RESOLUTION IV -FINAL ASSESSMENT
On October 24, 2000, the Indian River County Board of County Commissioners approved Resolution III,
No. 2000-131, for the preliminary assessment roll on the above -referenced project. Construction of the
project has been completed. Owners have been notified and connections have begun. Staff is requesting
the Board's approval of the final assessment roll.(See attached minutes -ATTACHMENT 1) of the above
referenced meeting.
The preliminary assessment was for an estimated cost of $1,856,564.20, which equated to $0.202375
(rounded) per square foot of property assessed. The final project cost and assessment (see attached
Resolution IV and the accompanying assessment roll -ATTACHMENT 2), is in the amount of
$1,271,797.02, which equates to a cost of $0.142141 (rounded) per square foot. The final assessment is
$ 0.0602 per square foot or 31.5. % less than the preliminary assessment.
The staff of the Department of Utility Services recommends that the Board of County Commissioners
approve adoption of Resolution IV, which is attached, and authorize the Chairman to execute same.

5. The assessments shown on Exhibit "A," attached to Resolution No. 2000-131, were
recorded by the County on the public records of Indian River County, and the lien shall
remain prima facie evidence of its validity.
The resolution was moved for adoption by Commissioner , and the motion
was seconded by Commissioner and, upon being put to a vote, the vote was as
follows:

BACKGROUND
On October 3, 2000, the Indian Riva Counry Board of County Commissioners approved Resolutions 2000-122
(Rcsoludon I) and 2000-123 (Resolution 11), which contained the preliminary assessment roll and established the
date of the public hearing for the subject project. Property owners have been noti5ed of the public hearing by mail.
Resolution 2000-122 was published in the PRESS JOURNAL on October 9, 2000.
Construction of the Phase D -D & II -E portions of the project area is underway and should be completed by August
2001- Weare now ready to proceed with Phase III -A.
ANALYSIS
Design of the water distribution system is complete. Approval of the attached Resolution III will confirm and
approve the preliminary assessment.
On October 12, 2000 at 7:00 p.m., an informational meeting was held, in the North County Library, for the benefit of
the property owners. Within the Phase III -A project area. bordered by Barber Avenue, to the East, with Periwinkle
Dnvc, along the South and West and Caravan Terrace to the North, there are 861 lots and tracts, and 384 homes, to
benefit from this project Typical platted lot sizes are .25 acre, plus or minus.
More effective management of project construction, inspections, cash flows, and interaction with property owners
is being accomplished by having divided Phases B and III into smaller projects. This may enable more utility
construction contractors to bid on these projects possibly malting the bid process more competitive. The attached
map displays the area to benefit from the assessment projects, as divided into parts A. B, C, D & E, for Phase 111
(Exhibit 3). Phases 11-D & D -E were combined to adhere with scheduling agreed upon with the City of Sebastian
and to complete the remainder of Phase II (North of CR 512). Phase E -E will serve the City of Sebastian
municipal complex, as well as provide potable water and fire protection to an area noted for failing well systems.
The City of Sebastian is waiting for the completion of the water line installation in order to complete road &
drainage improvements and comply with bonding requirements.

The Chairman opened the public hearing and asked if anyone wished to be heard
regarding this matter.
Alida Hirschfeld, 368 Concha Drive, Sebastian, stated she had received a letter
October 4" notifying her about the public hearing to consider the water project and the
workshop meeting on October 12' at the Library. When she attended the meeting, she felt
as though this were already a "done deal'. Some of the people in this area have barely
enough money for food and medication and simply cannot afford this $2,000 or more lien
on their homes. If the bids are correct, they will be paying about $50 per linear foot for
some plastic pipe. This project was determined between the County Commission and the
City of Sebastian Council in 1995 and most of the residents do not want the water. She
questioned why they were not alerted about this upcoming project when they purchased their
properties and built their homes. She felt this is taxation without representation.
Diane Wihlborg, 386 Concha Drive, Sebastian, felt she is being charged $2,000 for
something she does not want and also felt that this is taxation without representation.
Fred Hess, 437 Concha Drive, Sebastian, agreed with the ladies and felt the residents
were not given a voice in this decision.
David Costa, 499 Concha Drive, Sebastian, commented that this is a hardship on
people trying to sell their properties. He is on total disability and cannot afford this. He then
questioned how his property will be assessed as he is on a comer lot.
Director Hubbs stated that the assessments apply to the entire front footage. The
useable portion of the lot is assessed. He continued that he had discussed the project with

WHEREAS, the Board of County Commissioners of Indian River County has, by
Resolution No. 2000-122, adopted October 3, 2000, determined to make special
assessments against certain properties to be serviced by a water main extension to the
Sebastian Area Phase III -A (an area located south of Caravan Terrace with Periwinkle
Drive along the South and West); and o

WHEREAS, said resolution described the manner in which said special
assessments shall be made and how said special assessments are to be paid; and
o
WHEREAS, the resolution was published in the Vero Beach Press Journal, as 3
required by Section 206.04, Indian River County Code; and c
WHEREAS, the Board of County Commissioners of Indian River County passed CO
Resolution No. 2000-123 on October 3, 2000, and set a time and place for a public
hearing at which the owners of the properties to be assessed and other interested
persons would have the chance to be heard as to any and all complaints as to said
project and said special assessments, and for the Board to act as required by Section
206.07, Indian River County Code; and
WHEREAS, notice of the time and place of the public hearing was published in
the Press Journal Newspaper on Friday, October 6; 2000, and once again on Friday,
October 13, 2000 (twice one week apart; the last being at least one week prior to the
hearing), as required by Section 206.06, Indian River County Code; and _

On December 19, 2000 the Board of County Commissioner's awarded Bid No. 3025 to Tri -Sure
Corporation (see attached agenda item and minutes) in the amount of $1,364,954.00 to provide water
service and fire protection to the above -referenced project.
On May 22, 2001 the Board of County Commissioner's approved Change Order Nos. 1 and 2.
Change Order No. 1 involved relocating a water main, force main and reuse main away from a bridge
scheduled to be refurbished at the intersection of 74th Avenue and 26'b Street.
All work associated with both projects is now complete and the Department of Environmental
Protection has issued clearance to begin connecting customers. The Department of Utility Services is
now prepared to make final payment to the Contractor.
ANALYSIS
Change Order Nos. 1 & 2 increased the original contract by $85,648.00 to $1,450,602.00. The
Contractor was previously paid $1,054,729.80 for 72.1% of the project. There were miscellaneous
adjustments made to the amount of material used in the job (i.e. number of services, amount of pipe
fittings, number of fire hydrant, etc.). Change Order No. 3 reduces the contract amount by

$158,271.00 (see attached copies of Change Order No. 3). Change Order No. 4 adjusted the
contract, due to work associated with the bridge refurbishment plus included an additional service
in the assessment project for a total reduction of $5,042.00.
The total of Change Order Nos. 3 & 4 reductions ($163,313.00) results in a 11.26% decrease to the
approved contract and adjusts the contract amount to $1,287,289.00. Utilities staff is now
requesting final payment in the amount of $232,559.20 to complete the County's $1,287,289.00
obligation to the Contractor.
RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve Change Order Nos. 3 & 4, approve final payment in the amount of
$232,559.20 to Tri -sure Corporation, and authorize the Chairman to execute same, as presented.

AN ORDINANCE OF THE CITY OF SEBASTIAN,
FLORIDA, CONSENTING TO THE IMPOSITION OF
SPECIAL ASSESSMENTS AND OR THE INCLUSION OF
ALL OF ITS INCORPORATED AREAS WITHIN ONE OR
MORE MUNICIPAL SERVICE BENEFIT UNITS CREATED
BY INDIAN RIVER COUNTY TO PROVIDE WATER OR
WASTEWATER FACILITIES, SERVICES OR PROGRAMS;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, FLORIDA:
SECTION 1.01. FINDINGS.
determined, and declared that:
(A) Section 125.01(1)(q),
It is hereby ascertained,

legislative authorization for the governing body of a county to
establish a municipal service benefit unit for all or any part of
the unincorporated area within its boundaries, or within the
municipal boundaries of an incorporated area upon consent of the
governing body of the affected municipality, within which may be
provided water or wastewater facilities, services or programs, and
other related essential facilities and municipal services.
(B) The Board of County Commissioners of Indian River County,
Florida (the "County") and the City Council of the City of
Sebastian (the "City") have entered into an interlocal agreement
providing for the transfer of the City's water and wastewater
utility system to the County which authorizes the County to provide
such services within the incorporated areas of the City. This
ordinance shall be construed as authorizing the County to establish
a municipal service benefit unit and or to impose and collect water

and wastewater assessments within the incorporated area of the
City.
(C) The City Council of the City of Sebastian has determined
that the creation of a municipal service benefit unit and or the
imposition of special assessments for the purpose of providing
water and wastewater services, facilities and programs is in the
best interests of the owners of property within the corporate
limits of the City.
SECTION 1.02. CONSENT OF THE CITY OF SEBASTIAN. The City
Council of the City of Sebastian hereby consents to the inclusion
of all of the incorporated area of the City within one or more
municipal service benefit units created by the County to provide
water and wastewater services, facilities, and programs and or to
the imposition of a special assessment for such purposes. Such
consent shall become effective upon adoption of this Ordinance and
transfer of the City's water and wastewater utility system to the
County pursuant to interlocal agreement. The City Council finds
that such provision of water and wastewater services, facilities
and programs is an essential municipal purpose.
SECTION 1.03. SEVERABILITY. The provisions of this Ordinance
are severable; and if any section, subsection, sentence, clause or
provision is held invalid by any court of competent jurisdiction,
the remaining provisions of this ordinance shall not be affected
thereby.
SECTION 1.04. EFFECTIVE DATE. This Ordinance shall take
effect as provided by law.

RESOLUTION NO. R 96-48
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, WAIVING THE SIXTY DAY REQUIREMENT
IMPOSED BY SECTION 6.07(B) OF THE INTERLOCAL AGREEMENT
BETWEEN INDIAN RIVER COUNTY AND THE CITY OF SEBASTIAN
PROVIDING FOR THE TRANSFER OF THE CITY OF SEBASTIAN
WATER AND WASTEWATER SYSTEM; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City Council entered into an Interlocal Agreement with Indian River County
providing for the transfer of the City of Sebastian Water and Wastewater System on September 20,
1995; and
WHEREAS, Section 6.07 (B) of the Interlocal Agreement empowers the County to finance,
construct, acquire or extend water or wastewater transmissions, distribution or collection facilities
and improvements and impose special assessments therefore upon benefitted parcels located within
the incorporated area of the City, and further provides that the County notify the City of its intent to
do so and provide a period of sixty days for the City to opt to finance, construct, acquire or extend
the proposed facilities and improvements and impose special assessments upon benefitted parcels; and
WHEREAS, City Council, by consensus at its March 27, 1996 Regular Meeting, directed
the City Manager to request Indian River County to conduct the assessment hearings for the water
expansion program; and
WHEREAS, the Indian River County Conunission, at its June 18, 1996 meeting, considered
the City Manager's recommendation for the County to do the assessments and proceed with the water
expansion project and opted to proceed with the creation of a Municipal Service Benefit Unit District
(MSBU) in accordance with the Interlocal Agreement; and
WHEREAS, in order for Indian River County to proceed with installation of water fines and
establish the MSBU District, the sixty day time period must be waived; and.
WHEREAS, the City Council deems it in the best interest of the citizens of Sebastian that
Indian River County proceed as soon as possible on the water expansion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
,Section 1. WAIVER OF SIXTY DAY NOTICE REQUIREMENT. It is the intention
of the City Council that the sixty day notice requirement imposed by Section 6.07(B) of the Interlocal
Agreement providing for the transfer of the City of Sebastian Water and Wastewater System on
September 20, 1995, is hereby waived.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict herewith are
hereby repealed.
Section 3. SEVERABILJTY. In the event a court of competent jurisdiction shall hold or
determine that any part of this Resolution is invalid or unconstitutional, the remainder of the
Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian
did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the
City Council would have enacted the remainder of this Resolution without said invalid and
unconstitutional provision, thereby causing said remainder to remain in full force and effect.
Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon final
passage.

WASTEWATER SERVICE; PROVIDING FOR FINDING OF A
PUBLIC PURPOSE AND NECESSITY; PROVIDING THAT THE
ACQUISITION IS IN THE PUBLIC INTEREST IN CONFORMANCE
WITH SECTION 180.301, FLORIDA STATUTES; PROVIDING
AUTHORITY TO COMPLETE THE PURCHASE, SALE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA9 that:
SECTION 1. AUTHORITY. Pursuant to Chapters 166 and 180, Florida Statutes,
the City Council (the "Council') of the City of Sebastian, Florida (the "City") has all the
powers of local self-government to render municipal services and may exercise any power
for municipal purposes, except when expressly prohibited by law. Such power includes the
authority to provide for water and wastewater transmission, collection, treatment and
disposal services and to acquire and subsequently transfer such utility facilities to Indian
River County (the "County").
SECTION 2. FINDINGS. It is hereby ascertained, determined and declared:
(A) The City owns and operates a potable water production, treatment and
distribution and a wastewater collection, treatment, disposal and reuse system within and
around its incorporated area (the "Sebastian Utility System").
(B) The City Council expressly finds that the purchase, sale and transfer ofthe
Sebastian Utility System to the County resulting in the provision of a County -owned and
operated water and wastewater service constitutes a public purpose and is in the best interest
of the health, safety and welfare of the City and the inhabitants thereof. Further, the City
council expressly finds that the incorporation of the Sebastian Utility System into the County
water and sewer system will provide a greater public use and increased public benefit than
the existing uses.
SECTION 3. PUBLIC INTEREST DETERMINATION OF PURCHASE. In
consideration of the statement prepared by the City Manager and filed at this public hearing
set to consider the purchase and sale of the Sebastian Utility System in conformance with
Section 180.301, Florida Statutes, the City Council hereby considers the following;
(A) The most recently available income and expense statement of the Sebastian
Utility System;
(B) The most recently available balance sheet for the Sebastian Utility System
listing the assets and liabilities showing the amount of contributions -in -aid -of -construction
and the accumulated depreciation thereon;
(C A statement of the existing rate base of the Sebastian Utility System for
regulatory purposes;
(D) The physical condition of the subject facilities;
(E) The reasonableness of the consideration to be exchanged between the City and
the County and the terms of the interlocal agreement which will govern the transfer of the
Sebastian Utility System from the City to the County;
(F) The impacts of the contemplated transfer on utility customers now served by
the City as well as utility customers served by the County, both positive and negative;
(G) Any additional investment required and the ability and willingness of the
County to make that investment;
(H) The alternatives to the contemplated purchase, sale and transfer and the

potential impact on both County and City utility customers if the Sebastian Utility System
is not transferred to the County;
(1) The ability of the County to provide and maintain high quality and cost
effective utility service; and
(J) A statement prepared by the City Manager showing: (1) the transfer of the
Sebastian Utility System to the County is in the public interest, including a summary of the
County's experience in utility operation; and (2) the County has the financial ability to
provide, now and in the future, high quality and cost effective utility services.
SECTION 4. AUTHORITY TO COMPLETE PURCHASE AND SALE. An
interlocal agreement between the County and City entitled "Interlocal Agreement Providing
for the Transfer and Assumption of the City of Sebastian Water and Wastewater System"
which sets forth the consideration for the purchase, sale, transfer and assumption of the
Sebastian Utility System is attached as Exhibit "A" to the Resolution. The Council hereby
authorizes and directs the Mayor to execute such interlocal agreement on behalf of the City
in substantially the form of the agreement attached hereto as Exhibit "A" and to deliver a
fully executed copy of same to the Clerk of the Circuit Court for recording pursuant to
Section 163.01, Florida Statutes. The officials, officers, attorneys and other agents or
employees of the City are hereby directed and authorized to do all acts and things required
of them by this Resolution and such interlocal agreement, for the full, punctual and complete
performance of all of the terms, covenants and agreements contained in this Resolution and
such interlocal agreement, and each such official, officer, attorney and other agent or
employee is hereby authorized and directed to execute and deliver any and all papers and
instruments and to do and cause to be done all acts and things necessary or proper for
carrying out the transactions contemplated by this Resolution or such interlocal agreement.
SECTION 5. CONFLICT. All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed. This Resolution supersedes Resolution No. R-95-42.

SECTION 6. APPLICABILITY AND EFFECTIVE DATE. This Resolution
shall be liberally construed to effect the purposes hereof and shall take effect immediately
upon its adoption in accordance with applicable law.
