Dear Mr. Votapka:
As you may be aware, we are now finalizing the matters
necessary to go forward on this project which would lead to the
issuance of a building permit in the next week or so. A meeting
was held last Tuesday between the County and the City and I want
to go forward with whatever remains open for obtaining a building
permit.
In that regard, I believe I need�to purchase from the
City of Sebastian water capacity for this particular project. I
have instructed our engineer, Mr. Ron Howse, to contact you
regarding that matter and I would appreciate you letting me know
the amount necessary to purchase that capacity so that I can send
you a check in that amount.

the water supply, treatment or transmission facilities or the
wastewater transmission, treatment, or effluent disposal
facilities having a value of not less than the portion of the
water or wastewater capital charges being exempted.

City retail customers whose wastewater service capacity is
provided via the Indian River County Wastewater System shall pay a

(3) Time a I!avment. Beginning on the date the City
acquires the System from GDU, all water and wastewater capital
charges shall be paid prior to connection of a structure or
structures to be served by the City, or such other time as may be
specifically provided by City resolution, ordinance, agreement, or
permit; provided, however, that the City may permit installment
payments of any water or wastewater capital charges upon such
tests and conditions as the City deems appropriate.
(4) Determination of Equivalent Residential Unit
Factors for Water and Wastewater Services.
(a) For purposes of calculating and imposing the
wastewater capital charge provided for in this Section 4, the ERU
factor for any particular connections shall be calculated and
imposed in the manner provided as follows:

wastewater service capacity, one ERU is hereby established and

approved or determined by the Florida Department of Environmental
Protection.

established and determined to be equal to a flow of 250 gallons
per day, average annual basis (250 GPD).
(d) The "total equivalent residential unit value"
for an establishment shall be calculated by multiplying the ERU
factor listed above by the number of units, and- ,.shall be rounded
up to the nearest 0.5 ERU factor.
(e) For all establishments not listed above, the

total wastewater equivalent residential unit (ERU) value for
wastewater service capacity shall be determined by multiplying the
number of fixture units, as published in the Standard Plumbing
Code, by thirty (30), and then dividing that numerator by two
hundred (200). For example:
Total Wastewater ERU Value = umber of Fixture Units X 30
200 GPD/ERU
The wastewater capital charge shall be determined by using the
following formula:
Total ERU Value x $1,650.00 = wastewater capital charge
(f) For all establishments not listed above, the
total water equivalent residential unit (ERU) value for water and
service capacity shall be determined by multiplying the number of
fixture units, as published in the Standard Plumbing Code, by
thirty (30), and then dividing that numerator by two hundred fifty
(250). For example:
Total ERU Value = Number 21 Fixture Units x 30
250 GPD/ERU
The water capital charge shall be determined by using the
following formula:
Total ERU Value x $1,100 = water capital charge
(g) The above ERU Schedule applies to
establishments being connected to the City of Sebastian Water and
Wastewater System.
(5) Capital Improvement Funds: Establishment:

INSTRUCTIONS: This form shall be completed and submitted by persons proposing to construct new, or alter existing, public drinking water
facilities unless such proposed construction or alteration is permitted under the "General Permit for Construction of an Extension to a Public Drinking
Water Distribution System," in which case Form 62.555.910(71 is to be completed and submitted. Complete this form and submit it in quadruplicate
to the appropriate district office of the Department or the appropriate Approved County Public Health Unit (ACPHU) along with a check for the proper
application processing fee and the following supporting documents: a signed and sealed engineering report Gncluding design data); signed and sealed
engineering plans and specifications; a certificate that the project has been approved by the governing body of the applicant (city commissioners,
corporation, board, etc.); and, for each project involving the construction of a new drinking water treatment plant in a county regulated by the Florida
Public Service Commission IPSC), a copy of the PSC certificate authorizing the applicant to provide service or a copy of the PSC order exempting the
applicant from PSC regulation. (Section 367.031, Florida Statutes, requires that a utility obtain a certificate of authorization or an exemption order
from the PSC prior to being issued a permit by the Department for the construction of a new water facility.) All supporting documents, as well as
this form, shall be submitted in quadruplicate. All information provided on this form shall be typed or printed in ink. Complete Parts I, II, IV, V, and
VLA of this form for all projects, and complete Parts III and VLB through VLE of this form when applicable. A signature page or cover letter for
engineering reports, each sheet of engineering plans, and a cover or index sheet for engineering specifications shall be signed, dated, and sealed with
an impression -type metal seal by the professional engineers) in responsible charge of the documents. Also, engineering plans and specifications shall
be those intended for construction and shall not be stamped otherwise (e.g., "For Permitting Only," "For Review Only," etc.). Application processing
fees are listed in Rule 62-4.050, Florida Administrative Code. Checks for application processing fees shall be made payable to the Department of

INSTRUCTIONS: This form shall be completed and submitted by persons proposing to construct new, or alter existing, public drinking water
facilities unless such proposed construction or alteration is permitted under the "General Permit for Construction of an Extension to a Public Drinking
Water Distribution System," in which case Form 62.555.910171 is to be completed and submitted. Complete this form and submit it in quadruplicate
to the appropriate district office of the Department or the appropriate Approved County Public Health Unit (ACPHU) along with a check for the proper
application processing fee and the following supporting documents: a signed and sealed engineering report (including design data); signed and sealed
engineering plans and specifications; a certificate that the project has been approved by the governing body of the applicant (city commissioners,
corporation, board, etc.); and, for each project involving the construction of a new drinking water treatment plant in a county regulated by the Florida
Public Service Commission IPSC), a copy of the PSC certificate authorizing the applicant to provide service or a copy of the PSC order exempting the
applicant from PSC regulation. (Section 367.031, Florida Statutes, requires that a utility obtain a certificate of authorization or an exemption order
from the PSC prior to being issued a permit by the Department for the construction of a new water facility.) All supporting documents, as well as
this form, shall be submitted in quadruplicate. All information provided on this form shall be typed or printed in ink. Complete Parts 1, II, IV, V, and
VLA of this form for all projects, and complete Parts III and VI.B through VLE of this form when applicable. A signature page or cover letter for
engineering reports, each sheet of engineering plans, and a cover or index sheet for engineering specifications shall be signed, dated, and sealed with
an impression -type metal seal by the professional engineer(s) in responsible charge of the documents. Also, engineering plans and specifications shall
be those intended for construction and shall not be stamped otherwise (e.g., "For Permitting Only," "For Review Only," etc.). Application processing
fees are listed in Rule 624.050, Florida Administrative Code. Checks for application processing fees shall be made payable to the Department of

RE: Water Distribution System for Winn Dixie at Sebastian
Dear Mr. Howse:
I have reviewed your Site Utility Plan for the proposed Winn Dixie
supermarket at the location of Roseland Road and Laconia Street in
Sebastian. I have only reviewed that portion of the drawing
pertinent to the water distribution system because the sanitary sewer
system has been under the auspices of Indian River County, since
January 3, 1995.
Basically, my comments, although shown in red on the drawing, are as
follows:
1) Wherever a water main crosses your client's property and is
outside of the right-of-way, your client shall dedicate a
15' utility easement (centered on the water main) to the
City of Sebastian.
2) Gate valves should be shown for all hydrants on the plan
for their location relative to the tee and hydrant
regardless of the detail on Page 8. You may elect to place
the valve next to the tee or next to the hydrant depending
upon the location of the hydrant.
3) The two 8" taps on Laconia Street shall have additional
language added to the notes to read "using 12" x 8" tapping
sleeve and valve".

Please note that you should add under utility notes, a note
stating "After the tapping sleeve and valve are firmly
bolted on the existing water main, the contractor shall
test the integrity of the tapping sleeve by maintaining 150
psi for 15 minutes prior to making the tap."
4) Water meters and backflow preventers should be shown on the
plan views for the Winn Dixie Store and future restaurant.
5) Roseland "Blvd" should be re -printed as Roseland Road.
6) The 50 foot wide right-of-way for Roseland Road is
incorrect. According to Bruce Cooper, Director of the
Community Development Department, the right-of-way is 80
feet wide.
7) I have made several suggested revisions under the Utility
Notes, notably Note it - The "FDER" is now the "FDEP".
Note 12 - "The water mains must be tested at 150 psi for a
minimum of 2 hours", and Note 23 - the last sentence should
read "The "sewer" main in lieu of the "water" main".
8) On Sheet 8 of the details I have added the following:
A) For typical water services, add "Note 11 - Any crimped
service tubing shall be immediately replaced" and add
"Compact soil under bend" under the center detail for
the service.
B) For the FIRE HYDRANT detail, add note "Set Bury Line
to grade" and spell "nozzel" as "nozzle".
C) Change WATER SERVICE detail to "WATER METER WITH
BACKFLOW PREVENTER ASSEMBLY". Revise NOTE 1 to read
"Meter Assembly, provided by developer and installed
by Contractor." Revise Note 4 to read "Double Check
Valve Assembly in accordance with FDEP requirements."

Enclosed is Permit Number WD31-276457 to construct a water distribution
system extension issued pursuant to Section 403.861(9), Florida Statutes.
A person whose substantial interests are affected by this permit may
petition for an administrative proceeding (hearing) in accordance with Section
120.57, Florida Statutes. The petition must contain the information set forth
below and must be filed (received) in the Office of General Counsel of the
Department at 2600 Blair Stone Road, Tallahassee, Florida 32399-2400, within 14
days of receipt of this Permit. Petitioner shall mail a copy of the petition to
the applicant at the address indicated above at the time of filing. Failure to
file a petition within this time period shall constitute a waiver of any right
such person may have to request an administrative determination (hearing) under
Section 120.57, Florida Statutes.
The petition shall contain the following information; (a) the name, address,
and telephone number of each petitioner, the applicant's name and address, the
Department permit file number and the county in which the project is proposed;
(b) a statement of how and when each petitioner received notice of the
Department's action or proposed action; (c) a statement of how each petitioner's
substantial interests are affected by the Department's action or proposed
action; (d) a statement of the material facts disputed by petitioner, if any;
(e) a statement of facts which petitioner contends warrant reversal or
modification of the Department's action or proposed action; (f) a statement of
which rules or statutes petitioner contends require reversal or modification of
the Department's action or proposed action; and (g) a statement of the relief
sought by petitioner, stating precisely the action petitioner wants the
Department to take with respect to the Department's action or proposed action.
If a petition is filed, the administrative hearing process is designed to
formulate agency action. Accordingly, the Department's final action may be
different from the position taken by it in this permit. Persons whose
substantial interests will be affected by any decision of the Department with

be filed (received) within 14 days of receipt of this notice in the Office of

within the time specified for filing a petition and conforms to Rule 62-103.070,
F.A.C. Upon timely filing of a petition or a request for an extension of time
this permit will not be effective until further Order of the Department.
When the Order (Permit) is final, any party to the Order has the right to
seek judicial review of the Order pursuant to Section 120.68, Florida Statutes,
by the filing of a Notice of Appeal pursuant to Rule 9.110, Florida Rules of
Appellate Procedure, with the Clerk of the Department in the Office of General
Counsel, 2600 Blair Stone Road, Tallahassee, Florida 32399-2400; and by filing a
copy of the Notice of Appeal accompanied by the applicable filing fees with the
appropriate District court of Appeal. The Notice of Appeal must be filed within
30 days from the date the Final Order is filed with the Clerk of the Department.

2. A LETTER OF CLEARANCE MUST BE ISSUED BY THE DEPARTMENT TO YOU PRIOR TO YOUR
PLACING THIS PROJECT INTO SERVICE OR YOU, THE PERMITTEE, SHALL BE SUBJECT TO
APPROPRIATE ENFORCEMENT ACTION. To obtain clearance of the facilities for
service, the engineer of record shall submit a "Request for Letter of
Release to Place Water Supply System into Service" (DER Form 62-555.910(9)]
to the department, a copy of this permit, and a copy of satisfactory
bacteriological sample results taken on two consecutive days from the
proposed main at the two points of connection to the existing 12 -inch main
on Laconia Street, from the two proposed meter locations, and from a point
at, or near, the hydrant on Roseland Road.
3. Where water and sewer mains cross with less than 18" vertical clearance, the
sewer will be 20' of either ductile iron pipe or concrete encased vitrified
clay or PVC pipe, centered on the point of crossing. When a water main
parallels a sewer main a separation, measured edge to edge, of at least 10'
should be maintained where practical.
4. This permit does not pertain to any wastewater, stormwater or dredge and
fill aspects of this project.
S. The permittee will promptly notify the Department upon sale or legal
transfer of the permitted facility. In accordance with General Condition
#11 of this permit, this permit is transferable only upon Department
approval. The new owner must apply, by letter, for a transfer of permit
within 30 days.
6. NOTE TO THE UTILITY: Pursuant to 403.859(6), Florida Statutes, do not
provide water service to this project (other than flushing/testing) until
the Department of Environmental Protection has issued a letter of clearance
or you, the utility, shall be subject to enforcement action.

INSTRUCTIONS: This form shall be completed and submitted by persons proposing to construct new, or alter existing, public drinking water
facilities unless such proposed construction or alteration is permitted under the "General Permit for Construction of an Extension to a Public Drinking
Water Distribution System," in which case Form 62-555.910(71 is to be completed and submitted. Complete this form and submit it in quadruplicate
to the appropriate district office of the Department or the appropriate Approved County Public Health Unit (ACPHUI along with a check for the proper
application processing fee and the following supporting documents: a signed and sealed engineering report (including design data); signed and sealed
engineering plans and specifications; a certificate that the project has been approved by the governing body of the applicant (city commissioners,
corporation, board, etc.); and, for each project involving the construction of a new drinking water treatment plant in a county regulated by the Florida
Public Service Commission (PSC), a copy of the PSC certificate authorizing the applicant to provide service or a copy of the PSC order exempting the
applicant from PSC regulation. (Section 367.031, Florida Statutes, requires that a utility obtain a certificate of authorization or an exemption order
from the PSC prior to being issued a permit by the Department for the construction of a new water facility.) All supporting documents, as well as
this form, shall be submitted in quadruplicate. All information provided on this form shall be typed or printed in ink. Complete Parts 1, It, IV, V, and
VLA of this form for all projects, and complete Parts III and VLB through VLE of this form when applicable. A signature page or cover letter for
engineering reports, each sheet of engineering plans, and a cover or index sheet for engineering specifications shall be signed, dated, and sealed with
an impression -type metal seal by the professional engineers) in responsible charge of the documents. Also, engineering plans and specifications shall
be those intended for construction and shall not be stamped otherwise (e.g., "For Permitting Only," "For Review Only," etc.). Application processing
