Our firm represents Collier Place, a development bordering on the
Sebastian Golf Course and airport. I would appreciate if you
would send to me a copy of the latest draft of the City's
Comprehensive Plan.
My client is particularly concerned that additional regulations
may be added to the Comprehensive Plan that would restrict
development adjoining the Sebastian Airport. My client has
acquired the Collier Place property in reliance upon his ability
to develop said property according to the initial approvals
received. I understand that there was an attempt at the last
City Council meeting to add additional restrictions which
restrictions were rejected. I would appreciate being advised of
the dates of other hearings where this matter of regulating
properties adjoining the airport would be discussed.
This letter shall constitute an objection to any additional
restrictions that would affect the land abutting the Sebastian
Airport and most particularly the Collier Place property.

Gentlemen:
I have seen the conceptual development plan for
the above and I feel that their proposal for and temporary
access road through the golf course property is not in the
best interest of the people of the community. Not only
will disrupt the course but,why tear up the property?
They can gain access from Roseland Road at a
point a little farther south and will disturb no one (Mr.
Cooper said they did not want that access becasuse they
would have to bridge a small area to gain access to the
part of the project where they want to begin. They will
have to bridge it sooner or later, so why not now,and, it
would remove the problem of destroying the golf course
property.
I also question the plan to build in the area of
the first green,second hole and the third tee. There is
an area in there where the Sandhill Cranes nest and, to
destroy this area would endangerTiie future of this lovely
species.
Mr. Cooper states that there is no way to deny
them access by the way of Wimbrow Drive, however, I still
feel that this is not in the best interest of the citizens
that have built some of the most expensive homes in the
city.
Since Sebastian is one of the fastest growing
cities, I feel that a great deal of thought should be
given to the impact it will have on the city and the
citizens and the pros and cons be THOROUGHLY examined.
We have no water or sewer system and, a great
deal of consideration should be given in that area and,
possibly a moratorium on all large developments should be
given very serious thought, until such time that a plan
has been designed to protect our health.

Mr. Ted Preston of Alpha investments has petitioned the City
of Sebastian to rezone a 158 acre parcel of land that borders
the S.W. property of the City's golf course. This property
is know as the Collier Place P.U.D.
Presently, the property is zoned RS -20 (Residential Single
Family, 20,000 sq. ft. minimum lot size) and the applicant is
requesting to amend the zoning classification to P.U.D.-R
(Planned Unit Development - Residential). The applicant is
also requesting approval of the conceptual development plan
for Collier Place, a Planned Unit Development.
The Planning & Zoning Commission has reviewed and held the
required public hearing for the proposed zoning amendment_ and
conceptual plan and has recommended to the City Council
approval of the petition with several conditions.
Reviewing Section 20 A-11..6 (D) of the Land Development rode
(procedures for zoning amendments), the City Council shall
consider the petition after receiving the Planning and Zoning
Commission's recommendation of approval for any zoning
amendment. Should the Cit.v Council tentatively .approve the
petition, a public hearing shall be held on the petition.

With the applicant's proposal requiring a zoning amendment
which necessitates an approval by ordinance and the City
Council policy of all ordinances to be on a workshop agenda
first, staff will be prepared to make any presentations that
the City Council deems necessary in order for you to
tentatively approve the petition.
Presuming the City Council will tentatively approve the
petition, staff recommends the following schedule:
April 5, 1989 City Council Workshop - Direct
City Attorney to draft ordinance
approving petition with conditions
outlined in Planning & Zoning
recommendations.
April 12, 1989 Regular City Council meeting -
"Tentative" approval by City
Council by Resolution.
April 26, 1989 1st Reading of ordinance and set
public hearing date. (Advertisement
of notice must be at least 30 days
prior to public hearing).
June 14, 1989 Public hearing, 2nd reading and
adoption of ordinance.

Dear- Mr. McClary:
This is to confirm our understanding with regard to the
meeting which was held January 6, 1989 on the above
referenced project. The minutes of the meeting are outlined
as follows:
1.) Earl Masteler of MASTELLER & MOLER ASSOCIATES
opened the meeting with a status of the project, as
well as an overview of the proposed allignment and
Right—Of—Wav of the Roseland Road and Wimbrow Drive
Connection.
2.) Mr. Jim Davis, Indian River County Public Works
Director, expressed concern as to the ownership of the
100' Right—Of—Way as shown on the plan. Mr. Bruce
Cooper, City of Sebastian Building Official, concurred
that a title search should be performed and, the results
submitted with revised plans. It was agreed this will
be done.
'.) Mr. Robert McClary asked if the concerns of the
residents along Pono[.a Street had been addressed. Mr.
Masteller^ related discusions that MASTELLER & 11101 -ER
ASSOCIATES has Had with these residents and that their
concerns will be addressed with Landscape Buffers to be
constructed during the Land Development Phase.
4.) Mr. Davis expressed concern about the possible need
for a South Bound Left Turn Lane at Hart Ave and
Roseland Road. Mr. Gary Roberts, Traffic Consultant
with Keith and Schnars, related that the need for turn
lanes will be delineated in the Traffic Impact Study,
which will be performed in the Preliminary Design Phase.
5.) Mr. Davis suggested that the Home Owners
Association of Roseland Gardens will need to approve the
construction on Hart Ave. through grant of easement of
Right—Of—Way dedication.
The meeting ended with the under;standino that the revised
plan will be submitted under the original application.

Pursuant to Section 20A-2.6 of the Land Development Code of the City of
Sebastian, this is to inform you that the City Council of the City of Sebastian,
Indian River County, will hold a Special Meeting to conduct a Quasi -Judicial
Public Hearing on Wednesday, June 17, 1998, at 7:00 p.m. in the City
Council Chambers, City Hall, 1225 Main Street, Sebastian, Florida, to
consider adopting a resolution regarding an application for a sandmining
permit for the Phase I subdivision construction of Collier Club, a residential
planned unit development, located east of Roseland Road, north of Main
Street and Ponoka Street, and south and west of the Sebastian Municipal Golf
Course.
All records are available for review in the office of Community Development,
Building Department, 1225 Main Street, Sebastian, Florida, Monday through
Friday, between the hours of 8:00 a.m. to 4:30 p.m.
Any person who may wish to appeal any decision which may be made by the
City Council at this hearing will need to ensure that a verbatim record of the
proceedings is made which record includes the testimony and evidence upon

Sandmining Permit, Collier Club
I have been asked by RGPOA members to express their con-
cerns to you regarding Collier Club's proposed sandmining
operation at their project site off Roseland Road. I will
be out of town on the evening of the Council's hearing of
this matter, and I am using this method to communicate
their concerns. The concerns are as follows:
1. The possibility that the creation of three lakes could
effect the wells of nearby residents.
2. The trucking of spoil from the site of these mines to
another location in Indian River County, could create
a traffic hazard in Roseland Road. The egress for this
development is located just South of the narrow bridge
over Collier Creek. Members have asked, why not stock-
pile the spoil on the project's land for future use with-
in the development?
3. The project's land is rich in wildlife. Who will prop-
erly supervise the relocation of wildlife, such as, gop-
her tortoises, indigo snakes, etc.?
4. Because of the size of this project, it is felt that the
developers should be required to post a performance bond.
