grant would be up to $15,000 with the applicant paying what is remaining after the $15,000 award or receiving less, if appropriate. The City Attorney advised the division of funding source would be decided at the time of application and when the money is expended. He also advised that Council was giving the CRA more latitude by increasing the grant award and the CRA would review applications. The City Manager said there is a two year sunset on the grant and the City would contact the folks who are eligible to apply. The City Attorney noted Mr. Hill's comment on dividing the funding source would apply during the two year period. MOTION by Mr. Hill and SECOND by Mayor McPartlan to approve staffs recommendation The City Manager said 61 properties are eligible; he was using a previous applicant's cost to determine the grant amount; he recommended accepting applications from those who previously applied but backed out because of the remaining cost. The City Manager said the City has received the request for reduction and after consultation with Code Enforcement and Community Development Departments he recommended denying the request. MOTION by Mr. Hill and SECOND by Ms. Kinchen to move staff recommendation to deny the request. Kirk Lang, owner of the property asked why the interest could not be waived. Mayor McPartlan explained sometimes that has happened, but Council will take a vote on a case-by-case basis and in this case, the City has taken care of the property for many years and should be paid back for the money laid out to perform services on the property. CITY ATTORNEY MATTERS The City Attorney wished Council a happy holiday season. 14. CITY MANAGER MATTERS The City Manager asked Council if they wanted him to present any items to Indian River County Legislative Delegation Chairman Debbie Mayfield for consideration by the legislature. Council asked the City Manager to convey their concern for preserving the Lagoon, assist with sewer connections, and consider the position of small municipalities when considering any unfunded mandates. He wished everyone a Merry Christmas. 15. CITY CLERK MATTERS 16. CITY COUNCIL MATTERS A. Council Member Ed Dodd Mr. Dodd reported that he attended the MPO meeting earlier in the day and provided the other Members with a copy of the north County bus transfer station backup in case they receive calls from the public. B. Council Member Jim Hill - None C. Council Member Linda Kinchen Ms. Kinchen said she appointed Sergio Mote as her representative to the Citizens Budget Review Advisory Committee. He said visitors are impressed with the City. He wished everyone a Merry Christmas and Happy New Year. E. Vice Mayor Andrea Coy - Absent 17.
