CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor McPartlan called the regular City Council meeting to order at 6:00 p.m. 2. A moment of silence was held for K9 Officer Diesel, his handler, and the Sebastian Police Department. 3. The Pledge of Allegiance was recited. 4. Proclamation — National Police Week — May 14-20, 2017 and National Peace Officers Memorial Day — May 15, 2017 - Accepted by Police Chief Michelle Morris and Members of Sebastian's Police Department Mayor McPartlan read and presented the proclamation to Sergeant Steve Marcinik and Officer Jason Gillette. 17.088 B. Proclamation — National Safe Boating Week — May 20-26, 2017 - Accepted by Commander Mark Cannon, USCG Auxiliary Flotilla 56 Mayor McPartlan read and presented the proclamation to Commander Mark Cannon and members of the auxiliary. Brief Announcements - 5/12/17 Chamber Concert in Riverview Park — Bobby Owen Band — Country, Blues & Oldies — 5:30 to 8:00 pm Mayor McPartlan announced the upcoming concert in the park as well as the Law Enforcement Memorial Wreath Ceremony to be held at the Indian River County Court House on May 15 at 10:00 a.m. CONSENT AGENDA All items on the consent agenda are considered routine and will be enacted by one motion. There will be no separate discussion of consent agenda items unless a member City Council so requests; in which event, the item will be removed and acted upon separately. if a member of the public wishes to provide input on a consent agenda item, he/she should request a Council Member to remove the item for discussion prior to start of the meeting or by raising his/her hand to be recognized. COMMITTEE REPORTS & APPOINTMENTS City committee reports and Council Member regional committee reports. No public input or action except for City committee member nominations and appointments under this heading. 17.014 A. Citizens Budget Review Advisory Board (Transmittal, Application, Ad, List) i. Interview, Unless Waived, Submit Nomination for One Alternate Member Position — 5/1/2020 Regular City Council Meeting May 10, 2017 Page Three The City Clerk announced Andrea Ring was interested in serving and available to be interviewed. MOTION by Vice Mayor Coy and SECOND by Ms. Kinchen to appoint Andrea Ring to the alternate position passed with a unanimous support. 17.092 B. Construction Board (Transmittal, Application, Ad, List) i. Interview, Unless Waived, Submit Nominations for One Unexpired Regular Member, Contractor Position — Term to Expire 9/1/2018 The City Clerk announced Jock Crockett was interested in serving in the contractor position on the Construction Board. MOTION by Mr. Dodd and SECOND by Ms. Kinchen to approve Mr. Crockett to the contractor position with a term to expire 9/1/2018 passed with a unanimous support. 17.046 C. Planning and Zoning Commission (Transmittal, Applications, Ad, List) i. Interview, Unless Waived, Submit Nominations for One Expired Regular Member Position —Term to Expire 5/1/2020 The City Clerk reported that Mr. Qizilbash was not present but would like to serve again. In addition, Mr. Hughan and Mr. Krull were interested in the position. MOTION by Mr. Dodd and SECOND by Vice Mayor Coy to appoint Mr. Qizilbash for another term on the Planning and Zoning Commission passed with unanimous support. Committee Reports Vice Mayor Coy said she met with Indian River County Commissioner Susan Adams and the Mental Health Association of Indian River County on Monday. The Association is looking to expand services in the north County area and would like to hold a symposium in Council Chambers to receive community input. There was no objection from Council. 9. PUBLIC HEARINGS - None 10. UNFINISHED BUSINESS 17.068 A. The City Manager said this agreement would allow the inventory and inspection services to be completed as required by the recently executed interlocal agreement with the Treasure Coast Regional Planning Council with their development of a parks master plan. He recommended approval. The Parks Administrator said there would be an annual cost of $1,500 for the software. Regular City Council Meeting May 10, 2017 Page Four MOTION by Mr. Dodd and SECOND by Vice Mayor Coy to approve an agreement with Playground Guardian, Inc. to conduct safety inspections and inventory of City equipment. ROLL CALL: Motion carried 5-0. 17.093 B. Mr. Dodd—Aye Ms. Kinchen —Aye Vice Mayor Coy — Aye Mr. Hill —Aye Mayor McPartlan — Aye (Transmittal. CSA 1 Plans, Cost Estimates CSA 2, Zone Allocations, Available Funds) The City Manager said he included the conceptual plan for the pickle ball courts and projected impact fee balances, noting the estimate is about $200K over from the initial estimate. He explained other recent bids have come in over budget giving reason that Mr. Schulke's estimate might be in line. Mayor McPartlan confirmed the amount was $19,700. Vice Mayor Coy said she thought they were doing four courts now and four later. The City Manager explained that after determining the purchase of property wasn't necessary, he and the City Engineer determined the type of amenities needed and four courts would be built now with the land prepped for more courts later. Mr. Hill said it they should make plans for the additional four, reminding them that several tennis courts were originally planned for Friendship Park but not built, and now the courts are not usable, for example, as a tournament site. Mr. Dodd said there will be a larger cost to come back later to make the remaining courts. He went over the proposed expenditures and noted that although approximately $170,000 will be refurbished in the next budget cycle, they should consider any work that might be needed to bring playground equipment up to ADA compliance or safety compliance. He noted there will be a $150,000 deficit in the fund. He proposed they approve this engineering cycle, close the project for this budget year and add it to the CIP FY17/18 cycle with all the amenities. MOTION by Mr. Dodd and SECOND by Mr. Hill to approve the engineering study as presented, remove it from FY16/17 budget and move it as a new project to FY17/18 cycle. Ben Hocker cited part of the recreation impact fee code, noting the funds must be used in the zone collected. He asked for the code that provides that multiple zones can pay for the pickle ball courts. Mr. Hill explained regional parks can share the fees collected. The City Manager said there is enough money in this budget cycle but the fund would be dwindled fairly low because the football field restroom could come in high. Regular City Council Meeting May 10, 2017 Page Five Mr. Dodd said he wanted to break it into two budget cycles because more affordable alternatives have not been discussed. Vice Mayor Coy said the project could be modified while in progress. Mr. Hill and Ms. Kinchen commented that Mr. Dodd's motion would not slow down the project. Mr. Hill withdrew his SECOND to Mr. Dodd's motion. MOTION by Mayor McPartlan and SECOND by Vice Mayor Coy to approve the Continuing Services Agreement #2 to the Schulke, Bittle, & Stoddard, LLC Continuing Engineering Services Agreement to provide final design, construction documents and permitting for four pickle ball courts. PUBLIC INPUT New intormation or requests to city council not otherwise on the prepared agenda 17.051 A. Carey Timinsky — Light Up Blue Awareness Ms. Timinsky, Secretary to Autism Awareness, said as part of their fundraiser last month, a magnolia tree was donated to the organization and they would like to donate it to the City for planting at Riverview Park with a dedication sign and have it lit up blue every April. Vice Mayor Coy thanked them for the tree but requested they take ownership for anything the group would like to see around the site in perpetuity. Ms. Timinsky agreed to take care of the site. Roy Woodall, 7895 134th Street, Sebastian, said there is a lot of sand on the Main Street boat ramp caused by people gunning their engines to get their boats on and off their trailers. He said the revving also affects the nearby smaller docks which are unusable at the Yacht Club and undermines the piers stability. As the City begins to repair the docks, he suggested requiring the use of power wenches and the formation of a volunteer group to help get boats on and off their trailers. Mayor McPartlan suggested the City Manager send the City Engineer out to look at the washed out sand and maybe post a 'help your neighbor' sign. The City Manager said sand does need to be removed periodically from the Main Street boat ramp and washes out at the Yacht Club boat ramp, which can be looked at as they begin the repair. Ben Hocker said Hurricane Matthew was the cause of the sand accumulation on top of the boat ramp. He spoke of Casey Gilliams' participation in Habitat for Humanity's Bike and Build Project which indicates the caliber of citizens the City has in the community. Jim Sunnycalb displayed a sign that is available to remind individuals not to leave their children and animals in hot cars. He asked if the sign could be made into a decal and placed on City vehicles to promote awareness. Mayor McPartlan noted it is on channel 25 and posted in the dog park. Regular City Council Meeting May 10, 2017 Page Six 12. NEW BUSINESS 17.094 A. Approve the Automatic Renewal and 2nd Amendment to Waste Management's The City Manager said the franchise's auto renewal date was approaching and he recommended extending the contract until 2023, as well as eliminating the second community clean-up day from the contract in exchange for some community recycling amenities. MOTION by Mr. Dodd and SECOND by Vice Mayor Coy to approve the automatic renewal and second amendment for the agreement. Vice Mayor Coy asked if the promotional event for commercial businesses to recycle could be reinstituted since the Fagade, Sign and Landscape grant program was recently revised to include awards for concealing dumpsters. Dina Ryder -Hicks, Waste Management Public Affairs Manager, said they happen to be currently offering the promotion to Indian River County and the City of Fellsmere and would include the businesses from Sebastian. Ms. Hicks offered to provide flyers for distribution. Vice Mayor Coy also asked for two more solar powered compactor bins. Ms. Hicks said she would look into her request. The City Manager reported that the County has instituted a burn ban and he has posted the notice on channel 25, channel 99 and the City's website. 17.096 C. The City Manager said the organizers of the ShrimpFest are interested in moving their event to Riverview Park on a permanent basis. Mark Gringas described how the Rotary Club of Sebastian and Exchange Club of Fellsmere started the festival three years ago to raise infrastructure funds for youth sports; the organizing committee plans to run the festival similar to the Clambake; and they believe they will be more successful in Riverview Park with their effort. Regular City Council Meeting May 10, 2017 Page Seven MOTION by Mayor McPartlan and SECOND by Vice Mayor Coy for staff to continue to work with the event principals on a formal agreement to bring back to Council. Mr. Gringas stated they are a 501(c)(3) company through Sebastian Rotary Club's recreational foundation, the books are open and handled by a CPA; and, the all money would go out of the recreational fund checkbook. The City Manager stated Charter Officer evaluation forms have been dispersed to the Members and their goals discussed tonight would substitute for the goal setting workshop outlined in the resolution. Continuation of the pickle ball courts was mentioned. 13. CITY ATTORNEY MATTERS - Absent 14. CITY MANAGER MATTERS The City Manager reported he may have to address some conflict at the dog park and he would report back if adverse things happen. 15. CITY CLERK MATTERS — None 16. CITY COUNCIL MATTERS A. Mayor McPartlan Mayor McPartlan announced that May is Foster Care Awareness Month and invited anyone interested in becoming a foster care parent to call him at (772) 453-8540. B. Vice Mayor Coy Vice Mayor Coy asked the City Manager to enforce the sign ordinance at Damien Gilliams' No Name Bar. C. Council Member Dodd Mr. Dodd said there is a City owned property inventory being developed by staff and he would like Council to review the list to assist the City Manager in allocating the funds once the review is completed. 7 Regular City Council Meeting May 10, 2017 Page Eight D.
