Hydrologist St. Johns River Water Management District 305 East Drive Melbourne, Florida 32904 RE: City of Sebastian - Sebastian Highlands WTP Consumptive Use Permit Renewal for CUP No. 2-061-00142UNR Dear Mr. Burklew: This letter is in response to our recent telephone conversation in regard to the Park Place/Palm Lake Club potable water system relative to the current Sebastian Highlands Water Treatment Plant Consumptive Use Permit Renewal. The Park Place treatment/water distribution system currently serves about 225 customers in both the Park Place and Palm Lake club mobile home parks located in the southeastern corner of the City of Sebastian. The Park Place water treatment plant and two 106 foot deep wells were originally permitted and constructed circa 1986 under the ownership of The Village of Lake Dolores. The St. Johns River Water Management District Consumptive Use Permit No. 2- 061-0357N was issued on July 8, 1985. On July 11, 1989, Indian River County, through an agreement with Nelson Hyatt (the owner/developer of the Village of Lake Dolores), took over the operation of the water system which became known as the "Park Place Water System". The St. Johns River Water Management District and Florida Department .of Environmental Protection permits were transferred to Indian River County. On May 1, 1993, Indian River County conveyed the Park Place Water System to the City of Sebastian. The county transferred the operating permit for the water system from the Florida Department of Environmental Protection to the City, but never transferred the St. Johns Consumptive Use Permit. In 1993, negotiations were underway between the City of Sebastian and General Development Utilities (GDU) for the City to purchase the GDU Sebastian Highlands Water System. One of the immediate projects to be initiated by the City after the purchase of the Sebastian Highlands Water System was the connection of the September 30, 1994 Letter to Rich Burklew, St Johns River Water Management District Page 2 of 2 Park Place/Palm Lake Club water system with the Sebastian Highlands system. -This project would eliminate the Park Place water plant and the two wells at that plant would be abandoned. Water for the Sebastian Highlands and Park Place/Palm Lake Club water system would then be supplied by the wells at the Sebastian Highlands Water Plant. The City was finally able to purchase the GDU system on December 16, 1993, and in January authorized its utilities consultant, Hartman & Associates, to begin engineering and permitting on the interconnection of the water systems between Sebastian Highlands and Park Place. On August 11, 1994, the Florida Department of Environmental Protection issued Permit No. WD31-254412 for construction of the system. Currently, the contract documents for the project are being reviewed by the Sebastian City Attorney and easements are in the process of being procured from the owner of Park Place for a short segment of the water main on the owner's property. By coincidence, in August, 1993, I learned from the Palata office of St. Johns River Water Management District that the consumptive use permit for the wells at the Park Place water plant had expired on July 8, 1992. Indian River County had never renewed the permit and never informed the City of Sebastian about the expiration of the permit. By the time I learned of this fact, the permit had been expired for twelve (12) months. Indian River County should have renewed the permit because an expired permit cannot be transferred from the County to the City. The County should have taken the fiscal responsibility to renew the permit instead of waiting until the City took over the system. Since the City is in the process of eliminating the Park Place water plant and wells, I felt that applying for a new permit was not justified, especially when it was Indian River County's responsibility to renew the permit in 1992. Our consultants, Hartman & Associates, Inc., have indeed taken into account the water consumption for the Park Place/Palm Lake Club developments at full buildout and have included the withdrawal amount in the modelling done for the Sebastian Highlands Plant wells. Please be advised that you are required to abide by all conditions in Rules 17-4.510 through 17-4.540, FAC, the general requirements for general permits; and Rule 17-555.410, FAC. A LETTER OF CLEARANCE MUST BE ISSUED BY THE DEPARTMENT TO YOU PRIOR TO YOUR PLACING THIS PROJECT INTO SERVICE OR YOU, THE PERMITTEE, SHALL BE SUBJECT TO APPROPRIATE ENFORCEMENT ACTION. To obtain the clearance letter, the engineer -of -record must submit one set of record drawings, a "Request for Letter of Release to Place Water Supply System into Service" (DER Form 17-555.910(9)] (attached to the engineer'e copy of this letter), a copy of this letter and satisfactory bacteriological test results (with chlorine residuals indicated) taken on two consecutive days from, or near, the beginning and end of the proposed main.and from a point at Tracy Drive. Water sample forme must indicate specific recommended sample locations and file number above. NOTE TO THE UTILITY: Pursuant to 403.859(6), Florida Statutes, do not provide water service to this project (other than for flushing/testing) until the Department of Environmental Protection has issued a letter of clearance or you, the utility, shall be subject to enforcement action. Application No. 2-061-0183 AUF Section 7, Township 31S, Rangc 39E Dear Mr. Votopka: I have reviewed your letter dated June 24, 1994 regarding the current and future availability of reclaimed water from the City of Sebastian W.W.T.P. with respect to the above referenced project. Based on the information supplied, reclaimed water is currently not available, however an estimated 142,000+ gal/day may be available in 1996. The City of Sebastian is currently completing the Master Water and Wastewater Plan and has requested Atlantic Coast Enterprises to consider the use of the reclaimed water for spray irrigation. Atlantic Coast Enterprises has considered the request and hereby declines to accept and use the reclaimed water in their future grove, based on the following issues: 1) Marketability of the Fruit Crop - The fruit crop will be sold on the fresh fruit market. Fresh fruit must meet strict production standards in order to be successfully marketed. The use of reclaimed water may jeopardize the ability to market the crop. 2) Health Issues for Workers - The use of reclaimed water places the grove worker in a potentially unsafe environment given a treatment system failure. 3) Growers Cultivation Practices - The reclaimed water may contain dissolved nutrients. The growers cultivation practices include strict regulation of the application of nutrients to the crop during the year. During some periods of the year, nutrients are not applied and the tree receives only water. The loss of the ability to regulate the nutrients would diminish the quality of fruit. 4) The Financial Liability - The initial pipe distribution system cost and the potential reclaimed water consumption costs are a concern. Currently, the grove irrigation water sources include surface water from a proposed on-site wet detention pond (reuse of stormwater runoff) and existing Floridan Aquifer wells. The construction of the wet detention system pond is required for stormwater management and the wells are existing. Both sources are free of water consumption fees. Therefore, initial and long term cost are negligible. serving Florida Since I9u Misc2\Brwn-Vot.GAS Page 1 " RA 5) Water Source Requirements - The W.W.T.P. will produce a steady flow of effluent. The grower does not require water at a consistent consumption level. The crop may not require irrigation for weeks at a time during wet periods. During drought periods, the grove may require extended periods of heavy irrigation. During freeze events, an abundance of water in a short period of time is required to provide freeze protection for the grove. 6) Future Land Use - Atlantic Coast Enterprises cannot guarantee the life span of the grove. The grove will be in existence for as long as the owner deems it is in his best interest to maintain it. Long term commitments to accept reclaimed water on the property would cloud the deed and reduce future options for its use. 7) Planting Schedule - The grove will require extensive pre planting renovation and is not expected to be completely built out until December, 1999. Therefore, the peak irrigation requirements will not occur until after the year 2000. Based on the information supplied, the City of Sebastian will have more reclaimed water available in 1996 than would be required by the Atlantic Coast Enterprises at that time. The above issues are not necessarily in order of importance nor a complete list of concerns. Based on the issues listed above, the use of reclaimed water as an irrigation source is not feasible for the Atlantic Coast Enterprises project. Please remove the project from consideration as a reclaimed water end user. The City of Sebastian would be better served if a more appropriate end user was enlisted in the Master Water and Wastewater Plan. As a result. I conferred with Gary Revoir, Project Engineer with Hartman & Associates for the City of Sebastian Master Water and Wastewater Plan. Subsequent to our discussions, the following response is in regard to the availability of reclaimed (reuse) water from the City of Sebastian's wastewater treatment plant for the Atlantic Coast Enterprise Grove. The City of Sebastian owns and operates a 300,000 gallon/day wastewater treatment plant (WWTP). The facility currently produces secondary treated effluent for disposal via percolation ponds located on the treatment plant site. The percolation ponds have a maximum annual average capacity of 142,000 gal/day. The 1993 average annual daily flow from the City's WWTP was only 66,000 gallons per day. Based on the current treatment capabilities, the City of Sebastian can not produce or supply reclaimed water. However, Hartman & Associates, Inc. is currently completing the City's Master Water and Wastewater Plan which recommends increasing effluent disposal methods consisting solely of reclaimed water usage. Therefore, the City plans to construct the necessary facilities to produce reclaimed water to increase the _effluent disposal capacity beyond 142,000 gal/day. The City estimates that these facilities will be completed and reclaimed water will be available by 1996. In view of the above, the City would desire Page 2 of 2 June 24, 1994 Letter to George A. Simon consideration of use of reclaimed water produced at the WWTP for spray irrigation at the Atlantic Coast Grove in the future.
