Dear Nelson: As per your request I have prepared the above subject applications and revised the prints of the water & sewer originals to reflect the water & sewer extensions that you requested. If you want to extend more sewer on the west and south side of the lake, you will have to build the third lift station. You may extend the sewer on the east side of the lake without building the third lift station. The applications and prints show water and sewer extensions for a total of 92 lots: sixty (12) lots on the west side of the lake and 32 on the east side of the lake. These will give you a total of 18 lakefront lots on the east side. The total cost of the extensions has been estimated to cost $165,000 or $105,000 for sewer and $60,000 for water. I am giving you the following documents: 3 sets of the sewer extension drawings 2 sets of the water extension drawings 1 application to extend water and sewer each. The City of Sebastian must sign parts II & III of the water application and Part I only of the sewer application, since the WWTP is owned by IRC. They will have to sign Part III of the sewer application. I don't think Votapka will sign the sewer application without the County signature. When both applications are signed by all parties, send the water application and on set of water drawings with a check for $250 each for the sewer and water application fees. Label the street names for reference purposes. 2. Differentiate between "existing", "proposed", and "future" water and sewer systems for permitting purposes. 3. Identify the lots by lot number for reference now and for "As - Built" or "Record Drawings" later. 4. Identify manholes by number for reference in permitting, construction, and record drawings. 5. _ Show all water service and sewer lateral locations for the proposed new construction. The services and laterals should be identified by conventional symbols used in standard engineering practice and as shown in the legend. Conventional symbols for both double and single services and laterals are to be shown. 6. Label plans "Park Place MHP" in lieu of "Villages of Lake Dolores" or "Stratton Ave Extension". 7. All plans should show the latest revision date. Page 2 of 4 February 4, 1994 Letter to Nelson Hyatt Comments on Specific Plan Sheets Sheet 1 1. Identify the lift station on Barber Street as "Indian River County Lift Station" for permitting purposes. 2. Show and identify the force main to U.S. 1 as "Existing Indian River County Force Main" for permitting purposes. 3. Cross out the note pertinent to "Water -Currently Permitted to Pelican Pointe", since this is not applicable. 4. Show and label the guard house, and label the entrance road, East Lakeview Drive, and the road to the west opposite E. Lakeview Drive. Sheet 2 1. Label the existing water main and services, and sewer main and laterals in Phase 2. Show where they currently terminate so FDEP, the City, and the contractor know where they currently end. 2. Show limits of proposed water and sewer line construction in all proposed phases to be developed. 3. Show that the existing water main in Phase 2 is to be disinfected and recertified again. 4. Show that a new fire hydrant is to be installed at the intersection of Heatherway Lane and South Derry Drive. 5. Relocate the Phase Line between Phases 2-B and 2-C south of its present location for proper looping of water main in Phase 2-B, since no work is proposed in Phase 2-C at this time. 6. Show the termination of the water and sewer system in Phase 2- B north of Phase 2-C. Show the blowoffs at all water main terminations. 7. Eliminate three unnecessary gate valves shown east of the "Phase 2-A" wording. These valves were intended for mains going to the water plant which should be decommissioned this year. B. Two valves could be eliminated south of the cul-de-sac in Phase 2-A where shown. 9. Connect the main located in the cul-de-sac in Phase 2-A to both the 6" and S" water mains, as shown for looping purposes. Use a 4" minimum main. 10. I have suggested locations where fire hydrants should be placed for proper coverage based on a 500 foot radius and overlapping. I strongly suggest that fire hydrants be placed on West Lakeview Drive as soon as possible since there are none existing at this time. Hydrants should be located on both streets west of the lake for practicality in fire fighting ability. It is extremely difficult in an emergency situation for firemen to find a hydrant on one street when the fire is on the other street. Then, if the hydrant is found, Page 3 of 4 February 4, 1994 Letter to Nelson Hyatt the hoses would have to be carried through the residential yards from one street to the other. Hydrants should be located on all streets for visibility purposes and ease for connection to the fire truck to minimize time lost in responding to the fire. Sheet 3 1. The water mains in Phases 1-A, 1-B, and 2-B are to be shown where they terminate for the proposed development. Temporary blowoffs are to be installed at all termination points. Sewer stub outs and lengths of each should be shown on all phases where they will occur. 2. The phase line at the southeast corner of Phase 1-A should be shifted south to the south side of the connecting road between East Lakeview Drive and Brigadoon Drive to ensure that the water and sewer mains to be installed are not within Phase 1- C, since Phase 1-C is not listed on the permit application. 3. I have shown suggested fire hydrant locations for proper coverage in Phase 2-B and Phase 2-C. I did not review the remainder of the hydrants shown in Phases 1-C, 3, and 4 at this time. However. I believe that those shown should be relocated and a few more added for proper fire protection in these future phases. 4. I would suggest that the lift station be relocated to a site adjacent to West Lakeview Drive. The present location of the Lift Station in Phase 4 has it surrounded by residential lots. This is not conducive for good maintenance practice, especially if our Utilities Department personnel have to maneuver their boom truck to the lift station to pull pumps out of the wet well. By moving the lift station to the site I have suggested, your gravity sewers won't be as deep as the present design and the length of the mains will be reduced by approximately 95 feet. Finally, if a sewage overflow or spill occurs, the sewage won't spread into all of the surrounding residential yards. Sheet 4 1. I have revised the "Typical Service Connection Detail" to show concrete/polymer boxes that the City is currently using. Also, the City will install the meter and dual check valve, not the contractor. 2. I have revised the "Blow Off Detail" to replace the gate valve with a lock wing curb stop. A threaded plug and coupling is to be added to the flushing nozzle for the purpose of preventing foreign objects, insects, dust, etc. from getting into it. We will probably leave the nozzle in position instead of constantly removing it. Page 4 of 4 February 4, 1994 Letter to Nelson Hyatt Sheet 5 1. I have added a four (4) inch cleanout at the easement line for all house laterals. This cleanout is typical for all GDU sewer laterals that the City now owns. The cleanout defines the maintenance responsibility of the lateral between the City and the resident, should blockage occur. Normally, cleanouts are installed at the right-of-way line. However, since Park Place is a Planned Unit Development, there are no dedicated rights-of-way. You, as owner, will have to provide utility easements to the City. I suggest that they be the width of the corridor reserved for the road and utilities, as defined by the pair of parallel lines perpendicular to the lot lines, for lack of a better description. 2. I have added a note that the "Contractor shall televise (video tape) the sanitary sewer system upon completion and provide a copy of the tape to the City of Sebastian Utilities Department". This is typically required by all Utility Departments for the purpose of ensuring that the condition of the sewers are in excellent condition (no depressions, cracks, leaks, etc.) prior to the City taking over the system. Please have your engineer revise the plans as soon as possible. I will review the revisions at the earliest possible time. You can make arrangements with the Florida Department of Environmental Protection to hand carry these over to Orlando, if you wish. The requirements for the general permit that you noticed are specified in Rule 17-555.410, Florida Administrative Code, and the requirements for all general permits are specified in Rules 17-4.510 through 17-4.540, Florida Administrative Code. Your notice does not comply for the following reasons: 1. The existing system is out of compliance with respect to the auxiliary power requirements of Rule 17-555.320(6). The monthly operating report of February 1994 indicates that the system is supplying water to 223 services with 357 population. The proposed distribution system will add 114 services with 228 population. Evidence that, either an auxiliary power generator meeting the requirements of the rule in terms of capacity with automatic startup capability or an interconnection to another public water supply system that hag sufficient reserve capacity, must be provided prior to, or along with, the construction of the proposed main extensions. Portable power generator without an automatic startup device may be acceptable if proposed in lieu of the above only where 24-hour, seven days a week supervision is provided. 2. The information completed in the application, Items III "Statement by Utility" cannot be verified and appear to be erroneous. 3. The Department has no evidence that the water mains in Phase II where this project is proposed to connection to are cleared for service by the Department. Only water mains in Phase I of Park Place serving 175 unite and in Palm Lake Club serving 137 units (not shown on the plans) appear to have been permitted and cleared for service. The exact number of the proposed services must have been covered by the application regardless of the number per the lot phasing plan. 5. The engineer's signature and seal on the plan sheets were not dated. 6. The department guidelines call for 200 gpd per mobile home unit for the purpose of estimating the additional water demand. The estimated demand was not in accordance with this guideline. Also, the Department uses 3.5 persons and 100 gpd per person for calculating the number of equivalent residential connections. 7. Minimum separation between potable water lines and sanitary hazards (sanitary sewer, force main, storm sewer, reuse water) was not properly specified. A horizontal clearance of ten feet in parallel installation and 18 inches vertically at crossings must be maintained. Ductile iron pipe lengths, concrete encasement or alternate solutions according to "Recommended Standards for Water Works" shall be specified in case such clearances cannot be maintained. The water and sewer line orientation detail on Sheet 7 of 8 does not indicate the acceptable alternate measures in case the ten -foot horizontal separation from sanitary sewer is not practically maintained. Also, 18 -inches of vertical separation at the crossing of water mains and storm sewer is required; otherwise, ductile iron mains or concrete encasement should have been specified. 8. The references to the correct AWWA Standards covering the hydrostatic testing and disinfection of water mains are C600 or M23 (as applicable) and C651, respectively. Note 5, Sheet 7 of 8 did not specify the allowable leakage in case of 20 -foot lengths of PVC piping to be per AWWA M23 (90% of that allowed by the referenced AWWA C600), Also, Note 6 on the same sheet refers to a standard no longer in use. 9. No provisions were specified for the protection of existing active mains from backflow contamination during filling, flushing and testing of the new mains. Such provisions are required to be in accordance with Sections 4 and 9 of AWWA C651-92. Presently, in Phase 1B (part of old Phase II), Mr. Hyatt want to place homes on lots where existing water and sewer mains were installed during the initial development of Park Place. There is an existing sewer main running west from the entrance road to a manhole located in front of lots 2308 and 2309. There is an existing water main running west from the entrance road to a fire hydrant in front of lot 2308. Mr. Hyatt instructed his engineer, Mr. Hector Arias, to prepare the Florida Department of Environmental Protection (FDEP) General Permit applications for the new extensions of the water and sewer systems. These applications were filed with the FDEP on February 21, 1994. On March 15, 1994, a permit was received for the extension of the sewage collection system for Phases 1A, 2A, and 2B. However, today I received a Notice of Denial for the water distribution system. The reasons for denial will have to be resolved with the FDEP before connection to the water main can be made to any new residential homes. Presently, the only lots that are adjacent to the existing water and sewer mains are lots 2300, and 2302 to 2308, for a total of 8 lots. I personally have no objection to Mr. Hyatt installing a manufactured home on any of these lots, so long as he fully understands that none of the homes can be connected to the water main until the FDEP issues a permit. Therefore, he should not be allowed to have a Certificate of Occupancy issued to him until that occurs. I am hopeful that the water system permit can be resolved in 1-1/2 to 2 months. In the interim, perhaps your Department could issue Mr. Hyatt a "conditional" building permit so he could install homes on all eight lots. Please note as the condition on the permit that no meter can be installed by the Utilities Department and physical connection made to the water system until such time as the FDEP permit is issued. The developer, Mr. Nelson Hyatt, will be submitting a new individual permit application in which Items 4 through 9 of the March 21, 1994 Notice of Denial will be addressed. The purpose of my letter is to respond to the first three items listed as reasons for denial as follows: Item 1 - Auxiliary Power The existing Park Place 0.1 mgd water treatment plant does not have a stationery emergency generator. This fact was addressed in my correspondence with the FDER in May and June of 1993. At that time, the Park Place system had fewer than 350 residents that it served. Since then, I have contacted Scott Telford of Aggreko. Inc. who gave me information on renting a 100 kw trailer mounted generator that Aggreko would transport the generator to the plant during emergencies when there would be no electrical power to the plant for a sustained period of time. The City of Sebastian was able to purchase the former GDU Sebastian Highlands Water System on December 17, 1993. As of January 26, 1994, the City Council authorized the consulting firm of Hartman & Associates to begin work on the interconnection of the Park Place system with the Sebastian Highlands system. Design of the project is expected to be completed by April 15, 1994. Construction of the project is expected to be completed approximately three (3) months after a permit is granted. At that Page 2 of 3 April 8, 1994 Letter to Joseph McNamara time, the Park Place water treatment plant will be taken out of service since the system will be supplied water from the Sebastian Highlands water plant. The Sebastian Highlands water plant has a stationery 350 kw generator. Our certified operator is also responsible for the operation of the Park Place water treatment plant. The City has a plant operator at the Sebastian Highlands plant for seven days a week. An operator is on call 24 hours per day. In view of the fact that the City plans to decommission the Park Place water treatment plant, the City does not want to purchase and install a stationary generator. Therefore, based on the premise that the City can rent a generator in times of emergency, the City requests that the Park Place Mobile Home Park be allowed to expand its water system as proposed. Item 2 - Permit Application - Statement By Utility I am uncertain as to the statement made in the Notice of Denial regarding Item III Statement by Utility. The existing plant is a 100,000 gallons (0.100 mgd) per day water treatment plant as verified by the information received from Indian River County, the developer, and the FDER. The 30,500 gallon per day flow (0.0305 mgd) was taken from the December 1993 report (copy enclosed). The number of ERC's served and presently approved was based on the attached calculation sheets. I assumed that all of the 136 lots were already approved for service in Palm Lake Club since all of the water mains and services have been installed. To the best of my knowledge. I determined that 171 lots had been approved for service in Phase I of Park Place and 55 lots in Phase II during the initial permitting in 1986. Using 1.6 people per home (or meter) and 3.50 people per ERC (equivalent residential connection), I calculated the number of ERC's. If you disagree with the methodology, please let me know why and I will be more than happy to work with you in determining the figures you desire. Being that I did not obtain much information from Indian River County when the system was transferred, I do not have much history as the number of ERU's that were approved. Item 3 - Phase II Water Mains - Clearance for Service In regard to the FDER not having any evidence that the water mains in Phase II were cleared for service, I have attached a copy of your letter of March 14, 1990 to John Lang of Indian River County Utilities. The letter acknowledges receipt of certification by the County Utilities that the water distribution system has been completed in accordance with the plans for 37 lots in Phase II and Page 3 of 3 April 8, 1994 Letter to Joseph McNamara in accordance with FDEP Permit WC31-2040. These lots were approved for service by the Department. However, Phase II actually contains 55 lots, as you can readily see on the plans. Currently, there are 38 homes located on West Lakeview Drive in Phase 2 which are connected to the system. Also, Lots 2300, and 2302 to 2308 (a total of 8) on Kelly Drive had water services installed from the property line to the 8" water main which was installed in the mid 1980's along with the other mains and services in Phase II. Please refer to the April 6, 1994 letterfr'om Ernesto Velasco, PE of the Velcon Group, Inc. to me. It is apparent that Mr. Lang overlooked the fact that there were an additional eight lots on Kelly Drive which should have been cleared for service at the time he wrote his letter of March 14, 1990. The attached plan prepared by the Velcon Group of Port St. Lucie shows the extent of the existing mains and services. Since the County Utilities Department may have shut off the water in the Kelly Drive water main, I had the developer authorize his contractor to flush the line, rechlorinate it, and take two consecutive daily bacteriological tests for main line clearance. I have discussed this matter with City Manager, Joel Koford, and we are in agreement that due to current circumstances, the City will allow you to provide temporary service via well to these homes until such time as the Florida Department of Environmental Protection (FDEP) clears the existing water main serving these lots for service. On April 8, 1994, I sent a letter to the FDEP requesting clearance for service for the water main which provides service to Lots 2300 through 2308 on Kelly Drive and submitted the two satisfactory bacteriological test reports that were completed on April 1, 1994. I would estimate the FDEP will take a minimum of two (2) weeks before a clearance for service is issued. Meanwhile, you must have approval by the Indian River County Environmental Health Department to use the wells on site for water in the homes. Once the main is cleared for service, the residences must be connected to the City's water service within 30 days. Any connection between the on site well and house or public water supply must be disconnected at that time to eliminate any cross connections. The wells can still be used for irrigation purposes. The meter installation and inspection fees must be paid for in advance. Impact fees for homes in Park Place will not be required to be paid for water and sewer until July 11, 1994 in accordance with the Takeover Agreement. We would like to clarify the status of the watermain installed in Phase II (please see water and sewer plan, Sheet 2 of 8). Thirty-eight lots along West Lakeview Drive and Lots 2300, 2302, 2304, 2306, 2303, 2305, 2307 and 2309 have been in service since the mid 1980's. Lakeview Drive Park Place Sebastian, FL 32958 RE: Water Service for Lots 2300 through 2308 on Kelly Drive, Park Place, Sebastian, Florida Dear Mr. Hyatt: This letter is to confirm our telephone conversation of April 7, 1994, in regard to providing water service to Lots 2300 and 2302 at this time. I have discussed this matter with City Manager, Joel Koford, and we are in agreement that due to current circumstances, the City will allow you to provide temporary service via well to these homes until such time as the Florida Department of Environmental Protection (FDEP) clears the existing water main serving these lots for service. On April 8, 1994, I sent a letter to the FDEP requesting clearance for service for the water main which provides service to Lots 2300 through 2308 on Kelly Drive and submitted the two satisfactory bacteriological test reports that were completed on April 1, 1994. I would estimate the FDEP will take a minimum of two (2) weeks before a clearance for service is issued. Meanwhile, you must have approval by the Indian River County Environmental Health Department to use the wells on site for water in the homes. Once the main is cleared for service, the residences must be connected to the City's water service within 30 days. Any connection between the on site well and house or public water supply must be disconnected at that time to eliminate any cross connections. The wells can still be used for irrigation purposes. The meter installation and inspection fees must be paid for in advance. Units in Park Place which require a Certificate of Occupancy on or after July 11, 1994 shall be obligated to pay impact fees in accordance with Section 6 of the July 11, 1989 County Takeover Agreement. Currently, the sewer impact fee is $2,551.00 and the water impact fee is 51,100.00. Please inform the Utilities Department when the connection to the existing laterals has been made so an inspector from the Utilities Department can be sent to the site to check the installation and measure the as -built location of the cleanouts. It is imperative that you notify the Utilities Department should you wish to install wells for Lots 2303 through 2308 so that I am fully aware of those homes that will be served on a temporary basis. The results of the various tests of the water system, the video of the televised sewer system, certifications and the as -built plans have been furnished to me. The as -built plans, tests, and certifications have been sent to the Florida Department of Environmental Protection (FDEP) by The Velcon Group, the engineers for Park Place. Today I have received approvals from the FDEP for both the water and sewer system extensions. The water main on Kelly Drive has been cleared for service for Lots 2308 to 2408. The sewer main on Kelly Drive has been cleared for service for Lots 2309 to 2323, 2345, and 2400 to 2406. Therefore, the following twenty-one (21) lots can now be served by the City's Utilities system and are considered buildable lots: 2309, 2311, 2312, 2313, 2314, 2315, 2316, 2317, 2318, 2320, 2321, 2322, 2323, 2345, 2400, 2401, 2402, 2403, 2404, 2405, and 2406. According to Jim Fowler's As -Built Survey, the terminal manhole No. 39 was located in front of Lot 2406 and there was no sewer service to Lot 2408 because it wasn't shown on the map. However, on the other As -Built Map, Project No. 89-111, Sheet 3 of 8 dated 8/10/94, Lot 2408 was serviced by sewer but not by water. I met with Nelson Hyatt and his engineer, Ernesto Velasca of the Velcon Group, Inc. this morning at 10 AM. As a result, I determined that the as -built drawing by James Fowler, Land Surveyor, erroneously showed the terminal manhole in front of Lot 2406. It should be in front of Lot 2408. The other as -built drawing by the Velcon Group, Inc. shows the water main ending just past Lot 2406. Actually, the water main ends just past lot 2408. Therefore, I asked Nelson to have the as -built drawings revised so I could notify the FDEP in Orlando. I also asked for a letter from Nelson guaranteeing that the dirt road in front of Lot 2408 would be improved, an asphalt road constructed, prior to the certificate of occupancy being issued by the City of Sebastian Building Department. (Mr. Hyatt's engineer), I was able to determine that Lot 2408 on Kelly Drive has both water and sewer service available to it. Therefore, it can be considered as a buildable lot from a utilities standpoint. I did not include Lot 2408 in my memo of November 7, 1994 to you because James A. Fowler's "As -Built" Survey for the sewer line did not include it as being connected to the system. Unfortunately, his October 31, 1994 survey erroneously numbered the lots wrong, and Lot 2408 should have been shown where Lot 2406 was shown. Lot 2345 shown on the "As -Built" survey is a non-existent lot. Nelson Hyatt is now in the process of having Jim Fowler revise his "As -Built" Survey. Mr. Hyatt gave him the erroneous lot information. I do want to bring to your attention, though, that the paved road only extends six (6) feet south of the north property line of Lot 2408. It should be extended to at least the south property line of Lot 2408 before a Certificate of Occupancy is issued. park2408
