The design of the lakes was approved by City Council at the preliminary plan approval. The amount of material which must be excavated for the lakes exceeds the requirement for fill on the property. Therefore, fill must be removed from the site. The amount of fill to be removed is approximately 40,000 cubic yards. Since the amount of fill to be removed from the site exceeds 5,000 cubic yards, the proposed activity is, by definition, a sand mine and requires a permit. The Planning and Zoning Commission has recommended approval with conditions. RECOMMENDED ACTION Hold a public hearing and approve Resolution R-98-25. The areas to be mined are for future on-site drainage retention lakes. According to the Land Development Code Section 20A -5.22(f), excavation of greater than five thousand (5,000) cubic yards requires a sand mining permit. Compliance and restoration bonds shall be posted to ensure that the site is developed, operated, and restored in conformance with the approved mining site plan. The compliance bond can be assessed as a penalty only to violations of site plan approval that are chargeable to the mining permit holder, and those under his supervision, direction, or control. The restoration bond is to provide funds to restore the site. 2. Amount. The compliance bond shall be posted in the amount of one thousand dollars ($1,000) per acre of project site with a minimum of five thousand dollars ($5,000). The restoration bond shall be posted in the amount of one thousand dollars ($1,000) per acre of excavation with a minimum of five thousand dollars ($5,000). City Engineer's review: The proposed sandmining permit is acceptable to the City Engineer. Other Matters: The staff does not find the mining permit to be detrimental to the public safety, health or welfare or injurious to other properties or improvements within the immediate vicinity in which the property is located; and The use requested is consistent with the purpose and intent of the respective zoning district, and can be demonstrated to be similar in nature and compatible with the uses allowed in the zoning district. 8 29. The planning and zoning board has adopted this staff report and recommends approval to city council. 31. Recommendation: Staff recommends the city council approve the sandmining permit for Collier Club with the following conditions: 1. The hours of operation shall be 7:00 A.M. TO 5:00 P.M. Monday through Friday. This includes excavation and hauling of material from the site. 2. The property to be excavated shall be posted "no trespassing". 3. The required compliance and restoration bonds shall be posted. 4. Applicant shall provide permanent project boundary comers, with intermediate stakes at a minimum of three hundred feet and all limits of excavation shall be staked, marked and maintained with visible flags in the field, in accordance with approved plans for the permit.
