Dear Mr. Pinto:
H.F. Lentz Company, the engineering representative for
Walmart, has requested that the City of Sebastian make application
to Indian River County to provide the necessary sewage capacity for
the new Walmart store. H.F. Lentz Company has determined that a
total of 60 Equivalent Residential Units (ERU's) must be purchased.
It is my understanding that the North Indian River County
Wastewater Treatment Plant has capacity in excess of 60 ERU's at
the present time. The cost of 60 ERU's at the current rate of
$2,551.00 per ERU equals $153,060.00, which must be paid in full by
Walmart to the City. The City will then remit the payment to
Indian River County to guarantee capacity reservation in the plant.
Based on the aforesaid information I have presented in this
letter, the City of Sebastian formally requests the Indian River
County Board of County Commissioners to approve 60 ERU's of
capacity in the North Indian River County Wastewater Treatment
Plant to be purchased for Walmart. This request is understood to
be only for the assurance that the County will grant permission at
this time to allow Walmart to connect to the County's wastewater
system in the future. It is further understood that there will be
no guarantee that the 60 ERU's will be reserved at the plant for
Walmart until such time as the impact fees are paid in flill to
Indian River County.

This is to advise that based upon the project map site faxed to
the Department by H.F. Lenz Company, the proposed site consists
of two parcels for which 63 ERUs of wastewater capacity were
reserved in the North County Wastewater Assessment.
The Department would request you review the above with the
Engineer and Owner for clarification and advise if you wish us to
proceed with your request.
The Department will not proceed with the request until you have
advised if the capacity is definitely required.

Re: Potable Water Supply Request for the Proposed Wal-Mart
Retail Store, North US 1, Sebastian, Florida
Dear Mr. Pinto:
The local engineering representative for the proposed Wal-Mart
Store in Sebastian, H.F. Lentz Company, has asked the City of
Sebastian to request that Indian River County Utilities supply
water to the new Wal-Mart Store. The projected demand for daily
consumption is 15,000 gallons per day. Based on 250 gallons per
ERU, the total number of ERU's to be purchased would be 60. It is
my understanding that there is more than enough capacity in the
County water treatment plant to supply the requested 60 ERU's.
Neither the City nor Indian River County has an existing water
main located along the Wal-Mart property for it to be served. The
nearest water main is the 12" water main located at the southeast
corner of the K -Mart Store on the west side of US 1 approximately
2,000 feet to the north of the proposed Wal-Mart Store property.
The 12" water main would have to be extended south under a
developer's agreement between the County and Wal-Mart and the City
and Wal-Mart since it must traverse through County property
approximately 1,270 feet to the Sebastian City Limits. Wal-Mart
must be willing to install the water main at its own expense.
The City of Sebastian recognizes the fact that the April 21,
1992 Interlocal Utilities Agreement between the City and County
does not address the sale of potable water from the County to the
City. The City and County could, hopefully, negotiate an agreement
for the wholesale purchase of water from the County by the City and
establish wholesale rates to accommodate not only the Wal-Mart
project but other developments close to the County's water mains.
The purpose of this letter is to notify you of Wal -Mart's
intention on utilizing water supplied by Indian River County and
the City's intent on formulating an agreement with the County to

provide the enabling legislation. Should you know of any reasons,
at the present time, why the County may object to furnishing water
to the proposed Wal-Mart store in the City of Sebastian, please
inform me as soon as possible.

September 4, 1993 re: Reservation Request for Wastewater

I called Scott Doscher of H.F. Lenz Company regarding the letter I
received from Harry Asher, Assistant Director of Utility Services
for Indian River County. Harry said the proposed site consists of
2 parcels for which 63 ERU's of wastewater capacity were reserved
in the North County Wastewater Assessment. Stan Mayfield of H.F.
Lenz told me that 60 ERU's were needed for 15,000 gallons of flow.
(15,000 gals + 250 gals/ERU = 60 ERU's). I told Scott that I
needed a determination from his firm whether Walmart wanted 60 or
63 ERU's from the County.
I also asked Scott if Walmart already had the ERU's reserved under
a realtor's name. I was unsure what Harry Asher meant when he
stated 63 ERU's of wastewater capacity "were reserved in the North
County Wastewater Assessment". I told Scott that Walmart could
have had an agent purchase the ERU's sometime ago to ensure reserve
capacity in the sewer plant. Walmart could have directed its
realtor to purchase ERU's in the realtor's name so as not to alert
the public or the County that Walmart was interested in building a
new store.
Scott said that the County signed off in the DER wastewater system
application. I asked Scott to give me the date it was signed. I
asked Scott if he had an off site plan showing the water main
extension from the southeast corner of K -Mart on US 1 in Sebastian
to Walmart. He said that there was a plan developed. I requested
one since H.F. Lenz never furnished me an off site -plan. I also
asked for an 11"x 17" reduction of the site plan and off-site
utility plan. The reduction is known as a PMT (photo mechanical
transfer). Scott said he'd have to get the information and get
back with me.

The H. F. Lenz Company has been retained by Wal-Mart Stores, Inc. to design a
sanitary sewer pumping station in connection with the Wal-Mart Store No. 1068
project located on U. S. Highway 1 in Sebastian, Florida (see Figure 1). This station
will manifold into an existing force main system located in the Florida East Coast
Railroad right-of-way, directly west of and adjacent to the proposed site. The existing
system consists of a force main extending Southward from the Roseland Road
pumping station to the existing North Regional Wastewater Treatment Plant located
on Hobart Road. This force main varies in size from 12" to 24", and is 12" in diameter
at the project connection point. The proposed station and force main were modeled to
determine the pump operating point. Findings from the report are as follows:
The proposed station will utilize a duplex grinder pump system and 3" force main.
Pump selection consists of (2) ABS 5 H.P. Piranha - 5 pumps or approved equal. The
selection of these pumps results in a design operating point of 58.0 GPM at 123.5'
TDH. The pumping station will be owned, operated, and maintained by Wal-Mart
Stores, Inc.

The existing system consists of a force main extending Southward from the Roseland
Road lift station to the existing North Regional Wastewater Treatment Plant located in
Hobart Park. This force main varies in size from 12" to 24", and is 12" in diameter at
the project connection point.
3. PROPOSED SANITARY SEWER PUMPING STATION
The proposed lift station consists of a submersive duplex pump system and 3" force
main which connects to the existing 12" force main in the easement adjacent to the
Florida East Coast Railroad right-of-way, immediately west of the site.
4. SANITARY SEWER PUMP STATION ANALYSIS
The system was modeled to determine the operating point for the pump station using
an assumed intrusion head of 106' as specified by Mr. William McCain of the Indian
River County Utility Department. Minor losses were converted to equivalent pipe
lengths as shown in Table 1.

The pumping station was designed in accordance with the Indian River County Water
and Wastewater Utilities Standards and the Indian River County Water, Wastewater,
and Effluent Reuse and Disposal Master Plan, January 1993. Projected sewage flows
were calculated using water usage records from similar Florida Wal-Mart projects.
The station projected sewage flows are as shown in table 2. A system head curve was
developed for the station and 3" force main as shown in table 3.

6. PUMPING STATION SIZING AND DESIGN
The lift station was designed to pump at a rate exceeding the peak flow into the wet
well, and to provide a minimum flow velocity of 2 feet per second within the 3" force
main, which equates to a pumping rate greater than 50 GPM. Based on the design
system head curve, (2) ABS 5-H.P. Piranha -5 pumps were chosen to operate at a rate
of 58.0 GPM against a total dynamic head (TDH) condition of 123.5 feet (see
Appendix A for pump curve). The wet well size was calculated based on a cycle time
of 15 minutes. Calculations are shown in table 4.

COMPANY
The project consists of a 163,144 S.F. retail commercial shopping center to be
constructed in two phases. The proposed site is an undeveloped 23.5 acre tract
located adjacent to U.S. Highway 1, approximately 4750' south of Roseland Road, in
the City of Sebastian, Indian River County, Florida. Water for the potable service and
fire connection is provided to the area by the Indian River County Water Distribution
System.
The proposed water distribution system was designed in accordance with the
requirements of the Indian River County Utilities Department, the Insurance Service
Office (ISO), and Wal-Mart Stores, Inc. The proposed system will connect to the
existing 12" water main located at the south end of the Riverwalk Shopping Plaza,
approximately 1750' south of the intersection of Roseland Road and U.S. Highway f.
The proposed system consists of +/- 3325' of 12" water main within the U.S. Highway
1 right-of-way, a 12" feed into the site, and a 10" loop with hydrants and feeders to
the domestic service and fire sprinkler riser.
The system was modeled as a Main Line connected to the proposed Indian River
County Elevated Water Storage Tank, currently under construction. The design
elevation for the water level within the tank was assumed at an elevation consistent
with nodal pressures obtained from the Indian River County MasterPlan for various
boundary conditions. Models were developed for the simulation of fire flows to fire
hydrants and sprinkler riser, as well as domestic flow to the potable water service.
The Water Distribution System was designed to meet Indian River County Fireflow
Requirements without the need for any additional pumps, however, system pressures
are not adequate to meet the minimum Wal-Mart sprinkler riser requirements.
Consequently a fire pump will be required to provide additional pressure to the
sprinkler system.

2. INDIAN RIVER COUNTY WATER DISTRIBUTION SYSTEM
The project consists of a 163,144 S.F. retail commercial shopping center constructed
in two phases. The proposed site is an undeveloped 23.5 acre tract located on U.S.
Highway 1, approximately 4750' south of Roseland Road, in the City of Sebastian,
Indian River County, Florida (see figure 1). The site is zoned General Commercial.
Water for the potable service and fire connection is provided to this service area by the
Indian River County Water Distribution System. This existing system consists of a the
River's Edge water treatment plant, distribution mains, and an elevated storage tank
(currently under construction). The existing system is depicted in figure 2.
The existing Indian River County Water Distribution System was modeled as part of a
master plan entitled Water Wastewater. and Effluent Reuse and Disposal Master Plan,
by Brown and Caldwell Consultants, Orlando, Florida, in January 1993. The study
determined the system pressures at specific nodes under various conditions of demand
including existing peak hour, 2010 peak hour, and 2010 maximum day with fire flow.
Results of the study determined the need for an elevated storage tank to be located in
the vicinity of Roseland Road and U.S. Highway 1. Indian River County has
subsequently begun construction of this tank, with completion to occur in early 1994.
This 130' high tank will provide increased duration of fire flows to the Sebastian area.
The worst case scenario in the study was the 2010 maximum day demand with fire
flow, in which the water level in the tank was assumed to be 10' below the tank water
overflow elevation of +/-145' N.G.V.D. The existing Indian River County Water
Distribution System is shown in figure 2.
At this time, the existing Indian River County water distribution system in the vicinity
of the site has capacity for domestic flows only. Consequently hydrant flow tests were
not conducted as part of this report, as fire flow pressure and duration is not currently
available to the system.

3. SYSTEM DESIGN PARAMETERS
The proposed water distribution system was designed in accordance with the
requirements of the Indian River County Utilities Department, the Insurance Service
Office (ISO), and Wal-Mart Stores, Inc. These requirements are summarized in table
1. The proposed water distribution system was designed to connect to the existing
12" water main at the south end of the Riverwalk Shopping Plaza, approximately
1750' south of the intersection of Roseland Road and U.S. Highway 1. The proposed
system consists of +/-3325' of 12" water main in the U.S. Highway 1 right-of-way, a
12" feed into the site, and a 10" loop with hydrants and feeders to the domestic service
and fire sprinkler riser (See figure 3). Line sizes used in the computer modeling are
shown in table 2. For the purposes of this analysis, the design water level in the tank
was assumed to be at 75% of the tank capacity. This corresponds to an elevation of
133.5' N.G. V.D.

COMPANY
The system was analyzed using the Cybernet Program by Haestad Methods,
Waterbury, Connecticut. The program uses the Kentucky Pipe Algorithm to solve the
pipe network for various boundaries and node conditions. As shown in figure 4, the
system was modeled as a Main Line connected to the proposed Indian River County
Roseland Elevated Water Storage Tank. The water level in the tank was set at an
elevation consistent with nodal pressures calculated in the Brown and Caldwell master
plan for the various boundary conditions. Modeling was done to simulate fire flows to
both the fire hydrants and the sprinkler riser, as well as domestic flow to the potable
water service.
5. RESULTS OF ANALYSIS
The distribution system piping was sized such that the required hydrant flow and
system residual pressure could be achieved. Final pipe sizes are the same as shown in
table 2. Final results of modeling are summarized in table 3.

6. CONCLUSION AND RECOMMENDATIONS
The Water Distribution System was designed to meet Indian River County fire flow
requirements without the need for any additional pumps, however system pressures are
not adequate to meet the minimum Wal-Mart sprinkler riser requirements.
Consequently, a fire pump must be added to the system to supplement pressure in
order to meet Wal-Mart Fire Sprinkler Requirements.

As you aware, we have two (2) major concerns surrounding the serviceability
of this proposed project. The first concern is access to US -1 right-of-way in
accordance with the FDOT access management plan. As we discussed, we
need the City's support in our negotiations with the FDOT toward resolution
of this matter. The second major concern is the potable water service for the
project. It is our intention at this time to provide potable water to the project
via an extension of the Indian River County water main which is currently
located within the US -1 right-of-way +/- 1,500' to the north of the project site.
In an effort to address our second concern, please consider this letter as our
appeal for the City of Sebastian to make a formal request to Indian River
County through the appropriate channels to allow this water main extension to
occur.

I informed them that there is no water along US Highway 1. There
is a sewer force main installed along the FEC Railroad right-of-
way. Unfortunately, they relinquished their ERU's to Indian River
County some time ago. U.S. 1 North, Inc. owned 60 ERU's x 250
gal/eru = 15,000 gallons. I told them that the City would have to
request 60 ERU's from Indian River County. I also informed them
that the developer would have to pay for the cost of installing the
water main to his property. The City could,not do this.

In August of this year, plans were submitted to the City of
Sebastian for the review of the proposed Wal-Mart Store to be
constructed near the north City limits. Wal -mart desires to have
water provided to its store by extending Indian River County's
water main south from Roseland. The City must enter into an
agreement with Indian River County for the County to provide water
to Wal-Mart and establish bulk water rates to sell water to the
City. The City Manager and City Council should be involved in this
process as authorization from Council will be required for future
capacity and rate agreements with the County.
I would recommend that you convey to the City Council the City's
desire to have the County provide water to Wal-Mart and authorize
staff to formalize water purchase and supply agreements with Indian
River County for future Council approval.

RESUME OF CONVERSATION: Bruce Cooper called me from H.F. Lenz's
office regarding the meeting on Wal-Mart. I told him that the
meeting was scheduled for Thursday, October 14 at 9:30 a.m. in Jim
Chandler's office. I told Bruce that I had asked Stan and Scott
Doscher for a PMT site plan reduction (11"x 17") which I never
received. Bruce put Stan on the phone and I reiterated my request.
Stan said that his office had prepared a reduction of the site plan
although not a PMT. I also asked Stan for a copy of the off-site
water main extension which H.F. Lenz had. I had never received a
copy of this either. Stan said that in his discussions with the
County, the County Utilities Department is thinking of routing the
water main extension through Mrs. Hansen's property west of K -Mart
to the 20' easement east of the EEC Railroad right-of-way. The
water main would be installed in the 20' wide easement south to
Wal-Mart. Wal-Mart would be served with water from the rear
instead of from U.S. 1 as originally planned.
Stan suggested carving out the Wal-Mart property, St. Sebastian
Catholic Church, and North, Inc. (9t acres between the Church and
Wal-Mart) from the City's service territory and include it in the
County's service territory. He thinks this is the most expedient
way to handle the situation. A master meter would not be needed at
the City limits then. The City would not have to enter into a bulk
water rate agreement either.
I asked Stan about the question Harry Asher raised in his letter of
September 4, to me regarding wastewater ERU's. Stan said the Gran
Central had already purchased 63 ERU's from the County and

Dear Mr. Votapka:
This letter is to respond to your letter of September 7, 1993,
concerning the above request.
As we have previously discussed, the City of Sebastian (City)
stated that they did not want to be included in the Indian River
County (County) water system for the North County Region. The
County, at its own expense, was required to revise its existing
Master Plan to remove the City capacity from the Master Plan
capacity requirements for the North County Region.
As we previously advised you and City Manager Robb McClary at the
meeting in our office on May 25, 1993, concerning your request
for County water service on Roseland Road, in order to
accommodate capacity it would be necessary for the City to
designate specifically the service areas it would wish the County
to service. The City would be required to pay for the Master
Plan review by the County's Master Plan Consultant. It was our
understanding from twat meeting that you intended to perform a
review of your requirements and advise if you were going to
proceed in this manner.
Until you provide the above information and authorization for the
review of the area to be served by the County's Master Plan
Consultant, the County cannot proceed. The County will proceed
in an expeditious manner upon receiving the required information
and authorization.

REPORT ON WATER DEMAND
FOR POTENTIAL CITY OF SEBASTIAN CUSTOMERS
IN THE NORTH CITY LIMITS ALONG US HIGHWAY NO. 1
Currently, there are three consecutive properties south of the
north City Limits between U.S. Highway No. 1 and the Florida East
Coast Railroad rights-of-way whose representatives have expressed
an interest in receiving potable water from the City of Sebastian.
Those three properties include the St. Sebastian Catholic Church,
a 9 acre parcel owned by North. Inc., which is immediately south of
the St. Sebastian Catholic Church, and the 23.5 acre proposed Wal-
Mart store site, immediately south of the North, Inc. property.
The City of Sebastian does not have a water system in their area
and cannot serve these properties with potable drinking water.
Indian River County, however, provides potable drinking water to
the K -Mart Store, whose southeast property corner is approximately
1,250 feet north of the Sebastian City limits on the west right-of-
way line of U.S. Highway No. 1.
Wal-Mart has the most immediate need for water since it plans
to construct a 104,660 square foot store as soon as possible. A
site plan with accompanying engineering plans was submitted to the
City of Sebastian in late August for approval by the Planning and
Zoning Commission.
Wal-Mart proposes to extend a 12" water main from the
southeast corner of the K -Mart property in Roseland southerly along
the U.S. Highway No. 1 right-of-way to the southeast corner of its
property which is across from the main entrance of the Sebastian
Cemetery. Since a portion of the 12" water main must be
constructed within the unincorporated limits of Roseland, Wal-Mart
must enter into a developer's agreement with Indian River County.
At the point of crossing the City limits line at the northeast
corner of the St. Sebastian Catholic Church, a master meter must be
installed to measure the total flow of water from Indian River
County to the City of Sebastian. A developer's agreement must be
entered into between Wal-Mart and the City, whereby other entities
connecting to the water main will pay their fair share of the
initial cost for the water main extension. Wal-Mart is desirous to
have water provided for both potable water demand as well as fire
protection. The potable water demand for Wal-Mart is 15,000
gallons per day as calculated by their engineering representative,
H.F. Lenz Company.
The St. Sebastian Catholic Church will be starting
construction on a new 1,000 seat church sometime in the fall.

Currently, the Church has its own water system which provides water
to all the existing buildings on the Church property. Mosby and
Associates, engineers for the Church, calculated the water demand
to be 3,000 gallons per day. This is based on 3 gallons per seat
multiplied by 1,000 seats in the new Church.
North, Inc., which owns approximately 9 acres between the
proposed Wal-Mart Store and the St. Sebastian Catholic Church,
estimates its demand to be 15,000 gallons per day. North, Inc.
does not have formal plans at this time for development of the
property nor a time established for start of construction.
In summary, the three properties mentioned above would require
a total of 33,000 gallons per day for potable water use. Wal-Mart
would be responsible for extension of the water main south from K -
Mart in Roseland. The County would have to agree to provide to the
City a minimum of 33,000 gallons per day for service to these
customers.
The City recognizes that it must enter into an agreement with
Indian River County for the purchase of water at bulk rates.
Currently, the April 21, 1992 Interlocal Utilities Agreement has no
provisions for the sale of bulk water from the County to the City.
The Agreement only provides for bulk wastewater rates for
wastewater service that Indian River County provides City
customers. Therefore, an analysis must be done of the cost for
Indian River County to provide bulk water treatment and
transmission of service, and to develop rates to recover the costs
for providing water to the City. Both the base facility charge and
volume charge for water must be analyzed. Until the analysis is
done, and both Indian River County and the City of Sebastian must
approve an agreement for the sale of bulk water by the County to
the City, the County has no legal authority to sell water to the
City of Sebastian.

water for North County residents.
As he stands amid and pine
flatwoods, a 24 -acre U.S. 1 site
slated for Wal -Mart's new 163,000 -
square -foot store, the water will
be so close, yet so far away.
His engineering firm even pen-
ciled in a pipeline connecting to a
county water main behind Kmart,
2,000 feet away.
But water service to the site has
turned into a political football
pinching Wal-Mart and its $2 mil-
lion planned store.
"We're caught in the middle of
all this bureaucracy," explained
Mayfield, with H.F. Lenz, the firm
engineering the store. "We don't
care who gives us water; we just
need it."
The dilemma: Wal-Mart lies
within the city limits of Sebastian,
which has no water system to
serve its residents.
"We're in Sebastian's service
area — even though there's no
service," Mayfield said.
The city also has no agreement
with Indian River County to have
the county provide potable water
to city residents. And without that
agreement, the county cannot le-
gally serve customers in Sebas-
tian's service area.
"The city put the county on no-
tice they didn't want county water
service," county Utilities Director
Terry Pinto said. "They said,
point-blank, 'No exceptions, we're
not interested in the county serv-
ing the city water.' "
Two years ago, the city ended
its water service franchise
agreement with the county. The
county already had drafted its
master plan for North County wa-
ter service, and included the city.
But Sebastian's Kity Council,
with a resolution stating so, made
it clear they did not want to be a
part of the system, Pinto said.
"So we went back and revised
our master plan, reduced line
sizes and plant capacity, all at
their request," Pinto said.
An expanded Sebastian Wal-
Mart was merely a sparkle in the
company's eye at that point. Now,
Wal-Mart has little to say abou-
thow or when they get water.
"We have the line designed a

SUBJECT: Extension of Indian River County Utilities Service
Territory into Sebastian to Service the Proposed Wal-Mart
Store
On December 7, 1993, the Indian River County Board of County
Commissioners approved the Interlocal Utilities Agreement between
the County and the City for the extension of the County's service
territory within Sebastian City limits. A copy of the "Agreement"
is attached. The "Agreement" allows the County to provide water
and sewer service to the proposed Wal-Mart store on the west side
of US Highway 1 across from the Sebastian Cemetery. As a result,
water and sewer service will extend south from the north City
limits to both the St. Sebastian Catholic Church and the 9 acre
property owned by U.S. 1 North, Inc. lying between the Church and
Wal-Mart property. The City is only losing the ability to serve
these properties with water and sewer service. The properties
themselves will remain within the City limits. Therefore, the City
retains the ability to derive revenue from the property and sales
tax on the U.S. 1 North, Inc. and Wal-Mart properties. The Church,
of course, is exempt from property and sales tax by law.

INDIAN RIVER COUNTY, a political subdivision of the
State of Florida, the address of which is 1840 25th
Street, Vero Beach, FL 32960 ("COUNTY")
and the
CITY OF SEBASTIAN, a municipal corporation organized
and existing under the laws of the State of Florida, the
address of which is 1225 Main Street, Sebastian, FL
32958 ("CITY"), and its successors or assigns,
W I T N E S S E T H:
WHEREAS, the COUNTY operates a utility system generally throughout
the unincorporated area of Indian River County surrounding the CITY; and
WHEREAS, the CITY is just now creating a comprehensive utility system
within the City limits and is not able to service certain portions of the city
with utility service; and
WHEREAS, the property shown on Exhibit "A" adjoins the County/City
boundary and could be served at this time by the COUNTY's utility system;
and
WHEREAS, the COUNTY can serve this property not only immediately
but more cost effectively, since there will be a smaller capital expense than
the CITY would have; and
WHEREAS, the COUNTY has agreed to service this property provided
that the property is transferred to the COUNTY's service area permanently;
NOW, THEREFORE, for and in consideration of the premises and other
good and valuable consideration, the receipt of which is hereby
acknowledged, COUNTY and CITY mutually agree as follows:
I. The foregoing recitals are true.
2. The property ("Property") with the legal description shown on Exhibit
"A" shall be considered to be part of the COUNTY's permanent utility
service area for water and sewer service, for all intents and purposes
as if the Property were in the unincorporated area of the County.
3. COUNTY shall serve the Property as if it were a customer in the
unincorporated area of the County, i.e., there shall be no
discrimination in rates or quality or type of service based on the fact
that the Property is in the City.

4. CITY acknowledges that this transfer of service area responsibility is
permanent and that the CITY shall have no right in the future to
demand that the COUNTY cease providing utility service to this
property.
5. CITY shall not in any manner assert any rights or undertake any
responsibilities concerning COUNTY's rate setting, impact fees,
assessment fees, service fees, service standards, or franchise fees on
the Property.
6. This agreement may be recorded In the public records of public records
of Indian River County.
IN WITNESS WHEREOF the parties to this agreement have set their
