Reservation Request for Cumberland Farms Store at CR 512
and Barber Street, Sebastian, Florida
Dear Mr. Pinto:
Kimley-Horn and Associates. Inc., the engineering
representative for Cumberland Farms, Inc., has requested that the
City of Sebastian make application to Indian River County for
wastewater treatment plant capacity. In discussing the proposed
connection to the County's force main in the CR 512 right-of-way,
Bill McCain of your staff has determined that two Equivalent
Residential Units (ERU's) would be required for this project.
Based on the information presented herein, the City of
Sebastian formally requests that the Indian River County Board of
County Commissioners approve the 2 ERU capacity to be purchased by
Cumberland Farms, Inc. This request is understood to be only for
the assurance that the County will grant permission at this time to
allow Cumberland Farms, Inc. to connect to the County's wastewater
system in the future. It is further understood that there will be
no guarantee that the two (2) ERU's will be reserved at the plant
for Cumberland Farms until"such time as the ERU's are paid in full
to Indian River County. Cumberland Farms, Inc., of course, will
make application first to the City and pay the $5,102.00 required
for two (2) ERU's which in turn shall be remitted to the County by
the City once the County approves the request.

Force Main Connection to Indian
in the County Road 512 Right -
I have concluded my review of the construction drawings, lift
station calculations, DEP General Permit Application, and City of
Sebastian Utilities Department Impact Fee Application Form that I
received on October 29, 1993. All of my comments are marked in red
on the above documents. I suggest that you revise the documents
accordingly. If you need to discuss any item with me, please feel
free to call.
Once your revisions are made, please resubmit two copies of
each to me. I only need one copy of each for my files; I will
return the other copies to you. If you desire more than one copy
of each document, please furnish me the amount of copies you desire
for me to affix my final approval.
In specific regard to the anti -flotation collar at the bottom
of the lift station, I would suggest that the collar be precast on
the station. The station and collar can be set in the excavation
as one unit. Using this method, the dimensions of the collar can
be accurately controlled; dewatering costs are kept to a minimum;
and the time required to keep the excavation open for the collar
placement is reduced to the time it takes to prepare the bottom of
the excavation and place the station. This method was used in the
installation of the Davis House lift station in Sebastian.
Lastly, I am enclosing a copy of Mr. Harry Asher's letter of
November 1, 1993, that I received in regard to the five (5) ERU's
that will be reserved for the stores in the Cumberland Farms Plaza.
The County will accept the additional ERU's for its North County

Regional Wastewater Treatment Plant upon the City's total payment
of $12,755.00 for the five (5) ERU's. Of course, Cumberland Farms
will first have to pay this amount to the City and the City must
remit this amount to Indian River County. In addition, deposit
fees and inspection fees totalling $375.00 must be paid to the City
as shown on the application form.

Dear Mr. McAdams:
I have completed my review of the plans, permit, and
wastewater transmission system calculations that you sent to me on
January 11, 1994. I would recommend that in lieu of 30" shown from
the ground to the bottom of the lift station control panel on Page
2 of 6 of the plans that 36" be shown. Raising the height of the
panel box by 6" will make it easier for lift station personnel to
service the panel without having to bend over so much while working
on it. This comes from personal experience. Other than my
recommended revision. I have no further comments. Therefore, I am
approving the plans for construction on behalf of the City of
Sebastian Utilities Department.
The check for the $12,755.00 sewer impact fees has been
received by our Finance Department and your application is
currently being processed. I have enclosed two (2) copies of the
impact fee application as requested. I am returning two (2) copies
of the approved DEP application form, plans, and wastewater
calculations to you as requested and am retaining one copy for the
Utilities Department files.

I have just completed my review of the revised plans and
calculations for the proposed Cumberland Farms lift station and
forcemain, and have approved same. A check in the amount of
$13,130.00, for the total fees required, was sent to the City and
received by the Finance Department. The completed application form
is attached. Please process the application as soon as possible
and remit the impact fees to Indian River County Utilities
Department. According to Assistant County Utilities Director,
Harry Asher, the County will not sign off on the DER Permit or
issue a construction permit until the impact fees are received.
Please refer to the attached letter of January 27, 1994 from Harry

representative for Cumberland Farms, Inc., has requested that the
City of Sebastian make application to Indian River County for
wastewater treatment plant capacity. In discussing the proposed
connection to the County's force main in the CR 512 right-of-way,
Bill McCain of your staff has determined that two Equivalent
Residential Units (ERU's) would be required for this project.
Based on the information presented herein, the City of
Sebastian formally requests that the Indian River County Board of
County Commissioners approve the 2 ERU capacity to be purchased by
Cumberland Farms, Inc. This request is understood to be only for
the assurance that the County will grant permission at this time to
allow Cumberland Farms, Inc. to connect to the County's wastewater
system in the future. It is further understood that there will be
no guarantee that the two (2) ERU's will be reserved at the plant
for Cumberland Farms until such time as the ERU's are paid in full
to Indian River County. Cumberland Farms, Inc., of course, will
make application first to the City and pay the $5,102.00 required
for two (2) ERU's which in turn shall be remitted to the County by
the City once the County approves the request.

Dear Richard:
On behalf of Cumberland Farms, Inc., we hereby request approval of wastewater service
for the existing Cumberland Farms store and the attached three retail store units. It is proposed
to abandon the existing on-site septic tank system serving these four attached units and replace
with a pump station and force main connecting to the existing Indian River County Utilities
Department's 8" PVC force main running along the southerly side of CR 512.
It is my understanding from talking with you and Bill McCain of the Indian River County
Utilities Department that the appropriate procedure is to request approval of service from the City
of Sebastian and the City will request approval from Indian River County. Should this not be
correct, please notify me immediately.
The Cumberland Farms store and three attached retail units consists of a gross
floorlbuilding area of 5,520 s.f. (Cumberland Farms = 3,000 s.f. plus three rental units at 840 s.f.
each). According to Indian River County Resolution No. 91-9, this is over one and less than two
Equivalent Residential Units (ERU's). It is therefore understood that the Wastewater Impact Fee
would be $5,102.00 (2 ERU's @ $2,551.00).
Please pursue this request as necessary through Indian River County. We are very
anxious to proceed as the existing on-site system is currently under "Formal Notice to Correct
Violation" by the Indian River County Public Health Unit.

Pursuant to Rule 17-4 (Part III), Florida Administrative Code, you may not begin
construction until thirty (30) days from that date. Please be advised that the
construction must conform to the description contained in your Notice of Intent
to Use a General Permit and that any deviation therefrom will subject the
permittee to enforcement action and possible penalties. After the system is
constructed, certified complete and subsequently cleared for use by the
Department, the existing septic tank system shall be appropriately abandoned.

Impact fees were sent to Indian River County on February 14, 1994
to establish a sewer reserve account for this customer. Indian
River County added this account to their February billing and
charged the City of Sebastian for Cumberland Farms 5 ERU's. I did
not establish the account on the computer until March. Therefore,
the City did not bill Cumberland Farms for the month of February.
Please make the necessary adjusts to bill this customer for the
month of February.
