RESOLUTION NO. R-17-12
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, VACATING A PORTION OF A CERTAIN
EASEMENT ON LOT 22 AND WEST 55 FEET OF LOT 23, BLOCK 372,
SEBASTIAN HIGHLANDS UNIT 11; PROVIDING FOR CONFLICTS
HEREWITH; PROVIDING FOR RECORDING; PROVIDING FOR
EFFECTIVE DATE.
WHEREAS, Kenneth and Kimberly Nilson, owners of the land at 425 Lanfair Avenue,
Sebastian, Florida, have filed a request for a partial abandonment of the public utility and
drainage easement along the northern lot line of the site; and
WHEREAS, the providers of telephone, electric, cable, water, and drainage utilities have
all consented to abandonment thereof.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section 1. VACATION OF EASEMENT. The City Council of the City of
Sebastian does hereby vacate, abolish, abandon and discontinue all of that portion of land
previously dedicated for a public utility and drainage easement described as follows:
The southernmost four (4) feet of the northern twenty (20) foot public utility and drainage
easement located on Lot 22 & the west 55 feet of Lot 23, Block 372, Sebastian Highlands
Unit 11, less the eastern and westernmost six (6) feet thereof, as recorded in Plat Book 7,
Page 56, 56A through 56L of the Public Records of Indian River County, Florida.

Section 2. CONFLICT.
