A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, GRANTING TO HENRY A. FISCHER & SONS, INC., A SPECIAL USE PERMIT PURSUANT TO SECTION 20A-2.6, LAND DEVELOPMENT CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, Henry A. Fischer, on behalf of Henry Fischer and Sons, Inc., has applied to the City of Sebastian, for a Special Use Permit pursuant to Section 20A-2.6, Land Development Code of the City of Sebastian, and, WHEREAS, the proposed use of a residential structure for security personnel on land that is zoned industrial, and, WHEREAS, residential use is not a permitted or a conditional use in the zoning classification of the land site; nor is this use a special exception, and, WHEREAS, the only manner in which the proposed use can be authorized by the City is through the procedure of "Special Use" pursuant to said Section 20A-2.6, and, WHEREAS, the proposed use is not barred by the City of Sebastian Comprehensive Land Use Plan; in fact, SECTION IV (4-2)(C) at Page IV -10 of said Plan contemplates this proposed use as an exception to the general prohibition of residential use in land with industrial zoning classifications, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: 1. The City Council has held a Public Hearing on the Application of Henry A. Fischer on Wednesday, March 11, 1987, and heard testimony of all interested parties, and having considered said evidence, the City Council finds and determines as follows: (A). The proposed use does not violate the Comprehen- sive Land use Plan or other applicable rule or regulation; (B). The granting of this special use will not be detrimental to the public safety, health or welfare or be injuri- ous to other properties or improvements within the immediate vicinity in which the subject property is located. (See Exhibit A description). (C). The use requested is consistent with the purpose and intent of the respective district, and can be demonstrated to 11 be similar in nature and compatible with the uses allowed in such district. 2. This special use is granted with the understanding that the specifics of the proposed structure must otherwise comply with all applicable ordinances, rules and regulations, of the City of Sebastian, Indian River County, and the U.S. Government to the extent such laws, rules, etc., may be applicable. 3. This Resolution shall be effective immediately upon final passage and shall authorize the applicant to proceed with the necessary proceedings before the City Planning and Zoning Commission to further approve the proposed structure.
