An application for a special use permit has been submitted by Henry A. Fischer for certain
property located at 10900 U.S. Highway 1 containing 1.85 acres more or less. The applicant is
requesting a special use permit for a self-service storage facility.
Attached for your review is a special use permit application, a detailed staff report and a location
map. The planning and zoning commission recommended approval of this special use permit
request at their regular meeting on January 15, 1999.
Staff has reviewed this special use permit request and finds the following:
The granting of the special use permit will not be detrimental to the public safety, health or
welfare or be injurious to other properties or improvements within the immediate vicinity
in which the property is located; and
2. The use requested is consistent with the purpose and intent of the respective district, and
can be demonstrated to be similar in nature and compatible with the uses allowed in such
district.

RESOLUTION NO. R-99-16
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, APPROVING A SPECIAL USE
PERMIT FOR A SELF-SERVICE STORAGE FACILITY AT
10900 U.S. HIGHWAY 1; PROVIDING FOR CONFLICTS
HEREWITH; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, Henry A. Fischer has applied for a special use permit approval for a
self-service storage facility at 10900 U.S. Highway 1; and
WHEREAS, the zoning category for the site allows this special use request; and
WHEREAS, the Planning and Zoning Commission have recommended approval
of the special use permit application with conditions;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, as follows:
Section 1. SPECIAL USE PERMIT APPROVAL. The City
Council of the City of Sebastian does hereby approve the application in this cause for a
special use permit to allow a self-service storage facility at 10900 U.S. Highway 1.
Section 2. CONDITIONS.

A. The side lot lines shall be screened with a type "A' opaque screen
incorporating vegetation therein;
B. The front facing U.S. l shall utilize a type "C" opaque screen; and
C. The building shall incorporate architectural relief on all sides to prevent the
"long, blank wall" effect.
Section 3. CONFLICT. All resolutions or parts of resolutions in conflict 03
herewith are hereby repealed.
Section 4. EFFECTIVE DATE. This resolution shall take effect immediately
upon its adoption.

a. Narrative of proposed action: The applicant is requesting a special use
permit approval for a self-service storage facility on a 1.85 acre parcel of
land. The proposed land lies just East of an industrial tract containing
mini -warehouse units. The applicant is proposing to use the land for
phase 11 of the Fischer Trade Center project, but will contain self-service
storage units as opposed to the current mini -warehouse units. This use
is permitted as a special use within the CG zoning district.

10. Is the granting of the special use permit detrimental to the public safety,
health or welfare or injurious to other properties or improvements within
the immediate vicinity in which the property is located? Staff does not feel
this application will be detrimental to the public safety, health or welfare or
injurious to other properties or improvements with the immediate vicinity in which
the property is located. The granting of a special use permit for self-service
storage units is required per Section 20A-5.47 of the Land Development Code.
11. Is the use requested consistent with the purpose and intent of the
respective zoning district, and can it be demonstrated to be similar in
nature and compatible with the uses allowed in the zoning district? Yes —
Self-service storage facilities for the storage of only domestic and household
goods or personal and noncommercial goods can be considered as a special
use permit in the CG zoning district.
12: Additional considerations: The use shall meet the following conditions:
1. The maximum area for a self-service storage unit shall be 150 square
feet.
2. The maximum height of the building shall be 10 feet.
3. Outdoor storage is prohibited.
4. All outdoor lights shall be shielded to direct light and glare only onto the
self-service storage facility premises.
5. The maximum size of a self-service storage facility shall be two (2)
acres.
6. The setbacks for the respective zoning district shall be used except in no
case shall the setback be less than twenty (20) feet.
7. The rear and side lot lines shall be screened with a type "A" opaque
screen
8. One office for management may be included provided that it does not
exceed 400 square feet.
9. No occupational licenses other than for the main use (storage) shall be
permitted.
10. No garage sales, sales, manufacturing or repair is permitted.
11. There shall not be any storage of flammable, toxic, highly combustible or
other hazardous materials or substances.
12. Access shall only be to an arterial or collector roadway and in no case
through areas zoned residential.
13. No utilities (other than air conditioning and lights) can be provided to the
storage units.
14. The hours of operation shall be limited to 6:00 A.M. to 10:00 P.M.
12. Other Matters: The property in which this facility is to be located just recently
(January 21, 1999) received formal approval from the Department of Community
Affairs to be designated Commercial General (CG) on the City's future land use
map. The applicant, as part of this application, has requested the rezoning to
CG to allow for the proposed self-service storage units. The property has
already been targeted for designation as CG zoning as part of the Land
Development Code Revisions. However, this is not to take place for several

months and the applicant has requested the rezoning so as to not delay
construction of his site.
15. Analysis: The applicant is requesting a special use permit approval for a self-
service storage facility on a 1.85 acre parcel of land. The proposed land lies
just East of an industrial tract containing mini -warehouse units. The applicant is
proposing to use the land for phase II of the Fischer Trade Center project, but
will contain self-service storage units as opposed to the current mini -warehouse
units. This use is permitted as a special use within the CG zoning district.
At their regular meeting on February 04, 1999, the Planning and Zoning
Commission recommended approval of the special use permit with staff's
findings with an addition to condition #7 as follows:
7. The side lot lines shall be screened with a type "A" opaque screen and
vegetation must be incorporated within this screen. The front facing U.S.
#1 shall be screened with a type "C" opaque screen and the building
shall incorporate architectural relief.
15. Conclusion: The granting of the proposed special use permit application is
consistent with the Land Development Code, Comprehensive Plan and Code of
Ordinances.
16. Recommendation: Staff has reviewed the request for a special use permit for
Henry A. Fischer and finds this application to be consistent with the Land
Development Code and Comprehensive Plan. Additionally, the Planning and
Zoning Commission recommends the City Council approve the special use
permit for a self-service storage facility with the following conditions:
1. The maximum area for a self-service storage unit shall be 150 square

D. PUBLIC HEARING — Recommendation to City Council — Special Use
Permit — Self -Service Storage Facility (0-97-53) — Fischer Trade Center
Randy Mosby was present representing the applicant, and gave a presentation. He
presented a visual artist's concept of the proposed site and commented that this will be a
low key, passive facility.
Mr. Hass gave staff presentation and noted that the applicant has concurred with all of
the conditions listed on page 3 of the staff report. At this point he indicated that staff
recommends approval.
Chmn. Schulke opened the public hearing at 7:40 pm.
Mr. Richard Marco of River Run asked for a description of the "opaque screen" on the
two sides. Mr. Hass responded that this will be an issue for review during the site plan
review. Chmn. Schulke expanded on this issue.
Chmn. Schulke closed the public hearing at 7:45 pm.
There was discussion on the landscaping for this site. Mr. Mosby indicated that the
applicant intends to use the opaque wall of the building as their opaque screen, but will
offer architectural relief on the wall of this building.
Mr. Mosby suggested that landscape issues should be covered at the time of site plan
review. He also noted that the applicant will work with staff on the level of detail on the
landscaping. He then stated that "special care will be taken during the site plan review
process for the landscaping on all buffers of the building, and we agree to that and we'll
work that out with staff and you all....". He also noted that the applicant agrees with
additional landscaping on the north and south sides, and also on the east side.
At this point, Mr. Hass read from the Code description of Opaque Screening.
In response to a question from a Commission member, Atty. Stringer noted that
conditions can be attached to fulfill the intent of the code, since it is a special use, which
is like an exception to the code.
There was more discussion on the front/rear of this project. Atty. Stringer read the
definition of Type C landscaping from the Code.
Chmn. Schulke suggested including in the motion that the Type A opaque screen on the
north/south side shall consist of, partially with vegetation, and the east side, adjacent to
U.S. #1 would require, at a minimum, the landscaping between the pavement and right-
of-way, which would be a hedge and a tree every thirty-five (35) feet.
Mr. Mather suggested including in the motion wording to cover the architectural relief to
be used on the building.

Mr. Richard Marco commented that he was pleased to see that this Board, as well as the
project engineer, is concerned with the citizens who pass or live in close proximity to this
property and the landscape suggestions made here tonight, especially on the north and
east sides.
Chmn. Schulke closed the public hearing at 8:30 pm.
Chmn. Schulke suggested wording for condition #7 to read:

Mr. Mosby suggested that landscaping not be required on the west property line, facing
the railroad track. There was discussion on this issue.

WHEREAS, the City Council of the City of Sebastian, Florida, desires to amend the

Stetion 1. Section 20A-5.47. of the Land Development Code, City of Sebastian,
Florida is bereby created to read as follows:
Sec. 20A-5.47, Muu-storage facilities.
A.
1.1
Purpose. The purpose of this section is to provide for opportunities for the
development of mini -storage facilities within the city while minimizing the impact
of such facilities on the surrounding properties,
General regulations of mini -storage facilities.
1. The minimum site size for a mini -storage facility shall be two acres.

The maximum interior area of each unit shall be 400 square feet.
The maximum height of the buildings shall be 12 feet.
All setbacks of the respective zoning district shall be used except in no case
shall the setback be less than twenty feet.
The rear and side lot lines shall be screened with a type "A" opaque screen,
except where the lot line abuts another property lying in an industrial
zoning district and except where the lot line abuts a railroad right-of-way.
There shall be no outside storage.
One office for management may be included provided it does not exceed
400 square feet in area.
No occupational licenses other than for the main use (storage) shall be
permitted.
No sales, garage sales, manufacturing or repair is permitted. However this
does not preclude the use as a depot for such purposes as a franchised
distribution, the temporary storage of personal property used and stored in
residences, offices, retail stores, service establishments, professional offices
and other commercial uses, or for contractor supplies.
There shall act be any storage of flammable, toxic, highly combustible or
other hazardous materials or substances.

11. No utilities (other than air conditioning and a light) can be provided to the
storage units except as may be required for fire suppression.
C. Self-service Storage Facilities
I. Self-service storage facilities for the storage of only domestic and
household goods or personal and noncommercial goods can be considered
as a special use permit in the following districts: CG, PUD( C), and IN. In
addition to the requirements of Section 20A-2.6., the use shall meet the
following requirements:
a. The maximum interior area for a self-service storage facility shall be
150 square feet.
b. The maximum height of the building shall be 10 feet.
C. Outdoor storage is prohibited.
d. All outdoor lights shall be shielded to direct light and glare only
onto the self-service storage facility premises.
C. The maximum size of a self-service storage facility shall be two
acres.
f. The setbacks of the respective zoning district shall be used except
in no case shall the setback be less than twenty feet.
g. The rear and side lot lines shall be screened with a type "A" opaque
screen.

Section I CODMCATTON. It is the intention of the City Council of the
City of Sebastian, Florida, that the provisions of this Ordinance shall become and be made a
part of the Land Development Code of the City of Sebastian, Florida, and that the sections of
this Ordinance may be renumbered, releitered, and the word 'ordinance" may be changed to
"Section", "Article", or such other word or phrase in order to accomplish such intention.

Sec. 20A-3.10. CG, General Commercial District.
A. Purpose and intent. The CG district is established to imple-
ment comprehensive plan policies for managing land designated
for general commercial development.

B. Permitted uses. In this district, as a permitted use, a
building or premises may be used for only the below stated uses.
All applicable provisions of this code shall be satisfied, including
site plan review and performance criteria.
Permitted uses: Cultural or civic activities, places of worship,
public or private not-for-profit clubs, business and professional
offices, general retail sales and services (including antique
shops, consignment shops and secondhand stores), limited
commercial activities, parking garages, plant nurseries, restau-
rants (excluding drive-ins), trade and skilled services, transient
quarters, vehicular sales and related services, retail gasoline
sales, medical services, commercial amusements (temporary),

C. Conditional uses. In this district as a conditional use a
building or premises may be used for only the following condi-
tional uses upon compliance with applicable conditions stated in
article VI and all other applicable provisions of this Code,
including site plan review and performance criteria. The plan-
ning and zoning commission shall ascertain if such conditions
and provisions are satisfied. Appeal of such decisions shall be
heard by the city council.
Conditional uses: Adult entertainment establishments, bars
and lounges, child care facilities, drive-through facilities, farm-
er's markets, funeral homes, hotels and motels, indoor theaters
and other enclosed commercial amusements, flea markets and
pawn shops, nursing homes (including rest homes or convales-
cent homes), public and private utilities, public parks and
recreation areas, public protective and emergency services,
restaurants (drive-in), vehicular service and maintenance, vet-
erinary medical services, whole -sale trades and services, and

'Except that side yards for mobile home parks in existence prior to April 11, 1985, (regardless of current
zoning), shall be established as follows: Every mobile home residence shall be located on a space so that
no living space is closer than twenty (20) feet to any adjacent living space and no accessory structure shall
be located closer than ten (10) feet to any other structure on an adjoining space. An accessory open

public infrastructure, promote the economic well
being of the county, protect the natural resources
and beauty of the county and ensure commercial
development compatible with existing and pro-
posed development.
In order to achieve this purpose, these districts
shall regulate the size, scope, and location of
commercial uses and provide standards to ensure (c)
development compatible with the built and natu-
ral environment.
(2) Districts. The following districts are estab-
lished to implement the provisions of this chap-
ter:
(a) PRO. Professional office district. The PRO,
professional office district, is designed to
encourage the development of vacant land
and the redevelopment of blighted or de-
clining residential areas along major thor-
oughfares in selected areas of the county.
The selected areas will be deemed as no
longer appropriate for strictly single-
family use but which are not considered
appropriate for a broad range of commer-
cial uses, as permitted in a commercial
zoning district. The PRO district may
serve as a buffer between commercial and
residential uses or be established in areas
in transition from single-family to more
intensive land uses. The PRO district
shall be limited in size so as not to create
or significantly extend strip commercial
development.
In order to further encourage redevelop-
ment, any legally nonconforming struc-
ture may continue to be utilized, and its
use may be changed from one nonconform-
ing or conforming use category to another
use category permitted in the PRO dis-
trict, provided the change of use of the
legally nonconforming structure receives
site plan approval, or any other necessary
approvals.
(b) OCR: Office, commercial, residential dis-
trict. The OCR, office, commercial, resi-
dential district, is intended to provide
areas for the development of restricted

office, commercial, and residential activi-
ties in a manner which will be compatible
with surrounding neighborhoods. The OCR
district is further intended to provide land
use controls for ensuring the separation of
potentially incompatible activities, such
as intense commercial uses, from estab-
lished residential areas.
MED: Medical district. The MED, medical
district, is intended to provide a variety of
uses which support a major medical facil-
ity, and to protect such major medical
facility from encroachment by land uses
which may have an adverse effect on the'
operation and potential expansion of the
facility. Land uses that could cause an
adverse effect would generally include those
uses that are likely to be objectionable to
neighboring properties because of noise,
vibration, odors, smoke, amount of traffic
generated, or other physical manifesta-
tions.
(d) CN: Neighborhood commercial district. The
CN, neighborhood commercial district, is
intended to provide areas for the develop-
ment of highly restricted commercial ac-
tivities to serve primarily the residents of
the immediate area. The CN district is
further intended to limit the intensity of
commercial activities in order to ensure
compatibility with nearby residential uses.
(e) CL: Limited commercial district. The CL,
limited commercial district, is intended to
provide areas for the development of re-
stricted commercial activities. The CL dis-
trict is intended to accommodate the con-
venience retail and service needs of area
residents, while minimizing the impact of
such activities on any nearby residential
areas.
(f) CO. General commercial district. The CG,
general commercial district, is intended
to provide areas for the development of
general retail sales and selected service
activities. The CG district is not intended
to provide for heavy commercial activi-
ties, such as commercial service uses,
heavy repair services nor industrial uses.

site plan has been submitted or

veloping neighborhood nodes in
the area. After the public hear-
ing, the board of county com-
missioners will decide whether
to terminate the node approval
or extend approval for six (6)

Section 811.11. Industrial districts.
(1) Purpose and intent. The Industrial districts
are established to implement the Indian River
County Comprehensive plan policies for indus-

trial development. These districts are intended to
permit the development of industrial property to
provide an efficient use of land and public infra-
structure, promote the economic well being of the
county and ensure industrial development com-
patible with existing and proposed development.
The industrial districts shall regulate the size,
scope, and location of industrial uses and provide
standards to ensure development compatible with
the built and natural environment.
(2) Districts established. The following dis-
tricts are established to implement the provisions
of this chapter.
(a) IL -Light industrial district. The IL, light
industrial district, is intended to provide
opportunities for limited manufacturing
and industrial uses and to promote the
establishment of employment centers
which are accessible to urban services
and facilities, the area labor force, and
local industrial and business markets while
minimizing the potential for any adverse
impacts upon nearby properties.
(b) IG -General industrial district. The IG,
general industrial district, is intended to
provide areas where a broad range of
industrial activities may locate and oper-
ate without significant adverse impacts
upon nearby properties. The IG district is
further intended to promote the establish-
ment of employment centers which are
accessible to the transportation system
and other necessary urban services.
(3) Relationship to land use maps. Industrial
districts may be established in the following land
use designation:

3. Manufacturing activities, including assembly and distribu-
tion of goods, maintenance, repair, reconditioning, clean-
ing, transportation, utilities, printing, cooking, fruit and
vegetable packing and/or processing, general packaging
and processing activities, testing and research and devel-
opment industries, ice plants, commercial laundries, stone
shops, machine shops, agricultural research laboratories,
vocational and trade schools, and accessory uses.
Other manufacturing uses approved by the city building
official based on similarity of use, excluding.metal fabrica-
tion, chemical or petroleum manufacturing, rubber or plas-
tics manufacturing, or other use generating potentially
harmful nuisance impacts such as noise, vibration, glare,
dust, explosive or fire hazard, offensive odors beyond the
property line or causing air or water pollution in violation
of performance standards contained herein or in violation
of applicable state or federal standards; and based on ab-
sence of any characteristic dissimilar and incompatible
with the uses identified herein.
4. Truck or bus terminal facilities, including motor freight
transportation, and moving and storage facilities.
5. Manufacturing service establishments, such as heavy ma-
chinery repair and service; heavy machinery or heavy equip-
ment rental or other service uses approved by the city
building official based on similarity of use, excluding ser-
vices which may generate potentially harmful nuisance
impacts; and based on absence of any characteristic dis-
similar and incompatible with the uses identified herein.
6. Warehousing, storage and distribution activities, including
building contract construction, building supplies, furniture
stores with major warehousing, and trade services with
extensive warehousing, trucking support facilities, or re-
quirement of outside storage.
Sec. 20A-2.6. Special use permits.
A. Jurisdiction. Notwithstanding any provisions of this arti-
cle, the city council may, in its sole discretion, grant a special use
permit in any district for a use which is not provided for in the

zoning regulations. All such uses shall not be otherwise illegal,
shall not be specifically prohibited pursuant to the comprehen-
sive plan or other applicable law or regulations, and shall satisfy
the following fmdings of fact by the city council.
B. Required findings of fact. The city council shall not grant
any special use permit under this section unless it shall make
findings based upon the evidence presented that:
1. The granting of the special use permit will not be detri-
mental to the public safety, health or welfare or be inju-
rious to other properties or improvements within the im-
mediate vicinity in which the property is located; and
2. The use requested is consistent with the purpose and in-
tent of the respective district, and can be demonstrated to
be similar in nature and compatible with the uses allowed
in such district.
C. Conditions: In granting special use permits under this sec-
tion, the city council may require such conditions as will, in its
judgment, substantially secure the objectives and intent of the
_ zoning regulations and other components of the city's land devel-
opment controls.
D. Planning and zoning commission review. Prior to the city
council considering an application for a special use permit, the
planning and zoning commission shall hold a public hearing to
review and consider the application for a special use permit. After
the public hearing, the planning and zoning commission shall
indicate whether, in the opinion of the planning and zoning com-
mission, the proposed use meets the required fmdings of fact set
forth in subsection B) of this section 20A-2.6.
E. Public hearing. Before acting on any request under this sec-
tion, the city council shall hold a public hearing thereon, with
notice as follows: .
1. By publication in a newspaper of general circulation in the
City of Sebastian at least seven ('n days prior thereto; and
2. By certified mail, return receipt requested, to the owners of
record of real property located within two hundred (200)

feet of the real property involved in such request, at least
fifteen (15) days prior thereto. This requirement is direc-
tory only and not mandatory.
F. Fees and costs.'There shall be an application fee for a special
use permit under -this section. The amount of the fee shall be
determined by resolution of the city council. The applicant shall
bear the expense of giving the required notices.
G. Approval. By resolution of the city council, special use per-
mits may be granted, upon a finding that the requirements of
section 20A-2.6 of this Code have been satisfied.

the immediate vicinity in which the property is located? Staff does not feel
this application will be detrimental to the public safety, health or welfare or
injurious to other properties or improvements with the immediate vicinity in which
the property is located. The granting of a special use permit for self-service
storage units is required per Section 20A-5.47 of the Land Development Code.
11. Is the use requested consistent with the purpose and intent of the
respective zoning district, and can it be demonstrated to be similar in
nature and compatible with the uses allowed in the zoning district? Yes —
Self-service storage facilities for the storage of only domestic and household
goods or personal and noncommercial goods can be considered as a special
use permit in the CG zoning district.
12: Additional considerations: The use shall meet the following conditions:
1. The maximum area for a self-service storage unit shall be 150 square
feet.
2. The maximum height of the building shall be 10 feet.
3. Outdoor storage is prohibited.
4. All outdoor lights shall be shielded to direct light and glare only onto the
self-service storage facility premises.
5. The maximum size of a self-service storage facility shall be two (2)
acres.
6. The setbacks for the respective zoning district shall be used except in no
case shall the setback be less than twenty (20) feet.
7. The rear and side lot lines shall be screened with a type "A" opaque
screen
8. One office for management may be included provided that it does not
exceed 400 square feet.
9. No occupational licenses other than for the main use (storage) shall be
permitted.
10. No garage sales, sales, manufacturing or repair is permitted.
11. There shall not be any storage of flammable, toxic, highly combustible or
other hazardous materials or substances.
12. Access shall only be to an arterial or collector roadway and in no case
through areas zoned residential.
13. No utilities (other than air conditioning and lights) can be provided to the
storage units.
14. The hours of operation shall be limited to 6:00 A.M. to 10:00 P.M.
12. Other Matters: The property in which this facility is to be located just recently
(January 21, 1999) received formal approval from the Department of Community
Affairs to be designated Commercial General (CG) on the City's future land use
map. The applicant, as part of this application, has requested the rezoning to
CG to allow for the proposed self-service storage units. The property has
already been targeted for designation as CG zoning as part of the Land
Development Code Revisions. However, this is not to take place for several

months and the applicant has requested the rezoning so as to not delay
construction of his site.
15. Analysis: The applicant is requesting a special use permit approval for a self-
service storage facility on a 1.85 acre parcel of land. The proposed land lies
just East of an industrial tract containing mini -warehouse units. The applicant is
proposing to use the land for phase II of the Fischer Trade Center project, but
will contain self-service storage units as opposed to the current mini -warehouse
units. This use is permitted as a special use within the CG zoning district.
At their regular meeting on February 04, 1999, the Planning and Zoning
Commission recommended approval of the special use permit with staff's
findings with an addition to condition #7 as follows:
7. The side lot lines shall be screened with a type "A" opaque screen and
vegetation must be incorporated within this screen. The front facing U.S.
#1 shall be screened with a type "C" opaque screen and the building
shall incorporate architectural relief.
15. Conclusion: The granting of the proposed special use permit application is
consistent with the Land Development Code, Comprehensive Plan and Code of
Ordinances.
16. Recommendation: Staff has reviewed the request for a special use permit for
Henry A. Fischer and finds this application to be consistent with the Land
Development Code and Comprehensive Plan. Additionally, the Planning and
Zoning Commission recommends the City Council approve the special use
permit for a self-service storage facility with the following conditions:
1. The maximum area for a self-service storage unit shall be 150 square
feet.
2. The maximum height of the building shall be 10 feet.
3. Outdoor storage is prohibited.
4. All outdoor lights shall be shielded to direct light and glare only onto the
self-service storage facility premises.
5. The maximum size of a self-service storage facility shall be two (2)
acres.
6. The setbacks for the respective zoning district shall be used except in no
case shall the setback be less than twenty (20) feet.
7. The side lot lines shall be screened with a type "A" opaque screen and
vegetation must be incorporated within this screen. The front facing U.S.
#1 shall be screened with a type "C" opaque screen and the building
shall incorporate architectural relief.
8. One office for management may be included provided that it does not
exceed 400 square feet.
9. No occupational licenses other than for the main use (storage) shall be
permitted.
10. No garage sales, sales, manufacturing or repair is permitted.

11. There shall not be any storage of flammable, toxic, highly combustible or
other hazardous materials or substances.
12. Access shall only be to an arterial or collector roadway and in no case
through areas zoned residential.
13. No utilities (other than air conditioning and lights) can be provided to the
storage units.
14. The hours of operation shall be limited to 6:00 A.M. to 10:00 P.M.

D. PUBLIC HEARING — Recommendation to City Council — Special Use
Permit — Self -Service Storage Facility (0-97-53) — Fischer Trade Center
Randy Mosby was present representing the applicant, and gave a presentation. He
presented a visual artist's concept of the proposed site and commented that this will be a
low key, passive facility.
Mr. Hass gave staff presentation and noted that the applicant has concurred with all of
the conditions listed on page 3 of the staff report. At this point he indicated that staff
recommends approval.
Chmn. Schulke opened the public hearing at 7:40 pm.
Mr. Richard Marco of River Run asked for a description of the "opaque screen" on the
two sides. Mr. Hass responded that this will be an issue for review during the site plan
review. Chmn. Schulke expanded on this issue.
Chmn. Schulke closed the public hearing at 7:45 pm.
There was discussion on the landscaping for this site. Mr. Mosby indicated that the
applicant intends to use the opaque wall of the building as their opaque screen, but will
offer architectural relief on the wall of this building.
Mr. Mosby suggested that landscape issues should be covered at the time of site plan
review. He also noted that the applicant will work with staff on the level of detail on the
landscaping. He then stated that "special care will be taken during the site plan review
process for the landscaping on all buffers of the building, and we agree to that and we'll
work that out with staff and you all....". He also noted that the applicant agrees with
additional landscaping on the north and south sides, and also on the east side.
At this point, Mr. Hass read from the Code description of Opaque Screening.
In response to a question from a Commission member, Atty. Stringer noted that
conditions can be attached to fulfill the intent of the code, since it is a special use, which
is like an exception to the code.
There was more discussion on the front/rear of this project. Atty. Stringer read the
definition of Type C landscaping from the Code.
Chmn. Schulke suggested including in the motion that the Type A opaque screen on the
north/south side shall consist of, partially with vegetation, and the east side, adjacent to
U.S. #1 would require, at a minimum, the landscaping between the pavement and right-
of-way, which would be a hedge and a tree every thirty-five (35) feet.
Mr. Mather suggested including in the motion wording to cover the architectural relief to
be used on the building.
