RE: Payment of Impact Fees
Dear Mr. Hyatt:
It has come to my attention that the home at 2114 East Lakeview
Drive in Park Place has been sold to Park Place Sales, a DMV
dealership. Also, I have been informed that since the home was
bought by a dealership, no impact fees had to be paid until the
home was resold to another individual. Unfortunately, this line of
reasoning is totally incorrect. The County Takeover Agreement of
July 11, 1989, specifically states in Item 6 that when a home is
resold, the impact fees will be paid by the Seller without regard
to the 5 year Seller's grace period. There is absolutely no
provision to exempt a dealership or anyone else. Simply stated,
once a home is sold, the impact fees must be paid. The grace period
does not pertain in this type situation.
By virtue of this letter, please remit the water impact fee of
$1100 to the City of Sebastian and $2551 Sewer Impact Fee to Indian
River County Utilities Department. Thank you for your anticipated
co-operation.

On August 18, 1995 Mrs. Warner called concerning her father, Frank
Mitschang's, home at 2114 E. Lakeview Drive, Park Place. She
stated that Nelson Hyatt had purchased the home on August 15, 1995.
Mrs. Warner stated the she questioned Mr. Hyatt concerning
payment of impact fees and was told not to worry, it was taken care
of. I called Park Place the same afternoon and spoke to David
Hyatt. Mr. Hyatt informed me that the home was purchased by Park
Place Sales, which is a DMV dealership. He stated that since the
home was bought by a dealership no impact fees had to be paid until
the home,was resold to another indivi4ual� Mr. Hyatt said that
this had been agreed upon in the past;. #e didn't know if this
agreement was with City or County official . I was not aware of
any type of agreement postponing payment, of impact fees if a
dealership bought a mobile home. Please a4vise me if any further
action on my part is needed in this situat on.

SUBJECT: Impact Fees - Park Place
As you know the sewer and water impact fee for Park Place has been an ongoing item of
discussion. However, we have been able to obtain a change in "heart" from the County, so
the following policy is now in effect, for Park Place only.
a. Since impact fees will be held in escrow by the developer (Mr. Hyatt) pending
a change to the "Agreement" regarding impact fees for Park Place.
b. In the event the County changes their mind, the sewer impact fee will be
collected from Mr. Hyatt and remitted to the County. -
C. Water impact fees are payable to the City and there will be no change in this
procedure.
In summary, we collect and retain water impact fees and require Mr. Hyatt to hold sewer
impact fees. Once the new "Agreement" is finalized, we will change our policy and abide

I have received your letter of March 10, 1995 in reference to
the water and sewer bills for the following addresses.

Bills for 2210 E. Lakeview, 2073 E. Lakeview, and 3603 W.
Derry Drive are acknowledged as being paid in full.
The $5.00 late charge that you requested to be waived has been
done so for 1027 W. Lakeview Drive and 3611 W. Derry Drive because
of the extended grace period the City provided for customers to pay
their bills in late December. Our office was closed down on
December 23rd and 26th, 1994, and bills that were due could not be
paid in person at our office. Therefore, the payment period was
extended to December 29th.

No credit will be due for 3305 E. Derry Drive. As I discussed
with Nelson Hyatt, stormwater runoff was intentionally drained from
Lot 3309 to the sewer lateral on 3307 on Nov. 18, 1994 by the work
crew in Park Place. Although the City could have imposed a fine
and demanded payment for treating an estimated amount of gallons
drained off the lot, it will consider the charges incurred on
3305 E. Derry Drive as a trade off.
Credit will be issued for one $5.00 penalty for 3329 E. Derry
Drive, since bills that were delivered remained in the mail box.
I am curious as to why the bills weren't forwarded to Ann Buhrow
after she moved away, though. The reconnection fee of $18.00 will
not be credited since it covers the cost of transferring the
account into the name of Park Place and physically involves our
Utilities personnel in having to remove the lock on the meter
valve.
No credit will be issued for 3606 W. Derry Drive for
penalties. One $5.00 penalty was incurred by the owner on
September 23, 1994 for non-payment. The other two penalties were
incurred on Oct. 21 and Nov. 22, 1994 by Park Place after the City
was notified by Park Place on October 11, 1994 to change the
billing address. The reconnection fee of $18.00 will not be
credited since it covers the cost of transferring the account into
the name of Park Place and involves our personnel labor costs to
physically remove the lock on the meter valve.
In regard to 3535 South Derry Drive, before any consideration
for issuing credit for a leak is given, I need proof of how the
leak occurred, when and how the leak was corrected, and either a
bill from the plumber with a description of the work performed or
a dated invoice for materials used for the repair of the leak.
In checking our records for the above addresses, our staff has
found that the following residences have not had impact fees paid:
3329 East Derry Drive
3535 South Derry Drive
3611 West Derry Drive
Should the impact fees not be paid because the homes have not
been resold, please remember that impact fees are due upon closing
when the homes are purchased by a new owner. If our Dept. learns
that a new owner moved into a home where the impact fees were not
paid, our Dept. will promptly shut off the water until impact fees
and other charges for service are paid. Please inform me as to why
the impact fees haven't been paid to date for the above residences.

SUBJECT: Change of Ownership of Park Place Mobile Home Park
Mr. Joe Morozowski, past Vice President of the Park Place
Homeowners' Association, called me this morning to tell me that
Nelson Hyatt had recently sold Park Place. Mr. Morozowski said
that he had an attorney in Vero Beach review the July 11, 1989
County Takeover Agreement between Indian River County and Nelson
Hyatt, with specific regard to the payment of the $10.00 monthly
surcharge.
The attorney informed Mr. Morozowski that there was no provision in
the Agreement which allowed the City to continue collecting the
surcharge for a new owner. Based on the attorney's opinion, Mr.
Morozowski will not pay the $10.00 surcharge on this month's
utility bill.
I informed Mr. Morozowski that I would bring this matter to your
attention, but unless I received authorization from you, I could
not automatically discontinue the collection of the surcharge on a
monthly basis. Although the issue is a legal one, I am of the
opinion that the Takeover Agreement mandates the City to collect
the $10.00 surcharge for Nelson Hyatt regardless of whether or not
he sells Park Place. The surcharge is payment to Nelson Hyatt for
the improvements he made when he constructed the utility system.
I would like your opinion and/or that of our City Attorney on this
matter, so that I can contact Joe Morozowski before the due date of
his next bill in February.
Also, now that Park Place has been sold, will the City now have to
negotiate with the new owner to procure the necessary right-of-way
for Barber Street?

SUBJECT: Water Complaint
I received a call from Darryl Hyatt who stated that the water in
the toilets in the clubhouse was dirty. After lunch, I checked the
water in the restrooms. The water in the toilets seemed clear.
There was more color in the hot water in the sinks than in the cold
water.
The cold water was quite clear; the hot water was somewhat a very
light rust color. I checked the iron content and found it to be
0.1 ppm on the color wheel Hach test kit.
Since there was a water main break at Palm Lake Club yesterday, it
was more than likely that the velocity of the water in refilling of
the water mains carried rust in suspension, which will take a
couple of days to settle out before the water is clear again.

SUBJECT: Illegal Draining of Stormwater into the City's Sanitary
Sewer System
Harry Asher, Assistant Utilities Director of Indian River County,
called me at 3:50 p.m. to tell me that someone at 3309 E. Derry
Drive was illegally draining stormwater into the Park Place sewage
collection system. I drove to the address and saw that there was
a new mobile home which had been recently placed on the lot.
An Allis-Chalmers front end loader was on site which had been used
to spread sand around the lot. When I arrived at 4:20 p.m., the
machine was shut down and no one was around. The lot apparently
had been flooded on the north side, from front to rear, as
evidenced by the residual mud line on the grass on the north side
near the home on 3307 E. Derry Drive. The sand and soil mixture on
the lot was very wet and pumped water as I walked on it.
A small trench from 3309 E. Derry Drive led directly to a hole on
Lot 3307 in which the existing 4" PVC sewer lateral was located.
The small trench, approximately 6" wide, emanated about 10 feet
south of the hole. It progressively became deeper toward the hole.
At the shallow end, it was about 3" - 4" deep. At the edge of the
hole, it was about 8" - 10" deep. Approximately 5 feet of the
trench on the south side had been run over by the front end loader,
obscuring the trench (but a faint outline was still present). It

indicates that the trench curved to the west into an area which had
apparently been wet. There was a deep indentation in the soil not
too far from where the small trench seemed to terminate. The
indentation was caused by a wheel on the front end loader whose
weight had displaced the soil because of saturated conditions.
I was able to take a stick and probe the hole. I determined the
shape of a cap over the sewer cleanout. A piece of the PVC pipe
which included a straight section, 4" long, a 90 degree elbow and
another straight section 6' long, had been removed and was laying
alongside the hole. The glued joint around the elbow had turned
yellow, indicating that the pipe had been there for quite awhile.
Both Nelson Hyatt and Mike Cairns stopped and inquired as to what
I was doing there. I told them that I had received a call from
Harry Asher, Indian River County Utilities Assistant Director, who
explained that someone was draining stormwater from this lot into
the sewer system. Nelson and Mike professed that they were not
aware of this and that the workers who did this would be in a lot
of trouble. Nelson and Mike left around 4:50 p.m. and told me that
they would talk to the workers and get back with me.
I spoke with Joan Mira (589-5326), resident of 3307 E. Derry Drive.
Mrs. Mira said that prior to Tropical Storm Gordon, there were four
piles of sand dumped on Lot 3309 in the front yard near the road on
Monday. These piles prohibited the lot from draining to the road.
On Tuesday, the storm hit the area. No workers came to the site.
As a result of the rainfall on Tuesday, Mrs. Mira's yard flooded on
the south and west sides. Her air conditioning unit on the south
side of her house was partially submerged by waster as was her well
pump in the rear of her house. She hadn't turned either of these
on for fear that the water would short them out. Mr. Don Porter of
Lot 3313 walked by at the time and verified what Mrs. Mira had told
me.
According to Mrs. Mira, the hole was dug during the latter part of
the previous week. She did not recall seeing the white PVC section
of pipe laying on the ground. On Wednesday, there were three men
working on the hole around 11:30 a.m. She did not notice the small
trench until Wednesday following this activity after the water
drained off her lot and Lot 3309. She did not notice any pumps on
site. She did, however, observe the surface water going into the
hole.

In all practicality, it is my personal opinion after having visited
the site, that the surface water on the lot could have easily been
pumped down with a diaphragm pump. The hose could have been
discharged into the drainage canal on the other side of East Derry
Drive. Obviously, this was not done because the park residents had
not observed any pumps being used on the site.

It appears from your latest FAX that you have not received the information relayed to
your office or you are ignoring the content of this information for whatever the reason.
The Stratton/Barber Street is owned by Nelson Hyatt. I have no
document indicating conveyance or acceptance by the City. I do have a
new engineering/survey document that indicates a realignment of the
right-of-way as requested by our City Engineer. I have requested an
inspection of the roadway to determine if it meets FDOT specifications.
If it does, we can then proceed to the next step, which is to draft the
document of conveyance.
2. I have a file regarding the proposed or requested cut -through on U.S #1,
and copies of a petition sent to Representative Sembler. I would suggest
you contact him and determine the status of your request. He is up for
re-election,
3. The surcharge is an issue that can only be changed by Mr. Hyatt. The
contract provides that we charge, collect and remit the funds to Mr. Hyatt.
4. 1 am still positive, not negative as you claim.
The City will not provide additional funds to the County in order to
reduce the impact of the relationship to impact fees and the (5) five year
build out. The City is still willing to agree to the (10) ten year build -out
figure, as long as the County agrees. They were the entity that accepted
the original five (5) year term from Mr. Hyatt and programmed their costs
accordingly. If they are not willing to extend these terms for another five
(5) years, it is a moot issue, for the present.
6. The temporary hold on the date for enforcement of the July 11, 1994 date
to collect impact fees was related to City Council action. It was evident
at our meeting that the administrative process to change the five (5) years
to (10) years would go beyond the July 11, 1994 date. Hence, we would
not hold up your action accordingly. However, when I faxed to you the
memo from our City Attorney and the information from the County, it was
evident from these two documents that the City cannot change the terms
without County approval. Therefore, until the County changes their mind,
the terms of the document stand.
7. Your FAX to me on 7-12-94 has been answered. Why do you continue
to ignore the information?

I have reviewed your memo dated June 29, 1994 regarding the
amendment to the Nelson Hyatt - Indian River County Agreement,
dated July 11, 1989. With regard to your proposed amendment, I
have the following comments.
1. Rather than doing an addendum, it is my suggestion that
we simply write a new agreement with Mr. Hyatt, and reference
within that new agreement that the new agreement supersedes the
agreement dated July 11, 1989. The only reason I make this
suggestion is because it makes it easier for future individuals
trying to interpret agreements to be able to review one document
and not have to look at a document then read subsequent amendments
to it. Further, there is always the possibility that the amendment
could get lost or not attached to the original document properly
and create confusion as to what the actual agreement is.

This letter is a follow-up to our telephone call this morning, September 27, relative to the Nelson
Hyatt dedication of Barber Street to the City of Sebastian. Mr. Hyatt's prior attorney, Fred Gallagher
(now deceased) handled this transaction for him. Recently, Mr. Hyatt delivered Mr. Gallagher's file
to me. It appears that this process started in early 1992 and for some reason has yet to be concluded.
It is my understanding that Mr. Hyatt and the City of Sebastian are anxious to get this right-of-way
dedicated to the City.
In an effort to help you become familiar with the situation, I am providing you with copies of the
correspondence and documents concerning this matter. The following are enclosed:
1. City of Sebastian Ordinance No. 0-81-25-B and Ordinance No. 202-7 dated March
21, 1984. I would like to call your attention specifically to paragraph 2 which required a conveyance
of an 80 foot right-of-way. Amazingly, these Ordinances which approved the Mobile Home Planned
Unit Development of Mr. Hyatt were approved on March 21, 1984.
2. January 24, 1994, letter from Charles I. Nash, former attorney for the City of
Sebastian, to Daniel Eskis, City Engineer of Sebastian, outlining the requirements for the
conveyance.
3. Title Insurance Commitment in the amount of $100,000.00 dated May 4, 1992.

4. Warranty Deed between Villages of Lake Dolores, Inc., and Nelson C. Hyatt, as
grantor, to City of Sebastian, grantee, dated May 20, 1992. Please note attached legals and surveys
have since been updated.
5. Two Land Surveys and Legal Descriptions, one of which is dated 2/8/94 and
the latest dated 8/18/94. I believe these surveys included the proposed easements set forth in
items 4 and 5 of Mr. Nash's January 24, 1994, letter. The Land Survey dated 8/18/94 includes
a legal description of Barber Street and a survey and legal descriptions for the easements
designated as Easements A and B. These were prepared by Hayhurst Land Surveying with the
survey dated 8/18/94 and the legal descriptions dated February 21, 1994. I believe this is the
latest survey containing the legal descriptions that are necessary for the conveyance.
6. Proposed Landscaping and Lawn Maintenance Agreement the author of
which is unknown. It appears that the City and Mr. Hyatt were agreeing that Hyatt would be
allowed to landscape and maintain the area which is situated in front of his mobile home park but
located in the right-of-way which is being conveyed.
While reviewing the contents of this file, I discovered that the property is encumbered by certain
mortgages which will need to be released. It appears an attempt was made to obtain partial
releases in 1992; however, the legal descriptions have changed since that time. As a result, new
partial releases will be necessary.
After you have had an opportunity to review the enclosures, please call me so that we discuss
what further steps need to be taken to bring this matter to a conclusion. I am looking forward to
working with you and will be pleased to cooperate with you in making whatever changes are
required.

Dear Nelson:
Several months ago, I showed you where one of our employees had discovered
a 2" blowoff at the end of the water main on Brigadoon Drive. Unfortunately, it was
discovered that when the water main and blowoff were installed, the pavement was
constricted over them.
I had told you that all of the blowoffs that were indicated on the water system
plans for Park Place should be opened on a monthly basis to flush stagnant water at all
of the dead end mains. Other than Brigadoon Drive, we still don't know where the
blowoffs are at the end of East Lakeview Drive and West Lakeview Drive. I certainly
would like to locate these as soon as possible. They may be under the pavement as
well.
Meanwlule, as you mentioned to me at the meeting we had at the site of the 2"
blowoff on Brigadoon, you would have Daryl or someone else move the 2" blowoff to
the side of the street outside of the pavement. I have been informed that this has not
been accomplished yet and that a sizable hole has been left in the street. Please
schedule the work to be done as soon as possible, and keep me informed.

Mike advised me that he had no idea what I was talking about. He
stated that he and Nelson Hyatt had been negotiating with Mr.
Koford and Mr. Koford had assured them that there would be a
temporary policy put into effect regarding the impact fees. Mr.
Koford was not available for me to talk to at the time. Mike
requested that a written policy sent to Park Place.
Since I had notified Marge Poole in the Finance Department earlier
in the day that impact fees were to be charged for Park Place, I
notified Marge Poole of my conversation with Mike Cairns. I
advised her that I would let her know the outcome of my
conversation with Mr. Koford. At 2:30 pm Marge Poole notified me
that she had spoken to Mr. Koford and Mr. Koford said that impact
fees were to be charged in accordance with the interlocal
agreement.

I spoke to Mike at 3:30 pm on July 12, 1994 and reiterated the
conversation I had with Mr. Koford. Mike was extremely upset that
Mr. Koford had not directly informed he or Nelson of the situation.
Mike stated that he would be at the next City Council meeting to
address the issue before Council.

Park Place Sewage Treatment Plant
I called Harry to ask when the Park Place Sewage Treatment Plant
had been removed from the site. Harry said that the plant had
been removed from service some time in 1989 when the lift station
and force main were activated to pump sewage south to the
County's Hobart Park Wastewater Treatment Plant. He said the
plant stayed on site for about a year to a year and a half. The
County put it out for bids. The bids were about $1000 to $1500.
As a result they were rejected. Eventually, the County landfill
purchased it for $10,000 and tracked it down. The County
landfill is using it to treat leachate.

Questions Following the Presentation Made By Richard Votapka and
Robb McClary at the Park Place Clubhouse to Residents of Park Place
and Palm Lake Club.
1. Can the ends of dead end mains be blown off every three months
at the end of Brigadoon Drive, West Lakeview Drive, and East
Lakeview Drive?
Yes
2. Is there a budget system to pre -pay the water & sewer amounts
over a 12 month period?
Yes, pre -payments are accepted
3. Question as to THM's - will they be taken care of?
THM's are not applicable to the Park Place System, only GDU's
water system.
4. Question regarding surcharge - why does only Park Place pay
for this; Palm Lake Club is not involved with the agreement?
The County negotiated an agreement in 1989 with Nelson Hyatt.
The surcharge is a payment for Hyatt's development costs and
no one else's. A different agreement was negotiated with
Henry Fischer, developer of Palm Lake Club.
5. Why is Park Place paying for the $777,000.00 and not the rest
of the County?
The County entered into a separate contract with Nelson Hyatt,
the developer of Park Place, to acquire the system. The price
was specifically negotiated with Nelson and he is being
reimbursed through the utility bill surcharge over the course
of 10 years.
6. How will GDU's system be paid for?
The customers will pay for the takeover - present and future
customers. Repayment will be built into the rate structure
itself. The City will modify the plant and remove the THM
problem once the City purchases the GDU system. The City will
keep the expenses down as much as it possibly can.
7. Will Park Place pay for the GDU system once connected?

The City will want uniform rates and the debt service will be
included in the rates. The Park Place surcharge will be
eliminated if an agreement can be negotiated with Nelson
Hyatt. A water main will have to be constructed from the GDU
system to Park Place to eliminate the existing Park Place
water plant. GDU customers will help to pay for the cost of
this. Therefore, Park Place can help pay for the GDU system
as well, since they will be getting their water from the GDU
plant.
S. A water pipe broke on the individual's side of the meter. The
customer doesn't think the County was justified in charging
for the water.
We will, as a City, look at this under special circumstances.
The City's responsibility ends at the meter. Normally, the
Utility Company charges for the water lost. The City Council
may have to act as an adjustment board to resolve this type of
an issue.
9. A resident understood that Hr. Hyatt has to be reimbursed for
the water system. Who owns the system when Hr. Hyatt is paid
off?
Robb said that the City of Sebastian will. Initially, the
County would have. Now the County has transferred the Park
Place System to the City.
10. Why do we have to pay the sewer impact fees?
Robb said that there is nothing the City can do since the
County owns the sewage plant and transmission system. The
City collects the impact fees and remits them to the County.
11. Bob Freeland took exception with Robb's statement that City
Council sets policy and staff does not set policy. Bob said
that Council listens to consultants and staff. Therefore,
policy is based on this.
12. Steve Pitiak spoke. He thinks that Hr. Nelson Hyatt and the
City should be held to a "hold harmless" agreement. Why did
the City adopt the rates the County had?
The City adopted the County's Rate Resolution when it took
over Park Place and Palm Lake Club to maintain continuity.
The expense is not justified to do a full blown rate analysis
as there is such a small customer base. A rate analysis will
be done when the City purchases the GDU system.

13. Questions regarding expansion into new area. Rich explained
article regarding the Public Service Commission - will the
City of Sebastian be affected?
No, the City is not regulated by the Public Service
Commission.
14. Question regarding how impact fees and increments are tied to
Engineering News Record Construction Cost Index.
Initially Impact Fees are determined by consultants who do a
major fiscal analysis of the water and wastewater systems.
There was an impromptu straw poll taken by Robb McClary as follows:
Option 1 Who hates the $10.00 surcharge the most? 10 people
Option 2 Who hates the fact that the Impact Fees are due
on sale of the mobile home? 40 people
Option 3 Who hates the water & sewer rates the most? 42 people
Robb told the audience to only vote once. If they cast a vote for
one option, they couldn't vote on another. However, some people
raised their hand for each.
Robb said that he would hope Mr. Hyatt would give us the system.
However, so far that hasn't happened. Robb said that he and I have
been negotiating with Mr. Hyatt and hope to reach a mutually
beneficial agreement. Once the Park Place System is merged with
the GDU system, when the City buys it, the $10.00 surcharge should
disappear and the rates should be lower.

SUBJECT: PURCHASE OF NELSON HYATT WATER AND SEWER UTILITIES
(NHW&SU)
Indian River County has received an offer of sale from the owner of
NHW&SU to purchase the NHW&SU. Indian River County must comply with
Florida Statutes, Section 125.3401, as stated below. It is the
intent of this report to assist the County with the compliance.
Section 125.3401. Purchase or sale of water or sewer utility
by County. -- No County may purchase or sell a water or sewer
utility that provides service to the public for compensation
until the governing body of the County has held a public
hearing on the purchase or sale and made a determination that
the purchase or sale is in the public interest. In determining
if the purchase or sale is in the public interest, the County
shall consider, at a minimum, the following:
1. The most recent available income and expense statement for
the utility (attached);
2. The most recent available balance sheet for the utility,
listing assets and liabilities, and clearly showing the
amount of contributions -in -aid -of -construction and the
accumulated depreciation thereon (attached);

4. The physical conditions of the utility facilities being
purchased or sold:
WASTEWATER TREATMENT PLANT
The wastewater treatment plant which is currently serving
Nelson Hyatt Water and Sewer Utilities is an 0.130 million
gallon per day (MGD) extended air treatment process
wastewater plant. The disposition of effluent is by means
of two percolation ponds. The plant currently operates
within Federal guidelines, as do the percolation ponds.
The collection system is composed of 811 PVC. The
transmission system is composed of 611 and 411 PVC force
main with two lift stations.
The utility was inspected in February, 1989, and a listing
of items that would need to be addressed was developed.
The memo is attached.
WATER TREATMENT PLANT
The water treatment plant is an 0.100 MGD water plant; it
is a standard aeration/chlorination type plant, drawing
water from the surfacial aquifer.
The distribution system is composed of 1011, all and 6"
polyvinyl chloride pipe (PVC) water mains. services are
metered.
There are also several deficiencies associated with the
water plant (see the attached memos from John F. Lang,
Environmental Specialist).

5. The reasonableness of the purchase or sales price and
terms:
Terms of Purchase: See the attached contract documents.
6. Impacts of the purchase or sale price on the utility
customers:
The purchase of NHW&SU by Indian River County will
ultimately allow for connection of NHW&SU into the
County's utility systems. This will aid in
regionalization of the county's utilities, which
eliminates proliferation of private utilities and provides
for better overall water quality control for the North
County service area.
Based on current consumption statistics, a single family
home using 3,000 gallons of water per month would, under
existing NHW&SU rates, pay $30.00 a month. Under the
County rates, plus a $10.00 surcharge, the monthly charge
would be $35.08 a month, an increase of $5.08 per month.
The long-term effect of this buy-out will be a higher
level of service to the utility customers in the North
County area. Also, given all the deficiencies associated
with these systems, if the utility was to remain private,
the utility rates would most likely increase dramatically.

7. Additional investment required:
The investment to upgrade the utilities at NHW&SU is well
within the County's abilities, given the magnitude of
financial resources of the County's water and wastewater
impact fee fund and the County's past, present and planned
commitments to maintaining and expanding service to meet
effectively and efficiently the water and wastewater needs
of the County populace.

The County Utilities Department is currently moving to
regionalize water and sewer service within the County. If
we do not purchase the NHW&SU, it could lead to a further
increase in the proliferation of private utilities in the
area.
Long term, a higher level of service will be provided by
the County's Utilities service.
9. Ability of the purchaser to provide and maintain high
quality and cost-effective utility service:
The County's finished water and treated wastewater at all
their plants is in compliance with State and Federal
regulatory requirements, demonstrating the ability of the
County to provide and maintain high levels of quality and
service. The cost of providing services is reasonable,
considering the type and size of the facilities.

CONCLUSION
The purchase of NHW&SU benefits both the customers of the
utility company and Indian River County Utilities. The
customers will realize a consistent and reliable quality of
service for which Indian River County is known.
Indian River County's water and wastewater utility begain in
June of 1978 with the acquisition of a small utility system in
' the Gifford area. The purpose of the acquisition was to
improve water and wastewater service to the residents. Since
then, the utility system has grown from an initial customer
base of 300 water and 126 wastewater customers to more than
6,181 water accounts.
The NHW&SU water and wastewater company can be readily
incorporated into the County customer base without significant
effect on the operating costs of the County facilities, and
with no effect on the rates and charges of existing County
customers.

BACKGROUND:
The Nelson Hyatt Water and Sewer Utilities currently serves
approximately eighty customers within the Park Place Mobile Home
Park% 9605 U.S. Highway 1,
The Wastewater Treatment Plant is an 0.130 million gallons per day
(MGD) extended air treatment process wastewater plant.
The Water Treatment Plant is an 0.100 MGD -water plant; it is an
aeration/chlorination type plant with a raw water feed.
The utility has been through a bankruptcy and repossession during
the past twelve months.
The utility wishes to sell the system and, as a result, the County
has been negotiating its purchase. The negotiated price at this
time is $777,000.00.
ANALYSIS•
The County's policy has been to acquire such privately held
utilities and to expand its regional and subregional water and
wastewater facilities. Acquisition of this system will assist us in
implementing this policy for the,North County area.
Acquisition costs are to be financed at no interest through a
surcharge of approximately $10.00 per customer per month, for a
period of ten years. Based upon an average usage of 3,000 gallons

customers would realize an estimated increase of $5.08 in their
monthly charges.
RECOMMENDATION:
The staff of the Department of Utility Services recommends that the
Board of County Commissioners conceptually approve the proposed
Purchase agreement, based upon the outcome of the Public Hearing.

Terry Pinto, Director of Utility Services, explained that
the Lake Delores utility system is located within the City of
Sebastian and falls under the terms of the franchise issued by
that city. Their franchises are written a little bit differently
than niirs with regard to provisions for the purchase of the
utility. The purchase price is based on the value of the system
itself. This facility has changed hands and names several times.
It went into bankruptcy, and the present owner, Nelson Hyatt, got
back all the assets through bankruptcy. Over the past 6 months �(
we have negotiated a method of purchasing this system that would
not affect any of the existing customers of the county utility
system in a negative way and would be something that the present
customers within the Lake Delores system could live with. The
total potential build -out of the mobile home park is 650 units,
but there are only 100 units at present. State statute requires
us to go through various steps to analyze the value and the
assets of a utility and what it would do to our system if we
purchase it and bring it into our system.
Director Pinto emphasized that because of its location, the
acquisition of this utility is very crucial to the planning for
the north county utility system.
Commissioner Scurlock asked how our purchase price compares
to the original cost, and Director Pinto explained that the
maximum value of $777,000 doesn't mean that Mr. Hyatt is going to
be paid that much. The purchase price is based on a surcharge of
$10.00 per unit over a maximum of 10 years. This means that the
owner would get only $10.00 for every unit that is in place at
the end of that 10 -year period. We projected out what we thought
was a fairly liberal build -out schedule for the park, and even
with that, the maximum purchase price would be around $600,000.
However, if it clic) build out quicker, he would be allowed a
maximum price of $777,000, but we doubt very much if that would
take place. In any event, the total price would not exceed
$777,000, and in all probability, it would be lower than that.

Lengthy discussion ensued regarding the acquisition of a
facility with such a low customer base, and Director Pinto
emphasized that the primary concern is the consolidation of all
the systems up there.
Commissioner Bird felt that.the agreement needs to be
elaborated on, because as it reads now, it makes it sound like
there are only 8o customers in the system when there is a
potential 650 customers in the system. He felt that should be
spelled out in the agreement. Further, the purchase price should
read "up to $777,000."
Director Pinto explained that the agreement sets that out
very specifically.
Commissioner Eggert couldn't understand why staff's
recommendation, as set out in the above memo, is asking for
"conceptual" approval of the purchase'agreement, and Director
Pinto stated that they are not asking for conceptual approval
because the purchase price is $10.00 per month per unit for 10
years, not to exceed $777,000. That is what the purchase price
is, and that is how the agreement is written.
Commissioner Scurlock emphasized that staff is riot looking
for conceptual approval for these two items today. They are
looking for approval to purchase the system and adoption of an
ordinance establishing the surcharge.
Attorney Vitunac felt that what the memo meant was that
staff wants the Board's approval subject to the public hearing
and someone in the audience saying otherwise. What is being
requested is the Board's authority to sign this agreement and
have a closing at the end of this month.
Commissioner Bird was also concerned that the owner of the
facility Would be getting a free ride when it came to impact
fees, but Director Pinto and Commissioner Scurlock assured him
that was riot the case, and that all impact fees would be paid at
the appropriate time.

Chairman Wheeler opened the Public Hearing, and asked if
anyone wished to be heard in this matter. There were none.
Commissioner Bowman was concerned about the County buying a
another rinky dink operation, but Commissioner Scurlock
emphasized that no publir hinds are being used to acquire any of
these systems. lie pointed out that some of these franchises were
approved way back when, whereas current franchises do not allow
for this to happen. In fact, the existing franchises that we
approve entertain all the acquisition provisions and all the
renewal/replacement, and require all those escrow monies to be in
place. He wanted to make it clear on the record that Indian
River County does not allow franchises to be issued today to
leave all those deficiencies as a possibility.
Director Pinto pointed out that we have come a long way in
getting rid of these little franchises. We had about 130
facilities at one time, and now we are down to less than 60. In
fact, he would recommend that we not issue any more franchises.
Commissioner Bird wanted it made clear in the agreement that
after we buy the system any expansion of that system that is done
to accommodate those other approximately 600 lots will be done at
the developer's expense and not at the expense of the County
Utility Services Division.
Attorney Vitunac advised that it is automatically covered by
our standard policy. It will he a county facility, and if
somebody wants to add customers to it, they would have to do the
line extension themselves.
Commissioner Bird asked hog+• it would affect this agreement,
if that policy was changed in a year or so, and Attorney Vitunac
explained that if a developer wants future connections, he will
have to come in with a developer's agreement. It will be a
developer connecting to a county utility, and it will be done in
a standard way.
Commissioner Scurlock felt that the Commissioners don't want
the residents to become upset when they rear) in the paper tliat

the County Commissioners paid $777,00 for a little system with
only 80 units on it. He asked Attorney Vitunac if there is
anything we could include in the agreement that would give
Commissioner Bird a little more comfort, and Attorney Vitunac
advised that you can emphasize that not one dollar of public
funds is being spent to buy this system. We are taking over
their system August 1, 1989, and they are giving it to us for the
promise for us to charge their own customers $10.00 a month to
pay back to them for 10 years.
Director Pinto didn't want to reopen the negotiations on the
agreement and have to go back and get Nelson Hyatt's signature
again. If there could be an addendum, that would be fine.
Commissioner Bird stated he was convinced after talking with
Director Pinto yesterday and hearing all of this in—depth
dialogue today re impact fees, future 'connections, etc., that the
acquisition is basically a good deal for the County Utility
Division and that he would vote to approve the agreement.
Commissioner Bowman asked why the surcharge is to be in
effect for no more than 10 years, and Director Pinto explained
that we don't want them to receive more than what we think the
value of the system is.
ON MOTION by Commissioner Scurlock, SECONDED by
Commissioner Bird, the Board unanimously approved
the purchase agreement at a price not to exceed
$777,000 with the understanding that it is the
developer's responsibility for any expansion of pipe
lines within that system.

BE IT ORDAINED by Indian River County, acting through
its Board of County Commissioners, that:
SECTION 1. SURCHARGE ESTABLISHED

There is hereby established a special surcharge on the
monthly water and wastewater utility bill of the customers
of the former Lake Delores Utilities franchise territory,
which surcharge shall not exceed an additional $10.00 per
month per equivalent residential unit (ERU) over and above
the County water, and wastewater utility rate.
SECTION 2. SURCHARGE LIMITS
The surcharge shall be In effect for no more than ten
years from August 1, 1989.
Approved and adopted by the Board of County

owner' shall make the names and
addresses availahle upon rangy

restrictions imposed by governmental
entities and required to protect the
public health, safety, and welfare may
be enforced prior to the expiration of
the 90 -day period but are not
otherwise exempt from the
requirements of this chapter. Pass-
through charges must be separately
listed as to the amount of the charge,
the name of the governmental entity
mandating the capital improvement,
and the nature or type of the pass-
through charge being levied. Notices
of increase in the lot rental amount
due to a pass-through charge shall
state the additional payment and
starting and ending dates of each
pass-through charge. The
homeowners' association shall have
no standing to challenge the increase
in lot rental amount, reduction in
services or utilities, or change of rules
and regulations unless a majority of
the affected homeowners agree, in
writing, to such representation.
(2) Notice as required by this
section shall, in addition to the
information required in subsection (1),
only be required to include the dollar
amount of the reievant'parkans of the
present lot rental amount hist are

RE: Additional Fire Hydrants for Park Place Mobile Home Park,
Sebastian, Florida
Dear Nelson:
This letter is just a written follow up to our phone
conversation we had some time ago in regard to fire protection in
Park Place. In a residential district, the placement of fire
hydrants is normally determined by drawing a 500 foot radius from
each hydrant, as shown on the design plans, to ensure overlapping
protection coverage for all dwellings between hydrants. In
reviewing the Park Place water distribution plans that the County
gave to the City, I found that there were an insufficient number of
hydrants shown for your existing development.
In applying a 500 foot radius with coverage overlap, I find
that there should be a minimum of two (2) additional hydrants
installed in Park Place. I would suggest that these hydrants be
installed at the following locations:
1. South of the intersection of South Derry Drive and Heatherway
Lane Between Lots 3305 and 3395 on South Derry Drive.
2. Between Lots 1034 and 1036 on West Lakeview Drive.
Incidentally, Bob Korda, Sebastian's only Utility Service
Worker, did check the hydrant that is located in the undeveloped
portion of Park Place. The hydrant is situated north of West
Lakeview Drive and west of the guardhouse between future lots 2308
and 2310. He found that the hydrant is on a "dry" line and offers
no fire protection for the westerly portion of the Park whatsoever.
This hydrant should be made operational as soon as possible since
you do not have another hydrant providing fire protection coverage
west of your entrance road. In order to make this hydrant
operational, the line should be flushed and chlorinated before
being placed on line.

On December 21, 1993, I had to go to Park Place with Ron Briskie
for a meter installation on Heatherway Lane. While there,I checked
the valve box lids at the intersection of Heatherway and South
Derry Drive. To my surprise, all three lids have the words "Reuse"
on them. They must have "Water" on them. All three are to be
painted "Blue" and the one valve in the grass needs to have a
concrete pad around it. Return all three valve box lids to the
Vero Beach Warehouse as soon as possible in exchange for lids which
had the word "Water" on them. In the future, always check the
wording in the lids when you pick them up from the warehouse.
Also, I need a location sketch for the valves. They are to be
located on the plans.
As soon as possible, replace the double switch for the fan and
light by the door in the Park Place water treatment plant.

Dear Hal:
The following is a summary of the Park Place/Palm Lake Club
water and wastewater system as it presently exists:
The Park Place/Palm Lake Club water and wastewater system serves
two large mobile home developments in the southeast portion of the
City of Sebastian. Park Place is a residential mobile home
community which currently has 178 water and sewer customers with a
potential of 648 total customers, one for each residential unit.
Palm Lake Club currently has 25 water and sewer customers with a
potential of 136 total customers. The service territory was
initially known as The Village of Lake Dolores which was the former
name of the Park Place Mobile Home Park development. In 1989,
Indian River County began operating the water and wastewater
systems. On Hay 1, 1993, the City of Sebastian assumed the
operation of the systems from Indian River County with the
exception of the transmission and treatment of wastewater.
The City of Sebastian has acquired operation and maintenance of the
gravity sewer collection system in both Palm Lake Club and Park
Place and one sewage lift station located at the intersection of
Brigadoon and East Lakeview Drive in Park Place. The County owns
and operates a regional lift station in between both developments
which transmits the raw sewage to its North County Wastewater
Treatment Plant.
The City of Sebastian operates a 100,000 gallon per day
prefabricated steel water treatment plant at Park Place. There are
two wells located on the plant property. The primary well is 6" in
diameter with a 3" drop pipe and is capable of pumping 109,500 gpm.
The secondary or backup well is 4" in diameter with a 2" drop pipe

and capable of pumping 96,500 gpm. Raw water is pumped to a tray
aerator on top of a 32,320 gallon groundwater storage tank where
the water is chlorinated via a gas chlorination system. The plant
consists of two (2) 20 hp high service pumps which pump the water
into a 5,500 gallon hydropneumatic tank . Liquid levels and
pressure in the system are maintained by pressure switches.
Presently, the pressure in the system fluctuates between 42 psi and
62 psi. A contract Class "C" operator operates the plant. A 10"
main from the plant carries the water to the Park Place/Palm Lake
Club water distribution system.

RESUME OF CONVERSATION: I met with Harry Asher to obtain the documents that I
had requested on February 23, 1993. The list of documents requested and those
transmitted by the Indian River County Utilities Dept. are attached to this memo.
I asked Harry about the February 15, 1993 letter from Joseph McNamara of DER to the
County in reference to Park Place. The DER has requested that I. R. County install
a stationary generator for the Park Place Water Treatment Plant. Harry told me
that the County is not going to install a generator at the plant since the Park
Place Water system will be turned over to the City of Sebastian. Harry said he
would send me additional letters as referenced in the DER letter.
In talking with Harry, he mentioned that the Park Place system was connected to the
Pelican Point Plant on the east side of U. S. 1. The DER wants Indian River County
to install a stationary generator at that plant. Harry said that the County would
probably have to comply with the mandate. I asked Harry if the Park Place and
Pelican Point systems were connected, could not the County provide water to Park
Place on an emergency basis? Harry said that the County could. All that had to be
done is to open a normally closed gate valve on the shared main. This should
eliminate the need for a stationary emergency generator. Harry said that the County
has a shared main with a closed halve at the north end of Indian River Shores. The
County armed North Beach water system can receive or provide water to the Vero Beach
System through this common main should an emergency condition arise. Harry said
that there is no written agreement between the City and County and didn't think one
was necessary.
Harry told me that since the City will take over Park Place on May 1st, the City of
Sebastian will be responsible for collecting impact fees for Park Place.

Tncidently. Palm Lake Club is also included within the Park Place service
For "Sewer" only, the impact fee will be transferred to the Indian River County
Utilities Department because the County will be the provider for sewage treatment
at the Hobart Park Wastewater Treatment Plant.
In regard to the water meters in Park Place, Harry said that the City will take
over this responsibility from the County as of May 1st. After the City reads the
meters, the City shall furnish the meter readings to Indian River County Utilities.
The County will use the meter readings to bill the City for sewage fees. I asked
Harry to jointly read the meters at the end of March with the County's meter reader.
Harm said we should agree on the last readings taken for billing cut off purposes.
Harry said that we need to work out the mechanics of billings within the next two
months. I told Harry that I had a meeting with our Finance Director and Assistant
Director this afternoon about billings.
I also asked Harry about the meters referred to in Section 7.3 of the April 21, 1992
Interlocal Agreement between the City and the County. It states that "the County
shall read the meter for billing purposes." Harry said that these meters refer to
"sewage" meters, not the water meters in Park Place.
Re: 3:30 PM Telephone conversation with Harry Asher, Asst. Director, Indian
River County Utilities.
Following my meeting with Marilyn and Larry, respectively the Director and Assistant
Director of Finance, I called Harry Asher. I asked Harry to furnish us with the one
remaining item that our Finance Dept. needs - the "Accounting and Reconciliation of
Customer Deposits for Park Place." According to Harry, he thinks that Indian River
CounttV returned all of the deposits to the customers in Park Place! He'll check
on this for me and follow up with a letter. According to Larry Napier, the Count
only transferred the franchise fees to the City, not the deposits.

WASTEWATER TREATMENT PLANT
The shallow well located at the Wastewater Treatment Plant is
within 500' of the percolation ponds.
The Plant is missing a pretreatment zone. The force main
directly discharges to the surge tank.
There is not a functioning washdown system.
The splitter box does not work and is poorly designed.
The mixed liquor discharge box in the clarifier is too narrow.
The flow lifts the sludge blanket because it is highly
directed.
The hoses on the air lift are not the standard, long life,
outdoor use hoses, and need to be replaced.
The skimmer is too low and needs to be reworked to be
adjustable.
The chlorine booster pump is nonfunctional.
The plant provides secondary treatment only.
The panel for the facility is mild steel without a generator
receptacle, and has a live door.

The plant is missing a chlorine cylinder storage area.
The effluent line from the chlorine contact chamber is schedule
40 PVC pipe.
The chlorinator room is missing an outside switch for the fan
and light. Neither work.
The plant does not have a standby chlorinator.
The percolation ponds haven't any monitoring wells.
The pond base is within 100' of surface waters.
The pond berm on the north side has a power pole in its middle.
The effluent valves are buried in the dirt without any valve
boxes or a valve pit.
The Fischer fuel depot and garage are directly west of the
percolation ponds end drainage ditch abuts the westerly berms
and the railroad ditch lies within 50' of the easterly berm.
The power pole for the plant is listing at a 5 degree angle and
should be braced and secured.
The clarifier sweeps are missing a portion of the bottom of the
clarifier, as per the operator.
The plant doesn't have a flowmeter and has no provisions for
one.
The plant hasn't any lighting.
The surge tank's panel hasn't an alarm light, lightning
protection, or seal failure relays. The door is live.
Pond data is attached.
The plant is missing a security fence for the site.
WATER TREATMENT PLANT
The plant has two shallow wells, a 6" well capable of 100 gpm
and a 4" well capable of 150 gpm. Primary and secondary
analyses were run when drilled. The wells' pumps are not
interconnected at the wells and the pumps do not alternate.
The pumps are unsecured and vibration has caused leaks.
All piping is Schedule 40 PVC and is deteriorating.
The chlorinator shed doesn't have an outside switch. The light
does not work.

The plant does not have a chlorine storage area.
The wells are directly off of the entrance road and are
unprotected physically and hydraulically.
The plant is missing a flowmeter.
The blowoff valve on the hydropnuematic tank is missing.
The aerator's wood structure and the screening needs to be
replaced due to deterioration.
The ladder assembly for the aerator is missing.
The aerator trays are rusting and could be replaced with
fiber glass trays.
The aerator is missing a prechlorination system.
The plant panel hasn't any alarm system or generator
receptacle. The panel has a live door.
The compressor system is all manual.
' The third high service pump has not been installed. Fire flow
requirements could not be met.
The sight glasses have solvent welded joints that can't be
readily serviced.
The power line for the plant comes dangerously close to the
plant's steel structure.
There aren't any pump houses for the wells.
The well slabs are not adequate.
The wells are not interconnected.
The plant is lacking a security fence.
LIFT STATION #1
A washdown water source is missing.
The valve pit fills up with water, as no drainage was provided I
for.
The panel's upper and lower door closures don't work.
The meter service stanchion is of wooden 2" x 6" boards and a
pressboard sheet.

The vent screen is missing.
LIFT STATION #2
The meter station box, wet well, and valve pit are 6" below
grade.
The reduced pressure back flow preventer is missing from the
washdown water source.
The station is within 5' of a residential structural wall.

SERVING PARK PLACE MOBILE HOME PARK
BACKGROUND:
The Nelson Hyatt Water and Sewer Utilities currently serves
approximately eighty customers within the Park Place Mobile Home
Park.
The Wastewater Treatment Plant is an 0.130 million gallons per day
(MGD) extended air treatment process wastewater plant.
The Water Treatment Plant is an 0.100 MGD .water plant; it is an
aeration/chlorination type plant with a raw water feed.
The utility has been through a bankruptcy and repossession during
the past twelve months.
The utility wishes to sell the system and, as a result, the County
has been negotiating its purchase. The negotiated price at this
time is $777,000.00.
ANALYSIS:
The County's policy has been to acquire such privately held
utilities and to expand its regional and subregional water and
wastewater facilities. Acquisition of this system will assist us in
implementing this policy for the North County area.
Acquisition costs are to be financed at no interest through a
surcharge of approximately $10.00 per customer per month, for a
period of ten years. Based upon an average usage of 3,000 gallons
per month per customer paying current Indian River County rates,
plus the estimated $10.00 per customer per month surcharge, the
customers would realize an estimated increase of $5.08 in their
monthly charges.
RECOMMENDATION:
The staff of the Department of Utility Services recommends that the
Board of County Commissioners conceptually approve the proposed
purchase agreement, based upon the outcome of the Public Hearing.

The Park Place Water Treatment Plant has two wells capable of
currently delivering 132.5 gpm or 190.8 TGD. The wells, when
drilled, were rated at 250 gpm total pumpage. The site is permitted
by St. John's River Water Management District at 299 TGD max. day
and/or 150 TGD avg. day. A 150 TGD facility could serve Park Place
Mobile Home Park, Sand Lake Mobile Home Park, Breezy Village Mobile
Home Park and Fischer industrial Park until the North County Water
Treatment Plant came on-line in 48 months.
The two wells presently being utilized are shallow aquifer wells.
These type of wells are easily influenced by adjacent well
withdrawal rates and water tables, as well as groundwater
contaminants. The water treatment plants at Park Place and at
Breezy Village deliver water which violates the secondary
contaminant MCL for color; twenty color units delivered versus a MCL
of 15 color units. Joe McNamara of DER's Orlando office is
currently considering a variance for this MCL.
The County currently has 310 TG of ground storage and 12 TG of
pressurized storage in stock. A third well has not been permitted
for the site, and a third high service pump could be installed at
the package facility at the appropriate stub -in points. The water
plant site is adequate to install these improvements. The plant, as
delineated in the memo of February 24, 1989, has many small repair
needs. The electrical portion of the plant is inadequate,
unidentified, not to code, and will not pass DER inspection as
permitted. The plant could be upgraded via design, permitting,
bidding, and construction as a County project within 12 months.

WASTEWATER TREATMENT PLANT AND LIFT STATIONS
The wastewater treatment plant which currently serves Nelson Hyatt
Water and Sewer Utilities is a .130 MGD contact stabilization
treatment process package plant. The plant is currently permitted
at .096 MGD due to the lack of a monitoring well system. The
ultimate disposition of effluent is by percolation to shallow
groundwaters via a dual cell percolation pond.
The collection system is composed of 8" PVC pipe. The transmission
system is composed of 4" and 6" PVC force main pipe with two
associated lift stations, one main repump station and a subsidiary.
WATER TREATMENT PLANT
The water treatment plant is a .100 MGD aeration/chlorination
package plant, drawing water from the surfacial aquifer. The
distribution system is composed of 1011, 811 and 611 PVC water mains.
Services are metered.
THE UTILITY
The utility was inspected in February of 1989, and a listing of
items that would need to be addressed prior to purchase was
developed. The memo is attached.

Mr. Cioffi (Chofee) 589-3972 of Park Place called me. He said that
he was interested in selling his mobile home. He wanted to know if
he had to pay water and sewer impact fees. I read him Section 6 in
the County's July 11, 1989 Takeover Agreement with Nelson Hyatt and
told him that impact fees were due upon resale of his mobile home.
He asked if this was legal. I told him that the agreement had been
negotiated between Nelson Hyatt and Indian River County in 1989 and
transferred to the City of Sebastian by a mutual Interlocal
Agreement dated April 12, 1992. The document was discussed at
numerous public hearings held at the County Commission and City
Council meetings. The document was legal.
Mr. Cioffi told me that he heard GDU's. water was undrinkable and
that Park Place would be connected to GDU someday. I told him that
if the City purchased GDU, we would connect the Park Place system
to GDU to have only one plant and abandon the smaller Park Place
plant. As far as the water being undrinkable. I drink it everyday
because I am on the GDU system. I happen to think the water is
fine. He wanted to know about THM's so I explained to him that the
risk factor is such that if a person drinks 2 liters of water
everyday of his/her life for the next 70 years, he/she stands a 1
in 10,000 chance in getting cancer. My personal opinion is that
this is a very slight risk to be worried about.
He said he thought the impact fees were unfair and so was the
surcharge. I explained to him that the City adopted the rates,
fees, and charges from Indian River County and that everyone in
Indian River County pays the same rates regardless of location.
Mr. Cioffi wished me a lot of luck. He said he would stop in and
see me and give me a letter he had written to the editor of the
Press Journal regarding Terry Pinto, Director of Indian River
County Utilities.

According to Nelson Hyatt and Mike Cairns, all charges have been
waived for 5 years. They said to look at the Intergovernmental
Agreement.
Nelson Hyatt and Mike Cairns, of Park Place, said that in the past
Park Place never paid any meter installation fee ($130.00) and
$25.00 for Inspection Fees for water and sewer ($50.00)
On May 18, 1993 Lori Kowalski said that Park Place had installed
some meters and boxes on lots. If this was the case, there will be
no charge. If it is a model home and already connected, $18.00 is
charged for a transfer fee for service from one owner to the next.
Lori said that the County only charges when the digits on the meter
rollover past 1000.

On Friday, July 9, 1993, I obtained a copy of the attached
water restriction notice which I found posted on the Park Place
Clubhouse bulletin board near the mailboxes. The notice reads as
follows: "Now Hear This - The County is regulating lawn watering
from 8 PM to B. AM. For a healthier lawn, they are suggesting

know how to adjust your timer, ask a neighbor or ask Brad or
Graden."
I was surprised to see the word "County" on the notice.
Therefore, when I returned to City Hall I called Harry Asher,
Assistant Director of the Indian River County Utilities Department,
to inquire about the specific policy the County had implemented.
According to Harry, the only water restrictions in effect at the
present time are those imposed by the St. Johns River Water
Management District. The St. Johns policy is relatively simple.
It mandates that there shall be no watering from 10 AM to 4 PM,
seven days per week. A copy of their two page water conservation
pamphlet is attached for your use.
Harry Asher told me that Indian River County would not impose
a specific water restriction policy for Park Place being that Park
Place is within the City of Sebastian. He expressed to me that we
did not want the word " County" to be used on a document that
misrepresented the County's policy. Therefore, I suggest to you
that the "notice" be removed from the bulletin board immediately.
I would also recommend that you hold a meeting with the Homeowner's
Association to formulate a water restriction policy that will be
mutually beneficial and agreeable to the Park Place management and
the Association. You can be more strict than the St. Johns River
Water Management District's policy, if you wish. If you need to
prohibit watering between the hours of 7 AM to 5 PM to allow for
mowing lawns while they are dry, explain this to the residents so
that they understand why the watering policy in Park Place is

more restrictive than the St. Johns policy. Please do not use the
word "County" at all, or the "City", unless you check with me
first.
Our next utility bill coming out this week will contain the
following message: "The St. Johns River Water Management District
Conservation Rule is that watering is allowed anytime except
between 10 AM to 4 PM, 7 days per week. However, residents in Park
Place and Palm Lakes Club should check to see if their rules are
more restrictive". I have worded the message, as you can see, so
that Park Place and Palm Lake Clubs can impose their own rules.
When you formulate another written notice, please send me a copy
for my files. A couple of residents from Park Place have called me
about water restrictions and I want to be kept informed to properly
answer their inquiries.

Why conserve water?
' C] Don't we get plenty of rain?
Florida's water supply is dependent upon fickle
weather cycles -- periods of abundant rain
followed by periods of drought. Although Florida
receives an average of 55 inches of rain per year,
about 65%of that evaporates. Only a relatively
small percentage of total rainfall replenishes the
ground and surface water supplies.
In addition, rapid population growth, especially
in coastal areas, has placed a great demand on
our precious water resources. It's up to all of us
to conserve now -- and for the future.
Who decides when I can water?
Under Florida law, water management districts
may impose water use restrictions as conditions
warrant -- usually during times of.drought or
other water emergencies.
What is the Water Conservation Rule?
The St. Johns River Water Management District
(SIRWMD) is the first district in Florida to adopt a
rule requiring the wise and efficient use of water
on a year-round basis. The rule is simple, easy to
follow, and applies to everyone, Including
homeowners, businesses, farmers, growers, plant
nurseries, industries and golf courses.
When can I water?
Anytime except between the hours of
10 a.m. and 4 p.m.,
seven days a week.
However, watering during those hours will be
permitted, If you're using:
v low-volume or micro -irrigation methods
such as soaker hoses, drip irrigation, micro)ets or
a hand-held hose with automatic shutoff nozzle;
:• reclaimed water (provided signs indicating
such use are displayed on your property).
(Some cities and towns have adopted their own
local water use ordinances. Residents in those
areas should follow whatever restrictions are
strictest.)
Can 1 be exempted from the rule?
If you feel you cannot comply with the rule, you
must apply for a general permit Issued by staff.
The permit fee is $50. This permit is similar to
variances issued during a water shortage.
(Note: All variances previously issued during the
water shortage are void.)
What happens if I violate (tie
Water Conservation Rule?
The rule Is flexible enough that everyone should
be able to comply with the designated hours.
However, SIRWMD staff may issue consent
orders (citations) to violators, with penalties of
$50 (residential) and $t 00 (commercial) for
first-time violations. Penalties Increase for
second offenses. Law enforcement officers may
also enforce the rule by issuing second-degree
misdemeanor citations to violators.
What about new landscaping?
Watering is allowed at any time of day for:
•'r one 30 -day period for gardens, agricultural
crops or nursery stock, to allow for plant estab-
lishment;
4 one 60 -day period for any new landscaping
or newly -seeded or sprigged golf course areas.
Watering in of Insecticides, pesticides, herbi-
cides, fungicides and fertilizers is allowed any
time within 24 hours of application. Chemigation
and fertigation are allowed at any time of day
one time per week and any time during the
normal 4 p.m. to 10 a.m. Irrigation hours.
When can 1 wash ►fly car?
There are no restrictions on car washing, but
please follow water -conserving measures when
possible.
Is my indoor water use restricted?
No, but water conservation practices are
encouraged.
Can I wash my dog? Fill my pool? Use a
slip 'n slide? Pressure clean my house?
Yest But use common sense, and conserve water
whenever possible. Don't waste it --

Indoors:
■ Fix drips and leaks In faucets,
pipes and toilets;
■ Take shorter showers;
■ Don't leave water running while
brushing teeth, washing face,
or shaving;
■ Operate automatic dishwashers
and clothes washers only when
they are fully loaded;
■ Install low -flow fixtures on shower -
heads and toilets.
Outdoors:
■ Use the principles of
Xeriscape' when landscaping
your home or business. Xeriscape
information is available at the
SIRWMD, or through your local
county extension agent.
■ Don't leave water running freely
while soaping or rinsing vehicles;
■ Wash or rinse vehicles on a
porous surface so the water will
soak Into the ground rather than
becoming runoff;
■ Use a hose equipped with an
automatic shutoff nozzle;
■ Sweep -- don't hose down -- your
driveway or sidewalk.
■ Consider using a water -saving
filter on your swimming pool.

Pursuant to our conversation this morning, I am providing you
with a copy of the St. Johns River Water Management District's two
page brochure entitled "Turn It Off - Water Conservation Rule",
Article IV: Water Restriction Plan of the City of Sebastian's Code,
and my memo to the file dated July 1, 1993 stating that the water
restriction policy of the St. Johns River Water Management District
is the governing policy at present.
The St. Johns River Water Management District's water
restriction policy for Indian River County, including the City of
Sebastian, is that no one shall water lawns, gardens, landscaping,
etc. between the hours of 10:00 a.m. and 4:00 p.m., seven (7) days
a week. On July 8, 1993, I confirmed this policy with Cheryl Astey
of the Palatka office of the St. Johns River Water Management
District and on July 9, 1993 with Amy Lee Fannin of St. Johns
Melbourne office.
In my phone conversation with Nelson Hyatt and Michael Cairns
yesterday, Nelson informed me that he would prefer that there be no
watering of lawns from 7:00 a.m. to 5:00 p.m. so that the grass can
be mowed during the day when it would be dry instead of wet.
Therefore, I would suggest that you have the Park Place Homeowners
Association formulate a more restrictive policy for watering for
Park Place and put it in writing. Please notify me of this policy
so I can inform those Park Place residents who call me to ask what
policy is in effect. Also, a copy of the policy that the
Homeowner's Association formulates should be posted on the reading
board by the mailboxes at the Park Place Clubhouse.

A complaint was received by an anonymous caller this morning who
used to work for Nelson Hyatt. He said that the water lines at
Park Place have been put in some areas using gray electric conduit
instead of PVC. A chemical is now leaching out and oily scum is
getting in some people's water. The pipe size is either 2" or 3".
The caller said he installed the pipe at Hyatt's instructions, but
was told not to tell anyone. The caller said he doesn't work for
Park Place anymore. He said that the lines were buried within the
last year, maybe 6 or 7 months ago. He believes that the lines are
an extension of the original lines into the new area. The most
recent area is West Lakeview Drive.

the mains as soon as possible.

I contacted Mr. Don Allen at the south end of Brigadoon Drive (1193
Brigadoon Drive, 388-5595). Mr. Allen said that there is no
blowoff at the end of the water main. Mr. Allen said that he gets
a lot of scale in the house because of the hard water. He thinks
that possibly scale would be deposited at the end of the main. He
has to use Lime Away constantly.
Nelson Hyatt is thinking of expanding Park Place. If he is, he
will extend the water lines to the south. However, he may not
expand the main on Brigadoon. Mr. Allen suggested that the City
require blowoffs to be installed at all dead ends.
The City should also install blowoffs at the ends of dead end mains
where Nelson Hyatt will not expand.

As you are aware, the Park Place agreement calls for the impact fees to be paid by the
owner of Park Place Mobile Home Park upon transfer/sale of a unit. In review of the

Dear Mrs. Vincent:
This letter is in reference to your question to me regarding the
above as per our telephone conversations on March 29 and 30th.
It is my understanding from our conversation that you and your
husband bought a mobile home in Park Place over two (2) years ago.
At that time, you did not have to pay any water and sewer impact
fees to either the owner of Park Place, Mr. Nelson Hyatt, or Indian
River County. Since your husband has recently passed away, you
have decided to relocate elsewhere and sell your present home in
Park Place. Mr. Hyatt has informed you that you must now pay water
and sewer impact fees when you sell your home. You asked me to
determine whether or not you would now be responsible for paying
these impact fees since they were not required of you when you and
your husband purchased your home.
I have researched both the Interlocal Utilities Agreement between
Indian River County and the City of Sebastian and the Agreement
between Indian River County and Nelson Hyatt in regard to the
Indian River County takeover of the Park Place Utility System.
Information extracted from both documents should provide the answer
to your question as follows:
(1) Indian River County and Nelson Hyatt, the SELLER, of the Park
Place Water and Sewer Systems entered into an agreement on
July 11, 1989. Paragraph 5 on Page 1 states that the SELLER,
Mr. Hyatt, has agreed to having the County purchase his water
and sewer system providing him five (5) years to finish his
development. During the five (5) years from July 11, 1989 to
July 10, 1994, he will not have to pay "impact fees" for new
units sold. However, impact fees must be paid for those units
which are "resold" within the five year grace period.

(2) Section 6,"IMPACT FEES" on the last page of the agreement is
more specific. The second sentence specifically reads,
"Units which have had a Certificate of Occupancy issued to
them before five years from the date of this agreement must
have an impact fee paid when that unit is resold, without
regard to the five year SELLER'S grace period." This sentence
specifically relates to your situation. The five (5) year
grace period only pertains to the sale of new homes.
The last sentence of Section 6 states that "At closings on
such sales, SELLER (Mr. Hyatt) or successor in title shall
collect the impact fee and remit it to County. Since the
COUNTY has transferred its rights for Park Place, the water
and sewer impact fees must now be paid of the CITY OF
SEBASTIAN.
(3) Sentence one of Section 6 says that the seller pay impact fees
at the current rate. The current rate is $1,570.00 for the
water impact fee and $2,551.00 for the sewer impact fee for a
total of $4,121.00 payable to THE CITY OF SEBASTIAN. The
impact fees for the City are identical to the County's since
the Sebastian City Council adopted the County's fees and rate
schedule. Remember impact fees increment upward each October.
The City of Sebastian does have an IMPACT FEE APPLICATION
which must be completed at the time impact fees are to be paid
upon closing the sale of your home.
Mr. Harry Asher, Assistant Utilities Director of Indian River
County, told me that the County's intent in Section 6 was to
collect the Impact Fee from Nelson Hyatt at the time of closing
for any resold home, since the County had the agreement with
Mr. Hyatt.
Mr. Hyatt in turn must collect the money at the time of the closing
to give to the City of Sebastian. The City of Sebastian will retain
$1,570.00 for the water impact fee because the City will operate
the water system as of May 1, 1993. The City will
forward $2,551.00 to the County because the County provides the
transporting and treatment of the sewage at present.

approached SELLER concerning purchasing his utility system;

so collected shall be remitted quarterly to SELLER. SELLER
agrees that the funds so remitted shall be full satisfaction
for SELLER's right to be reimbursed for Its equity in the
SYSTEM. The COUNTY surcharge shall be $10 per ERU
(equivalent residential unit).
B. CLOSING DATE: The closing shall take place on
or before August I, 1989.

SUBJECT: DELIVERY OF SERVICE
The Utilities Department and Finance have been working together
with Indian River County to ensure a smooth transition in the
transfer of the Park Place Utility system to the City of Sebastian.
An area of concern is customer service related to the billing and
collection system. As I mentioned earlier, the data base for
utilities is extensive and must be researched when customers have
questions regarding billing, payments, usage and other charges.
As we reviewed how to best serve the utility customers, a number
of suggestions to improve our delivery of services to the residents
and taxpayers of the City come to mind that impact other
departments as well.
I recommend the following changes in the processing of daily
receipts (with appropriate written internal control procedures that
are periodically reviewed by the Finance Department):
1. Utility payments will be received by the Finance
Department. This, of course, may change in the future as
the Utilities Department grows in service connections and
staff.
2. Permits, impact and other fees resulting from Community
Development will be received by the Community Development
Department and remitted to Finance daily.
3. Golf Course cashiers will have a control count of each
cash drawer daily by a member of the Finance Department.
4. Golf Course paychecks not distributed on payday are
required to be locked in the Golf Course safe or returned
to the Finance Department on payday.

5. The Community Development Department will need a Change
Fund if they receive payments.
6. The Finance Department requests a Petty Cash fund and a
Change Fund to minimize the large number of checks we
write for amounts less than $20.00 and to accommodate the
need for a Cash Drawer when utilities comes on line.
7. The Clerk's office will continue to have responsibility
for billing and collecting fees such as occupational
licenses, rental and use of facilities, applications and
fees, and all records search, copying of documents, etc.
The above suggestions are meant to enhance our services to
residents in various departments, to save time and money in
processing information and money while maintaining strong internal
controls to ensure safeguarding of the City's assets.

RESUME OF CONVERSATION:
I asked Tom if GDU had responded to Gerry Hartman's letter of March
3, 1993, in which he had set a March 18, 1993 deadline date for a
response. Tom said "No". I asked Tom what the next step would be.
He said he needed about two (2) weeks to complete the legal
analysis before we take action against GDU under the terms of the
franchise agreement - Section 16 Conveyance of System. He would
want Robb McClary, Gerry Hartman, and I to discuss the next step.
I told Tom about the Press Journal publishing an article about the
City's position. He requested a copy and copies of all subsequent
articles concerning the City's intended takeover of GDU. He said
we could mail the article to him.
I told Tom that Indian River County had refunded all of the
deposits to the customers in Park Place which amounted to
$10,710.00 (117 Sewer Deposits, 111 Water Deposits). The county
refunded all of the deposits as of January 6, 1993, according to
Harry Asher, Asst. Director of Utility Services. I told Tom that
I had researched the Interlocal Agreement between the City of
Sebastian and Indian River County and could not find any reference
to "deposits". He told me that there wasn't any. The County never
volunteered the information during negotiations and he and Gerry
Hartman never thought the County required deposits because Nelson
Hyatt had originally established the utilities and later turned it
over to Indian River County. Evidently, since several years had
passed,neither Tom or Gerry had thought the County demanded the
deposits. Tom said the City could legally ask for the deposits
back but politically it could cause an uproar with the residents of
Park Place and Palm Lake Club. Actually,the County should have
transferred the deposits to the City of Sebastian, not the
customers.

This letter is to clarify the County's policy as to various utility items as they concern
areas in the City of Sebastian:
1.) The County will not continue to collect water impact fees in the Park Place
Development. This is an item the City should decide if they want to collect.
2.) The County has received requests for wastewater service within the City and
is referring these inquiries to the City as per Section 10 of Interlocal Utilities
Agreement between Indian River County, Florida and City of Sebastian,
Florida. This capacity should be purchased through the City of Sebastian.
Per the Interlocal Agreement, effective April 30, 1993, the County's retail service will end
within the City and the County will begin billing the City of Sebastian under the Bulk
Rates set forth in Exhibit "C" of the Interlocal Agreement.

RESUME OF CONVERSATION: Sharon Simmons called me about a specific situation in-
volving payment of a "water" impact fee for a mobile home in Park Place. She said
that initially the seller paid $4,121.00 in impact fees for water and sewer to
Indian River County. The $4,121,00 represents $1,570 for a water impact fee and
$2,551 for a sewer impact fee. The County now wants to refund the water impact
fee to the estate of the seller since the seller is deceased. Tucker Mobile Home
Sales wants to have the County send the impact fee to us. I said that the City
is responsible for collecting inpact fees now that the Park Place system will be
turned over to the City fron the County on May 1, 1993. Harry.Asher stated this to me
in his meeting on March 4, 1993 with me in his office.
I told Sharon that the City Council had adopted the same schedule of rates and
impact fees as the County had. I told Sharon to tell the County to send us the
impact fee for the water. Her boss, Doug Tucker, got on the line and I explained
everything to him. I told him to contact Harry Asher in regard to sending the
impact fee to the City. I asked him to write a letter to us that Tucker Mobile
Hare Sales wants the money to be transferred to the City.
After I_spoke with Harry Asher, Assistant County Utilities Director yesterday,
whereby he said the County had refunded the deposits to the Park Place customers.
I called Harry to ask if the County had also refunded the impact fees to the
customers. Harry was at a meeting: therefore I spoke with Carol Besancon in
Utilities. She told me that the deposits were requested back in January 6, 1993.
She knew because she was obtaining information for Harry's letter to me. Carol
told me that just yesterday, Charles Vitunac, County Attorney, made the decision
to refund the $1,570 in the Park Place situation to Tucker Mobile Hone Sales.

turned over all of the information Ann had gathered and I received frau Harry
Asher, Asst. Utilities Director of Indian River County to Marilyn I showed Marilyn
and Larry the samples of Utility Bills Ann had collected. I stated my preference
as follows:
(1) A typed statement which has provision for Ressages to the customer.
(2) A self addressed envelope (no postage) with a change of address form
The bill would be similar to the bill GDU aarrently sends its custarexs I don't
favor postcards such as I. R. County, City of Vero Beach and Barefoot Bay mails out.
People have to then find an envelope, write the address of the utility c=)anv put
their return address az (hand written or label). This is an inconvenience as I
have personally found. Marilyn and Larry said they would see what they could do
with the billing software purchase. They weren't sure of its capabilities vet
Marilyn suggested that our meter readers use an "electronic meter reader" such as
the City of Cocoa naw uses. It saves a tremendous amount of time in the field
Marilyn will check on obtaining information for me.
