Approval of minutes A. Regular Meeting of February 16, 2017 Ms. Kautenburg called for additions, deletions or corrections to the February 16, 2017 minutes. Hearing none she called for a motion. A motion to accept the February 16, 2017 minutes as presented was made by Mr. Carter, seconded by Mr. McManus and passed unanimously by voice vote. 6. Quasi -Judicial Public Hearings — None 7. Unfinished Business — None 8. Public Input — None F PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF MARCH 16. 2017 9. New Business PAGE 2 A. Request for Revisions to Building Elevations for Jackson Street Corners — Steve Neveleff— 1801 & 1807 US Highway#1. Ms. Bosworth stated that after Mr. Nevelef's presentation staff will comment. Mr. Neveleff explained that the revision being requested is three part: Reduce the overall building roof height by two feet; Change the shutter material from aluminum to vinyl; Reduce the width of the overhang by three feet. He explained that because of a change in the tenants the plans had to be revised significantly. In an effort to get all the approvals in place, the plans were not reviewed thoroughly before submission to the City. After having reviewed the plans with the contractor it was determined that constructing the buildings as originally approved would be more expensive than following the revised plans being presented this evening. He stated that he does not believe that the changes will greatly impact the aesthetics of the project. He distributed photos of other buildings in the City for comparison of eave widths. He explained that the reduction of building height will reduce the cost of HVAC and the vinyl shutters will be just as attractive at a lower cost, these changes will reduce the cost of the project by approximately $100,000. Mr. Neveleff responded to Mr. Hughan and Mr. Carter's questions concerning roof pitch/height by stating that the pitch will remain the same and the height will be sufficient to screen the HVAC equipment on the roof. Mr. Carter suggested the inclusion of some nautical accents at the front of the building in keeping with the City's nautical theme. Mr. Neveleff stated that he would have the architect prepare drawings with the nautical accents for review by the City. Mr. Reyes explained that the point Mr. Carter made is to maintain the nautical theme. He stated that he likes the appearance of the buildings with the higher roofs and feels that the shutters should be consistent throughout the site. Mr. McManus stated that in his opinion reducing the roof height will have a negative impact on the appearance of the building; he is not opposed to the change in material of the shutters. Ms. Kautenburg stated that she understands keeping the cost down, but the result of lowering the roof has a very negative impact on the overall appearance of the building. Ms. Bosworth showed the Commission a plan on the computer that showed the comparison of what was approved and what is being requested. She noted that there is a significant change to the appearance of the structures. She explained that the City has made an effort to make the appearance of buildings in the Overlay Districts special by requiring additional decorative accents. She noted that the plans originally approved accomplished that with the higher roofs, shutters and wider overhangs. She stated that because the change being requested impacts the aesthetics of the site, she wanted the Commission to have the opportunity to review the request and the decision not be made by staff. PLANNING AND ZONING COMMISSION PAGE 3 MINUTES OF REGULAR MEETING OF MARCH 16, 2017 Mr. McManus suggested voting on the request as three separate requests. Mr. Neveleff stated that the roof height and the eave width are connected and if the Commission does not approve that change, he will proceed with the plans as originally approved; the shutter material is a separate matter. Ms. Kautenburg called for any further questions or comments. Hearing none she called for a motion. Mr. Carter asked about the status of the Community Development Director. Ms. Bosworth responded the Ms. Moore had moved to Arizona to be near her family. She explained that the department consists of herself and Michelle Boswell who recently was promoted, coming from the Building Department. Ms. Bosworth stated that the First Reading and Public Hearing on the Medical Marijuana Treatment Centers Ordinance went before the City Council at their last meeting. They agreed with the language as presented; it will be on their April 12th agenda for Second Reading and Public Hearing. 13. Items for Next Agenda — Identified under Staff Matters 14. Requested Action: Temporary waiver requested from Section 54-4-21.A.5(e)(1) of the Land Development Code to allow visible mechanical equipment roof structures on the building without the required screening. 3. Project Description: a. Narrative of proposed action: Michael Allen, in regards to the Wendy's Restaurant located at 1625 U.S. Highway #1, is requesting a temporary waiver from the following: "Section 54-4-21.A.5(e)(1) "Visually offensive elements" whether freestanding, mounted on roofs, or located anywhere on a structure shall be concealed from view on all sides. Individual screens, building elements, or appropriate landscaping, are to be used to completely screen the offensive elements from view from adjacent roads, properties, and parking areas. Parapet walls, visible roof structures, individual screens, or building elements shall be used to completely screen roof mounted, visually offensive elements from view from any point around the entire building perimeter. Screening services shall relate to the building's style of architecture and materials. All screening devices shall be designed so that no part of the offensive element extends beyond the top of the screen, measured vertically. Rooftop screening devices shall not be required for plumbing roof vents which are less than four inches in diameter and less than 12 inches above roof penetration. These roof vents are to be located where they will be least visible from roadways." The applicant has tentative plans for a near future remodel of this location. He would like to address the screening non-compliance at that time instead of paying to screen the equipment now but having to modify or remove it during the remodel. b. Staff Comments: The Riverfront Overlay District establishes special architectural standards to promote attractive buildings by utilizing quality design. The code places emphasis on special features to guide development toward that end. FA During the installation of additional A/C equipment on the rooftop of the Wendy's • restaurant, structural necessity required the equipment to be relocated to the front of the building. Unfortunately, because of its revised location and bulk, it is very noticeable and visible from all directions. Staff contacted the owner, and explained the Riverfront Overlay District's requirement of having to screen the mechanical equipment. Mr. Allen discussed his tentative future plans to remodel the building, and requested delaying compliance until next year so he could finalize his proposed updates to the site. The building elevation changes would incorporate the screening of the rooftop equipment. Staff agreed that it would be a waste of funds to require screening compliance now because of the possibility that the new screening would need to be removed as part of the remodel plans. A temporary waiver was suggested with conditions of specific time limits. 9. Board Criteria for Determining Waivers (Section 54-4-21.6): As part of an application for development, a request may be made for a waiver of any of the provisions of this article (Article XXI. Performance Overlay Districts). The request shall be heard by the planning and zoning commission in determining if any such provision be waived, modified or applied as written. The planning and zoning commission shall hold a quasi-judicial hearing on the requested waiver. The criterion for granting a waiver or modification of any of the provisions of this article is whether the strict interpretation of the requirements of this article places an inordinate burden on the property owner as defined by Florida Statutes. The waiver procedure herein is the exclusive remedy to the application of the provisions of this article and is to be utilized in lieu of an application for a variance. 10. Staff Recommendation: Staff recommends that a temporary waiver be granted until October 2018 (18 months), by which time building permits will need to be issued and construction begun for a proposed remodel to the restaurant that includes complete screening of the rooftop equipment located to the front of the building. We hired a structural engineer to tell us where the unit could be mounted on the roof. The unit was going to be placed towards the back of the restaurant but had to be changed. The reason for the change is the weight of the unit required it to be mounted where there were double trusses. We were unaware of any issues this would cause with visibility. We are asking for a temporary waiver to allow us time to come up with a plan that will satisfy everyone. We are currently remodeling restaurants in Port St Lucie and Jensen Beach. Our next project will be the remodel of the Sebastian Wendy's pending financing. We have spoken to Dori Bosworth from Zoning about stepping out of our grand fathered landscaping and upgrading using ropes and pylons (More of the Sebastian tradition). I have owned the Wendy's in Sebastian for ten years and have always supported the city rules as well as provide a nice place for the residents and travelers to eat.
